La storiografi a recente ha profondamente rivisto alcuni consolidati stereotipi della storia politica e istituzionale veronese del tardo medioevo, e un aspetto importante di questa revisione è stata la "rilettura" del quindicennio di dominazione viscontea (dal 1387 al settembre 1402, quando morì Giangaleazzo Visconti; ne fu un'appendice la reggenza di Caterina Visconti, alla quale tenne dietro poi la dominazione carrarese, durata all'incirca un anno tra la primavera del 1404 e il 24 giugno 1405) 1 . Considerati in passato come una stanca prosecuzione dell'età scaligera in attesa del risolutivo abbraccio con il leone di san Marco, avvenuto appunto nel giugno 1405, in realtà quegli anni costituirono una svolta cruciale, anzi la svolta cruciale per la storia della città 2 .

The legal profession and oratory have always been inextricably linked. The Napoleonic ruling class was firmly convinced of this when they opened the Scuola di eloquenza pratica legale (a school of oratory for the legal profession), which was soon closed by the Austrian government in 1817. Oratory came back in vogue during the liberal age, as evidenced in the numerous legal galatei (something like codes of conduct for the legal profession) that appeared in that period. Indeed, although the galatei used different approaches and styles, they always recommended that lawyers take care of their oral skills. Despite the trend towards more concise and linear forms of oratory during the Fascist period, the heart of the twentieth century still saw lawyers using and abusing their skill as orators—indeed, it was a formidable tool, capable of manipulating legal reasoning and ensuring a victorious outcome in trial.

As a way of »performing the law«, courtroom
speeches have been a fundamental component of
the legal ritual and a basic component of lawyers’
identities in many countries with civil law traditions:
lawyers have presented themselves and have
been culturally perceived as legal experts who
make use of emotional strategies in order to
achieve their aims in court. Within the courtroom,
emotions have been both rhetorical tools and
goals, especially in criminal trials where forensic
eloquence aimed to create an emotional environment
that was favourable to the client. In France, a
rich literature on the art of forensic rhetoric was
both the result and the basis of a (re-)construction
of a tradition that was extremely self-conscious,
self-reflective and fundamentally emotional. The
present work analyses the role of emotions in
lawyers’ courtroom performances in the French
legal culture from the beginning of the nineteenth
century to the present. Its purpose is to identify the
main themes related to the use of emotions in the
pleading that legal professionals themselves have
considered important – albeit with differing opinions
– in the past three centuries. More broadly,
this study explores reason / dispassion and emotion
in legal practice beyond their longstanding dichotomy.
Investigating the courtroom speech as a
prototypical forensic performance through the perspective
of the legal professionals themselves shows
how reason and emotion have been continually
intertwined and how legal professionals have consciously
strategized approaches to the complex
interplay between them in the judicial processes.
