This article considers the history of the Spanish political pacts against terrorism and the political contexts in which they have been implemented since the beginning of the 1980s. This sociohistorical approach is necessary in order to understand the current Spanish unanimous repudiation of terrorism. It suggests that these political pacts helped build a consensus that has frozen the political field in Spain. Such a perspective takes into account some of the arguments of the CASE manifesto "Critical Approaches to Security in Europe" related to the need to proceed through meticulous examination of the logics of exceptionalism and decisionist politics that neutralize politics.

The object of this paper is to question the logic of generalised suspicion in indictment and detention procedures in the context of the war on terrorism, in order to understand the legal oscillation between resistance and deference to intelligence data in the judgment of terrorist acts. To illustrate these various forms of judicial resistance/deference, we closely examine three cases of judicial abuse in the fight against terrorism, corresponding to three different chronological and socio-political moments: the 'Guildford Four' in Northern Ireland (1974), the judicial condemnation and constitutional ban of Batasuna, the Basque nationalist party in Spain (2002) and the Maher Arar case in Canada (2002). Behind the screen of an elastic conception of public security, the primacy of an intelligence-based rationale over the judicial process results in tensions between the attribution of guilt and the rendering of justice that distort classical judicial procedures and the principle of a fair trial. Moreover, such tensions eventually legitimise proactive and preventive strategies that lead to condemnation through allegations of terrorism rather than proof.

L'ouvrage Empire de Michael Hardt et Antonio Negri, écrit entre la première du Golfe et la guerre du Kosovo, publié en 2000 aux Etats-Unis (éditions Harvard University Press), en France (éditions Exils) et paru en 2002 en Italie (éditions Rizzoli), ignoré dans un premier temps, semble avoir connu un certain succès depuis. Présenté par certains comme la nouvelle « bible » marxiste -ce qui est un contresens pour ses auteurs [1] -, l'ouvrage est résolument interdisciplinaire. De la démonstration philosophique, en passant par l'analyse historique et politique jusqu'à un certain lyrisme visionnaire poétique, signalé par des intermezzos, Empire entend analyser les transformations économiques, technologiques, sociales et politiques produites par la mondialisation et offrir une base de réflexion à la résistance politique. Le projet nourri aux écrits de Deleuze et de Foucault est ambitieux et l'effort de synthèse interdisciplinaire admirable. Ce livre se veut, suivant les mots des auteurs, une résistance théorique, « un cadre théorique général et une boîte à outils de concepts pour théoriser et agir à la fois dans et contre l'Empire » [2]. Prenant aux mots ces dires, le séminaire de lecture proposé par Cultures & Conflits a réuni sociologues, juristes, politistes, philosophes et anthropologues pour discuter de la pertinence analytique, des efforts et des ambiguïtés de l'ouvrage.
