Where the number of authorizations available for grant is limited in advance to a maximum number,... more Where the number of authorizations available for grant is limited in advance to a maximum number, public authorities have to make a choice between qualified applicants through a selection procedure. EU law has played a major role in developing legal rules on the issuing of these limited authorizations, through, amongst other methods, the development of the obligation of transparency. However, the allocation regime under EU law, in particular as it arises from the internal market freedoms, has some inherent restrictions, only applying to economic activities and sometimes requiring cross-border interest in addition. Thus, in order to develop a general legal regime that applies to any process for the issuing of limited authorizations, the development of an allocation regime rooted in domestic law is necessary. Als de wetgever meent dat Invest-NL niet moet worden gehouden aan de publiekrechtelijke normen, waaronder de algemene beginselen van behoorlijk bestuur, de Wet openbaarheid van bestuur en de Wet normering topinkomens en dat tegen het handelen van Invest-NL geen bestuursrechtelijke rechtsbescherming open hoeft te staan, dan dient dat in de wet zelf te worden geregeld.

Dat geldt ook voor hen die zich dagelijks bezighouden met het bestuursrecht, waartoe een belangrijk deel van de onderwijswetgeving mag worden gerekend. Voor een deel kan dit worden verklaard door het feit dat de wetgever in de onderwijswetgeving op veel punten keuzes maakt die afwijken van de algemene regels van de Algemene wet bestuursrecht (Awb), vooral op het gebied van financiering, sancties, en rechtsbescherming. Daardoor wordt de onderwijswetgeving atypisch en lastig te vangen in de “standaardsystematiek” waarmee zoveel bestuursrechtjuristen gewoon zijn te werken. Volgens de literatuur[3] zijn er verschillende omstandigheden die de eigen positie van de bijzondere onderwijswetgever ten opzichte van de Awb kunnen verklaren.
