Stefanie Grant's research interests focus on forced and involuntary migration, and the human rights consequences of leaving a country of nationality as a refugee or migrant. She has held visiting fellowships at the University of Sussex and the London School of Economics. Her previous work has included acting for immigrants and refugees as a solicitor in London, and heading the research branch of the UN’s Office of the High Commissioner for Human Rights in Geneva. She has also led Amnesty International’s Research Department in London, represented Amnesty in Washington DC, and consulted for IOM, ILO, the Global Commission on International Migration and the Council of Europe. Recent work has been on deaths during migrant cross border journeys, and the rights of families; and on consular protection and migrants' rights.

The document calls for substantial consultation with regional bodies and organisations and the participation of civil society in a transparent and open procedure. The Mediterranean Missing research project has sought to understand both the impact on families o... more The Mediterranean Missing research project has sought to understand both the impact on families of having a relative missing in migration, and the law, policy and practice around the identification of bodies of dead migrants in Italy and Greece. Interviews with families of missing migrants from five countries confirmed the huge impact of not knowing the fate of loved ones, with families tortured by ambiguity and suffering a range of emotional and psychological consequences. In Lesbos, Greece, and Sicily, Italy, interviews with authorities, civil society and others confirm the presence of a policy vacuum around the issue of the missing, despite the duties on states imposed by human rights law. Investigation of deaths is inadequate, with effective post-mortem data collection and management challenged by the huge numbers of migrants , in some cases sufficiently to compromise future identification. The UN Convention on the Protection of the Rights of All Migrant Workers and Members of their Fam... more The UN Convention on the Protection of the Rights of All Migrant Workers and Members of their Families broke ground in international law by articulating baseline treatment for migrants. But as the Convention approaches its 30-year mark with only 51 state parties, it is an outlier amongst the “core” UN human rights instruments. This low level of ratification reflects difficulty in shifting the perception by many sovereign states of migrants as intruders/supplicants to one of migrants as rightsbearing subjects. The objective of this chapter is to provide an account of how some of these UN processes are interacting with the Convention. The discussion includes both standing fora and special mechanisms of the UN. The standing fora examined are the UN Human Rights Council, and the treaty bodies for the nine other principal human rights treaties. Migrant deaths at EU maritime borders have more often been seen in the context of national border... more Migrant deaths at EU maritime borders have more often been seen in the context of national border control, than in terms of migrant protection and human rights. The 2009 Stockholm Programme accepted the need for action to avoid tragedies at sea, and to ‘record’ and ‘identify’ migrants trying to reach the EU. But it did not specify how this should be done. There are parallels between these migrant deaths, and deaths which occur in conflict and humanitarian disaster. The principles of human rights and humanitarian law which apply in these situations should be developed to create legal and policy frameworks for use in the case of migrants who are missing or who die on EU sea frontiers. The purpose would be to enable evidence of identity to be preserved, to protect the rights of families to know the fate of their relatives, and to create common national and international procedures.

Each year, thousands of migrants and refugees lose their lives or are missing at international bo... more Each year, thousands of migrants and refugees lose their lives or are missing at international borders:1 those crossing the Mediterranean, those lost in the Sahara, those dying from thirst in the Chihuahuan and Sonoran deserts between Mexico and the US, or the Rohingya in flight from Myanmar.2 They are casualties of dangerous journeys, extreme weather, unseaworthy boats, and unscrupulous smugglers. They are also an 'unintended consequence'3 of migration policies to control borders, and criminalise irregular movement. The names of most of the missing and dead are not known, their families are not traced, and where bodies are found, many are buried in unmarked graves. Relatives, often in other countries and continents, do not know if a missing family member – a parent, spouse, brother, sister or child – is alive or dead. In July 2016 the UN and IOM entered into an agreement whereby the IOM became a related organisati... more In July 2016 the UN and IOM entered into an agreement whereby the IOM became a related organisation within the UN system. In September of that year, the UN commenced negotiations towards the Global Compact on Safe, Orderly and Regular Migration to be adopted in Summer 2018. This paper examines the place of UN human rights obligations regarding migrants and the IOM Member states' position that it should remain a 'non-normative' agency even after its inclusion in the UN system. We question whether the primacy given to national law, and the lack of any reference to international law or human rights in the IOM Constitution are compatible with the substantial role assigned to the organisation in the development of the Global Migration Compact which the UN General Assembly has determined is a human rights driven project.
