  5. Where Wikidata is on spectrum of OpenStreetMap/Wikimedia Commons "we respect copyright, even stupid parts - we are not an experiment in copyright breaching", through Internet Archive with "we ignore copyright where it is stupid according to our opinion" to "Pirate Bay warez site". Is "it is a copyrighted data" or "this collection of data is protected by database rights" a valid removal decision?

I think there are a bunch of grey areas. In the case of data that's clearly licensed as share-alike by an entity outside of Wikimedia like OSM I consider copyright a good reason to remove the data. 09:42, 17 June 2020 (UTC)ChristianKl

I do not quite see the point. Manual copying of coordinates of a single object from OSM (or from Google Maps, for that purpose) is not in any way copyright or database right infringement. Are we talking here about automatic import of data for multiple objects? Single copy of a coordinate is not a problem, but "systematic extraction" is. Automatic import seems almost certainly to be "systematic extraction". The OP asserts that "This item was imported from OSM" - where is the evidence for this assertion? Where is the evidence that whoever added the data (and which data - there are three statements?) to OSM did original research, and was not copying it from elsewhere? Or that whoever imported it from OSM is not also the person who added it there? Where is the evidence that ODBL is the only licence applicable to the data in question? @Pigsonthewing: The creator of the item Fountain (Q76939332) added explictly stated in (P248)Open Database License (Q1224853) to the coordinate location (P625). This is an incorrect reference, not to OpenStreetMap, but merely to a license used by OSM. Though in conjunction with the fact, that the coordinates in WD are the coordinates in OSM rounded to six decimal places, it seems to be the cases, that the coordinates are indeed from OSM and the creator indeed knew about the license. From that though, we can only speculate, whether he only knew of the existence of the fountains from OSM. The OSM user ralfhauser did never edit fountains (or anything else) in Hamburg and has the same username as User:Ralfhauser – the creator of said items.  Not deleted; first of all a disclaimer: I am not a lawyer.
The main attack vector here seems to be the claim that OSM's database rights resulting from the EU Database Directive have been violated. For this comment, I assume that OSM does in fact enjoy protection by the EU database directive, although I am personally not 100% sure that this is even the case. Nevertheless, given the small amount of items/claims involved here (order of 1000), I do not see a violation of this right. Usually an extract is considered "substantial" when it is at or above 10% of the entire database, but this is more a soft limit and needs to be treated carefully. It is clear that this is not the only extract from OSM and there may have been other insubstantial amounts of data copied here by other users; the complete extent of this is unknown however.
That said, I mention here that meta:Wikilegal/Database Rights applies to Wikidata as well, thus imports from databases which are protected by the EU Database Directive and do not waive these rights should usually not be done in a systematic effort, as there is the risk that one crosses the somewhat soft limit to a "substantial" import (@Ralfhauser: FYI). —MisterSynergy (talk) 12:40, 26 September 2020 (UTC)

Specifically, the flag is shown in the cited Bing Streetside imagery – though I'll admit it's a slippery slope to consider anything visible in Streetside to be "published" – and it had been linked from The Walt Disney Company (Q7414) until Special:Diff/1234758125. For context, I created Mickey Mouse flag (Q97500972) and Walt Disney World flag (Q97500876) in order to link [2][3][4] to it, as part of a broader effort to link OSM flags to Wikidata flag items. (The goal is for this federated SPARQL query to be as comprehensive as possible.) If this item is deleted, I'll go ahead delete the QID from OSM and rely on the more ambiguous flag:name tags instead. Hello,

Here are some creations from User:Viapicante and these are just the latest modifications. Yes DeltaBot, each of the Items is linked to something else and that's the problem. But

  • the film trailers,
  • the ironworkers,
  • the actor-barber,
  • the soldier Unknown-Of-The-Battalion,
  • the short films That-The-Actors-Refuse-To-Put-On-Their-CV or
  • the complete Serafin-Butler family, etc.

all unknown (and therefore not respecting WD:N… in a roundabout way), we can do without. Each time there is a multitude of unnecessary pages, but one more interesting than another or a sitelinked Item causes all those unnecessary pages to be kept. Soon we are going to end up with a very famous film director who owned a puppy whose litter came to his neighbor John Doe, etc. Above, pages to delete that are pending due to internal links and it's been going on for a long time. Nothing has happened for months… I mean globally (already locked on enWP).
