and Conditions of Service) Rules, 1966

Section 49 of The Factories Act 1948

49. Welfare Officers- (1) In every factory wherein five hundred or


more workers are ordinarly employed the occupier shall employ in
the factory such number of welfare officers as may be prescribed.

(2) The State Government may prescribe the duties, qualifications


and condition of service of officers employed under sub-section
(1).

> 500 to 2500 workers - One Welfare officers
Assistant Welfare Officer and/or Additional Welfare Officers depending upon
number of workers > 2500 nos

3. Qualifications and disqualifications for being appointed as


Welfare Officers
Degree or Diploma in Social Science from recognised institution & qualified at a
viva voce test conducted by DISH and enrolled in the list maintained by DISH
Adequate knowledge of Marathi language

Titles of rules
3.A Provision for viva-voce test
General knowledge particular to labour problem to the State of
Maharashtra. Conducted by DISH at the beginning of every quarter.
Maximum three chances
4. Recruitment of a Welfare Officer
Advertisement in two news papers (one shall be in English)
Notification to State Government once appointed
5. Maintenance of list of candidates
Commissioner of labor shall maintain a list of qualified Welfare
Officers based on application filed by person desiring to get
enrolled.

6. Filling of vacancy
Shall be filled up within six months
7. Conditions of Service
Status of HOD, Shall work under directly under the control of the
Chief Executive of the factory,
The conditions of service of a Welfare Officers, Additional /
Assistant Welfare Officers shall be the same as those of other
officers
8. Chief Inspector of Factories to be informed of any action
proposed against Welfare Officer
Advance information to DISH , Wait for 30 days & consider any
advice rendered

9. Duties of Welfare Officers.- (1) The duties shall be,-
(i) Hold consultation with a view to maintain harmonious relationship
(ii) bring to notice the grievances of workers to secure their
expeditious redress
(iii) Help management to formulate labour polices and interpret these
polices to the
(iv) to watch industrial relations to prevent disputes and bring about a
settlement by persuasive efforts if in the event of disputes having
arisen
(v) Advise against illegal strikes and declaring illegal lock-outs to
workers & management respectively in preventing anti-social
activities

(vi) To maintain an impartial attitude during the lawful strike or lock-
outs and bring peaceful settlement
(vii) to advise and assist in the fulfillment of obligations, statutory or
otherwise provision of The Factories Act, 194 and rule made there
under
(viii) To promote good relation for 1. productive efficiency, 2.
amelioration in the working conditions & 3. Adjust and adopt to
work environment
(ix) To encourage the formation of production committees, Co-
operatives societies and Safety First and Welfare Committees and to
supervise their work

9.Duties of Welfare Officers …
(x) To advise and assist factory management in making provisions for
amenities such as canteens, shelters for rest, creches , adequate
latrine facilities, drinking water, sickness and benevolent scheme
payment, pension, superannuation funds, and gratuity payments
(xi) Regulating system of leave management
(xii) To advise and assist factory management in providing welfare
facilities such as housing facilities, foodstuff, social and recreational
facilities, sanitation, education of children and to advise on
individual personal problem

9. Duties of Welfare Officers …
(xiii) To advise and assist factory management in training, control of
notice board, information bulletin and encourage attendance at
technical institutes
(xiv) Propagate family programme to raise standard of living of workers
and well-being
(xv) Active promotion of Standing

(2) No Welfare Officers shall deal with disciplinary cases against workers
or appears in courts on behalf of the management against the
workers in labour disputes.

10. Welfare Officers, etc not to be required or permitted


to do work inconsistent with his duties
The Chief Inspector of Factories may direct by an order in
writing Welfare Officers not to be required or permitted to do such work
required or permitted by an occupier which is inconsistent with or
detrimental to the performance of the duties mentioned in rule 9

11. Repeal and saving.-


Earlier rules on Welfare officers ( 1952 & 1956) shall stand repealed
