Categories of the Law

Law can be classified on the following basis :-


1. On the basis of territorial limits of operation
2. On the basis of nature of law
3. On the basis of subject matter of law
4. On the basis of individual’s duty towards society
On the basis of Territorial Limits of
Operation
National Law
International Law
National Law
This law is operated and regulates the various
activities of people within the state territory. The law
which operates within the territory of state is known as
national law or municipal law. It is applicable to the
organs of state , its citizens or other administrative law
etc.
International Law
The international is the body of principles recognized
and applied by the civilized nations as well as
international Organizations. International Law
consists of bilateral, regional or universal treaties
agreed by the state and the common customary
practice of the states. For eg –The Charter of United
Nations Organizations, Rules of WTO and Rules of
UN.
On the basis of Nature of law
I. Substantive law
II. Procedural law
Substantive Law
The law which creates , defines and enforces legal
rights and duties that law known as substantive law.
So, it is related to the rights and duties that law known
as substantive law. So it is related to the rights and
duties of a people in society. For example has the
rights to make profit from the legal business, notice to
be given before making an arrest, a person has right to
use the property which is in his lawful possession.etc.
Procedure Law
The procedural law deals with the way and manner of
achieving remedies, protecting rights and imposing
the duties when the rights established by substantive
law are broken . When the rights and duties are
broken , while providing remedies the procedural law
guides.
On the basis of subject matter of law
Public law
Private law
Public Law
The law which regulates the relation of the state
organs and citizens known as public law. Public law
defines the various immunities, powers and duties of
government, it organs and officials , rights and duties
of individuals. For example , the constitution of Nepal
guarantees that every persons has right to earn from
business..
Private Law
Private law is directly related to the individual
interests or the interest other than the public matters
e.g law of contract deals with position, claims or
rights , property , etc.
On the basis of individual’s duty towards
society

Criminal Law :
Crime is defined as an act of disobedience of the law
for bidden under pain of punishment, e.g committing
murder. It determines the crime and punishment.
Whoever fails to follow or breaches the law , a
punishment will be determined for them under the
criminal law. It deals with the crime against that state .
Civil Law
It is related to the rights , status , position and
property of parties. It does not contain the matters
relating to the punishment. It useful to restore the
rights and authorities of a man. E. g Law of contract ,
law of property ,law of succession , family law.
