By Senator Manny
Villar
• Constitution, Article VI, Section 14. No Senator
or Member of the House of Representatives
may personally appear as counsel before any
court of justice or before the Electoral
Tribunals or quasi-judicial and other
administrative bodies. Neither shall he,
directly or indirectly, be interested financially
in any contract with, or in any franchise or
special privilege granted by the Government
or any subdivision, agency, or instrumentality
thereof, including any government-owned or
controlled corporation, or its subsidiary,
during his term of office. He shall not
intervene in any matter before any office of
the Government for his pecuniary benefit or
where he may be called upon to act on
account of his office.
• Constitution, Article VI, Section 12. All
Members of the Senate and House of
Representatives shall, upon assumption
of office, make a full disclosure of their
financial and business interests. They
shall notify the House concerned of a
potential conflict of interest that may
arise from the filing of a proposed
legislation of which they are authors.
• Republic Act No. 6713, Sec. 7. Prohibited Acts and
Transactions. “In addition to the acts and
omissions of public officials and employees now
prescribed in the Constitution and existing laws,
the following shall constitute prohibited acts and
transactions of any public official and employee
and are hereby declared to be unlawful: (a)
Financial and material interest. – Public officials
and employees shall not, directly or indirectly,
have any financial or material interest in any
transaction requiring the approval of their office.”
• Republic Act No. 6713, SEC. 9.
Divestment. – A public official or
employee shall avoid conflicts of interest
at all times. When a conflict of interest
arises, he shall resign from his position in
any private business enterprise within
thirty (30) days from his assumption of
office and or divest himself of his
shareholdings or interest within sixty (60)
days from such assumption.

The same rule shall apply where the


public official or employee is a partner in
a partnership. x x x

Summary of Charges
a. Villar, using his position in the
government and with conflict of
interest, caused the change of the
alignment of the planned C5 road
extension by proposing, initiating
and funding the construction of the
Las Pinas-Paranaque Link Road and
the C5 road extension project which
passed through properties of his
corporations.
b. Villar, as chairman of Senate Committee on
Finance, and later, Senate President, caused
the appropriation of public funds for the
construction of the Las Pinas-Paranaque Link
Road and the C5 Road Extension project.
Furthermore, Villar knowingly and wilfully
made a P200,000,000 insertion in the 2008
National Budget for the said project, including
payment for road-right-of-way, at a time when
his corporations had collectibles from the
government for unpaid road-right-of-way
compensation
c. Villar, through corporations that he
owned and controlled, sold
overpriced parcels of land to the
government as road-right-of-way for
the Las Pinas-Paranaque Link Road
through the use of falsified Bureau of
Internal Revenue Certifications on
zonal valuation to the great
detriment of the government and the
Filipino people
d. Villar, in causing the realignment of the C5
Road Extension, also caused the government
to incur unnecessary and additional
expenditures in the aggregate amount of
P3,764,799,130.35 and further, caused the
loss of P1,850,000,000 that was already paid
by the government for the acquisition of
lands to be used as road-right-of-way of the
originally planned C5 Road Extension Project
e. Villar failed to divest of his interests
and stockholdings in Adelfa
Properties, Inc. and Golden Haven
Memorial Park, Inc. and Brittany
Corporation, which corporations have
tremendously benefited from the re-
aligned C5 Road Extension and the
construction of the Las Pinas-
Paranaque Link Road and C5 Road
Extension Project

• MR. TAYAO. I still remember when we received the list for the 2008 budget, nakita po naming iyon na
mayroon ngang similarity iyong release na P200 million. So ang pagka-alam po ng Department,
especially the National Capital Region being the implementor of projects within Metro Manila, medyo
hindi ho namin alam iyong another P200 million. Only the first P200 million ang alam namin. In most
likelihood, even the Department, hindi rin po nila alam iyong another P200 million, your Honor.

• MR. FRANCISCO. What was the reaction of Secretary Ebdane when he learned about this redundant P200
million item in the 2008 budget?
• MR. TAYAO. Ang pagkadinig ko po noon, sabi n’ya “Hindi ika natin problema iyan.” Meaning, hindi naming
alam. The DPWH doesn’t know about the 200 million, Your Honor.

• MR. FRANCISCO. So, you did not request the office of Senator Manny Villar or Senator Manny Villar to fund
an additional 200 million for the C-5 Road Extension Project?
• MR. TAYAO. As far as I know, wala po kasi alam na namin mayroong 200 million. The 200 million is
included as part of the ceiling of the DPWH. Mayroon po kasing corresponding ceiling kada departamento.
In the case of NCR, binigyan po kami ng ceiling na ganon lang so we will not exceed – we cannot exceed
with that ceiling. The 200 million po ang kasama.

• MR. FRANCISCO. Noong sinasabi mong -- sinabi ni Secretary Ebdane, “Problema na nila ‘yon,” ano ang
ibig mong sabihin?
• MR. TAYAO. Ang ibig ko hong sabihin, ang sabi ni Secretary inasmuch as hindi naman po niya alam ‘yan
from the very start, maybe ‘yong — actually para bang bicam po yata ‘yong nabanggit pa niya, eh.

Senador, ito ay yung Doña Josefa Vda. De Santos na lupa
na may pitong ektarya lamang?

• MR. FRANCISCO. Pero in addition to the seven hectares,


you have other joint venture agreements with other
property owners in this area?
• MR. ADRIANO. We have one, Your Honor. Yes.

• MR. FRANCISCO. You have one. And can you state to the
record what is that joint venture agreement?
• MR. ADRIANO. I think it’s the de Leon family. I’m not --
that is one but I cannot specifically remember the full ...

family, how big is the land holdings of Brittany Corporation in this

Properties Inc. is to develop this 10 to 12 hectares into a subdivision,

by the developer with the help of professional
architects and engineers to give basically the
developer an idea in paper what he wants to put up
in the area.

• MR. FRANCISCO. And what are the components of


this master plan community?
• MR. ADRIANO. Well, initially, a master plan
community would just include conceptual plans of
how the area will be developed.
• MR. FRANCISCO. Now, with respect to this master plan
community under this land development agreement, how
many hectares would be needed or this master plan
community?
• MR. ADRIANO. Actually, it’s varying, Your Honor. So there is
no fuss, hard and fast rule as to how big the area would be.

• MR. FRANCISCO. So this master plan community would have


residential components, right?
• MR. ADRIANO. They would have residential component.
They would have commercial components, sometimes, they
would even have institutionalized component.

• MR. FRANCISCO. For the record, Your Honor, we are again


moving to sight this witness for contempt for repeatedly
telling the Honorable Committee that Adelfa Properties,
Incorporated did not have any plan with respect to its
landholdings in the vicinity of the Las Piñas-Parañaque Link
Road.

• MR. FRANCISCO. The question, Your Honor, is very clear. At the last
hearing, you undertook to submit to inform the Honorable
Committee the total landholdings of Adelfa Properties, Inc. in the
vicinity of the Las Piñas-Parañaque Link Road, including those lands
owned by Adelfa Properties, Inc. and those lands which are owned
by other property owners but under joint venture agreement with
Adelfa Properties, Inc. So the question is: How big is the total
landholdings of Adelfa Properties, Inc.?

• THE CHAIRMAN. Gaano daw kalaki—alam mo, pareho lang yung


issue eh. Kung may isang ektarya dun, o may issue na yon. Kung
isang daang ektarya ang nandun, pareho lang ang issue. Anong
problem a —

• MR. ADRIANO. As I mentioned before, Your Honor, I think I


mentioned about an area of approximately, on my personal
knowledge, about 40 hectares, Your Honor. But I still have to get
the exact figures, Your Honor.
