Joint Petition under section 13-B of Hindu Marriage


Act, 1955.

Respected Sir,

Respectfully Showeth :-

1.That the above noted petition was pending in the


Hon’ble Court and the same was fixed for 21.07.2023
and has been dismissed in default due to the non
appearance of the Petitioners and their counsels.

2.That the Petitioners could not appear before the


Hon’ble Court on 21.07.2023 as the Petitioners
mistook the date as 28.07.2023 and was under the
impression that the case is pending for 01.08.2023
and the counsel for the Petitioners also could not
appear before the Hon’ble Court due to his busy
schedule.

3.That the Petitioners came to the court premises


today and it was revealed that the aforesaid case
was pending for 21.07.2023and has been dismissed
in default and thereafter the present application
is being filed for the restoration of the suit,
today itself, without any delay.

4.That there is sufficient ground for restoration of


the application to its original number and stage.

5.That the present application is being filed in a


Bonafide manner. The Petitioners undertakes to be
more careful about the date of hearing in future.

6.That in case the suit is restored, then the rights


of any party will not be prejudiced in any manner
and if the suit is not restored, the rights of the
Petitioners shall be gravely prejudiced.
It is therefore, prayed that the application may
kindly be accepted and the aforesaid civil suit may
kindly be ordered to be restored and the same may
kindly be decided on merits on the interest of
Justice.
