ADMISSION PROCESS OF PDL’s in

(BJMP)

ADMISSION OF INMATES

1. RECEIVING - The new prisoner is received at the Reception and Diagnostic


Center (RDC). The new prisoner usually comes from a provincial or city jail where
he was immediately committed upon conviction by the court and escorted by the
escort platoon during his transfer to the National Prison.
2. CHECKING OF COMMITMENT PROCESS - The receiving officer checks the
commitment papers if they are in order. That is, if they contain the signature of the
judge or the signature of the clerk of court and the seal of the court.
3. IDENTIFICATION - The prisoner's identity is established through the picture
and fingerprint appearing in the commitment order. This is to ensure that the
person being committed is the same as the person being named in the
commitment order.
4. SEARCHING - this step involves the frisking of the prisoner and searching his
personal things. Weapons and other items classified as contraband are confiscated
and deposited to the property custodian. Other properties are deposited with the
trust officer under recording and receipts.

*PERMITTED ITEMS
Sanitary items such as toothbrush, toothpaste, soap, towel, etc.
Cooked food as approved by the prison director.
Any items not mentioned above will be put into the prison director's approval. The
identification card or any electronic cards (ATM card) will be kept by prison
authorities.
*UN-PERMITTED ITEMS
Contrabands:
Narcotic drugs, inhalant substance
Alcohols or other similar liquors
Gambling materials
Tools for escape
Weapons, bullets, explosives, fire work, and weapon accessories
Perishable or toxic items.
Fuel
Living animals
Computers, mobile phones and other electronic devices
Items or documents which can cause disorder or ethical conflicts
Cash:
Cash will be deposited in a prisoner's account called "Book". A prisoner can
withdraw in terms of card or coupon to buy things.
(3) Others
Other items not described in (1) and (2), such as valuable accessories (necklace,
ring, watch, small images of Buddha, etc.), are to be given to prisoner's relatives or
to be kept by the prison
5. INTERVIEW
A prisoner is photographed, fingerprinted, and interviewed about his/her
background in order to sock further assistance and to prevent a release mistake.
The prisoner shall have to inform the 13-digit-identification number for issuing the
National Health Assurance Card. If the prisoner has already got the National Health
Insurance Card, he/she is required to show it so as to adjust the right of treatment.
6. PHYSICAL CHECK-UP
Physical cheek-up is to be performed by a doctor or other medical staff on the
admission date or on the following date.
4. CHILDREN ATTACHED TO A PRISONER
In case a prisoner has a child/children attached to him/her, the child/children will
be allowed to be with the prisoner in prison temporarily. A Child/children attached
to the prisoner should not be over 3 years of age. In case the age of the child
exceeds 3 years, he/she shall have to be taken outside prison to the custody of the
relatives, or to the custody of public orphan facility.
5. PREGNANT PRISONER
In case a prisoner is pregnant when being sent into prison, after birth giving, the
treatment procedure will be as the foregoing passage.
5. BRIEFING AND ORIENTATION - the prisoner will be brief and oriented on the
rules and regulation of the prison before he will be assigned to the RDC or the
quarantine unit.

After the foregoing procedures, the prisoners will be sent to the admission centre
for the following processes:
(1) Orientation:
To introduce and explain prison rules and regulations that the prisoners have to
conform to during their
imprisonment, including the prisoner's rights and privileges. Drill exercise is
performed as part of prison
disciplinary training.
(2) Classification:
Social workers or psychologists will conduct interviews to collect information of
each prisoner. The gained. information will be forwarded to the Prison Classification
Committee. The prisoners may be brought to meet with the Committee in order to
plan an appropriate treatment for each prisoner, such as education, vocational
training. medical service, or social welfare assistances. If the information received
from the interview is incorrect the prisoners may receive disadvantages or may
lose certain privileges, such as rights of contact visit, medical welfare services,
parole, and good-conduct allowances.
III. PURPOSE
This policy aims to provide a standardized admission and releasing procedures of
inmates at the ail facilities of the Bureau of Jail Management and Penology as well
as the actions to be taken by the warden in relation to the case of the inmate from
the time he/she is admitted until the time of his/her release.
IV. OBJECTIVES
1. To provide standardized guidelines in the admission of inmates;
2. To institutionalize a feedback and referral mechanism for the notification of
stakeholders; and 3. To establish standardized guidelines in the releasing of
inmates.
V. PROCEDURE ON ADMISSION
A. DESK OFFICER
1. Upon commitment of an inmate, check the credentials of the person bringing
the inmate to determine his/her/their identity and authority.
2. Make sure that the following documents are available:
• Commitment Order
• Information/Complaint
•Medical Certificate issued by Government Hospital
3. Examine the arrest report and the authenticity of the commitment order.
4. Take all cash and other personal property from the inmate, list them down on a
receipt form duplicate, duly signed by him/her and countersigned by the inmate.
Original receipt should be kept for the record and duplicate should be given to the
inmate.
5. All cash and other valuables of the inmate must be turned over to the Jail
Property Custodian for safekeeping and covered by a receipt.
B. RECORDS/ADMITTING OFFICER
1. Receives the documents from the DO and starts the booking procedures.
2. Inmate is fingerprinted and photographed.
3. Inmate is strip-searched to check for any markings, cuts, bruises, etc. and same
shall be indicated in the jail booking report.
4. Inmates clothing shall be checked for presence of contrabands.
5. In a dialect that the inmate understands, he/she shall be apprised of the
provisions of Art 29 of the RPC as amended by RA 6127.
6. If the inmate agrees to abide by the e same disciplinary rules upon convicted
inmates, he/she shall be asked to sign a Detainee's Manifestation. Otherwise, the
warden issues a Certification under oath to the effect that the detainee was
apprised of the provision of Art 29 of the RPC as amended and that the inmate
refused to sign.
JAIL MEDICAL OFFICER
1. Conducts thorough check-up on the overall condition of the inmate during the
time he/she was brought to the jail.
2. Checks on the entries in the medical certificate to ascertain any discrepancies
and records any findings not indicated.
D. CHIEF CUSTODIAL! OFFICER OF THE DAY
1. Orients the newly committed inmate of the rules and regulations of the jail.
E. RECORDS! DESK OFFICER (as the case maybe)
1. Assigns the newly committed inmate to his/her cell.

REVISED LIST OF AUTHORIZED PERSONAL PROPERTIES FOR PERSONS
DEPRIVED OF LIBERTY
GENERAL GUIDELINES

The provisions of this standard operating procedure shall be strictly followed in


order to contribute to a safe environment for personnel and persons deprived of
liberty (PDLs). Reducing fire hazards, security risks, and sanitation problems could
accomplish this, while at the same time, ensuring the protection of properties
authorized to be retained by every person deprived of liberty (PDL). These safety
efforts shall include type, quantity and methods of acquisitions of inmate personal
property. The BJMP shall allow personal property based on the types and amounts
reasonable and necessary for the comfort and rehabilitation of persons deprived of
liberty (PDLs) while ensuring that order and security is maintained.
A. Allowable Personal Properties for Persons Deprived of Liberty

The Warden or any officer receiving the newly committed persons deprived of
liberty (PDLs) shall inform him/her that the personal properties that shall be
allowed for them to possess while incarcerated are those listed in the matrix in
page 7-10 of this SOP (See Annex A & B. Revised Authorize Inmate Property Matrix
for Male and Female Persons Deprived of Liberty).

a. Limitations on the source/s that PDLs may access to obtain items of personal
property not offered by Jail Cooperative/Commissary, such as livelihood supplies,
religious and cultural items as the case maybe, shall be established and
maintained by IWD Staff and/or Property Custodian of every jail.
b. The Chief, Custodial shall ensure the space limits for PDLs personal properties.
Provided, that the amount of space assigned for each PDL shall equally be
distributed among them per cell.
c. PDLs should not accumulate excessive quantity of paper materials that may
pose a fire, sanitation, and security hazard.
d. PDL personal property must fit in the assigned storage or stored in approved
storage containers determined, based on assessment by the Warden or any officer
with whom he/she delegated his/her authority.
e. PDLs are not allowed to possess personal property belonging to another PDL.
f. Religious items used in the practice of PDLs’ chosen religion not posing a
threat to safe, secure and orderly operation of the jail may be authorized.
Provided, that such items shall acquire the clearance from the Chaplain or Imam as
the case maybe.
g. PDLs are also allowed to possess money/funds to augment their day-to-day
living while incarcerated. (See Annexes A & B. Revised Authorize Personal Property
Matrix for Persons Deprived of Liberty). Provided, that any excess of the authorized
amount shall be considered as contraband/s and shall be subjected to the
provisions of the existing policies.
B. Acquisition

PDLs may obtain personal property through the following authorized sources:

a. Personal properties at the time of admission;


b. BJMP-issued supplies and items;
c. Mailed PDL packages approved by the Warden;
d. Jail Cooperative/Commissary; and
e. Donations from Accredited Jail Service Providers and NGOs
C. Recording and Monitoring

Every jail unit shall abide with the following provisions in recording and monitoring
of PDLs personal property/ies:

a. The recording of PDLs personal property does not create or infer liability to the
jail. Upon admission, newly committed PDLs shall declare all his personal
properties in the ODIFORM-001 PDL Property Declaration Form. The Property
Custodian, upon admission of the PDL, shall provide two (2) copies for the PDL to
fill out: One (1) copy shall be given to the PDL, and the other shall be signed both
by the PDL and the Property Custodian, which the latter shall keep for
documentation.
b. Any personal property reported by a PDL as lost, stolen, or missing shall be
entered on the PDLs property record as such. The PDL however, may be allowed to
purchase replacement property, as authorized by the Warden. Further, PDLs are
responsible for reporting all lost, stolen, missing, damaged and/or destroyed
personal properties. Moreover, if the lost, stolen or missing personal property item
is found and can be returned to PDL, the PDL shall be required to sent out or
destroy any property item(s) in excess of what is allowed by the Revised Authorize
Property Matrix for Person Deprived of Liberty.
c. The Jail shall not be liable for damages, actions, claims, demands or expenses
of whatever kind or character in connection to PDLs personal property resulting
from the acts or omissions by other PDLs.

D. Disposal
In handling and disposition of all contrabands relative to PDL personal property,
Wardens shall abide by the existing policies and procedures.
a. Following PDLs death, escape or release, all tangible personal properties shall
be disposed of based on the existing policies and guidelines.

E. Liability of the Warden and/or any Concerned Personnel


a. The Warden, Officer of the Day and/or any concerned personnel who without
valid reasons refuses to implement the aforementioned standard operating
procedure in their respective jails and/or violated and tolerated the same shall be
held administratively liable for misconduct and/or neglect of duty, as the case
maybe, depending upon the circumstances of participation and with corresponding
penalty as provided in the BJMP Administrative Disciplinary Machinery.
SEPARABILITY CLAUSE

In the event that any provision or part of this Standard Operating Procedure has
been declared unauthorized or rendered invalid by a competent authority, those
provisions not affected by such declaration shall remain valid and effective.
REPEALING CLAUSE

All existing issuances that are inconsistent with this policy are hereby rescinded or
modified accordingly.
EFFECTIVITY
This policy shall take effect fifteen (15) days after the registration with Office of
National Administrative Register (ONAR). Thereafter, all Regional Directors and
Wardens shall be given thirty (30) days to formulate their respective
Implementation Plans (IMPLANS) in order to execute the provisions of this policy.

MEMORANDUM CIRCULAR NO. 110

The implementation of the coupon system in jails under BJMP RO-VII is a


good development towards cash-less transaction by PDL in jails. The role
of Jail Commissary shall include the conversion of money to coupon within
the allowable limit, in the name of the Jail Commissary for exclusive use
by PDL in purchasing items solely from the Jail Commissary
General Guidelines
1. A Jail Commissary must be established in jails which must have a deposit
mechanism to store cash by PDL which must not exceed P1,000.00 per week.
2. A jail which does not have a Jail Commissary inside the jail cannot receive cash
from PDL for deposit.
3. Only the person in charge of the Jail Commissary is authorized to issue coupon
in the name of the Jail Commissary to the PDL.
4. Money or cash possessed by PDL shall be considered as contraband in jails with
Jail Commissary.

Specific Guidelines on PDL

1. A PDL shall deposit his cash/money, not exceeding P1,000.00, to the person in-
charge of the Jail Commissary. The amount used to purchase items from the store
under the Jail Commissary shall be deducted from the amount deposited by the
PDL.
2. Any amount in excess of P1,000.00 shall be confiscated and turned over to his
immediate family or duly authorized representative.
3. The person in-charge of the Jail Commissary shall issue a coupon with face value
of the cash/money deposited for storage.
4. The issued coupon is personal to the PDL and cannot be transferred or
negotiated.
5. The coupon shall be valid for one (1) month with subsequent security features.
The 1-month validity of the coupon shall be expressly and conspicuously shown on
the coupon.
6. Unused coupons shall be surrendered to the person in-charge of the Jail
Commissary
7. Unused coupons can only be encashed upon the PDL's release or transfer.
8. The amount used to purchase items from the store under the Jail Commissary
shall be deducted from the amount deposited by the PDL.
9 The person in-charge shall keep a full record of the deposit and the used and
unused coupons.

Specific Guidelines on Visitors

1. Visitors of PDL who want to give cash, not exceeding P1,000.00, to PDL shall
deposit the amount before the person in-charge of the Jail Commissary.
2. The person in charge of the Jail Commissary shall issue a coupon to be given
exclusively to the PDL with face value of the cash/money deposited in the account
of the PDL.
3 Giving of money or cash to PDE by any person (such as visitor BJMP personnel
etc in jails with Jail Commissary shall be considered of jail rules and regulations on
the part of the visitor a violation.
4 The person in charge shall keep a full record of the deposit made by visitors for
PDL.

BUREAU OF CORRECTION
(BUCOR)

Admission. An inmate shall be admitted in the Reception and Diagnostic Center of


a prison upon presentation of the following documents:
a. Mittimus/Commitment Order of the court;
b. Information and Court decision in the case:
c. Certification of detention, if any; and
d. Certification that the case of the inmate is not on appeal.
A female inmate shall be received only at the CIW.
SECTION 2. Form of mittimus/commitment order. The mittimus/commitment
order shall be under the signature of the judge and shall bear the seal of the court
attested by the clerk of court thereof.
SECTION 3. Registration book. A prison shall keep abound registration book
wherein all commitments shall be recorded chronologically. The register shall
contain the following entries:
a. Name of the inmate;
b. Reason for commitment and the authority therefor;
c. Sentence;
d. Date and hour admission; and
e. Date and hour of discharge or transfer and basis therefor.
SECTION 4. Admission process. After registration, the inmate shall be
photographed, front and side view, fingerprinted and assigned a permanent prison
number. The male inmate shall then be given a regulation haircut and his
beard/mustache, if any, shall be shaven off.
1. Admission procedure: (RA 10575, IRR)
2. Receiving-the new prisoner is received at the DRD. The new prisoner usually
comes from a provincial or city jail where he was immediately committed
upon conviction by the court, and escorted by the escort platoon during his
transfer to the National Prison.
3. SECTION 7(BUCOR MANUAL): Upon admission, the PDL shall be registered
by the Receiving Officer and processed accordingly:
4. Registration Logbook all committed PDL shall be officially recorded and must
contain the basic entrise, to wit:
1.1. Name of PDL:
1.2. Jail of origin:
1.3. Date and hour of admission;
1.4. Name of escort, contact number, email address (if any); and
1.5. Name of receiving officer.
1.6. Issuance of Certificate of Appearance to the Committing Officer –

a. The Jail/Police/Committing personnel shall be issued an appropriate


Certificate of Appearance by the Overseer office, without delay and
whether the purpose of the appearance is complete or otherwise, upon
presentation of proper identification credentials and a mission
order/directive.
5. Taking of fingerprints for the Registration Form, Criminal Fingerprint Chart,
and Registration Sheet Form shall be conducted by the Identification Unit
simultaneously with the taking of mug shots and photographs for the
Carpeta conducted by Photography Unit. The original copy of the documents
comprising the Carpeta shall be forwarded to the PDL Documents Processing
Division (PDPD), duplicate original/certified true copy of the documents
comprising the Carpeta shall be forwarded to the respective PDL Documents
Processing Sections (PDPS) and Overseer Sections of corrections facility.
6. PDL Number-a newly-committed PDL shall be duly assigned a PDL number.
7. Issuance of PDL provisions-A POL shall be initially issued with the following
personal supplies:
1. Toothbrush:
2. Toothpaste,
3. Pair of Slippers;
4. Briefs/Panties;
5. Brassieres;
6. Prescribed Uniform,
7. Short Pants,
8. Jogging Pants:
9. Bath Soap:
10. Laundry Soap:
11. Shoes,
12. Bath Towel
13. Mosquito Net,
14. Mat:
15. Blanket,
16. Pillow with Pillowcase, and
17. PDL handbook.

7. A male PDL shall undergo the regulation haircut and his beard/mustache must
be shaved off.
8. Hairpieces or wigs may be worn when recommended by the medical officer of
the BuCor and approved by the Superintendent
9. An admission slip shall be given to the Security and Housing Unit (SHU) and
Kitchen and Mess Hall Unit which shall indicate where the pdl will be quarantined.
2. Checking of Commitment Papers -receiving officer checks the commitment
papers if they are in order. That is, if they contain the signature of the judge or the
signature of the clerk of court, and the seal of the court.
3. Identification/Booking-the Prisoner's identity is established through the
picture and fingerprint appearing in the commitment order. This is to ensure that
the person being committed is the same as the person being named in the
commitment order.
4. Searching/Shakedown-this step involves the frisking of the prisoner and
searching his personal things. Weapons and other items classified as contraband
are confiscated and deposited to the property custodian. Other properties are
deposited with the trust fund officer under recording and receipts.
Pat-patting of subjects clothing.
Rub-patting of body over the clothing including the groin, buttocks, and breast.
Strip-naked search.
Body Cavity Search-expose body cavities like Anus and Vagina to look for
contrabands.

5. Briefing and Orientation-the prisoner will be brief and oriented on the rules
and regulations of the prison before he will be assigned to the DRD of the
Quarantine Unit.
6. Issuance of Clothes and Equipment-from the receiving office, the new
prisoner goes to the supply room where he receives his prison uniform, mosquito
net, and beddings
7. Assignment to Quarters-after the prisoner is issued his clothing's and
beddings, he is sent to the quarantine unit. The quarantine may be a unit of the
prison or a section of the Reception Center.
8. Body search of Inmate; personal effects
Upon admission, the inmate shall be searched thoroughly. He shall be allowed to
retain in his possession only such articles as are authorized hereunder. A list of all
articles taken from the inmate shall be entered in the inmate's record and
receipted for by the guard in charge thereof. All articles taken from the inmate
shall be return to him upon his discharge unless previously disposed of at the
inmate's request or ordered condemned by the Superintendent after a lapsed of
two (2) years.

Hairpieces-An inmate may not wear a wig or artificial hairpiece, unless medical
authorization to do so is approved by the Superintendent
9.Confiscation of contraband-Narcotics and all other prohibited drugs or
substances, as well as weapons of any kind, substances or chemicals that may
cause bodily harm, and any other items or articles that a PDL is not permitted to
possess under prison rules, will be considered contraband and confiscated
accordingly.
10. Issuance of uniforms etc.
The newly-admitted inmate shall be issued two (2) regulation uniforms/suits and
two (2) t-shirts, whenever practicable, he shall also be issued the following items:
a. One (1) blanket,
b. One (1) mat,
c. One (1) pillow with pillow case,
d. One (1) mosquito net,
e. One (1) set, mess kit, and
d. One (1) pair of slippers
Personal effects of inmate
In addition to the articles supplied by the prison, the inmate may bring clothes and
other items essential to his well-being, provided the quantity, nature and
dimension thereof will not interfere with the safety and living conditions of the
other inmates. The Superintendent may allow the inmate to bring in electrical
equipment like television sets, radio cassettes, video players, electric fans and
similar items provided the same is for common use with other inmates.
In no case shall an inmate be allowed to bring in luxurious items such as air
conditioners, carpets, sofas, beds, sleeping mattresses, washing machines and the
like.
Wearing of jewelry
An inmate may not wear any jewelry items. He may, however, be allowed an
inexpensive watch.
Inmate Record
The RDC shall keep a complete record of an inmate which shall include the
inmate's personal circumstances; a brief personal, social and occupational history;
the result of the intake interview; and initial security classification.
Prison Record-information concerning an inmate's personal circumstances, the
offense he committed, the sentence imposed, the criminal case numbers in the
trial and appellate courts, the date he commenced service for sentence, the date
he was received for confinement, the date of expiration of his sentence, the
number of previous convictions, if any, and his behavior or conduct while in prison.

Carpeta (also known as the inmate record or jacket) -Institutional record of an


inmate which includes the mittimus/commitment order, the prosecutor's
information and the decision of the trial court, including that of the appellate court.
