COMPETENT AUTHORITY TO COMMIT A PERSON TO CORRECTIONS

The following are competent institutions authorized to commit a


person to prison:
Supreme Court
RTC
Military Courts
Intermediate Appellate Court (C.A)
Sandiganbayan
Sharia Courts
Other authorities that can commit a person to Corrections:
Congress
Commission on Immigration and Deportation
Board of pardons and Parole
Commission on Election

RECEIVING PRISONERS

Upon arrival, the prisoner is ushered in the Receiving Office of the


inmate Reception and Education Center at the New Bilibid Prison and
other prisons authorized to admit prisoners.
The following documents shall be presented accordingly by the partly
escorting the prisoner:
Commitment Order
A court order that says a person must be kept in custody, usually in
a jail or mental institution.
Mittimus
A court order directing a sheriff or other police officer to escort a
convict to a prison. It is a written document. It can command a
jailer to safely keep a felon until he or she can be transferred to a
prison.
Court Decision of the Case
It is also called judgement, is a decision of a court regarding the
rights and liabilities of parties in a legal action or proceeding.
Judgement also generally provide the courts explanation of why it
has chosen to make a particular court order.
Information
It is a formal accusation of a criminal offense made by a public
official; the sworn, written accusation of a crime. An information
is tantamount to an indictment in that it is a sworn written
statement which charges that a particular individual has done some
criminal act or is guilty of some criminal omission.
Certification of Detention
If you arrest was a detention, then the law enforcement agency that
detained and released you must issue a Certificate of Detention,
which deletes the record of the arrest.

Detainees Manifestation
A written declaration of a detained prisoner, with the assistance of
a counsel, to abide by the same disciplinary rules imposed upon a
convicted prisoner for the purpose of availing the full credit.
Certificate of Non-Appeal
Is simply a document issued by the clerk of the court and certified
by the county clerk which states that as of a particular date, there is
no pending action in the matter of the divorce and that the divorce
is considered final and closed.

Certificate of No pending case


It is issued to confirm that the establishment has pending/no
pending General Labor Standards, Occupational Safety and Health
Standards, Labor-Only Contracting and Security of Tenure
Violations.
Thereafter, through routine inspection of articles in his possession is
made.
Unauthorized articles such as bladed weapons are receipted and
reflected in their respective prison record.
Drugs and other forms of medicines are turned over to the Medical
officer for proper administration.
The receipted unauthorized articles are returned to the prisoner upon,
release, and transfer to other prison or upon request, to be given to his
visitor to be brought back to his home.

His identification as a prisoner is established by

1. His rolled fingerprint card


2. His photograph
3. His prison number
Thereupon, he is taken to the quarantine cell and physically prepared
for the following:

1. Staff interview on religious, education, sociological and


vocational matters
2. Medical Examination
3. Psychological testing

Issuance of uniforms and other equipment. Each prisoner is provided


with the following articles for which he is held responsible and
accountable:

1. Two (2) regulation uniform suits and two (2) T-shirts


2. One (1) blanket
3. One (1) mat and pillow
4. One (1) aluminum plate
5. One (1) mosquito net

The prescribed uniform color shall be based on the prisoner’s security


status as follows:

1. Maximum Security – Orange


2. Medium Security – Blue
3. Minimum-security – Brown
