I. EXECUTIVE SUMMARY
The Environmental and Social Management Plan (ESMP) of the ICB No:
NRA/Wks/2023/RT-001 LOTS 1-9 CONSTRUCTION OF ROADS NATIONWIDE. The
Ministry of Transport, Works, and Infrastructure through National Road Authority NRA is
implementing another important road network project in Sanyang Village, covering a
distance of 4.4km Lot 9, funded by government of The Gambia.
The Government of the Gambia (hereinafter called “financier”) has secured funding
towards the cost of the project named above. The Beneficiary intends to apply a portion
of the funds to eligible payments under the contract(s) resulting from the bidding for which
this tender is conducted. Payment will be made only at the request of the contractors and
upon approval by the Supervising Engineer.
The Government of the Gambia require the design & build contractor and all technical
and construction services to ensure successful completion of the works.
The requirements and recommendations of the International Standards relevant to the
works form an integral part of these Terms of Reference.

1.2 Project Description


The proposed Roads are located in all regions of the Gambia. The proposed road project
is: Lot 9 4.4 kilometers from the highway in Sanyang Village to the Beach side.

1.3 Environmental, Social, Health and Safety


Before preparing and adapting the requirements or specifications listed hereafter the
explanations to Section Volume II, - Specifications for Environmental, Social, Health and
Safety Management (ESHS) including Disabilities, Sexual Harassment, Gender base
violence (GBV) Sexual Exploitation and Abuse (SEA) HIV/AIDS Awareness of the Works
should be duly considered.] The Bidder shall provide an ESHS Methodology providing
information on how the Bidder shall meet those requirements and objectives, which are
specified in the ESIA, Works Requirements - ESHS Specifications.

To be in compliance with Gambian rules, especially the occupational health and
safety, but also requirements of the project, the contractor shall always take
necessary measures to ensure health and safety of his personnel, including all other
workers on the site.

The occupational health and safety is the major concern of the construction company
whose responsibilities are:

• Perform risk assessment prior to the beginning of all activities and put in place

adequate protection measures with the aim of ensuring the health and safety
of their personnel.
• Inform and sensitize the administrative personnel, as well as the work
performing personnel, on the implementation of preventive measures.
• Identify the risk and propose preventative measures related to the co-activity
of the different workers on the site.

The health and safety plan of the site is updated through the risk assessment
processes. This is completed by specific safety procedures or instructions, if required,
for a continual improvement of workers health and safety.

2.0 PROJECT INFORMATION


2.1 Aim & objectives of the Project
The roads are critical to promote and facilitate traffic movement within and
around the target areas. The roads are meant to increase mobility, improve
access to goods/passenger transport services and reduce transport costs along
the route, improve access to social and economic development opportunities
along the routes by providing high-capacity infrastructure and to ensure no
roadside communities become worse off as a result of the road up grading
works.

3.0 SCOPE OF WORK


3.1 General
The Contractor shall perform all work necessary as called for in these Terms of Reference
including all technical studies, field investigations and related services. In carrying their
work, the Contractor shall co-operate fully with the concerned agencies of the
Government of Gambia, in particular the Ministry of Transport Works and Infrastructure
and The National Roads Authority, amongst others. The Contractor shall provide the
necessary support services related to and necessary for the completion of the
assignment. The work shall cover but not be limited to the aspects outline in these terms
and references.

4.0 Environmental, Social, Health and Safety

5.0 Project Requirements Environmental and Social Impact Assessment


The Contractor shall conduct analyses which shall detail the positive and negative
effects of the development of the project on the environment, and prepare an ESIA
report recommending appropriate solutions to minimize any undesirable effects
resulting from improvements of the road. The analyses shall include, but not limited to
the following:

a) The role of the project in the development plans at national and regional level;
b) Description of project baseline environment
c) Preservation of areas and land use of particular value including agricultural and,
natural conservation areas, forests and other important natural resources, cultural
and historic sites, etc;

d) Assessment of direct impact on agriculture and forestry, particularly the utilization
of the fuel wood and water;
e) Disturbance of vegetation, and plans for re-vegetation;
f) The prevention of soil erosion and sedimentation;
g) The presentation of health hazards arising from ponding water and pollution of
water courses and/or sources;
h) Measures for the rehabilitation of construction materials, borrow pits and quarries;
i) Health and sanitation for the road construction labour units;
j) Assessment of the impact on demographic factors including the prevention of
undesirable roadside developments and recommend regulations and measures to
limit negative impact on adjacent communities and areas.

Environmental Impact Assessment (EIA) study will be in accordance with the local
regulations.

The contractor will assist the client in following up and obtaining the approval and the
NEA licence.

6.0 RATIONAL FOR THE STUDY


An Environmental and Social Impact Assessment (ESIA) is a tool that guides the
development and management of projects that have a significant impact on the
human and physical environment. It adopts a comprehensive approach to the
analysis and amelioration of current and/or potential effects of the development on
the environment, including the people, the animals, the air, water resources, the
landscape, and the plants. In this sense, the Construction Environment and Social
Management Plan (CESMP) may be seen as an extension of the Environmental and
Social Impact Assessment (ESIA), with the further provision of a detailed action plan
for mitigating the negative impacts of specific development initiatives.

There is a clear plan of action, stipulating what specific activities need to be taken to
ensure mitigation measures are duly taken to address the harmful consequences of
the development in a timely manner. In this way, it helps integrate environment and
social issues of the project with existing programs, activities, and other components
of the project to promote overall improvement.

The overarching goal of the CESMP is to help ensure environmentally and socially
acceptable project implementation by mitigating the negative impacts, while
enhancing the positive ones in line with the ESIA requirement and recommendations.
Consequently, the CESMP for this project will include the following considerations:

• Proposed activities and potential sources of impacts.


• Corresponding potential impacts of the activities.
• Institutional arrangements and responsibilities.
• Target and timeframe for accomplishing mitigation measures.
• Potential environmental and social impact to be encountered during
the construction phase of the project.
• Specific mitigation measures and controls that can be applied on-site
during the construction phase to avoid or minimize negative
environmental impacts.
• Specific mechanisms for compliance with applicable policies,
approvals, licenses, permits, consultation agreements and legislation.
• The construction phase environmental management related roles and
responsibilities of personnel.
• Sets objectives and targets for issues that are important to the
environmental performance of the Project.
• Outlines a monitoring regime to check the adequacy of controls as they
are implemented during construction and identifies relevant support
institutions.

In general, mitigation measures are introduced to control or minimize negative


environmental impacts in the following forms:

• Prevention
• Reduction
• Remediation and Reclamation
• Resettlement and Compensation

7.0 OBJECTIVES
The main objective is to conduct the Environmental and Social Management Plan. The
contractor will be deemed to identify projected Impacts and establish appropriate mitigation
measures. Additionally, the Contractor will develop a monitoring program that will be
followed during the project implementation.

7.1 Specific Objectives


• To collect required information and data regarding upstream plans, natural
environment, socio-economic environment, and relevant data.
• Description of current environmental and social situation and the expected
trends in the presence of the project.
• Examination of the legal and administrative framework regarding
environmental and social management, health and safety policies.
• Analyze the environmental and social impacts utilizing the detailed
information and data gathered in both the environmental and social

screening stage, initial environmental, and social examination stage on
specific substantive parameters covering the natural, human, social
environments, and the activities involved in construction, operation, and
maintenance.
• Preparation of an Environmental and Social Management Plan.
• Preparation of a Resettlement Plan.
• Development of a Monitoring Program to be followed during the project
implementation.

8.0 SCOPE OF WORKS


The Contractor will conduct a combination of desktop and field studies to fully describe the
environmental and social baseline of the affected area. Based on the knowledge of the affected
environment, the contractor will identify and describe impacts and associated mitigation
measures for the design, construction, and operation phases.

During the study, the Contractor will consider issues and concerns raised through the Public
Consultation Process (PCP). These issues and concerns will be incorporated into the
environmental and social analysis.

9.0 METHODOLOGY

The methodology describes the proposed work plan for execution of the assignment

Exploitation and Abuse (SEA), and HIV/AIDS Awareness should be duly considered. The Bidder
shall provide an ESHS Methodology providing information on how the Bidder shall meet those
requirements and objectives, which are specified in the ESIA, Works Requirements - ESHS
Specifications.
The ESHS Methodology submitted shall be in the form of a preliminary draft of the Project Area
Environmental and Social Management Plan (PA-ESMP), the content of which is detailed in the
ESHS Specifications. Information should be provided on all items within the report.
To address the extremely sensitive ESHS issues highlighted during the project’s environmental
and social impact assessment, the ESHS Methodology shall provide detailed information on the
management of the following items:
(a) ESHS resources and facilities and ESHS monitoring organization,
(b) Project Areas description (base camps, quarries, borrow pits, storage areas),
(c) Relations with stakeholders, information and consultation of local communities and
authorities,
(d) Traffic management,

(e) Protection of water resources,
(f) Atmospheric emissions, noise, and vibrations,
(g) Biodiversity: protection of fauna and flora,
(h) Site rehabilitation and restoration,
(i) Erosion and sedimentation, and
(j) Control of infectious and communicable diseases (HIV/AIDS, malaria).

9.2 Desktop Studies

The study will review the national environmental policy, legislation, and directives relevant to
the project and other relevant Safeguards Policies and procedures, in the aim of developing the
contractor’s CESMP that focuses on the requirements during work. These requirements include
how to manage the negative impact(s) and develop the positive impact(s).

The study will make an analyzes of the physical environment including the topographical,
geological, ecology, and soil maps of appropriate scale relevant to the alignment. Where possible
aerial photographs should be analyzed. This analysis will serve the following purposes:

1. Topography and landforms (with emphasis on slope gradients concerning erosion and
sedimentation risk).
2. Soils (with emphasis on the distribution of soil types, their aptitude, and erosion
sensitivity).
3. Land cover and wetland vegetation (with emphasis on the floodplain in wetland
vegetation and community settlement).
4. Evaluate existing reports and documents to determine the possible occurrence of
conservation concerns and wildlife.
5. Describe the salient hydrological features to determine the impact on the hydrology.
6. Make a step by step-level analysis of the socio-economic environment (demography, land
use, commercial, and social development).
7. Overview of biophysical and socio-economic aspect, including areas of high priority for
conservation of natural habitats, formally protected areas, such as national parks, fragile
ecosystems, demographics, ethnicity, gender aspects, HIV/AIDS and COVID.
8. Assess project capacity and responsibility to implement the ESMP, the Resettlement
Plan, and its relationship with other government institutions, the private sector to
implement, monitor, and enforce the relevant guidelines and policies to undertake
Environmental and Social studies.
9. Construction waste management including wastewater, oil, and the management of
hazardous materials.
10. Off-site specific issues such as management of base camps, stores, source of
sand/gravel/basalt (quarries).
11. Public involvement and participation. Describe community engagement and how to
manage complaints and conflicts.
12. Health and safety plans to describe protection measures of the public and project workers
against hazards associated with the project activities, this includes risk identification, risk
reduction, use of PPE, emergency preparedness and response.

13. Ecological hazard risk assessment on sensitive environmental areas e.g., wetlands,
rangeland, farmlands, and cattle tracks.

9.3 Field Work

The study would be able to define with a high degree of certainty the area of
influence of the project. The second stage will involve fieldwork of the project
where a visual scoping exercise will be conducted. The approach adopted will
be to first identify the types of environmental and social impacts that can occur
with the project implementation.

The field visits will afford the Contractor with the opportunity for direct
observations, data collection, and interviews that provides:

• Detailed description of the project scope and its environs.

• Baseline data and information on the current environment and social


conditions to help analyze how the ESMP report must be implemented,
using guidelines and recommendations.

• Exchange of views and consensus building about the way forward,


including the potential roles and responsibilities of the different
stakeholders in the development of the Report, as well as its
implementation.

10.0.Implementation and Monitoring requirements for Health-Safety Environment


and Social mitigation.

10.1 STAFFING REQUIREMENTS

Given that the assignment is multi-faceted and requires diverse types of expertise, the
Contractor has built a team to manage the assignment. The team will comprise
environmental experts, land use planning specialist, health, and safety specialist. The
team of specialists, is indicated below in Table 1:

10.2 Human Environment and Social Environment

The following environmental and social issues will need to be investigated:

10.3 Analysis of Impacts

The impacts during design, construction, and operational phases must be identified
and evaluated. The predicted environmental and social impacts will be categorized
into primary and secondary effects. The description and quantification of the
environmental and social impact will be based on scientific methods as follow:

• An indication of the magnitude of the impacts.


• Extent, nature, and duration.
• The provision of criteria by which impacts have been assessed.
• The consideration of cumulative impacts within the area.
• Significance in terms of national and local impacts.
• Presentation and justification of the criteria used.

10.4 Public Consultation

Public consultation is an integral part of the ESIA process. Initial public consultation
will be undertaken with local communities, scientific experts, relevant government
agencies and the private sector. The draft recommendations of the study will be
discussed with key stakeholders at workshops to be held. Feedback from the
workshops will be incorporated into the Final Report.

11.0 Environmental and Social Management Plan

The overall mitigation plan will recommend feasible and cost-effective measures to
prevent or reduce significant negative impacts to acceptable levels. The study will
estimate the impacts and costs of these measures. It will prepare a short and concise
management plan including proposed work programs, budget estimates, schedules,
staffing and training requirements, and other necessary support services to
implement the mitigating measures.

11.1 The Resettlement Plan

The Study will analyze issues regarding resettlement. A Census survey of the
expected size of the displaced/affected properties, their socio-economic status
including the value of their assets and other sources of livelihood will be conducted.
The displaced people and the host population will be consulted about acceptable
project alternatives and will be informed about potential impacts on them. Description
of compensation options to be offered and other resettlement assistance to be
provided will be documented and discussed with resettles including their preferred
choice.

11.2 Environmental Monitoring Plan

The Contractor is required to prepare an Environmental Monitoring Plan. The


Monitoring Plan will be an appropriate tool followed by client staff and its
representative to confirm the implementation of mitigation measures recommended in
the study.

The Environmental Monitoring Plan will include guidelines for monitoring


environmental and social aspects of the project, rehabilitation, and maintenance, this
should be from the pre-construction to post-construction phase. Also, the guidelines
will include the main tasks such as the items and parameters to be monitored, the
checklist for mitigating potential environmental impacts, the method to present the
report, and the results of monitoring.

11.3 Reporting

The Contractor will be required to provide the following outputs:

11.3.1 Documents regarding Gambia’s EIA Procedures:


(Scoping report), TOR (ESM plan report) and relevant required documents (to be
submitted to Consultant) - (2 weeks after commencement)

11.3.2 Baseline survey report:


This report shall include General information, Present Condition (2 months after
commencement)

12.0 Coordination and Preparation of Documents for Required Meetings

12.1 Public Consultation regarding ESMP


A prescript public consultation shall be held based on the guidelines.
Frequency and timing: The contractor shall get in trim for effective meetings with
client in cooperation with project Study Team (Maximum twice in the affected
area).

12.2 Stakeholder Meeting regarding RAP

The contractor shall hold meetings with the project-affected population,


especially with the owners of the displaced structures. The Contractor will
coordinate with the Client regarding the compensation of such affected persons.

12.3 ESIA Presentation

A program of formal presentation of the ESIA procedures and findings must be made
to Client. This must be presented at Client´s office; it must be programmed and
planned in conjunction with the Project Engineer. This forms part of the Studies
approval procedures.

The report must be presented to all the key stakeholders. Presentations must be
made to coincide with the Draft Final Report.

All study investigations and findings will be documented and made available to
interested individuals and organizations. The contractor should display the study for
the public at various stages including the ESIA Final Report.

The Final Report shall be produced in English and copies provided.

All reports will be submitted on hardcopy and electronically in PDF format (the entire

report, including tables, graphics, and text), with tables provided in Microsoft Excel.

All documents and reports developed by the contractor and paid for under these
services will become the property of project upon completion of the services.

The draft ESMP report will focus on findings of the environmental and social scoping
exercise, the preliminary conclusions, and the recommendations.

The final reporting should also include alternative recommendations for the environmental
management system for presentation to the stakeholders.

12.4 Level of Effort and Duration

The required consultancy service duration is projected for two months. A detailed
study will be required to collect a baseline for the social and environmental data in
the environmental zones within the area of influence.

16.0 General Scope of Work

The services shall be conducted in accordance with accepted principles and


standards of professional practices. The Contractor’s Scope of Work will cover all
activities necessary to accomplish the stated objectives of these services while
adhering to the principles and practices, whether a specific activity is cited in this
Term of Reference.

The Contractor shall work under the direction of the Client and shall work in close
collaboration with the project appointed Coordinator.

16.1 Logistical Support:


Client will appoint a liaison officer through whom all requests for information,
guidance, and assistance should be addressed. All reasonable assistance will be
provided, including liaison with other Government agencies and access to any
relevant data that is not classified as restricted.

Client shall provide the Contractor, without charge, such support facilities as may be
needed for the expeditious performance of the required services, including
reasonable access to pertinent files, documents, and working papers.

16.2 Contractor’s Obligations:


Transport Requirements: The Contractor will be responsible for providing national and
international transportation and local land transport for its supplied personnel for the
duration of the contract period.
16.3 Staff Housing and Accommodation:
The Contractor shall be responsible for providing suitable accommodation for personnel
assigned to the services to be provided under the contract.

17.0 Communications, Office, and Documentation Costs:

The Contractor shall be responsible for meeting all costs of office operation, supplies,
communications, secretarial services, document translation, and logistical services.

18.0 IMPLEMENTATION OF ESMP


18.1 COMPETENCE, TRAINING AND AWARENESS

To ensure that this ESMP is effectively implemented, each level of


management is responsible for ensuring that all personnel reporting to them
are aware of the requirements of this ESMP. The Environmental
Manager/consultant will coordinate environmental training in conjunction
with other training and development activities.
18.2 INDUCTION

All personnel, including sub-contractors, are required to attend compulsory


site induction that includes an environmental, health and safety component
prior to commencement on-site. The Environmental Manager (or delegate)
will conduct the environmental component of the site induction. The
environmental component will include an overview of:
• relevant details of the EMP including purpose and objectives

• key environmental issues, i.e. protection of the sensitive areas, dust
and noise management
• conditions of environmental licences, permits and approvals
• specific environmental management requirements and responsibilities
• mitigation measures for the control of environmental issues
• incident response and reporting requirements, and
• Information relating to the location of environmental constraints.
A record of all environment inductions will be maintained and kept on-site.
The Environmental Manager may authorise amendments to the induction
where required to address Project modifications, legislative changes or
amendments to this ESMP or related documentation. The Environmental
Representative will review and endorse the induction program and monitor
its implementation.

18.3 TOOLBOX TALKS, TRAINING AND AWARENESS

Toolbox talks will be used to raise awareness and educate personnel on


construction related environmental issues. The toolbox talks will be used to
ensure environmental awareness continues during construction and
operation. Toolbox talks will include details of Environment Waste
Management System (EWMS) for relevant personnel.

Toolbox talks will be tailored to specific environmental issues including:


• Erosion and sedimentation control
• Hours of work
• Emergency and spill response
• Aboriginal and non-Aboriginal heritage
• Threatened species, endangered ecological communities, clearing
controls and vegetation protection
• Weed management
• Noise
• Housekeeping and waste
• Concrete washout
• Dewatering
• Project and clearing limits
• Works in waterways, and
• Dust control.
Targeted environmental awareness training will be provided to individuals
or groups of workers with a specific authority or responsibility for
environmental management or those undertaking an activity with a high risk
of environmental impact.

The Environmental officer/Manager will review and endorse the training
program and monitor its implementation.
18.4 COMMUNICATION

Clear lines of communication throughout all levels and functions (e.g.


management, staff and sub-contracted service providers), is key to
minimize environmental impacts and achieving continual improvements in
environmental performance.

The Management team will meet regularly to discuss on-site environmental


management, amendments to plans, changes to construction activities etc.

Regular meetings may also be scheduled with the Environmental


Representative and Project management to communicate ongoing
environmental performance and to discuss issues to be addressed.

The Management team members will participate regularly in toolbox talks


to communicate to the wider project personnel on environmental
performance, to advice on sensitive environmental matters for future work
areas and to receive feedback from on-site personnel.

The Environmental Manager will be the main point of contact regarding


specific environmental issues. The Environmental Manager/consultant has
the responsibility to report on the ongoing environmental performance to
NEA and the Stakeholder. The Environmental Manager will report regularly
to contractor on progress and any key environmental matters.

The following two project team members are nominated as 24-hour contacts
for environmental regulatory authorities, with the authority to take
immediate action to shut down any activity, or to affect any pollution control
measure:

Should the NEA be notified of any pollution incident, Contractor will be


notified verbally within two hours and in writing as soon as the cause, extent
and details are known.
A report will be submitted to contactor on each occasion when the site is
visited by the NEA or any other Authority, other than for arranged
inspections. The report will detail the purpose, outcome and actions
pertaining to the visit and is submitted to contractor within one working day.

19.0 COMMUNITY/PUBLIC CONSULTATION

The involvement of the local population is essential to the success of the project
to ensure smooth collaboration between project staff and local communities and
to minimize and mitigate environmental and social risks related to the proposed
project activities.
19.1 Summary of stakeholder consultative meetings

To adequately represent the views and concerns of stakeholders and partners of the
project. Consultative meetings will be conducted with the affected communities.

The meeting arrangements are made through the Village Head (Alkalo) as the official
entry point in all Villages. The participants must be composed of the community leaders,
men, women, youths, and community members.

19.2 Conclusion
The CESMP will be prepared based on environmental and social assessments conducted
to guide the contractor on management of potential environmental and social impacts
encounter during the construction phase of the project and to ensure there is compliance
with the Environmental Laws and Regulations of The Gambia.

The project has environmental and social impacts but do not have long term and
cumulative nor significant impacts. The proposed development project addresses various
economic and social challenges most significantly transport challenges face by not only
the host communities within the project areas, but to the entire country.

The negative environmental impacts that have been identified and are associated with
the implementation of this project are minimal and could be addressed by implementing
the proposed mitigation measures to ensure that they pose no significant threat to the
environment, workers and to the host communities.

The contractors and the project proponents should take into consideration all the
legislative measures addressed in the ESIA report so as to ensure due process is
followed.

The project proponent shall strictly follow and implement recommended mitigation
measures of this report so as to address the environmental issues that may arise in the
course of the implementation of this project.
