1. Why do you think is Facebook protected from liability for content posted by third parties?
➢ Facebook is protected from liability for content posted by third parties due to Section 230 of the
Communications Decency Act (CDA), which protects website owners from liability for content
posted by users. This law was enacted to encourage the growth of the internet and to protect free
speech online. The idea is that website owners should not be held responsible for the actions of
their users, as this would create a chilling effect on free expression and innovation. Instead, the
responsibility for illegal or harmful content lies with the individual who posted it.
2. Do you think that Facebook and other social network providers should be protected from liability for
what their members post? Why or why not?
➢ Whether or not Facebook and other social network providers should be protected from liability for
what their members post is a matter of debate. Some argue that social media companies should be
held responsible for the content on their platforms, while others believe that this would stifle free
speech and innovation.
3. How is a student’s freedom of speech restricted on social media sites such as Facebook?
➢ A student's freedom of speech on social media sites such as Facebook is restricted by state and
federal laws that prohibit cyberbullying and other forms of online harassment. Additionally, social
media companies may have their own policies and guidelines that restrict certain types of speech
on their platforms.
4. Should Taylor Wynn and McKenzie Barker have been prosecuted despite the victim’s attitude that the
teasing would pass?
➢ Whether or not Taylor Wynn and McKenzie Barker should have been prosecuted for teasing a
classmate is a matter of opinion. However, it is important to note that cyberbullying can have
serious consequences, and that laws exist to protect victims from harassment and abuse.
5. How should cyberbullying laws be implemented?
➢ Cyberbullying laws should be implemented in a way that balances the right to free speech with the
need to protect individuals from harm. This may involve educating students, parents, and teachers
about the dangers of cyberbullying, as well as providing resources and support for victims.
Additionally, law enforcement agencies may need to be trained to identify and respond to cases of
cyberbullying.
