‫• ﻻ ﻳﺴﻤﺢ اﻟﺒﻨﻚ ﺑﺄي ﻣﻌﺎﻣﻠﺔ ﻣﻊ ا•ﺷﺨﺎص أو اﻟﻜﻴﺎﻧﺎت أو اﻟﻔﺮوع اﻟﻤﺤﺪدة ﻛﺄﻫﺪاف ﻟﻠﻌﻘﻮﺑﺎت‬ ‫ا•ﻣﻮال ﺑﻌﺪ ﻓﺘﺢ اﻟﺤﺴﺎب‪.‬‬
‫ﻣﻦ ﻗﺒﻞ اﻟﻤﻨﻈﻤﻴﻦ اﻟﻤﺤﻠﻴﻴﻦ واﻟﺪوﻟﻴﻴﻦ‪.‬‬
‫• ﻻ ﻳﺸﺎرك اﻟﺒﻨﻚ ﻓﻲ ﻣﻌﺎﻣﻼت )ﺑﻤﺎ ﻓﻲ ذﻟﻚ اﻟﻮاردات أو اﻟﺼﺎدرات( ﺗﺘﻀﻤﻦ ﻣﻨﺘﺠﺎت ذات‬
‫اﺳﺘﺨﺪام ﻣﺰدوج ﻳﻤﻜﻦ اﺳﺘﺨﺪاﻣﻬﺎ •ﻏﺮاض ﻫﺠﻮﻣﻴﺔ ﻋﻠﻰ ﺳﺒﻴﻞ اﻟﻤﺜﺎل اﻟﻤﻮاد اﻟﺘﻲ‬

‫اﻟﺒﻨﻚ‪ .‬ﻟﺬﻟﻚ ُﻳﻨﺼﺢ اﻟﻌﻤﻼء ﺑﻌﺪم إﺟﺮاء ﻣﻌﺎﻣﻼت ﻓﻲ ﺣﺴﺎﺑﻬﻢ )ﺣﺴﺎﺑﺎﺗﻬﻢ( ﻧﻴﺎﺑﺔ ﻋﻦ‬ ‫ﻳﺠﺐ ﻋﻠﻰ اﻟﻌﻤﻴﻞ إﺑﻼغ اﻟﺒﻨﻚ ﻓﻲ ﺟﻤﻴﻊ ا•وﻗﺎت ﺑﺄي ﺗﻐﻴﻴﺮ ‪ /‬ﺗﻌﺪﻳﻞ ﻓﻲ ﺑﻴﺎﻧﺎت اﻟﺘﻮاﺻﻞ‬
‫ﻃﺮف )أﻃﺮاف( أﺧﺮى‪.‬‬ ‫وﺣﺎﻟﺔ ا‪³‬ﻗﺎﻣﺔ واﻟﺘﺄﺷﻴﺮة وﺑﻴﺎﻧﺎت اﻟﻬﻮﻳﺔ ا‪³‬ﻣﺎراﺗﻴﺔ وﺑﻴﺎﻧﺎت ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﻋﻦ ﻃﺮﻳﻖ )‪ (1‬زﻳﺎرة‬

‫اﻟﺒﻨﻚ ﻗﺎدر‪ Æ‬ﻋﻠﻰ ﺧﺪﻣﺔ اﻟﻌﻤﻼء اﻟﺬﻳﻦ ﻻ ﻳﻠﺘﺰﻣﻮن ﺑﺎﻟﻤﺘﻄﻠﺒﺎت اﻟﺴﺎﺑﻘﺔ‪.‬‬ ‫ﻋﺪم ﺗﻘﺪﻳﻢ اﻟﻤﻌﻠﻮﻣﺎت اﻟﻤﺤﺪﺛﺔ أو اﻟﻤﺴﺘﻨﺪات ذات اﻟﺼﻠﺔ‪ ،‬ﻳﺤﺘﻔﻆ اﻟﺒﻨﻚ ﺑﺎﻟﺤﻖ ﻓﻲ‬
‫ﺣﻈﺮ ﺣﺴﺎب )ﺣﺴﺎﺑﺎت( اﻟﻌﻤﻴﻞ ﺣﺘﻰ ﻳﺘﻢ ﺗﻮﻓﻴﺮ اﻟﻤﻌﻠﻮﻣﺎت أو اﻟﻤﺴﺘﻨﺪات اﻟﻤﺤﺪﺛﺔ‪.‬‬

‫اﻟﺴﺮﻳﺔ وا•ﻣﺎن‬
‫ﺳﻴﺎﺳﺔ اﻟﺸﻴﻜﺎت اﻟﻤﺮﺗﺠﻌﺔ وﺗﻘﺎرﻳﺮ اﻟﺒﻨﻚ اﻟﻤﺮﻛﺰي‬
‫ﻳﺤﺘﻔﻆ اﻟﺒﻨﻚ ﺑﺴﻴﺎﺳﺎت ﺻﺎرﻣﺔ وﺿﻮاﺑﻂ أﻣﻨﻴﺔ ﻟﻀﻤﺎن ﺣﻤﺎﻳﺔ ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ ﻓﻲ‬
‫أﻧﻈﻤﺔ وﺿﻮاﺑﻂ اﻟﺒﻨﻚ‪ُ .‬ﻳﺴﻤﺢ ﻟﻤﻮﻇﻔﻲ اﻟﺒﻨﻚ واﻟﻤﺘﻌﺎﻗﺪﻳﻦ ﻣﻌﻪ ﻓﻘﻂ ﺑﺎﻟﻮﺻﻮل إﻟﻰ‬ ‫إذا ﻛﺎن ﻳﺠﺐ إﻋﺎدة اﻟﺸﻴﻚ )اﻟﺸﻴﻜﺎت( اﻟﺼﺎدرة ﻋﻦ اﻟﻌﻤﻴﻞ ﻏﻴﺮ ﻣﺪﻓﻮﻋﺔ ﺑﺴﺒﺐ ﻋﺪم‬
‫ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ اﻟﺘﻲ ﻗﺪ ﻳﺤﺘﺎﺟﻮﻧﻬﺎ •داء وﻇﺎﺋﻔﻬﻢ وﻟﺘﻘﺪﻳﻢ اﻟﺨﺪﻣﺎت ﻟﻠﻌﻤﻴﻞ‪.‬‬ ‫ﻛﻔﺎﻳﺔ ا•ﻣﻮال‪ ،‬ﻳﺠﻮز ﻟﻠﺒﻨﻚ إﻏﻼق اﻟﺤﺴﺎب وﻓﻘŽ ﻟﻠﻘﻮاﻧﻴﻦ واﻟﻠﻮاﺋﺢ اﻟﻤﻌﻤﻮل ﺑﻬﺎ ﻓﻲ دوﻟﺔ‬
‫ﻳﻤﻜﻦ ﻟﻤﻮﻇﻔﻴﻨﺎ وﻣﻘﺎوﻟﻴﻨﺎ اﻟﻮﺻﻮل إﻟﻰ ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ ﻋﻨﺪ اﻟﻀﺮورة ‪³‬ﺟﺮاء ﻣﻌﺎﻣﻠﺔ أو‬ ‫ا‪³‬ﻣﺎرات اﻟﻌﺮﺑﻴﺔ اﻟﻤﺘﺤﺪة‪ .‬ﻓﻲ ﻣﺜﻞ ﻫﺬه اﻟﺤﺎﻟﺔ ﻳﺠﺐ ﻋﻠﻰ اﻟﻌﻤﻴﻞ إﻋﺎدة دﻓﺎﺗﺮ اﻟﺸﻴﻜﺎت‬
‫اﻟﺮد ﻋﻠﻰ اﺳﺘﻔﺴﺎراﺗﻪ‪ .‬ﻳﺘﻌﻴﻦ ﻋﻠﻰ ﺟﻤﻴﻊ ﻣﻮﻇﻔﻲ وﻣﺘﻌﺎﻗﺪي اﻟﺒﻨﻚ اﺣﺘﺮام ﺧﺼﻮﺻﻴﺔ‬ ‫اﻟﻤﺘﻌﻠﻘﺔ ﺑﺎﻟﺤﺴﺎب إﻟﻰ اﻟﺒﻨﻚ‪ .‬ﻗﺪ ﻳﻜﻮن اﻟﺒﻨﻚ ﻣﻠﺰﻣŽ ﺑﺎ‪³‬ﺑﻼغ ﻋﻦ اﻟﺘﻔﺎﺻﻴﻞ اﻟﺨﺎﺻﺔ ﺑﻪ ‪/‬‬

‫إﺧﻄﺎر اﻟﻌﻤﻴﻞ ﺑﻪ ﻣﻦ وﻗﺖ ‪È‬ﺧﺮ‪ .‬ﻳﺠﻮز ﻟﻠﺒﻨﻚ ﺗﻌﺪﻳﻞ أﺳﻌﺎر اﻟﻔﺎﺋﺪة واﻟﺮﺳﻮم ﻣﻦ وﻗﺖ ‪È‬ﺧﺮ‬
‫ﺗﻤﺎﺷﻴŽ ﻣﻊ ﻣﻌﺎﻳﻴﺮ ﺣﻤﺎﻳﺔ اﻟﻤﺴﺘﻬﻠﻚ اﻟﺼﺎدرة ﻋﻦ اﻟﻤﺼﺮف اﻟﻤﺮﻛﺰي ﻓﻲ ا‪³‬ﻣﺎرات اﻟﻌﺮﺑﻴﺔ‬ ‫ﻋﻨﺪ ﺗﻘﺪﻳﻢ إﺷﻌﺎر ﺧﻄﻲ ﻣﺴﺒﻖ ﺑﻬﺬا اﻟﺘﻐﻴﻴﺮ أو اﻟﺘﻐﻴﻴﺮات‪.‬‬
‫اﻟﻤﺘﺤﺪة وﻓﻘŽ ﻟﻼﺋﺤﺔ ﺣﻤﺎﻳﺔ اﻟﻤﺴﺘﻬﻠﻚ )ﺗﻌﻤﻴﻢ رﻗﻢ ‪ ،(8- 2020‬ﺳﻴﺘﻢ إﺑﻼﻏﻚ ﺑﻤﻮﺟﺐ‬
‫ﻫﺬا ﺑﺄﻧﻪ ﻳﺤﻖ ﻟﻚ ﺳﺤﺐ أو إﻟﻐﺎء ﻃﻠﺐ ﻓﺘﺢ ﺣﺴﺎب ا•ﻋﻤﺎل اﻟﺨﺎص ﺑﻚ ﻓﻲ ﻏﻀﻮن ‪ 5‬أﻳﺎم‬
‫ﻋﻤﻞ ﻣﻦ ﺗﺎرﻳﺦ اﻟﺘﻮﻗﻴﻊ )"ﻓﺘﺮة اﻟﺴﻤﺎح"(‪ .‬ﻓﻲ ﻳﻮم اﻟﻌﻤﻞ اﻟﺴﺎدس )أو ﺑﻌﺪ ﻳﻮم واﺣﺪ ﻣﻦ‬
‫اﻧﺘﻬﺎء ﻓﺘﺮة اﻟﺴﻤﺎح(‪ ،‬ﻳﺠﺐ ﻋﻠﻴﻚ إﺑﻼغ اﻟﺒﻨﻚ ﺑﻘﺮارك ﺑﺈﻟﻐﺎء أو ﺳﺤﺐ ﻃﻠﺐ ﻓﺘﺢ ﺣﺴﺎب‬
‫ا•ﻋﻤﺎل وإﻻ ﺳﻨﺴﺘﻤﺮ ﻓﻲ ﺗﻨﻔﻴﺬ ا‪³‬ﺟﺮاءات واﻟﺘﻲ ﺗُﻌﺘﺒﺮ ﻣﺆﻛﺪة ﻣﻦ ﻃﺮﻓﻚ‪.‬‬
‫ﺳﻴﻘﻮم اﻟﺒﻨﻚ‪ ،‬ﺧﻼل ﻓﺘﺮة اﻟﺴﻤﺎح‪ ،‬ﺑﺘﺰوﻳﺪك ﺑﺈﻣﻜﺎﻧﻴﺔ اﻟﻮﺻﻮل إﻟﻰ ﺣﺴﺎب ا•ﻋﻤﺎل اﻟﺨﺎص‬ ‫ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ‪:‬‬
‫ﺑﻚ واﻟﺨﺪﻣﺎت ا•ﺧﺮى ذات اﻟﺼﻠﺔ ﺑﺎﻟﺤﺴﺎب‪ ،‬وذﻟﻚ وﻓﻘŽ ‪³‬ﺟﺮاءات ﺳﻴﺎﺳﺔ "اﻋﺮف ﻋﻤﻴﻠﻚ"‬
‫وإﺟﺮاءات اﻻﻣﺘﺜﺎل اﻟﺨﺎﺻﺔ ﺑﺎﻟﺒﻨﻚ‪.‬‬ ‫ﺑﻴﻨﻤﺎ ﻳﺒﺬل اﻟﺒﻨﻚ ﻗﺼﺎرى ﺟﻬﺪه ﻟﻠﺘﻌﺎﻣﻞ ﻣﻊ ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ ﻋﻠﻰ أﻧﻬﺎ ﺳﺮﻳﺔ ﻟﻠﻐﺎﻳﺔ‪،‬‬
‫إذا اﺧﺘﺮت اﻟﺘﻨﺎزل ﻋﻦ ﺣﻘﻚ ﻓﻲ ﻓﺘﺮة اﻟﺴﻤﺎح‪ ،‬ﻓﻴﺠﺐ ﻋﻠﻴﻚ ﺗﺄﻛﻴﺪ أو إﺧﻄﺎر ﻫﺬه اﻟﻨﻴﺔ‬ ‫ﻳﻘﺮ اﻟﻌﻤﻴﻞ وﻳﻮاﻓﻖ ﻋﻠﻰ ﻗﻴﺎم اﻟﺒﻨﻚ ﺑﺎ‪³‬ﻓﺼﺎح ﻋﻦ ﻣﻌﻠﻮﻣﺎت اﻟﻌﻤﻴﻞ أو ﻣﺸﺎرﻛﺘﻬﺎ ﻓﻴﻤﺎ‬
‫ﻟﻠﺒﻨﻚ ﻛﺘﺎﺑﺔ‪ .‬وﺗﺠﺪر ا‪³‬ﺷﺎرة إﻟﻰ أﻧﻪ إذا اﺧﺘﺮت إﻟﻐﺎء أو ﺳﺤﺐ ﻃﻠﺐ ﻓﺘﺢ ﺣﺴﺎب ا•ﻋﻤﺎل‬ ‫ﺑﻴﻦ‪:‬‬
‫ﺧﻼل ﻓﺘﺮة اﻟﺴﻤﺎح‪ ،‬ﻓﺴﺘﻜﻮن ﻣﺴﺆوﻻً ﻋﻦ دﻓﻊ ﺟﻤﻴﻊ اﻟﺘﻜﺎﻟﻴﻒ واﻟﺮﺳﻮم اﻟﺘﻲ ﻗﺪ ﺗﻜﻮن‬ ‫)أ( ﻓﺮوع اﻟﺒﻨﻚ وﺷﺮﻛﺎﺗﻪ اﻟﻔﺮﻋﻴﺔ وﻣﻜﺎﺗﺒﻪ اﻟﺘﻤﺜﻴﻠﻴﺔ واﻟﺸﺮﻛﺎت اﻟﺘﺎﺑﻌﺔ و ‪ /‬أو وﻛﻼء‬
‫ﺗﻜﺒﺪﺗﻬﺎ ﻓﻴﻤﺎ ﻳﺘﻌﻠﻖ ﺑﺄي أو ﺟﻤﻴﻊ اﻟﻤﻌﺎﻣﻼت اﻟﺘﻲ أﺟﺮﻳﺖ ﻓﻲ ﺣﺴﺎب ا•ﻋﻤﺎل اﻟﺨﺎص ﺑﻚ‬ ‫اﻟﺒﻨﻚ؛‬
‫ﺧﻼل ﻓﺘﺮة اﻟﺴﻤﺎح وﻗﺒﻞ إﻟﻐﺎء ﺣﺴﺎﺑﻚ‪.‬‬ ‫)ب( ا•ﻃﺮاف اﻟﺜﺎﻟﺜﺔ اﻟﺘﻲ ﻳﺨﺘﺎرﻫﺎ اﻟﺒﻨﻚ و ‪ /‬أو أي ﺷﺨﺺ ﻣﺬﻛﻮر ﻓﻲ )أ( أﻋﻼه‪ ،‬أﻳﻨﻤﺎ ﻛﺎن‬
‫ﻣﻮﻗﻌﻬﺎ‪ ،‬ﻟﻼﺳﺘﺨﺪام اﻟﺴﺮي ﺑﻤﺎ ﻓﻲ ذﻟﻚ ﻋﻠﻰ ﺳﺒﻴﻞ اﻟﻤﺜﺎل ﻻ اﻟﺤﺼﺮ‪ ،‬أي ﻣﻌﺎﻟﺠﺔ ﺑﻴﺎﻧﺎت‪،‬‬
‫وأﻏﺮاض إﺣﺼﺎﺋﻴﺔ وﺗﺤﻠﻴﻞ ﻣﺨﺎﻃﺮ؛ أو‬
‫)ت( أي ﻣﺤﻜﻤﺔ ﻣﺨﺘﺼﺔ أو ﺟﻬﺔ ﺗﻨﻈﻴﻤﻴﺔ أو ﺳﻠﻄﺔ وﻓﻘŽ •ي ﻗﺎﻧﻮن أو ﻻﺋﺤﺔ أو إﺟﺮاء‬
‫ﻗﺎﻧﻮﻧﻲ ذي ﺻﻠﺔ ﻳﺨﻀﻊ ﻟﻪ اﻟﺒﻨﻚ )ﺑﻤﺎ ﻓﻲ ذﻟﻚ أي ﻣﻦ ﻓﺮوﻋﻪ أو ﻣﻜﺎﺗﺐ ﺗﻤﺜﻴﻠﻪ أو‬
‫اﻟﺸﺮﻛﺎت اﻟﺘﺎﺑﻌﺔ ﻟﻪ و ‪ /‬أو وﻛﻼﺋﻪ(‪.‬‬

‫ﻣﺮاﺟﻌﺔ اﻟﺸﺮوط وا•ﺣﻜﺎم‬


‫إﻟﻰ اﻟﺤﺪ اﻟﺬي ﺗﺴﻤﺢ ﺑﻪ اﻟﻘﻮاﻧﻴﻦ اﻟﻤﻌﻤﻮل ﺑﻬﺎ‪ ،‬ﻳﺠﻮز ﻟﻠﻤﺸﺮق ﺗﻌﺪﻳﻞ أو اﺳﺘﺒﺪال أو‬ ‫إﻏﻼق اﻟﺤﺴﺎب‬
‫اﺳﺘﻜﻤﺎل أو ﺣﺬف أي ﺷﺮوط وأﺣﻜﺎم ﻓﻲ أي وﻗﺖ وﻓﻘŽ ﻟﺘﻘﺪﻳﺮه اﻟﺨﺎص‪ .‬إذا ﻛﺎﻧﺖ ﻫﻨﺎك أي‬
‫ﺗﻐﻴﻴﺮات ﻣﻘﺼﻮدة ﻋﻠﻰ اﻟﺸﺮوط وا•ﺣﻜﺎم أو ﻋﻠﻰ أي ﻣﻦ اﻟﻤﺰاﻳﺎ اﻟﻤﺤﺪدة‪ ،‬ﻓﺴﻴﻘﻮم‬ ‫أ( ﻳﺠﻮز ﻟﻠﺒﻨﻚ ﻓﻲ أي وﻗﺖ وﻓﻘŽ ﻟﺘﻘﺪﻳﺮه اﻟﺨﺎص وﻗﺮاره‪ ،‬ﺑﻌﺪ إرﺳﺎل إﺷﻌﺎر إﻏﻼق اﻟﺤﺴﺎب‪،‬‬
‫اﻟﺒﻨﻚ ﺑﺈﻋﻄﺎء اﻟﻌﻤﻴﻞ إﺷﻌﺎر‪ Æ‬ﻟﻤﺪة ‪ 60‬ﻳﻮﻣŽ ﻗﺒﻞ أن ﺗﺴﺮي ﻫﺬه اﻟﺘﻐﻴﻴﺮات ﻣﻦ ﺧﻼل‬ ‫إﻏﻼق اﻟﺤﺴﺎب )اﻟﺤﺴﺎﺑﺎت( اﻟﻤﻌﻨﻴﺔ‪ .‬ﻓﻲ ﺣﺎﻟﺔ إﻏﻼق اﻟﺤﺴﺎب )اﻟﺤﺴﺎﺑﺎت( •ي ﺳﺒﺐ ﻣﻦ‬
‫ﻣﻮﻗﻊ اﻟﻤﺸﺮق ا‪³‬ﻟﻜﺘﺮوﻧﻲ )‪(Mashreqneo.com‬و ‪ /‬أو ﻋﺒﺮ اﻟﺒﺮﻳﺪ ا‪³‬ﻟﻜﺘﺮوﻧﻲ و ‪ /‬أو ﻣﻦ‬ ‫ا•ﺳﺒﺎب‪ ،‬ﻳﻮاﻓﻖ اﻟﻌﻤﻴﻞ ﻋﻠﻰ أن اﻟﺮﺻﻴﺪ اﻟﻤﺘﺒﻘﻲ ﻓﻲ اﻟﺤﺴﺎب )اﻟﺤﺴﺎﺑﺎت(‪ ،‬إن وﺟﺪ‪،‬‬
‫ﺧﻼل أي وﺳﻴﻠﺔ اﺗﺼﺎل أﺧﺮى ﻳﺮاﻫﺎ اﻟﺒﻨﻚ ﻣﻨﺎﺳﺒﺔ‪.‬‬ ‫ﻳﻤﻜﻦ ﺻﺮﻓﻪ أو رده إﻟﻰ اﻟﻌﻤﻴﻞ ﻣﻦ ﻗﺒﻞ اﻟﺒﻨﻚ ﺑﺎﻟﺪرﻫﻢ ا‪³‬ﻣﺎراﺗﻲ‪ ،‬ﺑﻌﺪ ﺧﺼﻢ أي رﺳﻮم‬
‫وﺗﻜﺎﻟﻴﻒ ﻣﻄﺒﻘﺔ )ﺑﻤﺎ ﻓﻲ ذﻟﻚ ﺗﻜﻠﻔﺔ ﺗﺤﻮﻳﻞ اﻟﻌﻤﻼت ا•ﺟﻨﺒﻴﺔ(‪.‬‬
‫ب( ﺳﻴﻐﻠﻖ اﻟﺒﻨﻚ ﺣﺴﺎب )ﺣﺴﺎﺑﺎت( اﻟﻌﻤﻴﻞ إذا ﻟﻢ ﺗﻜﻦ ﻫﻨﺎك أﻣﻮال ﻓﻲ اﻟﺤﺴﺎب‬
‫)اﻟﺤﺴﺎﺑﺎت( ﻟﻤﺪة ‪ 180‬ﻳﻮﻣŽ ﺗﻘﻮﻳﻤﻴŽ‪.‬‬
‫اﻟﻤﺸﺮق ﻧﻴﻮ ﺟﺰء ﻣﻦ ﺑﻨﻚ اﻟﻤﺸﺮق ش‪.‬م‪.‬ع وﻫﻮ ﻣﺮﺧﺺ وﻳﺨﻀﻊ ﻟﺮﻗﺎﺑﺔ اﻟﻤﺼﺮف اﻟﻤﺮﻛﺰي‬
‫ﻟﺪوﻟﺔ ا‪³‬ﻣﺎرات اﻟﻌﺮﺑﻴﺔ اﻟﻤﺘﺤﺪة‬
