RESOLUTION ESTABLISHING THE BIDS AND AWRDS COMMITTEE (BAC) OF

THE SANGUNIANG KABATAAN OF BARANGAY CAGHALO CARIGARA, LEYTE.

WHEREAS, By virtue of Section 20(b) of RA No. 10742, the SK shall have financial
independence in its operations, disbursements, and encashment of their fund, income and
expenditures. Accordingly, it has the capacity to act as a procuring entity as defined under
Sections 5(o) 4 of RA No. 9184 and 5(bb) of its 2016 revised IRR.

WHEREAS, Republic Act 9184 known as the Government Procurement Act provides for
the establishment of a Bids and Awards Committee:

WHEREAS, the Bids and Awards Committee (BAC) shall be responsible for ensuring
that the Procuring Entity abides by the standars set forth by the Republic Act 9184 and its
Implementing Rules and Regulation;

NOW THEREFORE, be it Resolved to establish the Bids an Awards Committee (BAC)

of the Sanguniang Kabataan of Barangay Caghalo with the composition as follows:

DISBURSING THE AMOUNT OF FIVE THOUSAND NINE HUNDRED FIFTY-

SEVENN AND 28/100 (5,957.28) AS PAYMENT TO THE SK FEDERATION-CARIGARA
ANNUAL DUES

WHEREAS, Republic Act No. 10742, otherwise known as Sangguniang Kabataan Reform Act
of 2015, establishes reforms in the Sangguniang Kabataan (SK) creating enabling mechanisms
and support systems that will ensure the meaningful participation of the youth in local
governance and nation-building;

WHEREAS, paragraph (b), Section 20 of Republic Act No. 10742 provides that all
Sangguniang Kabataan shall have financial independence in its operations, disbursements and
encashment of their fund, income and expenditures;

WHEREAS, Section 3 of Article XI of the Constitution and by-Laws of Sangguniang Kabataan

provides that two percent (2%) of the Annual SK Funds in every barangay shall be appropriated
for annual dues payable to the respective SK Federation;

WHEREAS, the payment of the annual dues should be made through the following bank details:

WHEREAS, the 2% Annual Dues shall be used to defray expenses of the SK Federation arising
from its programs, projects and activities subject to usual government accounting and auditing;
NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE
MEMBERS OF THE SK CAGHALO, to disburse the amount of Php 5,957.28 as payment to
the SK Federation-Carigara Annual Dues.

A RESOLUTION DISBURSING THE AMOUNT OF THREE THOUSAND (3,000) AS A

FUNDS FOR THE KATIPUNAN NG KABATAAN ASSEMBLY

WHEREAS, the Sangguniang Kabataan of Barangay Caghalois a legislative body duly

organized pursuant to the law for the adoption of policies and for the enactment of resolution
necessary to carry out the objectives of the youth of Barangay Caghalo;
WHEREAS, Rules and implementing regulations of Republic Act 10742, otherwise
known as Sangguniang Kabataan Reform Act of 2015 states that “Sangguniang Kabataan shall
give priority to programs, projects and activities that will promote and ensure the equitable
access to quality education, environmental protection, climate change adaptation, disaster risk
reduction and resiliency, youth employment and livelihood, health and antidrug abuse, gender
sensitivity, sports development, and capability building which emphasizes leadership training”;
WHEREAS, Section 4 of the same act, there shall be in every barangay a Katipunan ng
Kabataan to be composed of all citizens of the Philippines residing in the barangay for at least
six (6) months, who are at least fifteen (15) but not more than thirty (30) years of age, and who
are duly registered in the list of the Commission on Elections (COMELEC) and/or the records of
the Sangguniang Kabataan Secretary;
WHEREAS, Section 6 (a) of the same act, the SK chairperson shall convene the first KK
general assembly not later than three (3) months after the proclamation of the results of the SK
elections;
WHEREAS, it is necessary to conduct Katipunan ng Kabataan to formalize programs,
plans and activities through youth consultation and seminar necessary to allocate funds to be use
for token for speaker and foods and other logistics;
WHEREAS, the Sangguniang Kabataan of Barangay Caghalo agreed to disburse the
allocated funds to ensure youth participation and community development through Katipunan ng
Kabataan;
NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE
MEMBERS OF THE SK CAGHALO, to disburse the amount of Php 3,000 for the Katipunan
ng Kabataan Assembly.

SK TREASURER MA. CLAIRE LATAYADA TO DISBURSE THE AMOUNT OF 10,000
AS PAYMENT TO REYFER ENTERPRISES FOR THE SK UNIFORM

WHEREAS, it is necessary and beneficial for the Sangguniang Kabataan (SK) members to have
a uniform for the purpose of identification and unity;
WHEREAS, Reyfer Enterprises has been chosen as the supplier for the said uniforms due to its
reputation for quality and affordability;
WHEREAS, the total cost for the said uniforms amounts to 10,000;
NOW THEREFORE, on motion of Hon. Francis Mae Velonta, duly seconded by Hon. Jamaila
N. Velunta, it was
RESOLVED, as it is hereby resolved, to authorize SK Chairperson Hon. Leo I. Cordel Jr. and
SK Treasurer Ma. Claire Latayada to disburse the amount of 10,000 as payment to Reyfer
Enterprises for the SK uniform.
RESOLVED FURTHER, that copies of this resolution be forwarded to the Barangay Council,
Reyfer Enterprises, and other concerned parties for their information and appropriate action.

“A RESOLUTION ADOPTING THE INTERNAL RULES OF PROCEDURE OF THE

SANGGUNIANG KABATAAN OF BARANGAY CAGHALO, CARIGARA, LEYTE”

WHEREAS, we, the duly-elected Sangguniang Kabataan Officials of Barangay CAGHALO

CARIGARA, LEYTE, adhere to the principle that sincere and meaningful unity among the
members of the Sangguniang Kabataan in order to uplift the general welfare of the youth;

WHEREAS, the challenges that confront the Sangguniang Kabataan march as briskly as the
changes that occur in the society;

WHEREAS, in order to cope up with these challenges, we have to have a Constitution and By-
laws that is responsive to the demands of the present times;

NOW THEREFORE, on motion of SK Member Jenny Q. Picao, duly seconded by SK Member

Hon. Mico H. Ligutan, this resolution unanimous approved by this body present in the session.

RESOLVED, as it is hereby resolved, ADOPTING THE INTERNAL RULES OF

PROCEDURE OF THE SANGGUNIANG KABATAAN OF BARANGAY CAGHALO
CARIGARA, LEYTE.

Article I
COMPOSITION
Section 1. The Sangguniang Kabataan of Barangay Caghalo, the youth governing body of this
barangay, shall be composed of a Chairperson and seven (7) Members including the Secretary
and the Treasurer.
Section 2. All these officials of the Sangguniang Kabataan shall be elected by the Katipunan ng
Kabataan registered voters.
Section 3. The secretary and the treasurer shall be appointed by the chairperson from among the
members of the Sangguniang Kabataan, subject to their concurrence.

Article II
NAME AND DOMICILE
Section 1. The organization shall be known as Sangguniang Kabataan of Caghalo, herein referred
to as SK – Caghalo.
Section 2. The principal office of the SK – Caghalo shall be located within the area of Barangay
Caghalo.

Article III
POWERS AND FUNCTIONS OF THE SK – Caghalo
Section 1. The SK – Caghalo should have the following powers and functions:
a. Promulgate resolutions necessary to carry out the objectives of the youth in the barangay, in
accordance with the applicable provisions of the Local Government Code of 1991, otherwise
known as Republic Act 7160;
b. Initiate programs designed to enhance the social, political, economic, cultural, intellectual,
moral, spiritual and physical development of the members;
c. Hold fun-raising activities, the proceeds of which shall be tax exempt and shall accrue to the
general fund of Sangguniang Kabataan. Provided, however, that in the appropriation thereof, the
special purpose for which such activity has been held shall be first satisfied;
d. Create such bodies or committees as it may deem necessary to effectively carry out its
programs and activities;
e. Submit annual and end of term reports to the Sangguniang Barangay on their respective
projects and activities for the survival and development of the youth in the barangay;
f. Consult and coordinate with all youth organizations in the barangay for policy formation and
program implementation;
g. Coordinate with the appropriate National Agency for the implementation of youth
development projects and programs at the National level;
h. Exercise such other powers and perform such other duties and functions at the Sangguniang
Barangay may determine or delegate; and
i. Exercise such other powers and perform such other functions as maybe prescribed by law or
ordinance.

Article VI
POWERS AND FUNCTIONS OF THE OFFICIALS OF THE SK – CAGHALO
Section 1. The Sangguniang Kabataan Chairperson shall:
a. In addition to the duties which may be assigned to him by the Sangguniang Barangay upon
assumption of office, he shall exercise the same powers, discharge the same duties and functions
and enjoy the same privileges as the regular Sangguniang Barangay members, and shall be the
Chairman of the Committee on Youth and Sports Development;
b. Serve as member of the Barangay Development Council (BDC);
c. Represent the Sangguniang Kabataan in the Pederasyon ng mga Sangguniang Kabataan;
d. Implement policies, programs and projects within his jurisdiction in coordination with the
Sangguniang Barangay;
e. Exercise general supervision over the affairs and activities of the Sangguniang Kabataan and
the official conduct of its members and the Sangguniang Kabataan Officials within his
jurisdiction;
f. Appoint with the concurrence of the Sangguniang Kabataan among the members of the
Sangguniang Kabataan, the Secretary and the Treasurer, and such other Officials as may be
deemed necessary; and
g. Exercise such other powers and perform such other duties and functions as may be prescribed
by law or ordinance.
Section 2. The Sangguniang Kabataan secretary shall:
a. Keep all records of the Sangguniang Kabataan;
b. Prepare and keep the minutes of all meetings of the Sangguniang Kabataan;
c. Prepare all forms necessary for the conduct of resignation, elections, initiatives, referenda,
plebiscites, in coordination with the Barangay secretary and the COMELEC; and
d. Perform such other duties and discharge such other functions as the Sangguniang Kabataan
Chairman may prescribe or direct.
Section 3. The Sangguniang Kabataan Treasurer shall:
a. Take custody of all Sangguniang Kabataan property and funds not otherwise deposited with
the Municipal Treasurer;
b. Collect and receive contributions, moneys, materials and all other resources intended for the
Sangguniang Kabataan;
c. Disburse funds in accordance with the approved budget of the Sangguniang Kabataan;
d. Certify the availability of fund whenever necessary;
e. Submit to the Sangguniang Kabataan and to the Sangguniang Barangay certified and detailed
statements of actual income and expenditures at the end of every month; and
f. Perform such other duties and functions as the Sangguniang Kabataan Chairman may direct.

Article VI
MEETINGS, ORDER OF BUSINESS AND QUORUM
Section 1. The regular meeting of the SK – Caghalo shall be every First and Third Sunday of
each month, 10 o’clock in the morning at the SK Session Hall.

Section 3. Special meetings maybe called by the SK Chairman or any three (3) of the Members
by giving written notice to all members of the date, time, place, agenda of the meeting at least
one (1) day in advance.
Section 4. Notices of regular or special meetings shall be furnished the Punong Barangay and the
Sangguniang Barangay for their information.
Section 5. A majority of all the SK – Caghalo officials shall constitute a quorum in order to
transact official business.

Article VII
DECORUM AND PENALTIES AND FINES
Section 1. Conduct during meetings, during every regular and/or special meeting, the SK –
Caghalo Members should observe the following rules and policies:
a. The meeting will start at 10:00 in the morning and five minutes before the start of the meeting;
b. Early quitting during regular meeting is not allowed except for emergency cases as permit by
the majority of the members present;
c. Tardiness is not allowed with some provisions of fifteen (15) minutes is the grace period but
sixteen (16) minutes to thirty (30) late had a fine of snacks for the next meeting; and thirty-one
(31) minutes late is automatically absent.
d. Absent without justifiable reason during regular and/or special meeting will be fined of
Php200.00
e. Proper attire will be wore and violation hereof will be fined of Php 100.00;
f. Absent without justifiable reason during an event, or any SK Activities will be fine of Php.
100.00;
e. Three consecutive excuse letter will be fine of Php150.00
Section 2. Discipline of Members, the SK – Caghalo Members may punish its members for
disorderly behavior and with the concurrence of two-thirds (2/3) of its Members, suspend or
exclude from the member a Member, but if the penalty is suspension, this shall not exceed sixty
(60) days.

Article VIII
GROUNDS FOR DISCIPLINARY ACTION
Section 1. Any SK – Caghalo Official may be disciplined, suspended, or removed from office on
any of the following grounds:
a. Disloyalty to the Republic of the Philippines;
b. Culpable violation of the Constitution of the Republic of the Philippines and SK Caghalo
Constitution and By-law;
c. Dishonesty, oppression, misconduct in office, gross negligence, or dereliction of duty;
d. Abuse of authority; and
e. Such other grounds as may be provided in the Local Government Code of 1991, this
Constitution and By-laws, their respective Internal Rules of Procedures, and other laws.

Article IX
AMENDMENTS
Section 1. Any portion of this Constitution and By-laws may be amended by a majority of all the
SK – Caghalo Members.

Article X
EFFECTIVITY
Section 1. This Constitution and By-laws shall take effect on the date of adoption of this
Sangguniang Kabataan of Barangay Caghalo.
