Prelims MCQs Solutions

1) Answer: d
Exp: The preamble to our constitution provides LIBERTY of thought, expression, belief,
faith, and worship.

2) Answer: d
Exp: All four are main features of the Rule of Law according to Dicey. Law does not recognize
any special rights for any individual or group of individuals, none is punished without proper
trial, rule of Law safeguards and advances the political and civil rights of the individual in a free
society and all individuals are subject to the same set of laws and regulations.

3) Answer: b
Exp: Statement 1 is incorrect. This statement suggests that the primary function of a
constitutional government is to limit individual freedoms to empower the state. This is not
accurate as the main objective of a constitutional government is not to restrict individual liberties
but to safeguard them.

4) Answer: d
Exp: While the Parliament of India has significant legislative powers, its sovereignty is not
absolute. It is subject to the supremacy of the Constitution and the judicial review power of the
courts. Therefore, the sovereign power of the Parliament is not considered a feature of the basic
structure since it is limited by the Constitution itself.

5) Answer: c
Exp: Statement 4 is incorrect. Freedom of expression does not extend to the right to disobey the
law. All freedoms under Article 19 are subject to reasonable restrictions as provided by law.

6) Answer: c

7
Exp: Option c is correct because, in a federal system, the state legislature does not hold
supremacy. Instead, the supremacy belongs to the Constitution, which ensures a balance of
power and proper functioning of both central and state governments.

7) Answer: d
Exp: Opportunity to develop oneself fully is correct because it aligns with the broader and more
constructive understanding of liberty, which includes not just freedom from interference but also
the positive conditions necessary for personal growth and development.

8) Answer: b
Exp: Only statement 2 is incorrect. In the Indian parliamentary system, the President is the
nominal executive or the ceremonial head of state, while the real executive authority is vested in
the Prime Minister and the Council of Ministers.

9) Answer: a
Exp: Statement 2 is incorrect. The Doctrine of Basic Structure precisely ensures that there are
limitations on the power of the Parliament to amend the Constitution. It prevents the Parliament
from altering the fundamental framework or essential features of the Constitution, thereby
maintaining its core principles and values.

10) Answer b
Exp: The fundamental rights are available to citizens and foreigners but there are five
fundamental rights like articles 15, 16, 19, 29 and 30 which are not available to foreigners.

Mains Level 1 Answer Writing
Q.1) Discuss the role of Directive Principles of State Policy in the Indian Constitution. (10
marks, 150 words)

Model Structure
Introduction
● The Directive Principles of State Policy (DPSP) are guidelines set forth in Part IV of the
Indian Constitution. They aim to establish social and economic democracy and guide the
State in creating policies to achieve social justice and welfare for all citizens.

Main Body
● Some of the features include-
○ Taken from various sources like the UK, USA, Japanese, South African,
Australian, French etc.
○ Blend of rigidity and flexibility which has resulted in many amendments.
○ Parliamentary form of government from British polity which include cooperation
and coordination between legislative and executive organs.
○ Synthesis of constitutional sovereignty and judicial supremacy. Unlike Britain
where parliament is sovereign, in India the constitution is sovereign and supreme.
○ Federal system with unitary bias like division of powers, independent judiciary,
bicameralism, supremacy of constitution etc.
○ Integrated and independent judiciary. Integrated judiciary means that courts at all
levels are hierarchical and independent judiciary means that there are mechanisms
which ensure the judiciary is not compromised.
○ Universal Adult Franchise which has been provided since the commencement of
the constitution.
○ Fundamental rights, directive principles and fundamental duties.

Conclusion
● Thus it can be said that the constitution of India is an organic and growing document
which is still growing due to progressive amendments.
