AN ACT
STRENGTHENING MEANINGFUL YOUTH PARTICIPATION IN LOCAL
GOVERNANCE AND FURTHER AMENDING REPUBLIC ACT 10742 OTHERWISE
KNOWN AS THE "SANGGUNIANG KABATAAN REFORM ACT OF 2015"

EXPLANATORY NOTE

Ttie enactment of the Sangguniang Kabataan (SK) Reform Act of 2015 is an


important victory o f the youth sector. However, there is a need to address policy gaps
and issues tha t lim it the participation o f the youth in governance like the lack of
compensation o f the SK officials, the lack of Local Youth Development Office (LYDO) in
many Local Government Units (LGUs), and the lack o f funds for the Local Youth
Development Plan (LYDP).

The law does not provide for the compensation of the SK officials and for the
inclusions o f the SK Kagawad in the list of Elective Barangay Officials, who are granted
with first level civil service elegibility. While this intends to encourage volunteerism, it
should be noted that the reform also mandates the financially-independent SK to
formulate, implement and monitor local yotuth development plans; thus, it is fitting that
we compensate the SKs for their work, especially now that we expect them to deliver
best outcomes and contribute greater impact.

The Local Youth Development Office sen/es as the Secretariat of the Local Youth
Development Council (LYDC) and is expected to provide technical assistance and
mandatory and continuing training to SK officials and LYCD members. However, the gap
in the law is tha t while it requires the establishment o f the LYDO, the last statement of
Section 25 makes it permissive. In effect, many local government units are yet to establish
the office or to at least appoint or designate their youth development officer. This
situation limits youth participation in governance in the local scene. This measure,
therefore will mandate Local Chief Executives (LCEs) to establish the office within one
year, and to include administrative and criminal liabilities for non-compliance.
Furthermore, to ensure tha t programs, projects, and activities for the youth will be duly
funded and in turn be effectively implemented, it is vital that the LGU appropriates a
portion of its budget to the LYDO for the Local Youth Development Plan (LYDP).

In view of the foregoing, the approval o f this bill is earnestly sought.

10 TREASURER AND; (3 ) SET THE SCHEDULE OF REGULAR SK MEETINGS
11 AND ASSEMBLIES

13 (k) Exercise such other powers and perform such other functions as may

14 be prescribed by law or ordinance or delegated by the Sangguniang Barangay or

15 the Commission.

5 - The Sangguniang Kabataan Chairperson shall exercise such powers and

6 discharge such duties as follows:

8 (f) With the concurrence o f the Sangguniang Kabataan, appoint from

9 among the members o f the Katipunan ng Kabataan a secretary and a treasurer.

13 SEC. 3. Section 16 o f Republic Act 10742 is hereby further amended to read as

16 SEC. 16. Privileges o f Sangguniang Kabataan Officials, - (a) All Sangguniang

17 Kabataan officials in good standing, whether elected or appointed, shall be granted

18 the following privileges:

20 (2 ) BE EXEMPT FROM TAKING ANY OF THE COMPONENTS OF
21 THE NATIONAL SERVICE TRAINING PROGRAM (NSTP);
22
23 (6 ) RECEIVE AN HONORARIUM WHICH SHALL BE CHARGEABLE
24 AGAINST THE SK FUNDS: PROVIDED, THAT NOT MORE THAN 2 0 % OF
25 THE FUNDS W ILL BE ALLOCATED FOR PERSONNEL SERVICES:
26 PROVIDED, FURTHER, THAT THE AMOUNT RECEIVED OF THE SK
27 OFFICIALS SHALL NOT BE GREATER THAN THE AMOUNT RECEIVED BY
28 THE SK CHAIRPERSON: PROVIDED, FINALLY, THAT THE AMOUNT SHALL
29 NOT BE GREATER THAN THE EQUIVALENT OF A SALARY GRADE NINE (9)
30 GOVERNMENT EMPLOYEE.

2 (7 ) BE ENTITLED TO APPROPRIATE CIVIL SERVICE ELIGIBILITY,
3 PURSUANT TO RULES AND REGULATIONS ISSUED BY THE CVIVIL
4 SERVICE COMMISSION: PROVIDED, THAT THE SK OFFICIAL HAS

7 (8 ) The Sangguniang Kabataan chairperson shall have the same privileges

8 enjoyed by other Sangguniang Barangay officials under this Act subject to such

9 requirements and limitations provided herein.

11 SEC. 4. Section 20 o f Republic Act 10742 is hereby further amended to read as


12 follows:

14 SEC. 20. Sangguniang Kabataan Funds. The Sangguniang Kabataan

15 Funds shall be governed by the following provisions:

17 (c) All Sangguniang Kabataan funds shall be allocated in an annual budget,

18 and if the funds allow, in a supplemental budget in accordance with the

19 adopted annual barangay investment program. BOTH THE


20 COMPREHENSIVE BARANGAY YOUTH DEVELOPMENT PLAN
21 (CBYDP) AND ANNUAL BARANGAY YOUTH INVESTMENT PROGRAM
22 (ABYIP) SHALL GIVE PRIORITY TO PROGRAMS, PROJECTS, AND
23 ACTIVITIES THAT W ILL PROMOTE AND ENSURE THE NINE CENTERS
24 OF PARTICIPATION WHICH ARE HEALTH, EDUCATION, ENVIRONMENT,
25 GLOBAL MOBILITY, ACTIVE CITIZENSHIP, GOVERNANCE, SOCIAL
26 EQUITYANDINCLUSION, PEACE-BUILDING AND SECURITY, AND
27 ECONOMIC EMPOWERMENT.

29 (e) THE SK SHALL SET ASIDE AN AMOUNT FOR THE SK
30 MANDATORY AND CONTINUING TRAININGS. THE TOTAL AMOUNT
1 APPROPRIATED FOR TRAINING SHALL NOT BE MORE THAN 15 % OF THE
2 SK FUND.

4 SEC. 5. Section 21 o f Republic Act 10742 is hereby further amended to read as
5 follows:

7 (d) DUTIES AN D FUNCTIONS OF THE SK PEDERASYON. - THE SK


8 PEDERASYON SHALL IN ITIA LLY DRAFT THE LOCAL YOUTH
9 DEVELOPMENT PLAN, WHICH SHALL BE FINALIZED BY THE LOCAL
10 YOUTH DEVELOPMENT COUNCIL.

12 THE PEDERASYON SHALL CONVENE QUARTERLY WITH THE


13 MEMBERS OF LYDC TO ENSURE IMPLEMENTATION OF LYDP AND
14 ALIGNMENT OF CBYDP AND ABYIP TO THE LYDP.

16 THE PEDERASYON SHALL ALSO CASCADE INFORMATION AND
17 FACILITATE KNOWLEDGE TRANSFER TO THEIR RESPECTIVE
18 LOCALITIES.

20 SEC. 6. Section 25 o f Republic Act 10742 is hereby further amended to read as
21 follows:

23 SEC. 25. Creation. - There shall be in every province, city, and municipality

24 a Youth Development Office which shall be headed by a youth development

25 officer with the rank of at least division chief. Such may be put under the

26 Office of the Local Chief Executive, the Office o f the Planning and Development,

27 the Office of the Social Welfare, or in any other office deemed appropriate by the

28 local government unit. I f the funds of the local government unit are sufficient, it

29 can be a separate department with divisions and units for policy and planning,

30 administration and finance, and programs and operations. In the event when the
1 local government unit has exceeded the prescribed personal services limitations,

2 the local chief executive may designate existing personnel whom he or she deems

3 fit to serve this purpose, PROVIDED THAT A PERMANENT LOCAL YOUTH

4 DEVELOPMENT OFFICER SHALL BE APPOINTED W ITHIN ONE (1) YEAR


5 FROM THE EFFECTIVITY OF THIS ACT. IN COMPLIANCE WITH THE SEAL
6 OF GOOD LOCAL GOVERNANCE ACT OF 2019, FAILURE TO CREATE THE
7 LOCAL YOUTH DEVELOPMENT OFFICE AND APPOINT THE YOUTH
8 DEVELOPMENT OFFICER W ITH IN THE PRESCRIBED PERIOD SHALL BE
9 GROUNDS FOR ADMINISTRATIVE LIABILITIES OF THE LOCAL
10 PERSONNEL SELECTION BOARD AND THE LOCAL CHIEF EXECUTIVE.

12 SEC. 7. Section 26 and Section 27 o f Republic Act 10742 are hereby further
13 amended to read as follows:

15 SEC. 26. Funding. - THE LOCAL GOVERNMENT UNIT SHALL
16 APPROPRIATE NOT LESS THAN 1 % OF ITS ANNUAL BUDGET FOR THE
17 LOCAL YOUTH DEVELOPMENT OFFICE, WHICH SHALL BE USED FOR
18 THE IMPLEMENTATION OF THE LOCAL YOUTH DEVELOPMENT PLAN,
19 CONVENING THE MEETINGS OF THE CONCERNED PEDERASYON NG MGA
20 SANGGUNIANG KABATAAN AND LOCAL YOUTH DEVELOPMENT
21 COUNCIL; AS WELL AS ITS OPERATIONS AND EFFECTIVE FUNTIONING.

23 SEC. 27. CAPACITY BU ILDING . - THE NYC SHALL BE
24 SPEARHEADING THE CONDUCT OF CAPACITY-BUILDING AND
25 TRAININGS FOR LYDOs.

27 SEC. 8. F u n d in g a n d A p p ro p ria tio n s. - The initial amount necessary to carry
28 out the implementation o f this Act shall be charged against current appropriations of the

29 Department o f the Interior and Local Government (DILG). Thereafter, such sums as may
1 be needed for its full implementation shall be included in the annual General

2 Appropriations Act.

4 SEC. 9. S e p a ra b ility Clause. - I f for any reason any part or provision of this Act
5 is declared unconstitutional or invalid, such parts or portions not affected thereby shall

6 remain in full force and effect.

8 SEC. 10. R e p e a lin g Clause. - All laws, decrees, orders, rules and regulations or
9 other issuances or parts inconsistent with the provisions of this Act are hereby repealed

10 or modified accordingly.

12 SEC. 11. E ffe c tiv ity . - This Act shall take effect fifteen (15) days after its
13 complete publication in the Official Gazette and in at least two (2) newspapers o f general

14 circulation.
