IRREVOCABLE GENERAL POWER OF ATTORNEY
KNOW ALL MEN BY THESE PRESENTS, that We,
1. , aged about 53 years, 2. aged about 50 years, 3. , aged about 48 years, all are children of Late A Nagappa A Kunder, residing at C/2 , Sai Apartments, J.P. Road, 7 Bangles, Opp Bond Lane, Andheri (West) Mumbai, Mharastra State now come down to Udupi, do hereby nominate, appoint and constitute Mrs. , aged about 46 years, W/o District, to be our true and lawful attorney, in fact and at law, in our name and on our behalf, to make, perform, execute and exercise all or any and such of the several acts, deeds, authorities, matters and things hereinafter mentioned in, that is to say:
1. To manage and look after Immovable properties morefully
described in the schedule herebelow.
2. To file applications before the concerned authorities and to
sign necessary applications, forms, notices and to acknowledge such notices in respect of the said properties, in our name and on our behalf. …2, -2- 3. To pay land revenue, assessments and any other taxes, due to the Government or Local Bodies etc., on our behalf.
4. To enter in to Agreement for Sale, and to receive
consideration amount, and to execute Deed of Sale, and in that connection to appear before the concerned Sub- Registrar’s Office and to sign Sale deed and to sign any documents, papers and to swear any affidavit in connection with the same.
5. To execute Settlement Deed, Rectification Deed,
Supplemental Deed, Gift Deed, or any other Deeds in respect of Schedule properties and in that connection to represent me before concerned Sub Registrar, and to sign necessary documents, application, and swear to any affidavit.
6. To obtain any ‘No Objection Certificate’ from the
Tahashildar or from any concerned authority if needed and in that connection to submit any application, to give any statement and to swear any affidavit etc., ….3, -3-
7. To represent us before the office of Deputy Commissioner,
Assistant Commissioner, Taluk Office, Panchayath Office, Revenue Inspector’s Office, Village Accountant’s Office, Electricity Department or any other revenue offices etc. and to sign any papers, documents, statements and to swear any Affidavit etc.
8. To receive any notices and summons of any offices,
departments or courts, etc.
9. To measure the below mentioned schedule properties by
the Assistance of competent surveyor.
10. To get the properties Converted for Non Agricultural
Purposes and in that connection to appear before concerned Departments and to file and sign necessary applications on our behalf. 11. To mortgage the Schedule properties in any Nationalized banks, Financial Institutions or Co-operative Societies and to raise loan for the improvements of Schedule Properties.
12. To construct Compound wall, Dig Well and Construct
Compound Wall in the Schedule Properties and to obtain necessary license from the concerned Departments, by filing application, Forms etc on our Behalf.
13. To carry our renovation Working respect of the existing
building in the Schedule properties, to Demolish, or to carry out alterations, extension work, or to construct New Building thereon, and in that connection to submit necessary Papers, Applications to the concerned authorities and to obtain license in that regard. ….4, -4-
14. To represent us before all Government Authorities, such as
Revenue Department, Survey measurement department and local bodies such as Village Panchayath, Municipality, and KPTCL, Town Planning Authorities, to receive any notices or documents and to acknowledge for having received the same in our name and on our behalf.
15. To appoint any advocate or pleader, to file any suits, sign
and verify any plaint, written statement or counter, to file any application before any Civil, Criminal or Revenue Court, to represent us before any court of law, Land tribunal, to swear on oath any affidavits, sign memos or Joint Memos, compromise petitions in respect of the schedule property in our name and on our behalf.
16. To commence development work of the said properties
and to take such of the action and steps as may be necessary to commence the said development work, and for that to execute all such applications and writings as may be necessary in our name and on our behalf. 17. This General Power of Attorney is Irrevocable and the same shall not be cancelled unilaterally without the consent of the attorney.
18. Generally to do, execute and perform any other acts,
deeds and things whatsoever which is in the opinion of our said attorney ought to be done or execute and perform in relation to the said properties as ourselves could do the same as if we were personally present.
AND we hereby agree that all acts, deeds and things
lawfully done by the said attorney shall be construed as acts, deeds and things done by us and we hereby undertake to ratify and confirm all and whatever the said attorney shall lawfully do or cause to be done for us by virtue of the powers hereby given. ….5, -5-
