ADVERTISEMENT NOTIFICATION

No. 03 of 2024/RG/GS Dated:05..06.2024..

1. Applications through online mode, are invited from the eligible


Advocates for filling up the posts in the cadre of District Judges (Entry
Level) in the Pay Level .J-5 (144840-194660) by direct recruitment, in
accordance with the provisions of Jammu and Kashmir Higher Judicial
Service Rules, 2009, as amended from time to time. The candidates are
advised to go through these Rules before applying for the said posts.

2. Number and Break-up of posts Category-wise:

The total number of posts is twelve (12) and their share is as


per the detail given below:-

*posts advertised include seven posts (OM) and one post (Backward
Area) re-advertised (second time), in terms of proviso to Sub Rule (1)
of Rule 5 of the Jammu and Kashmir Higher Judicial Service Rules,
2009.

3. Eligibility:-

In order to be eligible for appointment by direct recruitment to


the cadre of the service, the incumbent:-

a) must possess a Degree in Law from a recognized University


established by Law in India and recognized as such by the Bar
Council of India;

b) must be a practicing Advocate in Courts of Civil and Criminal


jurisdiction and must have been in actual practice for a period
of not less than seven years as on the last date of the receipt
of the application and in this regard the candidate must
submit an experience certificate issued by the concerned
Principal District and Sessions Judge/Registrar Judicial of the
concerned Wing of the High Court in the format annexed as
Annexure-A, to this notification;

c) must have attained the age of 35 years and not above the age
of 45 years (relaxable in case of candidates belonging to
Scheduled Castes or Scheduled Tribes or Other Backward
Classes by two years) as on the date of receipt of the
application; and

d) must be proficient in reading and writing Urdu.

4. Competitive Examination for Direct Recruitment:-

I) The competitive examination for appointment of District Judges


by direct recruitment shall consist of:

a) A written examination comprising of two papers of two


hours duration each. Each paper shall carry 80 marks.
The syllabus for these papers as prescribed by the High
Court of J&K and Ladakh is attached as Annexure-B, to
this notification; and

b) Viva-voce examination shall carry 40 marks.

ii). Only those candidates who shall obtain 60% or more marks in
the written examination shall be called for viva-voce test in the
ratio of 3:1 i.e., three candidates for one available vacancy.

Provided that Scheduled Caste/Scheduled Tribe candidates


who obtain 50% or more marks in the written examination shall
be eligible for viva-voce examination.

iii) The candidate has to obtain 60% marks out of 40 marks


earmarked for viva-voce provided that in case of Scheduled
Caste and Scheduled Tribe, the candidate has to obtain 50%
marks out of 40 marks reserved for viva-voce; and

iv) After the candidate makes the grade in written examination and
viva-voce, selection shall be made on the cumulative grade
value obtained in the written examination and vice-voce.

5. Disaualification for Appointment:-

No person shall be eligible for appointment to the service:

a) Unless he/she is a domicile of UT of Jammu and Kashmir in


terms of S.O. 166 dated 18.05.2020 issued by GAD,
Government of Jammu and Kashmir and those who are
residents of UT of Ladakh for a period of not less than 15
years before the date of applying and are actually residing in
the area.

b) If he/she is dismissed from service by the Central


Government, any State Government, Government of a
Union Territory, High Court or any statutory or local
authority;

c) If he/she has been convicted of an offence or has been


debarred or disqualified by any High Court or Public Service
Commission or by any recruiting or examination conducting
authority from appearing in examinations or selections;

d) If he/she directly or indirectly influences the recruiting


authority by any means for his/her candidature;

e) If he is a man and has more than one wife living, unless


permissible under any law for the time being in force; and if
she is a woman and has married a man already having
another wife.

6. Reservation:-

A candidate seeking his/her consideration under any


Reserved Category must ensure that he/she possesses a
valid requisite Category certificate as on the cut-off date.

ii. The candidature of the candidates will be provisional till the


genuineness of the reserved category certificate is verified by
the Appointing Authority.

iii. Candidates may note that in case a claim for reservation is


made on the basis of false/fake/fraudulent certificate, he/she
shall be debarred from the examination, in addition to any
other penal action as may be deemed appropriate.

7 Prescribed Fee:-

After successful submission of the online application form,


candidate will be required to deposit requisite fee of Rs. 1200/-
through online mode.

8. Documents to be Uploaded:-

While filling the online application form, the applicants are


required to upload the documents as per details given below:-

i. Date of birth certificate (Secondary School/Matric


Certificate).
ii. Domicile Certificate/Residence Certificate.
iii. Bachelors Degree in Law.
iv. Experience certificate issued by the concerned Principal
District and Sessions Judge/Registrar Judicial of the
concerned Wing of the High Court of J&K and Ladakh in the
format annexed as Annexure-A.
v. Reserved Category Certificate (if claiming benefit)

Note:-

a) Any wrong or incorrect information furnished by the candidate


shall lead to the rejection of his/her candidature at any stage.

b) Applications along with the prescribed fee will be received only


through online mode on recruitment portal of the High Court of
J&K and Ladakh, link of which will be activated on 09.06.2024
on the official website of the High Court of J&K and Ladakh:

c) Last date for filling up of online application form, complete in all
respects alongwith the requisite fee is 23.06.2024.
d) Submission of Application Form and fee payment shall not be
accepted/entertained after the cut-off date fixed for receipt of
the same.
e) The printout of the application alongwith the fee payment receipt
and required copies of documents shall be kept ready to be
submitted as and when required.
f) The eligible candidates shall have to appear in the test on the
date(s) to be notified separately. No separate call letters shall be
issued individually; however, wide publicity shall be given
through print and electronic media, official website
https://www.jkhighcourt.nic.in of the High Court of J&K and
Ladakh about the venues, dates of written test/ interview for the
information of eligible candidates. No claim of being unaware of
the dates/schedule for written test/interview shall be
entertained.
g) No TA/DA shall be paid for the test/interview.
h) Incomplete application(s) or application(s), received after the
last date or received by any other mode than specified above,
shall not be entertained.

SYLLABUS FOR EXAMINATION


UNDER RULE 8 (i)(a)
JAM MU AND KASHMIR HIGHER JUDICIAL SERVICE RULES, 2009

• There shall be two papers carrying 80 marks each.


• The duration of each paper will be of two hours.
• Each paper shall comprise of three parts carrying equal number of
questions.
• The candidates shall have to attempt nine questions in each paper,
three from each part.

PAPER-I

Part-I
(a) Essay- Precise writing
(b) Constitution of India.
(c) Legal Maxims.
(d) Translation of passage in Urdu to English.

Part-Il
a) Judgment Writing on Civil Original & Civil Appellate side.
b) Laws relating to Partnerships, Contracts and Arbitration,
Transfer of Property Act 1882, Rent Laws, Jammu and Kashmir
Agrarian Reforms Act 1976, Jammu and Kashmir State Evacuees
(Administration of Property) Act 2006, Jammu and Kashmir
Alienation of Land Act 1995 (1938 A. D.) and Specific Relief Act
1963.
c) Law relating to Compensation under the Motor Vehicles Act,
1988.
d) Laws relating to Marriages, Divorce and Succession governing
Hindus, Muslims, Christians and Buddhists.

Part-Ill
a) Civil Procedure Code, 1908.
b) Laws relating to acquisition and requisition of immovable
