Dear Sir,

The property in question for which the due diligence


exercise has been carried out by us relates to the property
bearing Tirunelveli District, Nanguneri Taluk, Nanguneri
Union, Karanthaneri Village Old Survey No.713/1 now at the
new survey number of 713/1B, 713/1C total area admeasuring
Acres 5 acres of land divided into housing plots and named
as Eden City plot no.2,3 (now at the new survey number of
713/1B, 713/1C) north & east (30+30) 60 feets and south side
40 feets in 2400 Sq feets 222.97 sq mtr admeasuring in 5.51,
which is more fully described in the Schedule hereunder and
(hereinafter referred to as “Schedule Property”). This Report has
been prepared on the basis of information and copies of the
documents which were made available to us.

C. DISCUSSION :

1. Larger extent of 5 acres of land in S.No.713/1 in Karanthaneri


Village was originally owned by Mrs.Maduravani by right of
purchase by means of a registered sale deed number: 852/1993
dated 14.10.1993 from Mr.Durairaj. A photostat copy of the sale
deed has been produced for my perusal. Since, the said
document itself is more than 30 years old, there is no need to
trace the title beyond the said period. As such Mrs.Maduravani
became the absolute owner of the property. the above
Mrs.Maduravani as the Pattadar as per the Karanthaneri village
patta number 527. As such we can safely conclude she was in
continuous possession and enjoyment of the above said item of
property and had perfected her title by continuous enjoyment.

2.Subsequently, the said Mrs.Maduravani died intestate leaving


her husband i) Pitchumani Ayyar ii) seethasankar iii) Showmiya iv)
Balasubramaniyan v) Jeyashri vi) Lakshmi Ragu regarding the
legal heir of late.Mrs.Maduravani Legal heirs. The above said i)
Pitchumani Ayyar ii) seethasankar iii) Showmiya iv)
Balasubramaniyan v) Jeyashri vi) Lakshmi Ragu became the co-
owners of the property.
Note: We note that the Legal Heir Certificate of Mrs. Maduravani has not been
provided for our review. Hence, the same is required to be obtained.

3.Subsequently, the said i) seethasankar ii) Showmiya has


executed a power in favour of Mr.Pitchumani Ayyar by means of a
registered power deed number.1927/2007 dated 10.09.2007
authorizing him to sell their share property and iii)
Balasubramaniyan iv) Jeyashri v) Lakshmi Ragu has executed a
power in favour of Mr.Pitchumani Ayyar by means of a registered
power deed numbrt.5429/2007 dated 12.09.2007 authorizing him
to sell their share property, Subsequently the above Pitchumani
Ayyar him self and as a Power agent of above said i to v persons
has sold the land in Survey No.713/1, total area admeasuring
Acres 5 acres in favour of Mr.Chandrasekara Raja by means of a
registered sale deed document no.5209/2007 dated 26.09.2007
for a consideration of Rs.1,21,500/-. A photostat copy of the
certified copy of the sale deed has been produced for my perusal.

4. Subsequently, the said Chandrasekara Raja has sold the land


in Survey No.713/1, total area admeasuring Acres 5 acres of
land divided into housing plots and named as Eden City plot
no.2 & 3 north & east (30+30) 60 feets and south side 40 feets
in totally 2400 Sq feets equal to 222.97 sq mtr admeasuring in
5.51 cents in favour of Mr.Jayaramesh by means of a registered
sale deed document no.6725/2008 dated 25.07.2008 for a
consideration of Rs.39,020/- A photostat copy of the certified copy
of the sale deed has been produced for my perusal.

5.Subsequently, the said Mr.Jayaramesh died on 30.04.2021 A


photostat copy of the death certificate dated 28.05.2021 issued by
the Public health and Preventive medicine department Tration
No.16046-003072 intestate leaving his wife Mrs.Saraswathy
Daughter Iswarya regarding the legal heir of late.Jayaramesh
Legal heir certificate issued by Tashildhar, Virudhunagar dated on
10.11.2021 Certificate No.TN-720211109530 has been produced
for my perusal. Mrs.Saraswathy & Iswarya became the co-owners
of the property.

6. Subsequently, the above said Mrs.Saraswathy & Iswarya has


sold the land in Property bearing Survey No.713/1, total area
admeasuring Acres 5 acres of land divided into housing plots
and named as Eden City plot no.2 & 3 north & east (30+30) 60
feets and south side 40 feets in totally 2400 Sq feets equal to

222.97 sq mtr admeasuring in 5.51 cents as bounded., On The


North: 20Ft wide common Road, On the East. Plot No .1,On the
South Survey No.713/2, On the West ; Plot No 4, in favour of
Mr.Vignesh by means of a registered sale deed document
no.697/2024 dated 02.05.2024 for a consideration of Rs.2,31,000/-
A photostat copy of the certified copy of the sale deed has been
produced for my perusal. As such Mr.Vignesh became the absolute
owner of the property.

7.The online printout copy of Patta in respect of this land is


standing in the name of Mr. Vignesh in Patta No.5005 & 5006 and
an online printout copy of the Patta dated 21.06.2024 has been
produced for my perusal.

8.The online encumbrance certificate in respect of the above-


mentioned property for a period of 50 years Online E.C. from
01.01.1975 till 29.04.2024 has been produced for my perusal. In
the said E.C, the entry relating to the execution of sale deed
document no.697/2024 dated 02.05.2024 by Mr.Vignesh is
mentioned and there is no subsisting encumbrance over the same
Old Survey No.713/1 now at the new survey number of 713/1B,
713/1C total area admeasuring cents 5.51 housing plots named
as Eden City plot no.2,3 (now at the new survey number of
713/1B, 713/1C) north & east (30+30) 60 feets and south side 40
feets in 2400 Sq feets 222.97 sq mtr admeasuring in 5.51 and the
above said property is changed now at the new survey No.
713/1B & 713/1C as shown in the present Sub-division Patta.

9.The online printout copy of Patta in respect of the schedule


property land is standing in the name of Mr. Vignesh in Patta
No.5005 & 5006 and a online printout copy of the Patta dated
21.06.2024 has been produced for my perusal.

D. OPINION:

In view of the above facts and after perusing the documents


mentioned above, I am of opinion that Mr.Vignesh has got a valid,
legal and marketable title over the property more fully described
above subject to the following conditions.,
i. Death & Legal heir certificate of Mrs. Maduravani
ii.Original sale deed No.697/2024 dated 02.05.2024 in the name of
Mr.Vignesh to be produced.
