Ref: Notice u/s 91 CrPC issued by the Cyber Police Station, Dist. Rohini
Sub: Reply to the notice u/s 91 issued by this office to the Manager, Al
Khair Diagnostic Centre in FIR No. 38/22 u/s 420 IPC.
Dear Sir,
We are in possession of the captioned notice u/s 91 CrPC issued by the
office of SHO, Cyber Police Station, Sector 17, Rohini, and reply to you as
under under:
1. At the very outset it is submitted that the undersigned are willing to
fully cooperate with the Police and join the investigation, and towards
that very end, are furnishing the instant reply.
2. That the details of the client of Al Khair Diagnostic Centre, who

referred the checkup of the Complainant Sanjeev Kumar are being
attached herewith and marked as Annexure R-1.
3. That the Registration Certificate of the Al Khair Diagnostic Centre,

which was valid when the said tests were conducted, is being
attached herewith and marked as Annexure R-2. It is further
submitted that currently, the Al Khair Diagnostic Centre is non-
functional, and hence, no current registration is available with the
undersigned.
4. That the complete medical report of the Complainant cannot be

provided, as the same relates to information over 2 years old, and
the Diagnostic Centre disposes off of reports and other such
documents after a period of around 90 days, except in cases such
documents are ordered to be preserved by appropriate authorities.
5. That all the documents are being supported by a certificate u/s 65B
of the Indian Evidence Act, which is being attached herewith and
marked as Annexure R-3.
6. That the Al Khair Diagnostic Centre does not ordinarily hold any other
information of either the people who visit to get tested, nor of the
referring persons. However, as stated hereinabove, the Al Khair
Diagnostic Centre does undertake to provide any specific information
sought, subject to availability of the same and just exceptions.
7. That the Al Khair Diagnostic Centre further undertakes that it was not
aware of the fraud being committed upon the Complainant, and
conducted the diagnostic checkups in a bona-fide manner, and the
fee so charged was for the services rendered by the Al Khair
Diagnostic Centre to the Complainant. However, subject to directions
from an appropriate authority, the Al Khair Diagnostic Centre hereby
expresses its assent to refund the cost of the diagnostic checkups
incurred by the Complainant. However, it be noted on record that
such willingness to refund does not, in any manner whatsoever, is to
be considered an admission of any guilt or wrongdoing on the part of
the Al Khair Diagnostic Centre, and is merely a goodwill gesture
showcasing the Diagnostic Centre’s bona-fide.
That in light of the aforestated, it is most humbly prayed that the office of
the SHO, Cyber Police Station, Dist. Rohini be pleased to take the instant
reply of the Al Khair Diagnostic Centre on record, alongwith their co-
operative conduct with the Police, and an acknowledgment of the same be
provided to the undersigned.

02. That the printouts, and other digital documents are taken from the
computer owned, maintained, managed, and operated by me. The
details of the said computer and the printer used to print the
aforementioned documents are as follows:

the electronic record or of the kind from which the information so
contained is derived was regularly fed into the computer in the ordinary
course of working of the Diagnostic Centre.
05. I state that throughout the material part of the said period the
computer was operating properly without affecting the contents of the
electronic record or its accuracy or its contents.
06. I state that the information contained in the electronic record is derived
from such information fed into the computer in the ordinary course.
