1.0 Aims of Micro-Project


• “ Prepare a report on Disputes between owner and contracter”.

2.0 Rationale
For infrastructure development various construction projects are required to be undertaken.
These projects are to be executed by entering into a legal contract. The diploma student shall
have adequate knowledge of different types of contract and accounting procedures of
organization about the projects are to be executed by entering in to legal contract. The
procedure of execution of work by various organizations will be useful while working as an
engineer in organization to execute various works. Concept of Tender and knowledge about
preparation of tender documents, writing specification for different items of work will be
helpful to prepare actual Tender papers and contract documents which are required before
execution of construction. The information on procedures and different types of forms used by
department will be useful to prepare bills and different modes of payment to contractors. This
Course will help the student in implementing actual field practices, which will make student
further more competent in the execution of civil engineering works.

Common Causes of Disputes:


1.Scope Changes and Design Issues: Changes in project scope or design specifications can lead
to disputes regarding additional costs, delays, and responsibilities. Miscommunication or
inadequate documentation of changes often exacerbates these conflicts.

2.Schedule Delays: Delays in project timelines due to unforeseen circumstances, weather


conditions, or contractor inefficiencies can result in disagreements over project completion dates
and associated penalties.

3.Payment Disputes: Issues related to payment, including delays, insufficient funds, or


disagreements over invoicing, can strain the relationship between the owner and contractor.

4.Quality of Workmanship: Differences in expectations regarding the quality of workmanship


and materials may lead to disputes during the construction process or upon project completion.

5.Contract Interpretation: Conflicting interpretations of contract terms, including obligations,


responsibilities, and dispute resolution mechanisms, can contribute to disagreements between
parties.

promptly can prevent disputes from escalating.

contracts, change orders, and correspondence, helps clarify responsibilities and resolve disputes
more effectively.

3.Mediation and Alternative Dispute Resolution (ADR): Utilizing mediation or other ADR
methods can facilitate amicable resolutions while avoiding the time and expense of litigation.

❖ SOLUATION OF DISPUTE

▪ Arbitration :-
The method of setting disputes between owner or
department and contractor outside the court is called arbitration .
The person who settles such dispute s is called arbitrator.

The dispute arises during the process of work or after the completion
of work should be referred to the independent arbitrator.

Quality of arbitrator:-

✓ Person with long standing experience


✓ Person acceptable to both parties
✓ Should be impartial
✓ Should have knowledge of rules, procedure and law
✓ Should be member of panel of arbitrators

Power of arbitrator:-

✓ To administrate oath to both parties and witness


✓ To declare the award
✓ To call any party for interrogation

Procedure:-
Any injured party demanding arbitration. The arbitrator will fix up date
and time of hearing the case. Then upon hearing the case in detail he will give his award,
which is final and binding on both parties. The cost of arbitration is to be shared by both
parties.

Advantages of arbitration:-

• Award can be obtained in less time and less expenses


• Simple procedure
• Award may be fair as it is obtained from experts in engineering field.
• The hearing may be arranged considering the convenience of both parties
