AFFIDAVIT OF ARRESTING OFFICER


(POSEUR BUYER)

I, Police Corporal Mariel P Salvatierra of legal age and a bona fide member
of Philippine National Police after having been sworn in accordance with the law do
hereby depose and state the following;

1. That, I am currently assigned at Police Station 4, Novaliches Police Station,


located at Quirino Highway, Novaliches, Quezon City as SDEU operative with a broken
hour tour of duty;

2. That, at around 3:00 PM of April 16, 2024, our male regular confidential
informant (RCI), arrived at our office and reported to PCPT BIENVENIDO V DUCUSIN
JR., Chief, SDEU regarding the alleged illegal drug peddling/selling of SHABU of a
certain alias BOSS who is operating within Brgy. Gulod, Novaliches, Quezon City. At
about 5:00 PM of April 16, 2024, a test buy was conducted to verify the veracity of the
report that yielded positive result. At 6:00 PM on the same date the suspected shabu
from test buy was brought to forensic group for chemical examination. At about 7:00 PM
of April 16, 2024, while we were inside the SDEU Office when alias BUCHOY
contacted thru cellular phone call the male regular confidential informant and selling him
Shabu, the RCI told alias BOSS that his companion was the one who will buy Shabu.
Afterwards, alias BOSS bargain to sell shabu amounting to Five Hundred Pesos (Php
500) that we agreed upon and then alias BUTCHOY decided to meet our confidential
informant and his companion (poseur buyer) later designated as me, PCpl Salvatierra)
at about 9:00 PM of April 17, 2024, In front of No. 201 Nitang Ave., Brgy. Gulod,
Novaliches, Quezon City. Thereafter, PCPT BIENVENIDO V DUCUSIN JR. informed
PLTCOL NORBERT Z PRAGA, our Station Commander about the above report and
then he immediately hatched a plan and directed PCPT DUCUSIN JR., Chief SDEU to
form a team and conduct briefing for a possible conduct of a buy-bust operation;

3. That, PCPT BIENVENIDO V DUCUSIN JR formed a team and conducted a


briefing. Likewise instructed Pat Arriane Billy C Liwanag to contact and invite the
insulating witnesses to our Station for briefing and witness our will conduct anti-illegal
drug buy bust operation in front of No. 201 Nitang Ave., Brgy. Gulod, Novaliches,
Quezon City, and if succeeded witness the marking and inventory of the possible
recovered evidence. Afterwards, at about 4:30 PM of April 17, 2024, Pat Arriane Billy
C Liwanag contacted thru cellular phone the Barangay Gulod wherein Kagawad Dennis
R. Salcedo affirmed to our request. Afterwards, at about 4:35 PM contacted also the
Media Representative Christy Ngaloy of TV 5 Philippines;

4. That, considering the approval and presence of the Barangay Elected Official
and the Media Representative to attend as primary witnesses in the conduct of the
inventory proceedings if the operation will become successful, the presence of two (2)
primary witnesses is sufficient and already substantial compliance on the required
witness during physical inventory under Sec. 21 of R.A. 9165 as amended by R.A
10640;

5. That, PCPT BIENVENIDO V DUCUSIN JR designated Pat Arriane Billy C


Liwanag to coordinate to PDEA-RONCR, DDEU QCPD and DTOC HQ QCPD which
granted to operate with control number 1001-041724-2302, with a duration time of 3:00
PM of April 17, 2024 up to 3:00 PM of April 18, 2024;
6. That, PCPT BIENVENIDO V DUCUSIN JR tasked me (PCpl Mariel P
Salvatierra) to act as poseur buyer, while Pat John Christian A Ballarda as the
immediate back-up arresting officer while our colleagues stated in the coordination will
serve as perimeter back-up security. Likewise, PCPT BIENVENIDO V DUCUSIN JR
designated Pat Arriane Billy C Liwanag as the Photographer/Videographer.
Thereafter, at around 5:30 PM of April 17, 2024, PCPT BIENVENIDO V DUCUSIN JR
gave me (PCpl Salvatierra) money from the intelligence fund of our Station a One (1)
piece of Genuine Five Hundred Peso Bill (500) with serial No. BB950395 incorporated
with four (4) pieces of one thousand boodle money which I all marked as “JC” and I will
utilize as buy-bust money. The pre-arranged signal agreed upon was “Immediate call”
indicating that the deal was consummated;

7. That, after a short briefing at around 8:00 PM of April 17, 2024, the team
proceeded in front of No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City,
(target area) on board private vehicles. Upon arrival thereat at about 8:30 PM of April
17, 2024, we strategically parked our vehicles along Nitang Ave., Brgy. Gulod,
Novaliches, Quezon City. After few minutes waiting inside the vehicle, I (PCpl
Salvatierra) together with confidential informant secretly alighted from our vehicle and
cautiously walked towards the target place. While, Pat Ballarda also alighted our
vehicle and strategically followed us at a viewing distance of more or less 4 to 6 meters
and posed himself as bystander and the other operatives strategically positioned
themselves at a viewing distance more or less 8-10 meters away from us to monitor the
transactions;

8. That, I (PCpl Salvatierra) together with our RCI are on said area at around
8:40 PM of April 17, 2024, when we noticed one (1) male person (who was later known
as ARIEL REYES alias BOSS) both was standing in front of No. 201 Nitang Ave., Brgy.
Gulod, Novaliches, Quezon City, after which, our RCI whispered to me “SIR, YUN
PONG LALAKE NA NAKA KULAY BLACK T-SHIRT AT BLACK SHORTS PANTS
AY SI alias BUCHOY, ANG NAG BEBENTA SA AKIN NG ITEMS” items referring to a
shabu. That point I whispered to RCI “TARA LAPITAN NATIN SIYA”;

9. That, at around 8:50 PM of April 17, 2024, I (PCpl Salvatierra) together with
our RCI approached the said subject and he introduced me to suspect (alias BOSS) as
drug pusher who wants to buy SHABU so I asked alias BOSS, “BOSS YUNG ORDER
NAMIN NA HALAGANG 500” then he replied “OO, INIHANDA KO NA KANINA PERO
AKIN NA MUNA ANG BAYAD MO” during the sale, I gave the buy bust money, One
(1) piece of Genuine Five Hundred Peso Bill (500) with serial No. BB950395
incorporated with four (4) pieces of one thousand boodle money all marked as “JC” to
alias BOSS which he received by his right hand, he just take a quick look of it and then
he brought out a dark green coin purse using his left hand from the left front pocket of
his worn short pants and opened it using his right hand and then inserted therein the
buy-bust money. Immediately after, alias BOSS brought out using his right hand from
said pouch a one (1) piece heat-sealed sachet containing white crystalline substance,
suspected to be Shabu and he sold/gave to me (PCpl Salvatierra) which I received
using my left hand while alias BOSS told us “PANALO YAN”;

10. That, immediately thereafter, I (PCpl Salvatierra) immediate call as a


signal to my colleagues that deal was consummated and then Pat Ballarda rushed at
the scene;

11. That, I (PCpl Salvatierra) immediately apprehended suspect alias BOSS


and introduced ourselves as SDEU operative of PS-4 Novaliches Police Station. First, I
temporarily placed the sold item/evidence (which I later marked as ARL-MS 04-17-24
9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City with my
signature) Second, I instructed alias BOSS to empty the content of his dark green coin
purse, which he do so, he brought out using his right hand from the said pouch the buy
bust money One (1) piece of Genuine Five Hundred Peso Bill (500) with serial No.
BB950395 incorporated with four (4) pieces of one thousand boodle money all marked
as “JC” which I seized from his possession and control particularly while held on his
right hand. Third, alias BOSS brought out using his right hand from the said dark green
coin purse a four (4) pieces of heat-sealed transparent plastic sachets containing white
crystalline substance suspected to be Shabu (which later marked as ARL-JC 4-17-24
9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City, ARL-JC1 4-17-
24 9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City, ARL-JC2 4-
17-24 9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City and ARL-
JC3 4-17-24 9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City
with my signature) which I seized from his possession and control particularly on his
right hand and I temporarily placed it inside a large self-sealing plastic bag (which I later
marked as ARL-JC4 4-17-24 9:00 PM at No. 201 Nitang Ave., Brgy. Gulod, Novaliches,
Quezon City masking tape with my signature). Fourth, I seized the coin purse colored
dark green from his possession and control particularly while held on her left hand
(which I later marked as’ ARL-JC6 4-17-24 9:00 PM at No. 201 Nitang Ave., Brgy.
Gulod, Novaliches, Quezon City with my signature). Fifth, I instructed alias BOSS to
empty the pockets of his worn short pants, which he do so, he brought out using his
right hand from the right front pocket of his worn short pants his One (1) unit of OPPO
cellular phone colored black (which I later marked as ARL-JC56 4-17-24 9:00 PM at No.
201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City masking tape with my
signature). Thereafter, I informed suspect alias BOSS of his constitutional rights in
“TAGALOG” dialect, a language known to and understood by him as well as the nature
and cause of his apprehension under R.A. 9165 but he opted to remain silent in the
absence of his chosen counsel;

12. That, I (PCpl Salvatierra) recovered piece of evidence are all in my


custody during the time of arrest of the suspect and I did not transfer it to anybody;

13. That, immediately after the buy-bust operation at about 9:02 PM of April
17, 2024, Pat Liwanag contacted again thru cellular phone the insulating witnesses. At
the same time, I (PCpl Salvatierra) am preparing the materials for the conduct
weighing, marking and inventory of the sold/seized items when the mandatory
witnesses arrived at the scene within a minute after the call;

14. That, at about 9:10 PM of April 17, 2024, I (PCpl Salvatierra) weigh my
sold drug evidence, one (1) piece of heat-sealed transparent plastic sachet containing
white crystalline substance, suspected to be Shabu which resulted to 4.68 grams and
then I marked it as ARL-MS 4-17-24 on a masking tape with my signature. Second, Pat
Ballarda marked seized drug evidence, the four (4) pieces of heat-sealed transparent
plastic sachets containing white crystalline substance, suspected to be Shabu which
resulted to 24.77 grams and marked it as’ ARL-JC 4-17-24, ARL-JC1 4-17-24, ARL-
JC2 4-17-24 and ARL-JC3 4-17-24 with my signature; One (1) piece coin purse colored
dark green as’ ARL-JC4 4-17-24 on masking tape with my signature; One (1) unit of
OPPO cellular phone colored black ARL-JC5 4-17-24 on masking tape with my
signature. Immediately after, at about 9:15 PM of same date, I (PCpl Salvatierra)
together with Pat Ballarda conducted inventory of the sold/seized/ items/evidence and
buy bust money. Both marking and inventory of evidence were made were in front of
No. 201 Nitang Ave., Brgy. Gulod, Novaliches, Quezon City, wherein the items/evidence
and buy bust money were sold/seized and place of arrest, in front of suspect alias
BOSS and were duly witnessed by Kagawad Dennis R Salcedo of Brgy. Gulod,
Novaliches, Quezon City and Media Representative Christy Ngaloy of TV5 to justify
the compliance of Sec. 5 and Sec. 11 of R.A. 9165. At the same time, Pat Ariane Billy
C Liwanag took photographs while conduct of marking and inventory. Then, to preserve
the integrity and to prove that it was the sold/seized illegal drugs during the drug
transaction, I did not transfer it to anybody;
15. That, the written Inventory of Property Seized was signed by the above
name witnesses and suspect. After which they were given each of their respective
copies;

16. That, we proceeded to our Police Station together with the suspect and
upon arrival I (PCpl Salvatierra) turned over my said sold/seized drug evidence placed
in my said self-sealing plastic bags, while presented only the non-drug evidence to the
duty investigator PSSg Jaymar A Sierra at about 10:00 PM of April 17, 2024 for
investigation and documentation. At the station when asked, the suspect identified
himself as: ARIEL REYES alias BOSS, (Sec. 5&11) 22 years old DOB January 15,
2002, male, single, jobless, native of and residing at No. 34 Villegas St., Brgy. Bungad
Quezon City; (under custody)

17. That, after investigation and documentation, we accompanied PSSg


Sierra as he brought my (PCpl Salvatierra) recovered sold/seized items/evidence of
alleged/suspected to be shabu and arrested suspect to the QCPD Forensic Group for
qualitative and quantitative examination and drug test examination. The recovered
suspected illegal drugs were turned over by PSSG Sierra to PMAJ JOSHUA L
NATIVIDAD at around 12:00 MN of April 18, 2024. As a result, thereof, Laboratory
examination/analysis yielded POSITIVE results to the test for Methamphetamine
Hydrochloride, a dangerous drug under R.A. 9165 per Chemistry Report No. D-214-
2024 QCPDFG. The urine sample of the suspect alias BOSS gave NEGATIVE results
to the presence of Methamphetamine and THC-metabolites, both are dangerous drug
under R.A. 9165 per Chemistry Report No. DT-373-2024 QCPDFG;

18. That, after process at the QCPD Forensic Group, I (PCpl Salvatierra)
together with Pat Ballarda brought the suspect to QCGH for physical examination;

19. That, I executed this affidavit of arrest, voluntarily with full understanding
of its contents to attest the veracity of the above-mentioned facts and to support my
charges for Violation of Sec. 5 (Sale of Dangerous Drugs) and Sec. 11 (Possession of
Dangerous Drugs) of Art II, of R.A. 9165 against the suspect ARIEL REYES alias
BOSS;

20. That, anything not mention in this affidavit will be narrated during proper
trial;

21. That, to attest to the truth of the foregoing, I hereunto affixed my signature
