AFFIDAVIT OF ARRESTING OFFICER

I, POLICE STAFF SARGEANT RICKY L CALUBID, of legal age, Filipino, married, and
a bona fide member of the Philippine National Police (PNP), after having been sworn to
in accordance with the law, hereby depose and say THAT:

1. I am presently assigned with the Station Drug Enforcement Unit (SDEU) of


Police Station 3 (PS3), Tacloban City Police Office (TCPO), Tacloban City led by PLT
ANGELO LEO S SILVESTRECE that conducted a BUY-BUST OPERATION at about
08:04 in the Evening last June 6, 2022, at Barangay 106 Sto. Niňo, Against ALLAN
AROMIN y' Arigola, 29 years old, male, with live-in Partner, DOB: August 17 1992,
POB: Sta. Rosa Nueva Ecija, High School level, tricycle driver, and a resident of Block 3
Lot 17, St Francis Village Phase 2, Barangay 105 Suhi San Isidro Tacloban City, and a
Street Level Individual (SLI), which resulted to his apprehension for illegal sell and
possession of dangerous drugs;

2. Three (3) weeks ago, we received information from a Confidential


Informant (CI) that a certain “JUN”, a Street Level Individual (SLI) is actively
engaged of selling and distributing suspected “SHABU” at Block 3 Lot 17, St Francis
Village Phase 2, Barangay 105 Suhi San Isidro Tacloban City, and its neighbouring
places this City. The CI also averred that, three (3) days before he disclosed the said
information to us, he was able to buy from alias “JUN” a sachet of shabu. In view
thereof, PLT ANGELO LEO S SILVESTRECE, our team leader, tasked the SDEU and SIU
operatives to validate the said information. After conduct of discreet casing and series
of surveillance and thru the aid of the CI and also based on our Barangay Information
Network (BIN) it was discovered that he is positively engaged in the proliferation of
illegal drugs particularly “shabu”;

3. Earning strong evidence, on 7:30 in the Evening June 6, 2022, an immediate


BRIEFING was conducted inside our office in the presence of the CI and operatives as
presided by our Team Leader (PLT SILVESTRECE). I was been designated by our TL as
the APPREHENDING OFFICER (AO), if the circumstances would warrant. he
designated also POLICE STAFF SERGEANT HERNAN BRENT F ESELLER as the
POSEUR-BUYER/SEIZING OFFICER/ EVIDENCE CUSTODIAN, PAT LEWARD BALLAIS as
the PHOTOGRAPHER; and PATROLWOMAN MONALISA M CHUA and PATROLMAN
RONEL H CAHAGNA-AN was assigned as videographers using the Body-worn
cameras while the rest of the operatives were designated as back-up/perimeter
security. One (1) piece genuine Five-Hundred Peso Bill (Php 500.00) bearing Serial
Number (SN) N714105 was given to the PB (PSSG ESELLER) by our TL to be used as
the buy-bust money. Our TL set an agreed pre-arranged signal for the PB (PSSG
ESELLER) by taking off his worn Facemask to indicate that the transaction was already
consummated;

4. Afterwards PATROLMAN SIDNEY JASPER E WENDAM, initiated in


coordinating with the Philippine Drug Enforcement Agency (PDEA R8). While, our TL
contacted Councilor Renier Reas an ELECTED PUBLIC OFFICIAL and Mr. Lito Bagunas a
MEDIA representative, for them to join our planned buy-bust operation and for them to
serve as mandatory witnesses. Then, our team jumped-off as we boarded two (2)
separate private unmarked vehicles. Situated several meters away before reaching the
agreed transaction area, PB (PSSG ESELLER) and our CI alighted from our vehicle and
walked casually towards the agreed area. On the other hand, I and other member of
the Operating team and above-mentioned mandatory witnesses remained inside the
car. We parked our vehicle strategically positioned near the supposed place at a safe
distance where we could covertly observe the transaction;

5. on 08:04 in the Evening of June 6, 2022 I saw our PB (PSSG ESELLER) and CI
approached the target person (suspect) on-board his motor-cycle for hire. They had a
conversation and moments thereafter our PB executed the agreed pre-arranged signal
by taking off his worn facemask, prompting me to alight from our vehicle. Moreover,
the rest of the team rushed also towards the suspect. I apprehended then handcuffed
the suspect. Simultaneously, I introduced myself as a police officer and subsequently
informing him nature and cause of the apprehension and constitutional rights provided
under the law in a dialect known and understood by him. While PAT CAHAGNA-AN
informed the suspect that the arrest was being recorded through the use of body-worn
cameras in faithful compliance to AM. No. 21-06-08-SC or the Rules on the Use of Body-
Worn Cameras, in the Execution of Warrants. Said arrest was made in the presence of
the witnesses, Councilor Renier Reas an ELECTED PULIC OFFICIAL and Mr. Lito
Bagunas a MEDIA representative;

6. When the suspect was already neutralized and handcuffed, PSSG ESELLER
(PB) laid the purchased One (1) heat-sealed transparent sachet containing white
crystalline substance suspected “SHABU” (Subject of Sale) and marked the subject of
sale with HBFE with date, time, place of operation and affixed his signature where the
evidence was seized, still in the presence of the above-mentioned witnesses;

7. Afterwards, still in the presence of the above-mentioned witnesses, PSSG


ESELLER conducted body search on the suspect and he was able to recover from her
possession and control the following, to wit: (a) one (1) piece Five Hundred Pesos Bill
(Php 500.00) Buy-Bust money with Serial Number: N714105 placed inside his Right
side pocket of his worn Grey color short-pants; (b) Four (4) heat-sealed transparent
sachet containing white crystalline substance suspected “SHABU” (Subject of
possession) placed in a transparent cellophane, recovered from his right pocket of his
worn Grey color short-pants marked as HBFE-1, HBFE-2, HBFE-3, and HBFE-4, with
respective date, time, and place of operation and affixed signature. Also the driven
motor cycle for hire by the suspect describe as One (1) Unit SKYGO color black with
side-car (keyless), unregister and without plate number was marked also as HBFE-5
with respective date, time, and place of operation and affixed signature;

8. Subsequently, an ON-SITE INVENTORY was conducted in accordance with the


provision of section 21 of RA 9165, as amended by RA 10640 in the presence of the
SUSPECT, the ELECTED PUBLIC OFFICIAL, Barangay Councilor Renier Reas (Barangay
18, Gomez Sto Niňo Street Tacloban City) and MEDIA representative, Mr Lito Bagunas
(radio man DYMS).

9. All confiscated pieces of evidence were photographed by PAT BALLAIS


designated photographer and were properly inventoried and entered into the certificate
of Inventory prepared and signed by our PB (PSSG ESELLER) and were likewise signed
by the above-mentioned witnesses. Meanwhile, the suspect refused to sign the said
documents;

10. After the inventory was conducted, PSSG ESELLER (PB) kept the suspected
ILLEGAL DRUGS and Buy-bust money in to self-sealed transparent cellophane
(commonly known as zip-lock) then, brought the same all safe and secured. While, I,
(AO) escorted the suspect until we reached our office and temporarily detained him at
our custodial facility while he waits to be scheduled to undergo medical/physical
examination;
11. Then, PSSG ESELLER (PB) turned-over the purchased and confiscated
suspected illegal drugs to our Investigator On-Case, Pat. Jake Cillo Casillar, in
preparation for the complaint and subsequent submission to PNP Regional Forensic Unit
8 (RFU8) for chemical examination (Attached Chain of Custody Form);

12. Together, with Pat Chua (PB), we accompanied the investigator On-Case to
Camp Ruperto Kangleon, Palo Leyte, to turn over all seized exhibits that were submitted
to PNP RFU8 for chemical analysis and examination duly received by PMAJ VIVIENE
MAE S DEL PILAR-MALIBAGO, R. Ch (Forensic Chemist). Said seized suspected
“SHABU” yielded POSITIVE result for the presence of methamphetamine hydrochloride
(Dangerous Drug) as reflected in Chemistry Report No. D-74-22-RFU8.

13. The acts committed by the suspect ALLAN ARIGOLA AROMIN @Jun
would constitute to the crime for violations of section 5, and 11, Article II of RA 9165;

14. I am executing on this affidavit to attest to the truth of the foregoing facts.
