DEED OF GIFT

THIS DEED OF GIFT is made at Mumbai

on this ____day of , 2015 between Mrs.

BHARTI MUGATLAL VORA an adult Indian

Inhabitant, residing at Flat No. 7/43, Sagar

Darshan Co-operative housing society ltd

(Building known as Sagar Tarag) , Plot no

689,81/83 Bhulabhai Desai road, Mumbai-

400 036 hereinafter referred to as ‘the

Donor’ the Party of the One Part and 1) Mr.

adult aged-------- Indian Inhabitant,

residing at referred to as “the Donee”,

Party of the Other part.


WHEREAS-

1. The Donor is the absolute Owner

and is in possession of flat No.1G,

admeasuring of 223 sq ft. on 1ST

floor of the building known as

Navratna Co-Operative Housing

Society Limited, CS NO : 1351, Dr

D.D Sathe Marg, Prathana Samaj,

Girgaon, Mumbai-400004.

(hereinafter for brevity's sake

referred to as "the said flat")

2. The Donor is absolute owner of

aforestated flat and holding Shares

No.16 to 20 of Rs 50 each under

share Certificate No.4 dated 1/11/95

of the Navratna Co-operative

Housing Society Limited, Reg No.

Bom/W-D/HSG/TC/4087/89-

90/1989 OF 5-10-89 (hereinafter for

brevity sake referred to as said


shares of said society) respective

undivided of the Doner.

3. The Donor desires to relinquish her

rights, title, and interest in the said

flat by transferring and conveying all

her rights, title and interest in the

said flat and aforesaid share of said

society, together with the permanent

right to use, occupation and

possession of the said flat, to the

Donee jointly of equals shares as gift

in consideration of natural love and

affection as hereinafter mentioned.

4. The Donee is blood brother of the

Donor, Donee of the Donor.

5. The Donee have agreed to accept the

gift as is evidenced by execution of

these presents.
NOW THIS DEED

WITNESSETH that the Donor,

without any monetary consideration

and in and out of natural love and

affection for the Donee which the

Donor bears to the Donee doth

hereby grant and transfer by way of

gift all right title and interest in the

said flat, described in at schedule

hereunder and the said shares of

said society, with all the things

permanently attached thereto or

standing thereon with all the benefits

liberties, privileges easements and

advantages Claims, demands

amenities, appurtenant thereto And

all the estate, right title, interest use,

inheritance, possession, benefit,

claims and demand whatsoever of

the Donor To Have And To Hold the


same unto and to the use of the

Donee as equal shares and joint

holders absolutely but subject to the

future payment of all taxes, rates,

assessments, dues and duties now

and hereafter chargeable thereon to

the Government or Municipality or

other Local Authority or any other

competent body under statutes and

payment of stamp duty and

registration charges on these

execution.

AND the Donor doth hereby

covenants with the Donee:

(A) That the Donor now has in

herself, good right, full power

and absolute authority to grant

the said flat and said shares of


said society hereby granted as

gift in the manner aforesaid.

(B) The Donee may at all times

jointly here after peaceably and

quietly enter upon and occupy,

possess and enjoy the said Flat

and said shares of said society

and receive the rents, and

profits thereof and every part

thereof to and for their own use

and benefit without any suit,

lawful eviction, interruption,

claim or demand whatsoever

from or by the Donor or her

heirs, executors, administrators

and assigns or any person or

persons lawfully claiming or to

claim by, from, under or in trust

for the Donor.


(C) That the title of Donor in said flat

is free and clear and freely and

clearly and absolutely and forever

released and discharged or

otherwise by the Donor which is

well and sufficiently saved, kept

harmless and indemnified of and

from and against all former and

other estate, titles, charges and

encumbrances whatsoever, had

made, executed, occasioned or

suffered by the Donor or by any

other person or persons lawfully

claiming or to claim by, from,

under or in trust for the Donor.

(D) AND FURTHER that the Donor

and all persons having or lawfully

claiming any estate or interest


whatsoever to the said flat or any

part thereof from under or in

trust for the Donor or her heirs,

executors, administrators and

assigns or any of them shall and

will from time to time and at all

times hereafter at the request and

cost of the Donee do and execute

or cause to be done and executed

all such further and other acts,

deeds, things, conveyances and

assurances in law whatsoever for

better and more perfectly

assuring the said title in said flat

and said shares, and every part

thereof unto and to the use of the

Donee in the manner aforesaid as

by the Donee, their heirs,

executors, administrators and


assigns or counsel in law shall be

reasonably required.

IN WITNESS WHEREOF the Donor

as well as the Donee (by way of

acceptance of the said gift) have put

their respective hands the day and

year first hereinabove written.
