Series 2024
WHEREAS, Sec. 50 of RA 7160 otherwise known as the Local Government Code of 1991,
provides that;
“on the first regular session following the election of its members and within ninety (90) day
thereafter, the Sangguniang concerned shall adopt or update its existing rules or procedures’’.
WHEREAS, such rules or procedures shall provide for the organization of the Sangguniang
and the election of its officers to different committees; the order and calendar of business, the
legislative process, the parliamentary procedures, and the discipline of members for disorderly
behavior and absences; and other matters as the Sangguniang may adopt;
WHEREAS, pursuant to DILG-DBM Joint Circular No. 90-01 dated February 14, 1990 the
Barangay Council by majority vote, may determine the grounds causes for forfeiture of the
benefits such as the honorarium, for non-attendance in regular sessions/meetings and other
officially approved activities of the barangay council;
SECTION 2. COMMITTEES. At the first regular session of the new barangay council the
Punong Barangay shall appoint the Chairmen and members of the standing committees with
the concurrence of majority of the members of the barangay council, there shall be following
standing committees in the barangay council:
SECTION 3. Every standing committee shall be chaired by a barangay kagawad, who shall
be assisted by two other members from the Sangguniang Barangay. Each barangay kagawad
shall chair at least one committee. The SK Chairman shall automatically be the chairman of the
Committee on Youth and Sports Development.
SECTION 4. The purpose for which the committees are created is to assist the barangay
captain in the performance of his duties and responsibilities, and the evolvement of a sound
legislative measures, as well as in the exercise of the general and corporate powers of the
barangay.
SECTION 1. The barangay captain shall preside over all meetings of the Sangguniang
Barangay Assembly. In this absence or inability, the Kagawad who obtained the highest number
of votes will take over as the presiding officer. In case that latter presiding officer is also
absent, then the next kagawad who obtained the next highest number of votes shall preside.
The order herein stated shall likewise apply when the presiding officer relinquishes the chair
temporarily with intent to participate actively on matter pending deliberations by the body.
SECTION 2. The barangay captain shall have the following duties as presiding officer aside
from his/her other duties prescribed in the Local Government Code.
a. to preserve order, the decorum during all meetings. In case of disturbance or disorderly
conduct in the meeting place or within its immediate premises, he/she shall take
measures as he/she may deem necessary and reasonable or as the Sangguniang
Barangay may direct.
b. to decide all questions of order, subject to appeal to the Sangguniang Barangay.
c. to observe the fundamental principles of parliamentary rules in conducting Sangguniang
Barangay session, such as; that members have equal rights and duties, that majority
rules; that the minority must be protected; the singularity or subject matter is the order
of business; the full and free debate must be allowed; that group interest must prevail
over personal interest; and that he/ must she be impartial.
d. to sign all barangay ordinances, resolution and other acts of the Sangguniang.
e. to exrcise such other powers and perform such other duties as the Sangguniang may
prescribe.
SECTION 1. The barangay captain shall appoint the barangay secretary accordance with
Section 394, RA 7160, otherwise known as the Local Government Code of 1991.
SECTION 2. The barangay secretary shall have the following duties aside from his/her
duties and responsibilities prescribed in the Local Government Code;
a. to send notices of meeting/session to all Kagawad
b. to call the roll before the opening of every meeting
c. to maintain a record of attendance or absences per session of the Sangguniang
d. to submit certified list of absences per month to the Barangay Treasurer for the purpose
of affecting appropriate forfeiture of honorarium.
e. to collect and consolidate the monthly accomplishment reports of all Committee
Chairmen and furnish original copy thereto the City DILG Office.
f. to attest to the minutes of every meeting of the Sangguniang and all resolutions nd
ordinances, the barangay secretary shall furnish the Sangguniang Panlungsod of
Tacloban City copies of said ordinance for the purpose or review.
g. to effect the turn-over of records to the incoming Barangay Secretary, after his/her term
ends.
h. to furnish copies of Barangay Annual Budget and Barangay Development Plans City
DILG.
i. to exercise such other duties as may be assigned to him by the Sangguniang or the
presiding officer.
SECTION 1. The barangay captain shall appoint barangay treasurer in Accordance with
Section 395, RA 7160, otherwise known as the Local Government Code of 1991.
SECTION 2. The Barangay Treasurer shall exercise the following duties and functions aside
from those prescribed in the Local Government Code:
a. to submit quarterly the financial status of funds copy furnished the City Mayor, CLGOO,
City Accountant, City Treasurer and City Auditor.
b. to enforce the forfeiture of honorarium of barangay officials in accordance with these
rules.
c. to furnish copies of payrolls duly acknowledged by concerned payees to City DILG.
d. to effect the turn-over of records, funds, and properties to the in-coming barangay
treasurer, after his/her term ends.
e. to exercise such other powers and perform such other duties as the Barangay Captain or
Sangguniang may direct.
RULE V: MEETING
SECTION 1. Sangguniang Baranggay shall meet regularly on the First and Third Monday of
the month.
SECTION 2. Special meetings shall be called by the barangay captain or any Sangguniang
members by giving written notice to all members of the date, time, place and agenda of the
meeting at least one (1) day before said special meeting.
SECTION 3. The assembly shall meet at least twice a year to hear and discuss a semestral
report of the Sangguniang Barangay concerning its activities and finances as well as problems
affecting the barangay. The meeting shall be held upon call of at least (4) members of the
Sangguniang Barangay, or upon written petition of at least five percent (5%) of the assembly
members.
SECTION 4. No meeting of the barangay assembly shall take place unless a written notice
is given one (1) week prior to the meeting except on matters involving public safety or security,
in which case notice within a reasonable time shall be sufficient.
SECTION 5. All meetings shall be open to the public unless a closed door meeting or
ordered by an affirmative vote, of a majority of the members present, there being a quorum,
for reasons of security, decency, or morality, or public interest requires it.
SECTION 1. A simple majority of the members of the Sangguniang Barangay who have
been elected and qualified shall constitute a quorum to transact official’s business of the
Sangguniang including the Punong Barangay.
SECTION 2. In the absence of quorum, the Punong Barangay od the presiding officer may
declare a recess of not more than one (1) hour and wait for other members to come; or the
members present may adjourn from time to time or day and may compel the immediate
attendance of any member absent without justifiable cause by designating a member of the
Sangguniang, to be assisted by a member of the Barangay Tanod, to arrest the absent member
and present him at the meeting hall. If there is still no quorum despite the enforcement of the
above remedial measures, the Presiding Officer may proportion or proper motion from the floor
duly adopted by the body, then declare the session adjourned for lack of quorum.
SECTION 7. The member shall be in decent attire when attending the meeting of the
Sangguniang. They shall observe proper decorum in the meeting place and shall not leave the
place without first obtaining the permission of the Presiding Officer.
RULE VII: SANCTIONS
SECTION 1. Failure to attend meetings. Any member of the Sangguniang Barangay who
fails to attend any regular meeting or duly called special meeting shall forfeit his honorarium for
the month at the following rate:
SECTION 4. The Punong Barangay who incurs an unauthorized leave of absence shall
forfeit his honorarium during said absence, and his honorarium shall accrue to the Sangguniang
Kagawad who exercises the powers and performs the duties and responsibilities of an Acting
Captain, provided that requirements are duly complied with, per opinion No. 66, dated April 13,
1994 of DILG Acting Secretary Alexander Aguirre.
SECTION 6. Any amount in accordance with these rules shall accrue as savings of the
barangay and shall form part of the general fund of the barangay.
These rules of procedure shall not be amended except upon approval of two-thirds (2/3)
votes of all the members of the Sangguniang Barangay. Provided, said amendments shall not
be contrary to law, public order or public policy.
RULE IX: EFFECTIVITY
These rules shall take effect immediately upon its approval and adoption APPROVED:
