Ufone WhatsApp Terms and Conditions

Disclaimer: Ufone WhatsApp Helpline Service, (as defined below and as amended
from time to time) are applicable to the Ufone customers that avail this Service
provided thereon by Ufone on the WhatsApp platform and by using Service you agree
to be bound by these T&Cs and related services (excluding any services for which you
have a separate agreement with us).

Terms and Conditions (T&Cs):

o Ufone WhatsApp Helpline Service (“WhatsApp Service”) means service, either


customized or otherwise, provided by Ufone, its partner(s), services
provider(s), and/or Ufone on or through Ufone WhatsApp platform, from time
to time, within Pakistan, Azad Jammu & Kashmir and Gilgit Baltistan
(“Territory”).
o The Service mode of user facilitation is available for all Ufone Prepaid and
Postpaid customers who have independently subscribed to use WhatsApp
Service.
o There are no subscription charges for the WhatsApp Service mode; however,
default internet usage charges will apply for using WhatsApp Service.
o This WhatsApp Service is a limited time user facilitation mode and is intended
for use on as is basis.
o It is advised to review this page periodically for any changes in terms and
conditions or important notifications. These terms and changes are effective
immediately after they are posted on this page.
o If you have any questions or suggestions, do not hesitate to write us at

o In case of subscribing multiple packages and offers, each subscription will have
its own charging priority. You are requested to call 333 or email us
at [email protected] for details about the charging preference of your
intended/subscribed offer.
o We do not endorse any third-party services. Third-party providers of websites
and applications (including Ufone WhatsApp platform) accessed by you through
the Service are accessed at your own risk, and we have no liability for third
party services. If third party websites or applications (including Ufone
WhatsApp Platform) cause any problems or harm, you should seek redress
directly from the third-party provider of those services. We have no
responsibility in such matters and cannot assist. Third-party providers of
websites or applications (including Ufone WhatsApp platform) that you access
through your Ufone network/ mobile phone number may have their own terms
and conditions. It is your responsibility to read and adhere to such terms and
conditions.
o You agree that Ufone shall not be liable if (a) you have breached any of the
terms and conditions, contained herein or (b) there has been an unauthorized
transaction/instruction provided through Ufone WhatsApp platform as a result
of any person having control or custody of telecommunications instrument
(such as the mobile handset) so that such instrument may be used to give
telecommunications instruction without authorization or any other
issue/error/technological problem in the telecommunication instrument (such
as the mobile handset) or duplication of mobile number / SIM of the customer
such as but not limited to SIM card cloning, virus in handset etc.
o Advertising: From time-to-time Ufone may advertise its own products and
services, and those of its associated companies of Ufone, through Ufone
WhatsApp Services. Ufone may send the customer advertising material in
respect of the said products and services and other associated companies of
Ufone from time to time.
o Privacy and Personal Data: In connection with the provision of WhatsApp
Service, Ufone will collect and process personal data about you and your use of
WhatsApp Service. You understand that by opting to use WhatsApp Services you
consent to the collection, use and disclosure of your Personally Identifiable
Information (PII) and aggregated data. By using WhatsApp Service, you agree
that Ufone can use your personal data in accordance with our Privacy Policy
and as otherwise set out in any applicable service specific terms for inter alia
for provision and analyzing service performance of WhatsApp Service.
o Warranties and Disclaimers: Ufone warrants that it will perform its obligations
in a professional manner in accordance with prevailing industry standards and
make reasonable efforts to keep the required service operational. However,
WhatsApp Service is provided on “as is” basis. You acknowledge that WhatsApp
Service is not error-free. Ufone makes no warranties, expressed or implied,
with respect to the availability, merchantability, fitness for a particular
purpose, non- infringement, accuracy, completeness, performance and quality
of service of Ufone WhatsApp platform or otherwise.
o Liability: Ufone (including, but not limited to, its shareholders, executives,
officers, affiliated companies, partners and their contractors, officers,
directors and employees) shall not be liable for any damages, whether arising
under law, contract, warranty, indemnification, tort or otherwise, including,
without limitation, incidental and consequential damages, loss of profits or
business opportunities, or damages resulting from loss of data or loss of access
to the WhatsApp Service or otherwise.
o Indemnity: (a) You agree to indemnify, defend and hold harmless Ufone
(including, but not limited to, its shareholders, executives, officers, affiliated
companies, partners and their contractors, officers, directors and employees)
from all claims, liabilities and expenses (including attorney’s fees) that arise
from your misuse of WhatsApp Service in breach of these T&Cs or applicable
laws and (b) Ufone reserves the right to assume the exclusive defense and
control of any matter otherwise subject to indemnification by you. You shall
cooperate in good faith with Ufone in asserting any available defenses.
o Proprietary Rights: The customer acknowledges that the software/ other
internet related software which are required for providing WhatsApp Service or
any Intellectual Property Rights (“IPRs) of Ufone in the process are the legal
property of Ufone/ respective service providers. The permission given by Ufone
to avail of WhatsApp Service to the customer shall/ does not create or convey
any rights, title or interest to the customer or to any person, in the above
software or IPRs of Ufone. The customer agrees that he shall not attempt to
modify, translate, disassemble, decompile or reverse engineer such software or
create any derivative product based on the software.
o Force majeure: Force Majeure means any circumstances beyond the reasonable
control of either party, including, without limitation, fire, explosion, strikes or
other labor disputes, riots or other civil disturbances, voluntary or involuntary
compliance with any law, order regulation, recommendation or request of any
governmental authority, and errors or downtime in networks, power supply,
gateway or similar failures of communication. Neither Ufone nor you will have
any liability, other than for the payment of money owing, for their failure to
perform any of their contractual obligations arising out of or in connection with
events of force majeure.
o Termination: (a) You may stop using WhatsApp Service by deactivation of your
account at Ufone WhatsApp platform. You may do so by updating the settings
on your personal account on Ufone WhatsApp platform. (b) Ufone may also stop
providing WhatsApp Service to you, or add limits to your service, if you act in
breach of these T&Cs or applicable laws, your right to use WhatsApp Service
and access its content will in any event immediately, without notice, terminate
without refund of any fees.
o Partial Invalidity: If any provision of the Terms and Conditions is declared
invalid or unenforceable by a court or other binding authority, the remaining
terms (or parts), conditions and provisions shall continue to be valid and
enforceable to the fullest extent permitted by law.
o Language versions: Any translations of these T&Cs from English into another
language are made solely for your convenience. In the event of discrepancies
between different language versions, the English version shall prevail.
o Governing Law & Dispute Resolution: These T&Cs shall be governed by and
interpreted in accordance with the laws of the Islamic Republic of Pakistan.
Any dispute, controversy or claim arising out of or in connection with these
T&Cs shall be subject to the jurisdiction of the courts at Islamabad as the legal
venue.
o Binding Contract: These T&Cs form a contract between you and Ufone.
