JAZZ WHATSAPP SELF-SERVICE - TERMS & CONDITIONS

By using Jazz WhatsApp Channel as defined below, you agree to receive notification/information messages
from Jazz over WhatsApp regarding your account, bill payments / balance recharge subscription to Jazz
products and value-added services. You further hereby agree to these Terms of Use, Authorization, General
Terms and any Service Specific Terms (collectively referred to as the “terms”). Please read them carefully.
These terms govern your access to and use of the Jazz WhatsApp Channel, services and any information sent,
received, stored or otherwise appearing on the application developed by Jazz including its services. The
information collected by Jazz is related to the use of the Jazz WhatsApp Channel specifically, and is controlled
by Jazz. In case of conflict between these terms and the terms stated in the Terms of Use or Privacy
Statement, these terms will take precedence.

Service

Service(s) means the services, whether customized or not, provided by Jazz or its Partner(s), services
provider(s), and/or Jazz on or through the Jazz WhatsApp Channel within the Territory of Pakistan,Gilgit
Baltistan and Azad Jammu and Kashmir (referred to as the “Territory”).

Privacy Notice

When you use the Jazz WhatsApp Channel, we require your personal information to provide our services.
You are responsible for providing and maintaining accurate and updated personal information, as well as
safeguarding your account information. By using the Jazz WhatsApp Channel, you authorize us to share your
personal information with Jazz and its sub-contractors to verify and authenticate your account at any time.

We want to remind you that it's important to keep your account information safe. Please don't share your
login credentials with anyone else. If you hand over a device with the Jazz WhatsApp Channel installed to
another individual, you should lock or deactivate the device before doing so. If a device with the Jazz
WhatsApp Channel installed is lost or stolen, please inform the relevant authority.

through your Jazz’ network or mobile phone number may have their own terms and conditions. It is your

Entire Agreement

These Terms & Conditions form the entire agreement between us and you regarding the use of Jazz
WhatsApp Channel and related services (excluding any services for which you have a separate agreement
with us).

GENERAL TERMS

General

These General Terms apply to the use of any or all of Jazz’s services via/through Jazz WhatsApp Channel
(referred to as the “Service”). Please note that our Service is diverse, so additional Service Specific Terms
may apply.

Jazz may engage or cooperate with affiliates, suppliers, partners and other third parties in connection with
the Service.Therefore, where applicable, the references to “PMCL”, “Jazz” or “we” shall also include such third
parties.

Jazz Service

Jazz services comprises digital products and/or services distributed over the iinternet for private use by
individual consumers. These Services are accessible on our websites and, for certain Services, on your own
device(s) after you have installed them.

Some parts of the Service may display content that is not provided by Jazz (including User Content). Such
content is the sole responsibility of the person or entity that has made it available.

Privacy and Personal Data

To provide you with the Service, Jazz will need to collect and process personal data about you and your use
of the Service. Jazz's Customer Privacy Policy, which may be updated periodically, is available below on this
page. By using the Service, you consent to the collection, use, and disclosure of your Personally Identifiable
Information (PII) and aggregated data as outlined in Jazz's Customer Privacy Policy, available at
https://jazz.com.pk/help/customer-privacy-policy. By using the Service, you acknowledge and agree that Jazz
may use your personal data in accordance with our Privacy Statement and as further described in any
applicable Service Specific Terms. Additionally, you permit Jazz to share your personal information with our
service providers to offer customized promotions and other material directly to you. Jazz will retain customer
data on its servers for a period of two months, after which it will be discarded in accordance with our policy
and will not be accessible.

User Content and Submissions

You may have the ability to submit, post or display content (including information, data, text, software, music,
sound, photographs, graphics, videos, advertisements, messages or other materials) through Jazz’s services
and/or Jazz WhatsApp Channel (collectively referred to as “User Content”). You are solely responsible for
such content. Please note that Jazz’s network/ mobile phone number acts as a mere conduit and we have no
obligation to screen or monitor User Content but may remove any User Content that, in our sole judgment,
violates the terms, applicable laws, or generally accepted practices or guidelines in the Jurisdiction.

Under the terms, the following types of User Content are prohibited:

• Offensive content that engages in, endorses or promotes racism, bigotry, discrimination, hatred,
harassment or physical harm of any kind against any group or individual
• The transmission of “junk mail”, “chain letters” or unsolicited mass mailing, “spamming” or “phishing”
• Promotion or endorsement of false or misleading information or illegal activities or conduct that is
abusive, threatening, obscene, defamatory or libelous
• Promotion or endorsement of an illegal or unauthorized copy of another person’s copyrighted work
• Content containing restricted or password-only access pages or hidden pages or images
• Display or links to pornographic, sexually explicit or any other indecent material
• Soliciting passwords or personal data from other users
• Violating the rights of or harming or threatening the safety of other users or the Service

Warranties and Disclaimers

Jazz warrants that it will perform its obligations under these terms in a professional manner, in accordance
with industry standards, and will make reasonable efforts to keep the Service operational.

However, the Service is provided on an “as is” basis and Jazz makes no warranties, expressed or implied, with
respect to its availability, merchantability, fitness for a particular purpose, non-infringement, accuracy,
completeness, performance or quality. You acknowledge that service may contain errors and that Jazz does
not guarantee its uninterrupted or error-free operation.

Liability

Jazz, including its shareholders, executives, officers, affiliated companies, partners and their contractors,
officers, directors and employees will not be liable for any expenses, claims, losses and/or damages, whether
arising under law, contract, warranty, indemnification, tort or otherwise, including incidental and
consequential damages, loss of profits or business opportunities, or damages resulting from loss of data or
loss of access to the Service, even if Jazz has been advised of the possibility of such damages, This limitation
of liability applies regardless of the form of action, whether in contract, tort or otherwise.

Indemnity

You agree to indemnify, defend and hold Jazz harmless from any claims, liabilities and expenses (including
attorney’s fees) that arise from your misuse of their Service in breach of the terms or applicable laws.

Jazz reserves the right to assume exclusive defense and control of any matter subject to indemnification by
you. You shall cooperate in good faith with Jazz in asserting any available defenses.

Force Majeure

Force Majeure means any circumstances beyond the reasonable control of either party, including, without
limitation, fire, explosion, strikes or other labor disputes, riots or other civil disturbances, voluntary or
involuntary compliance with any law, order regulation, recommendation or request of any governmental
authority, and errors or downtime in networks, power supply, gateway or similar failures of communication.

Jazz is not liable for any failure to perform contractual obligations arising from events beyond our control,
including natural disasters, compliance with laws or governmental orders, and communication failures.

Termination

You may stop using the service by deactivating your account on the Jazz WhatsApp Channel and Jazz may
also terminate your access to the service without notice or refund of any fees if you breach the terms or
applicable laws.

Changes

Jazz may update or amend the terms to reflect changes in the Service or the law.

We will publish any amended terms on our website, and your continued use of Jazz’s Service after the
publication or notification of changes constitutes acceptance of the updated terms. We encourage you to
check our website regularly.

Partial Invalidity

If any provision of the terms is declared invalid or unenforceable by a court or other binding authority, the
remaining terms (or parts), conditions and provisions shall continue to be valid and enforceable to the fullest
extent permitted by law.

Language Versions

Any translations of the terms from English to another language are provided for convenience only and the
English version shall prevail in the event of any discrepancies between the translations.

Choice of Law and Dispute Resolution

The terms are governed by and interpreted in accordance with the laws of the Islamic Republic of Pakistan,
any disputes, controversies or claims arising from the terms of or in connection with the terms shall be
subject to the jurisdiction of Pakistani courts at Islamabad as the legal venue.
