INTRODUCTION
In our Writing Exercise 2, we have made the Certification for Extract from the Blotter
which is one of the essential in case build up and one of the content of a Case Folder. On
this part of our course we will be writing the Complaint Sheet. Likewise, this part will also
discuss the writing of a Narrative Affidavit to include its parts.

INTENDED LEARNING OUTCOME

1.) To gain knowledge in preparing a Complaint Sheet


2.) To acquire knowledge on what are the contents of a CARPETA or Prison Record
3.) To know the parts of an Affidavit
4.) To gain knowledge on what to write in an Affidavit

DISCUSSIONS

Rape Scenario Case

At about 12 midnight in the evening of 24 November 2022, Juan de la Cruz, residing


adjacent to Brgy Tulog-Tulog, Sto Nino, Samar where a lady named Maria Dimakulangan
resides, was seen wearing red shirt and blue maong pants near the house of the latter by
Pedro Sto Tomas a neighbor of the said lady. Prior to that occurrence Juan de la Cruz was
known to like Maria who was still 17 years old and frequently seen in above-stated
barangay.

After 3 hours had passed, Juan de la Cruz was seen by a fisherman named Lito Mata,
that former came from the house of Maria who were alone on that night. Juan was walking
fast away from the house of Maria with his red shirt tore down. Later, when Maria’s parent
(Lucio & Edna Dimakulangan) arrived home at abut 6 o’clock in the morning 25 November
2022 they have seen their daughter sitting down beside her bed as if out of her mind and
dress were torn down. Looking around at the bedroom of Maria her parent observed that
things inside were in disorder, scattered and disarranged noting also red cloth.

After a while when Maria recovered her normal feeling and state of mind she
revealed that she was raped but she wasn’t able to identify the suspect. Upon the revelation
of Maria, her parent accompanied her to the Police Station and reported the incident right
away. Maria was then undergone Medical Examination which she was taken semen on her
organ. While the Police Investigators likewise proceed to the crime scene and conducted the
Crime Scene Search Procedure to include the Interrogation and/or Interview to the
individuals who observed an unusual occurrence the other night. Crime Scene Search
Investigator likewise gather evidences such as the red cloth and the took fingerprint
specimen.
Since Juan de la Cruz was named by the 2 informants/witness, the former was
arrested at about 2 pm of 25 November 2022, as the primary suspect. On the other hand,
Juan de la Cruz denied the allegation which he defended that he was somewhere in the
town proper but presented no proof or evidence.

Findings of the Medico Legal:

1.) Presence of seminal fluid on the private part of the victim


2.) ½ inch laceration of the victim’s private part
3.) Contusions of the victim’s left & right arm

Findings of the Forensic Laboratory Examinations:

1.) Skin scrape specimen taken from the victim’s fingernails that match with
the accused

Same Rape case scenario that we will be having until we finished all the topics
covered on this course. After the Extract from the Blotter was made and the complainant is
willing to file a case against the suspect, a Complaint Sheet will follow to be written.

A complaint sheet contains the very essential of 5Ws & 1 H out from the initial
information gathered. Take note that, the How & the Why in a certain case mostly are
undetermined during initial information. Hence, it is the very subject of the investigation. In
the above-written case scenario some of the details of 5Ws & 1 H are already provided.
Thus, as an investigator we have to use our imaginative skills in building up a case against
the accused.

Writing an Affidavit

What Is An Affidavit?

An affidavit is a legal document that is very similar to a witness’s sworn testimony in


a court of law. Prior to giving testimony, a witness in a trial must swear that what they are
about to say is true and correct under penalty of perjury. An affidavit carries the same
penalty of perjury, only it is used to attest to things outside of the courtroom.

An affidavit is only valid when made voluntarily and without coercion.

The person making the sworn statement is referred to as the “affiant.” In signing an
affidavit, the affiant is asserting that the information is true and that they have personal
knowledge of the facts contained in the affidavit. They are also stating that they are
competent to testify about the information provided if called into court.

 Start with a heading. The heading may be made of a case heading if the affidavit is
for an open case, or it may simply say “Affidavit of [your name]” if you do not have
an open case. The case heading includes the court where your case is being heard,
the case number, and the names of the plaintiffs and defendants. After the case
heading or general title, the county and state where you will sign the affidavit will be
listed.

 The first section should contain your name in a sentence that generally states that
you, the affiant, swear that the following account of events is true and correct to
the best of your knowledge. For example, “Before me comes [your name], whose
residence is [address, including city, county, state and zip code], and hereby swears
to the following facts under penalty of perjury.” Depending on who drafts the
affidavit, this sentence may vary in wording.

City, after having been informed of my constitutional rights, do hereby depose and say:
 The content or the deposition, on this part, the Affiant will state what he wanted to
tell out from his/her personal knowledge on a certain event of an occurrence. This
will be stated/written in a paragraphs chronologically according to the sequence of
the event/s personally known to him/her.

 Lastly, you will need to include the signature lines and notary section. Keep in mind
that by signing the affidavit, you are swearing that the facts in the document are
true and correct.

Jail Booking & CARPETA:

As we had gone with the Jail Booking Report on our previous course CDI 5, you were
required to write a such document in which it contains all the details of an accused to
include his personal information, case filed against him/her, brief facts of the case, the title
of the case filed against him/her. This also includes his/her previous criminal cases.

While CARPETA in short to say is called Jail/Prison Record. It contains the following:

1.) Jail Booking Report/Booking & Arrest Report


2.) Information
3.) Medical Certificate
4.) Certificate of Detention
5.) Records of previous cases
6.) And all other criminal case’ records

Same with other documents, it has to follow the proper spacing, margin and
indentions. If an Affidavit consists of several pages each page should have a page number:
written either on the upper right or lower right of each page

I, Dra. Janice Angel, of legal age, designated as Officer In-Charge, Jail Provincial
Administrator BJMP Northern Samar and concurrent Officer In-Charge, Jail Warden of
Catarman District Jail, Brgy Acacia, Catarman, Northern Samar by virtue of Special Order
Numbers 2011-07, para # 2 dated 03 February 2011, hereby states that:.

That in the morning of 18 August 2011, I was informed by SJOI Arnel


M Odtujan JMP, presently assigned at Catarman District Jail and designated
as BJMPN/Samar and concurrent Catarman District Jail, Admin JNCO who
was then the most senior jail officer on duty of that day that there will be a
MANCON to be held on 22 August 2011 that requires my attendance.

In view thereof, I re-activated the BJMPN/Samar Office Order


Numbers 2011-03, dated 09 February 2011, designating SJOI Arnel M
Odutjan JMP as Officer In-Charge transferring the duties and responsibilities
which are inherent to the designation. Said order is reflected in the Log Book
Entry # 2472, page 253 and recorded at about 6:30 in the morning of 21
August 2011 by JOI Mardueño D Camposano II JMP one of the Outgoing Duty
Jail Officer of that day. The same was acknowledged in the next entry.

That I leave jail station at about 9:30 in the morning of 21 August


2011 to Tacloban City to be prepared in the next day’s official activities set by
RBJMP-VIII for Management Conference and Forum/Seminar. Said activities
lasted up to 5:00 o’clock in the afternoon of 22 August 2011 evidence thereto
is Attendance Sheet of the MANCON which is in possession of RBJMP-VIII,
HRM Division as Exhibit “A” and the photocopy of Certificate of Attendance
for the Forum/Seminar on TB in Jails and Smoking hereto attached as
Exhibit “B”. Right thereafter, I went to RBJMP-VIII, Regional Headquarters
for some official transactions thereto which made me stayed therein at about
past 7:00 o’clock in the evening of same date.

That upon reaching my place at Anibong, Tacloban City after taking


rest for about almost a quarter or half of an hour, I made a cell phone call
two times to JOII Michael N Cuanico JMP. Said calls got no answers , however
approximately twenty minutes after later I received a call from the said jail
officer informing that one inmate Jaime Oras y Lutao charged for Attempted
Homicide bearing Criminal Case Numbers 6220 under the jurisdiction of the
Honorable Court of MTC Bobon, Bobon, Northern Samar managed to
escaped. Same information also was received through text message from

SJOI Arnel M Odtujan JMP. After reading the text message I immediately
called the latter through his cell phone asking the veracity of the information
and instructed to conduct manhunt operations, coordinate with the
Catarman Municipal Police Station and nearby units to seal all the exit points
for possible recovery of the said escapee.

That at about past 2:00 or almost 3:00 o’clock in the morning of 23


August 2011 SJOI Arnel M Odtujan JMP made a call using the jail unit’s
telephone to my cell informing that recovery teams returned Catarman
District Jail’s station to effectively plan for the soonest recovery.

After I packed my things, I leave Tacloban City heading to my


workplace at Catarman, Northern Samar at about 9:00 o’clock in the morning
and arrived at about 4:30 in the afternoon of 23 August 2011.
