    RESOLUTION NO. 2023-01


    A RESOLUTION RECOMMENDING TO THE LOCAL CHIEF EXECUTIVE, HON.
    ARMI DC. CARRION, TO PROCESS THE PAYMENT FOR THE PURCHASE OF
    THE FACILITY EQUIPMENT FOR THE ISOLATION FACILITY/MULTI-
    PURPOSE BUILDING IN BANTAD, BOAC, MARINDUQUE
    WHEREAS, the Municipal Government of Boac was a fortunate recipient in the 2021
    Local Government Support Fund (LGSF) from the Department of the Interior and Local
    Government;
    WHEREAS, the LGSF received by this Municipal Government was used for the
    project for the construction of a multi-purpose building/isolation facility/quarantine facility in
    Barangay Bantad, Boac, Marinduque in the midst of the COVID-19 pandemic, as well as for
    the procurement of ancillary equipment therefor;
    WHEREAS, the Department of Interior and Local Government has previously called
    for the return of the said fund to the National Treasury for the reason that the validity of the
    2021 General Appropriations Act lapsed after December 31, 2022;
    WHEREAS, the Municipality though the Municipal Mayor has already expressed its
    intent to appeal the return of the fund for the reason that the procurement process for the
    purchase of facility equipment had already commenced before the end of 2022;
    WHEREAS, the Local Finance Committee believes that public health and the general
    welfare must take precedence over any other issues, and the procurement of facility
    equipment is necessary for this purpose;

    WHEREAS, the winning supplier had already successfully delivered the facility
    equipment as of May 2023 and according to the terms and conditions of the contract
    agreement between the LGU and the supplier, is entitled to receive its payment for the
    project;
    WHEREAS, the Local Chief Executive and the Local Finance Committee had already
    reached an agreement to include in the next supplemental budget the necessary amount to
    return to the National Treasury in the event that the DILG maintains its position of returning
    the remaining portion of the LGSF;
    WHEREAS, failure to pay the supplier would render the LGU liable for breach of
    contract and damages;
    WHEREFORE, on the unanimous decision of the Local Finance Committee, it was;
    RESOLVED, as it is hereby resolved, to recommend to the local chief executive,
    Hon. Armi Dela Cruz Carrion, Municipal Mayor, to process the payment for the transaction
    for the procurement of facility equipment of the multi-purpose building/isolation
    facility/quarantine facility in Barangay Bantad, Boac, Marinduque for the reasons cited
    herein;
    RESOLVED FINALLY, to furnish copies of this resolution to all concerned.
    ADOPTED, this 15th day of June 2023 in Boac, Marinduque.
