CHILD PROTECTION COMMITTEE


GUIDELINES and POLICIES

I. RATIONALE

Article 15, Section 3 (2) of the Philippine Constitution


upholds “the right of children to assistance, including proper
care and nutrition, and special protection from all forms of
neglect, abuse, cruelty, exploitation, and other conditions
prejudicial to their development”
Likewise, the Convention on the rights of the child (CRC)
spells out the basic human rights that children everywhere
have: the right to survival; to develop to the fullest; to
protection from harmful influences, abuse and exploitation;
and to participate fully in family, cultural and social life.
In the same light, the Family Code of the Philippines, by
the way of the principle of in loco parentis, gives the
school, its administrators and teachers the special parental
authority and responsibility over the minor child while under
their supervision, instruction, or custody. More recently,
Republic Act 10627 or the Anti-Bullying Act of 2013 was
enacted to ensure that all schools provide a conducive and
safe learning environment for children.
The school strongly supports the DepEd’s Zero Tolerance
Policy for any act of child abuse, exploitation, violence,
discrimination, bullying and other forms of abuse. It is
towards this end that the Libertad National High School Child
Protection Program and Policies has been formulated.
II. OBJECTIVES
This Program aims to:

A. Empower the students by including in the curriculum


activities that would develop their self-esteem, self-
confidence, assertiveness, and self-protective skills;
B. include in the faculty training program capacity
building activities for school personnel that would develop a
more pro-active stance toward ensuring a safe, fear-free and
healthy learning environments for the students;
C. Involve parents through various activities that will
raise level of awareness on the significance of their role in
protecting their children against different forms of abuses;
and
D. Ensure that effective working relationships and
coordination are constantly maintained between the school and
the community/ concerned agencies.

III. MAIN THRUSTS OF THE PROGRAM

PREVENTION. All members of the community shall work


collaboratively to provide a positive school atmosphere and
exhaust measures to prevent possible hazards of child
protection through advocacies.
PROTECTION. There shall be consistent implementation of agreed
common procedures, ensuring first that the school personnel
are trained to respond appropriately; parents and concerned
agencies are tapped to assist in child protection concerns.
• The school community shall ready provide appropriate
moral, psychological and spiritual support to students
who may be victims of any form of abuse or violence.

DEFINITION OF TERMS (DepEd Order No.40,s.2012:p-2)

Child - refers to any person below eighteen (18) years of age


or those over but are unable to fully take care of themselves
or protect themselves from abuse, neglect, cruelty,
exploitation, or discrimination because of a physical or
mental disability or condition;(RA7610). For purposes of this
Department Order, the term also includes pupils or students
who may eighteen (18) years of age or older but are in school.
Children in School - refers to bona fide students or learners
who are enrolled in the basic education system, whether
regular, irregular or transferee or repeater, including those
who have been temporarily out of school, who are in the school
or learning centers premises or participating in school-
sanctioned activities.
Pupil, student or learner - means a child who regularly
attends classes in any level of the basic education system,
under the supervision and tutelage of a teacher or facilitator
School personnel - means the person, singly or collectively,
working in a public or a private school. They are classified
as follow as;
A. School Head - refers to the chief executive officer or
administrator of a public or private school or learning
center.
B. Other school officials - include other school officers,
including teachers, who are occupying supervisory
positions or positions of responsibility, and are
involves in policy formulation or implementation in a
school.

C. Academic personnel - includes all school personnel who


are formally engaged in actual teaching service or
research assignments, either on a full-time or part-time
basis, as well as those who possess certain prescribed
academic functions directly supportive of teaching, such
as registrars, librarians, guidance counselors,
researchers, and other similar persons. They may include
school officials who are responsible of academic
matters, and other school officials.
D. Other personnel - includes all other non-academic
personnel in school whatever may be the nature of their
appointment and status of employment.
E. Guidance Counselor/Guidance Advocate – Refers to the
License/Registered Guidance Counselor or the Teacher
guidance designated by the school head who is in-charge
of the guidance program in the school. It supports the
student’s in terms of career coaching, counseling and
many more. The guidance counselor in not part of the
disciplinary committee and will only conduct a
preventive counseling and follow-up counseling for
students’ after the case is decided by the CPC.
Child Protection - refers to program, services, procedures and
structures that are intended to prevent and respond to abuse,
neglect, exploitation, discrimination, and violence.
Parents - refers to biological parents, step-parents, adoptive
parents and the common - law spouse or partner of the parent.
Guardians or custodians - refers to the legal guardians
(legality through documents), foster parents, and other

persons, including relatives or even non-relatives, who have


physical custody of the child.
School visitor or guest - refers to any person who visits the
school, and any person who does not have any official business
but is found within the premises of the school. This may
include those who are within the school premises for certain
reasons e.g. student teachers, catechists, service providers,
suppliers, bidders, parents and guardians of other children.
Child Abuse - refers to the maltreatment of a child, whether
habitual or not, which includes the following:
A. Psychological or physical abuse, neglect, cruelty,
sexual abuse, and emotional maltreatment
Any act by deeds or words which debases, degrades or
demeans the intrinsic worth and dignity of a child as
a human being;
B. Unreasonable deprivation of the child’s basic
needs for survival such as food and shelter; or
C. Failure to immediately give medical treatment to
an injured child resulting in serious impairment of
his or her growth and development or in the child’s
permanent incapacity or death(Sec,3[b], RA 7610).
Discrimination against children - refers to an act of
exclusion, distinction, restriction sexual orientation and
gender, identity, language, religion, political or other
opinion, national or social origin, property, birth, being
infected or affected by Human Immunodeficiency Virus and
Acquired Immune Deficiency Syndrome(AIDS), being pregnant,
being a child in conflict with the law, being a child with
disability or other status or condition, and which has the

purpose or effect of nullifying or impairing the recognition,


enjoyment or exercise by all persons, on an equal footing, of
all rights and freedoms.
Child Exploitation - refers to the use of children for someone
else’s advantage, gratification or profit often resulting in
an unjust, cruel, and harmful treatment of the child. These
activities disrupt the child’s normal physical and mental
health, education moral or social emotional development. It
covers situations of manipulation, misuse, abuse,
victimization, oppression or ill-treatment.
There are two (2) main forms of child exploitation that
are recognized:
A. Sexual exploitation - refers to the abuse of a
position of vulnerability, differential power, or trust
for sexual purposes. It includes, but is not limited to
forcing a child to participate in prostitution or the
production of pornographic materials, as a result of
being subjected to a threat, deception, coercion,
abduction, force, abuse of authority, debt bondage,
fraud or through abuse of a victim's vulnerability.
B. Economic exploitation - refers to the use of a child
in work or other activities for the benefit of others.
Economic exploitation involves a certain gain or profit
through the production, distribution, and consumption
of good and services. This includes, but is not limited
to illegal child labor or defined in RA 9231.
Violence against children committed in school - refers to a
single act or series of acts committed by school
administrators, academic and non-academic personnel against

a child, which result in or is likely to result in


physical, sexual, psychological harm or suffering, or other
abuses including threats of such acts, battery, assault,
coercion, harassment or arbitrary deprivation of liberty.
It includes, but is not limited to, the following acts;
A. Physical violence - refers to acts that inflict bodily
or physical harm. It includes assigning children to
perform tasks which are hazardous to their physical well-
being;
B. Sexual violence - refers to acts that are sexual in
nature. It includes, but is not limited
a) Rape, sexual harassment, acts of lasciviousness,
making demeaning and sexually suggestive
remarks, physically attacking the sexual parts
of the victim’s body;
b) Forcing the child to watch obscene publications
and indecent shows or forcing the child to do
indecent shows or forcing the child to do
indecent sexual acts and/or to engage or be
involved in, the creation or distribution of
such films, indecent publication or material;
and
c) Acts causing or attempting to cause the child to
engage in any sexual activity by force, threat
of force, physical or other harm or threat of
physical or other harm or coercion or through
inducements, gifts or favors.
C. Psychological Violence – refers to acts or omissions
causing or likely to cause mental or emotional

suffering of the child, such as but not limited to


intimidation, harassment, stalking, damage to property,
public ridicule or humiliation, deduction or threat of
deduction from grade or merit as a form of punishment,
and repeated verbal abuse.
D. Other acts of violence – of a physical, sexual or
psychological nature that are prejudicial to the best
interest of the child.
Bullying or Peer Abuse – refers to willful aggressive behavior
that is directed towards a particular victim who may be
outnumbered, younger, weak, with disability, less confident,
or otherwise vulnerable. More particularly:
A. Bullying – is committed when a student commits an act
or a series of acts directed towards another student, or
a series of single acts directed towards several
students in a school setting or a place of learning,
which results in physical and mental abuse, harassment,
intimidation, or humiliation. Such acts may consist of
one or more of the following:
a) Threats to inflict wrong upon a person, honor or
property of the person or on his or her family;
b) Stalking or constantly following or pursuing a
person in his or her daily activities with the
unwanted and obsessive attention;
c) Taking of property;
d) Public humiliation, or public and malicious
imputation of a crime or of a vice or defect,
status, or circumstance tending to cause dishonor,
discredit, or expose a person to contempt.

e) Deliberate destruction or defacement of, or damage


to the child’s property;
f) Physical violence committed upon a student, which
may or may not result to harm or injury, with or
without the aid of a weapon. Such violence may be
in form of mauling, hitting, punching, kicking,
throwing things at the student, pinching, spanking
or other similar acts;
g) Demanding or requiring sexual or monetary favors,
or exacting the money or property, from a pupil or
student; and
h) Restraining liberty and freedom from a pupil or
student.
Cyber-bullying – is any conduct defines in the preceding
paragraph, as resulting in harassment, intimidation, or
humiliation, through electronic means or other technology,
such as, but not limited to texting, email. Instant messaging,
chatting, internet, social networking websites or other
platforms or formats.
Other acts of abuse by a pupil, student or learner – refers to
other serious acts of abuse committed by a pupil, student or
learner upon another pupil, student or learner of the same
school, not falling under the definition of “bullying” in the
preceding provisions, including, but not limited to, acts of
physical, sexual or psychological nature.
Corporal Punishment – refers to a kind of punishment or
penalty imposed for an alleged or actual offence, which is
carried out or inflicted for the purpose of discipline,
training or control, by a teacher, school administrator, an

adult, or any other child who has been given or has assumed
authority or responsibility for punishment or discipline. It
includes physical, humiliating or degrading punishment,
including, but not limited to the following:
A. Blows such as, but not limited to, the following:
lashing, on any part of a child’s body, with or without
the use of an instrument such as, but not limited to a
cane, broom, stick, whip or belt;
B. Striking of a child’s face or head, such being
declared as a “no contact zone”
C. Pulling hair, shaking, twisting joints, cutting or
piercing skin, dragging, pushing or throwing of a child;
D. Forcing a child to perform physical painful or
damaging acts such as, but not limited to, holding a
weight or weights for an extended period and kneeling on
stones, salt, pebbles or other objects;
E. Deprivation of a child’s physical need as a form of
punishment;
F. Deliberate exposure to fire, ice, water, smoke,
sunlight, rain, pepper, alcohol, or forcing the child to
swallow substances dangerous chemicals, and other
materials that can cause discomfort are threaten the
child's health, safety and sense of security such as, but
not limited to bleach or insecticides, excrement or
urine;
G. Tying up a child;
H. Confinement, imprisonment or depriving the liberty of
a child;

I. Verbal abuse or assaults, including intimidation or


threat of bodily harm, swearing or cursing ridiculing or
denigrating the child;
J. Forcing a child to wear a sign, to undress or disrobe,
or to put on anything that will make a child look or feel
foolish, which belittles or humiliates the child in front
of others;
K. Permanent confiscation of personal property of pupils,
students or learners, except when such pieces of property
pose a danger to the child or to others; and
L. Other analogous acts.
Positive and Non-violent Discipline of a children - is a way
of thinking and a holistic, constructive, and pro-active
approach to teaching that helps children develop appropriate
thinking and behavior in the short and long-term and fosters
self-discipline. It is based on the fundamental principle that
children are full human beings with basic human rights.
Positive discipline begins with setting the long-term goals or
impacts that teachers want to have on their students’ adult
lives, and using everyday situations and challenges as
opportunities to teach long-life skills and values to
students.
A. Progressive discipline - a whole-school approach
that utilizes a continuum of prevention programs,
interventions, supports, and consequences to address
inappropriate student behavior and to build upon
strategies that promote and foster positive and
productive behavior. This means that when inappropriate
behavior occurs, disciplinary measures are applied

within a framework that shifts the focus from one that


is solely punitive to one that is both corrective and
supportive.
B. Restorative discipline - a type of discipline use to
respond to incidents of bullying in order to repair
harm to relationships. It refers to a range of
processes that are underpinned by the following
concepts:
A. Misconduct is a violation of people and
relationships
B. These violations create obligations and
liabilities
C. Problem-solving focuses on healing and making
things right

V. RIGHTS AND RESPONSIBILITIES OF THE CHILD

A. Rights of the Child:(United Nation Convention on the


Rights of the Child)
1. All children have the right to life. (Article. 6)
2. All children have right to a legally registered name,
and nationality. (Article. 7)
3. Children should not be separated from their parents
unless it is for their own good. (Art. 9)
4. Children have the right to say what they think should
happen, when adults are making decisions that affect
them, and to have their opinions taken into account.
(Article. 12)

5. Children have the right to get and to share


information (Art. 13)
6. Children have the right to think and believe what they
want, and to practice their religion, as long as they
are not stopping other people from enjoying their
rights. (Art. 14)
7. Children have the right to meet together and to join
groups and organizations, as long as this does not
engage in actual battle against the national government
forces. (Art. 15)
8. Children have a right to privacy. (Art. 16)
9. Children have the right to reliable information from
the mass media. (Art 17)
10. Children who have any kind of disability have the
right to special care and support as well as the rights
in the convention. (Art. 23)
11. Children have the right to good quality health care,
to clean water, nutritious food, and a clean
environment, so that they will stay healthy. (Art. 24)
12. All children and young people have a right to a
primary education, which should be free. (Art. 28)
13. Children have a right to learn and use the language
and customs of their families, whether these are shared
by the majority of people in the country or not. (Art.
30)
14. All children have a right to relax and play, and to
join in a wide range of activities. (Act. 31)
15. Children have the right to be protected from any form
of abuses. (Art. 34)

16. Children who break the law should not be treated


cruelly. (Art. 37)
17. Children who have been neglected or abused should
receive special help to restore their self-respect.
(Art. 39)
18. Children who are accused of breaking the law should
receive legal help. (Art. 40)
B. Duties and Responsibilities of Pupils (D.O. 40 s. 2012)

1. Comply with the school’s regulations, as long as


they are in harmony with their best interests. Students
shall refrain from:
A. Engaging in discrimination, or leading a group of
pupils or students to discriminate another, with
reference to one’s physical appearance, weaknesses
and status of any sort.
B. Doing any act that is inappropriate or sexually
provocative;
C. Participating in behavior of other students that
is illegal, unsafe, or abusive;
D. Marking or damaging school property, including
books, in any way;
E. Engaging in fights or any aggressive behavior;
F. Introducing into the school premises or otherwise
possessing prohibited articles, such as deadly
weapons, drugs, alcohol, toxic and noxious
substances, cigarettes and pornographic material;
and
G. Performing other similar acts that cause damage or
injury to another.

An allegation of commission on any of these acts shall


not be used to curtail the child’s basic rights, or
interpreted to defeat the objective of this Department Order.

A. Conduct themselves in accordance with their levels of


development, maturity, and demonstrated capabilities,
with a proper regard for the rights and welfare of other
persons;
B. Respect another person’s right regardless of
opinion, status, gender, ethnicity, religion, as well
as everyone’s moral and physical integrity; and
C. Observe the Code of Conduct for students
C. General Behavior

Success in schools occur when there is cooperation


between students, teachers, administrators, and parents.
We believe that discipline is an integral part of
education process. Its purpose is to communicate the
expectations of the school for students conduct to
promote safe, orderly and positive learning environment.
Maintenance of discipline may at times require the
impositions of sanctions provided for in the DepEd Order
no. 40 series 2012(Child Protection Policy)
A. Proper Grooming/ Good Grooming
Students should come to school neat and clean. A well-
groomed hair is one of the keys to a pleasing
personality.
-Boys’ hair is advice be properly cut so that the ears
are not covered and length does not go beyond the

hairline; and other hairstyle provided it is descent and


acceptable
-Preferably no hair coloring e.g. Red, Blue, Ash Brown
etc. nor highlights
-Girls preferably wear make-up lightly and in moderation
-Fingernails should be always clean and trimmed
-Wearing of expensive and fashion jewelries are highly
discouraged

Special Considerations:
For LGBT’s, in accordance to D.O.32 s2017, and has
been reiterated in OUGFO No. 2022-02-0153.
-Lesbian and Gays, Bisexuals and
Transgender(LGBT)students and boys with head deformities
and other valid reasons can have descent, acceptable
hairstyle.
-Gays who have long hair must be tied and keep.
-Gays may wear make-up lightly and moderation

Remember that you are a group of cultured people and


therefore your appearance should look pleasant and
desirable to others, not repelling.
B. Proper School Attire (D.O.46, S.2008)
SHS - White polo with Logo and Navy Blue Pants/Skirts
JHS - White Polo/shirt with Logo and dark Pants/Skirts
The School supports SOGIE, that is why, every
student has the right to wear whatever he/she prefers
according to his/her expression, however, it is advised
that it should be neat, formal and in accordance to the
suggested school uniform.

C. Special Uniforms Day (D.O. 76, S.2012)


A. To imbibe among the students a strong sense of
loyalty and love of country through the adherence of
the principles and idealism of Scouting, every
Monday is declared a uniform day for all grade VII
to Grade XII students either in Type A or B
uniforms.
D. Rules on Student’s ID Card
A. Student ID card is non-transferable
B. ID must be worn around the neck at all times in
the school premises.
C. Loss of the ID must be executed with an affidavit
before replacement is made
D. ID must be surrendered upon transfer or at the end
of the school year as a requirement for clearance.
E. Attendance Regulation
A. Punctuality
Regular and Punctual attendance is absolutely
necessary for all students. A student is considered
late if he or she is not inside the classroom after
fifteen (15) minutes. Five (5) successive tardiness
is equivalent to one day of absence. Continuous
tardiness shall be subjected for disciplinary
action.
B. Absences
Unreasonable absences are not allowed. The
student should give prior notice or ask permission
from his/her teachers (subject and class adviser) a
day before he/she intend to be absent. When a

student returns classes, he/she should present a


letter of excuse to his/her teachers duly signed by
his/her parent or guardian. Students who incur
absences of more than twenty percent (20%) of the
total number of school days without any valid reason
shall be subjected to disciplinary action.
Parents or guardian should not withdraw their
son or daughter from classes without informing the
teachers for a valid reason.
Attendance in Flag ceremonies is a must for all
students whose classes start at seven o’clock in the
morning. Likewise, attendance in flag retreat is
required for all students whose classes ends at five
o’clock in the afternoon including those who are
still inside the school campus.
F. Health Condition of the Student
A. Parents or guardian should inform the class
adviser and subject teachers of any congenital or
developed disease of the student per confirmation
from any health authority. consultations and the
appointment with doctors or nurses should be done
outside class hours.
B. The school and the teachers shall not be held
responsible for any untoward incident beyond their
control that may happen in school which may be
caused by the disease or illness.

A. Every student must be well-behaved and


courteous at all times. Students shall at all times shall
observe the laws of the land and the rules and
regulations of the school.
B.Students are strictly prohibited from saying and
or loitering in stores, houses, etc. Within the immediate
vicinities of the school during flag ceremonies and
school hours.
C. Students should handle and use school properties
and school facilities with care as they do their own
personal effects.
D. Every student is expected to maintain
cleanliness and orderliness in all parts of the building
and the school campus. Walls are to be kept free from the
marks and dirt of all kinds. Students should refrain from
carving out names and writing other graph lines on the
desk, doors, tables, walls, blackboard, inside the
toilets, etc.
E. Students are advised to buy healthy and
nutritious snacks. (D.O.8,s.2007)
F. Students are not allowed to use the school or any
activity outside or inside the school campus without the
knowledge and approval of the school authorities.
G. Loitering and shouting along corridors are
strictly prohibited. Students are enjoined and utilize
their free periods for studying and/or reading and doing
other related academic activities. Unnecessary noise
during vacant/free/guidance period is prohibited.

A. It is the policy of DepEd to promote effective and


efficient policies and programs. To realize this, DepEd should
be free from any partisan activities. As such, this Office

reminds the officials and. employees to practice the highest


form of professionalism and. to observe the following
measures:

a. Refrain from seeking endorsements, recommendations,


contributions, support, consideration, political
accommodations, or any form of intervention from other
government personnel or similar entities outside of
DepEd;

b. Desist from soliciting favorable actions from


politicians to facilitate the implementation of programs,
projects, or activities, except those covered by the
Adopt-a-School Program, initiated by the local.
government units, funded. by the Special Education Fund
(SEF), or covered by partnership agreements and/or
allowed by law;

c. Refrain from requesting or obtaining support or


endorsement from any third party in the hiring, transfer,
promotion, removal, or any other personnel movement;

d. Follow the internal rules and Department on protocols


relative regulations of communication, correspondence,
and other appropriate work processes; and
e. Raise issues and concerns regarding basic education
via formal and appropriate DepEd channels, either
directly to the Office of the Secretary or through the
concerned Assistant Secretary or Undersecretary, without
resorting to any political or third-party intervention or
accommodation.

Failure to comply with any of the abovementioned acts shall


mean outright denial of any request or appeal for
consideration in the Office of the Secretary.

B. In defining acceptable norms of conduct and relationships


in DepEd, officials and employees are reminded of the
provisions of Republic Act No. 6713, otherwise known as the

Code of Conduct and Ethical Standards for Public Officials and


Employees, in line with this, DepEd officials and employees
are expected to observe the following:

a. Treat and approach DepEd. colleagues, employees,


learners and stakeholders with the highest deg.-ee of
professionalism, skill, and excellence;

b. Respect the rights of others and refrain from doing


any act that is contrary to law, good morals, good
customs, public policy, public order, public safety, and
public interest;

c. Serve and perform one’s duties and responsibilities in


a prompt, courteous, and fair manner;

d. Refrain from engaging in any activity or any


relationship that may impair one’s ability in making
objective decisions in the performance of his/her job
functions;

e. Avoid relationships, interaction, and communication,


including following social media with learners outside of
the school setting, except if they are relatives;

f. Desist from any act that may compromise one’s


integrity as a government employee and that may
compromise the honor of the DepEd.

C. Employees and officials must consider the legal


restrictions imposed by existing statutes, rules, and DepEd
Orders in ‘the use of social media. Whether it be for personal
use of the DepEd official or employee, or as an essential or
an incidental tool in carrying out their mandate, social media
rules should be complied with. As such, employees and
officials of the DepEd:

a. Shall exercise caution when sharing posts or other

DepEd employees and must utilize legal and human resource
mediation procedures; and

c. Shall not disparage DepEd and must always be mindful


of the reputation and honor of the organization.

The use of DepEd email addresses shall only be for work-


related subscriptions and applications. In no case shall the
DepEd email address be used for any personal social media
account, profile, or activity.

VIII. ESTABLISHMENT OF THE CHILD PROTECTION COMMITTEE(CPC)


Pursuant to DepEd order No.40,s.2012 “Policy and
Guidelines on Protecting Children in School from Abuse,
Violence, Exploitation, Discrimination and Bullying, and other
forms of Abuse”, The school has established the Child
Protection Committee(CPC)which shall work closely with
existing concerned agencies in:
A. Drafting policies and plans to ensure child protection and
safety which shall be reviewed every three (3) years
B. Initiating information dissemination programs and
organizing capacity-building activities among faculty
/personnel and students;
C. Developing and implementing a school-based referral and
monitoring system in response to identifying students who may
be suffering from significant harm from other;

D. Ensuring that the children’s right to be heard is respected

Investigating Team FFIT) to fast tract in dealing with and in
obtaining necessary findings/facts for immediate action by the
CPC on matters involving child abuse.

expeditious actions on matters involving any form of abuse


considering the big number of students enrolled in the school
and the immediate availability of CPC members for the welfare
and protection of the student concern, thus, the creation of a
Fact Finding and Investigating Team is deemed necessary.
A. The CPC members will be the Fact finding and
investigating team in LNHS.
IX. OFFENSES
A. Minor
Minor offenses are those that would first receive a
verbal warning by the teacher or person in authority.
Repeatedly doing the same offense would result in written
disciplinary warnings and parents will be notified and invited
to come for a conference. The following list is not
exhaustive; the school may classify other improper behaviors
as minor offenses.
a) Dress code violation (D. O. 46, s.2008)
b) Non-wearing of school ID and use of other
student’s ID
c) Tardiness
d) Cutting classes
e) Absenteeism
f) Doing things that they swap classes (excessive
talking, playing, standing, walking, shouting,
etc.)
g) Unauthorized use of school sport facilities during
class hours
h) Use of cell phones (texting, playing, calling,
taking selfies) during classes except for

o) Loitering during class hours
p) Bringing items such as iPods, musical instruments,
sports equipment in the class without permission.

B. Major
Major offenses will be catered accordingly, the adviser
of the involve learners will lobby the case with its
respective Department Head together with the learners’
parents/guardian and settle the matter. The adviser will fill
out the anecdotal form of the student involve, one (1) record
in every incident. If the Department head cannot settle the
incident in its level, the adviser will set a meeting with the
Assistant Principal for Operations and Learner Support with
the presence of the School Counselor and parents/guardian of
the victim and the offending child in a special conference
called for this purpose. If the previous procedure did not

settle the incident, CPC will be called to settle the case, an


intervention will be agreed if it does not involve expulsion
of the student.

Reprimand, suspension, and expulsion may be imposed


without any prior warning, depending on the seriousness of the
case. The following list is not exhaustive; the school may
classify other improper behaviors as major offences.

1. Stealing (Theft) - Taking someone’s property without

a. Changing the answers

3. Vandalism - an act of destroying or damaging
something. It also includes graffiti on walls, windows
and benches, which is hard to remove and costs a lot of
money.
Common behaviors that may lead to a vandalism charge
include;

a. Spray painting another's property with the

4. Robbery - defined as taking the property of another,
with the
intent of permanently deprive the person of the
property by means of force or fear.
5. Threat - A menace or declaration of an intention to
inflict
future wrong upon a person, honor or property
of another or the latter's family. The acts or
words must be so efficacious as to amount to
moral pressure and thus produce fear, or mental
disturbance.
a. Light threat - Any threat to commit a
wrong not constituting a crime
b. Grave Threat - The act threatened to be
done is a crime
e.g. to kill, to burn, to destroy property, to
punch or to inflict injuries
6. Coercion - an intent to obtain advantage or to compel
a person
to act against his or her will.

It may comprise either physical or psychological
abuse. It may also include nudity and/or sexually
based offenses.

Note: Aside from disciplinary administrative actions, the


school shall also provide counseling and referral to
appropriate services for both bullies and their victims. The
principal shall notify the law enforcement agency if he
believes that a crime has been committed.

XI. PREVENTIVE MEASURES TO ADDRESS CHILD ABUSE EXPLOITATION


VIOLENCE DISCRIMINATION BULLYING AND OTHER ACTS OF ABUSE

A. Integration of education sessions and corporal


punishment and positive discipline and the initiatives
of the Parent-Teachers Associations(PTA's);
B. Capacity-building programs for school administrators,
teachers and non-academic personnel focus on children's
rights, child development and positive and nonviolent
approaches in teaching and classroom management, to
enable them to incorporate positive discipline messages
in parent-teacher conferences and family counseling,
and integrate messages on children's rights and
corporal punishment in classroom discussions;
C. Encouraging and supporting the formation and
initiatives of support groups among teaching and non-
teaching staff, and parents and caregivers;
D. Implementing specific parenting orientation sessions
with parents and caregivers and other activities;
E. Implementing school activities or events that raise
awareness and children's rights, corporal punishment
and positive discipline, fostering the active
involvement of and providing venues for bringing
together parents, families and children;

F. Encouraging and supporting student-led initiatives to


raise awareness and children's rights, corporal
punishment and positive discipline; and
G. Setting up child-friendly mechanisms for obtaining
children's views and participation in the formulation,
monitoring and assessment of school rules and policies
related to student discipline.

XII. PROCEDURES IN CHILD PROTECTION CONCERNS

A. Any student, parent, may report any instance of


bullying or peer abuse incident, witnessed or that has
come to one's attention to the CPC. Anonymous reports of
bullying shall be verified and investigated following
procedures stated above.

B. If data/information gathered confirms such an


incident, the adviser (the adviser is in-charge of the
anecdotal record) of the involve learners will lobby with
its respective Department Head together with the
learners’ parents/guardian and settle the matter.

C. If the immediate supervisor of the adviser/teacher


cannot settle the incident in its level, the adviser
and/or the Department Head will set a meeting with the
Assistant Principal for Operations and Learner Support
with the presence of the School Counselor and
parents/guardian of the victim and the offending child in
a special conference called for this purpose.

D. If the previous procedure did not settle the incident,


CPC will be called to deliberate the case, and an
intervention will be agreed if it does not involve
expulsion of the student.

E. Depending on the gravity of the offense /abuse


committed by the student, the school may impose other
non-punitive measures in accordance with the principles
of Positive and Non-violent Discipline.

The victim and the offending child shall be referred to


the Guidance Counselor for processing and follow-up
counseling.

F. Cases warranting reprimand or minor sanctions based on


policies stipulated in this Manual/Guideline shall be decided
by the CPC and recommend its sanctions to the school
Principal. The Principal will be the one to give the final
decision in all cases.

G. In all cases where the imposable penalty on the offending


child is suspension, exclusion or expulsion, the following
minimum requirements of due process shall be complied with:

a. The child and the parents or guardians must be


informed of the complaint in writing.

b. The child shall be given the opportunity to answer the


complaint in writing. with the assistance of the parents
or guardian;

c. The decision of the CPC must be in writing, stating


the facts and the reasons for the decision;

d. The decision of the CPC may be appealed, as provided


in existing rules the Department.

Any commission of the above major offenses which cause


serious physical injuries or death shall be referred to
concerned authorities/agencies in accordance with RA 9344,
ESTABLISHING A COMPREHENSIVE JUVENILE JUSTICE AND WELFARE
SYSTEM, CREATING THE JUVENILE JUSTICE AND WELFARE COUNCIL
UNDER THE DEPARTMENT OF JUSTICE, APPROPRIATING FUNDS THEREFOR
AND FOR OTHER PURPOSES) and its Implementing Rules and
Regulations.

XIII. RULES ANDPROCEDURES IN HANDLING CHILD ABUSE,


EXPLOITATION, VIOLENCE, DISCRIMINATION CASES (D.O. 40 S 2012)

EXPLOITATION, VIOLENCE OR DISCRIMINATION, FOR PUBLIC SCHOOLS.

XIV. JURISDICTION

Complaints of child abuse, violence, discrimination,


exploitation, bullying and other acts of abuse under this
Department Order shall be within the exclusive jurisdiction of
the Department, and shall not be brought for amicable
settlement before the Barangay, subject to existing laws,
rules and regulations. Complaints for acts committed by
persons not under the jurisdiction of the Disciplinary
Authority of the Department shall be referred to the
appropriate authorities.

In child abuse, violence, discrimination, exploitation,


bullying or peer abuse and other acts of abuse by a pupil,
student or learners, the identity or other information that
may reasonably identify the pupil, student or leaners, whether
victim or offender, shall be withheld from the public to
protect his or her privacy.

On the other hand, the Magna Carta for Public School


Teachers protects the rights of teachers and no publicity
shall be given to any disciplinary action against a teacher
during the pendency of his or her case.

XVI. CRIMINAL AND CIVIL LIABILITY

Criminal and Civil liability arising from child abuse,


discrimination exploitation, and other acts of abuse are
separate and distinct, and shall not be a bar to the filing of
an administrative case under these guidelines.

XVII. REFERRAL AND ASSESSMENT OF VICTIMS AND OFFENDERS AND


OTHER CHILDREN

In all cases involving child abuse, violence,


exploitation, discrimination, bullying and other acts of
abuse, the CPC shall accomplish the Intake Sheet (Annex "B").
The School Head may refer the victims and offenders in cases
involving child abuse, exploitation, discrimination, bullying
or peer abuse and other acts of abuse, to the CWDO for
assessment. The CWDO shall determine the appropriate
intervention.

The School Head, with the aid of the assigned Guidance


Counselor/Teacher, and in coordination with the CWDO, shall
immediately remove the victim, or in appropriate cases the
offender, from the place of the incident, if the victim is
determined to be at risk. The child's family shall be informed
of any action taken. The School Head may also refer to the
CWDO other pupils, students or learners who are victims of
abuse at home, children at risk, children in especially
difficult circumstances, children with special needs or at
risk, children facing difficult situations, or those who are
exhibiting signs of aggressive behavior, with a view to
obtaining professional assessment, appropriate interventions
and assistance from competent service providers.

XVIII. MISCELLANEOUS PROVISION

A. DUTIES OF THE PARENTS/GUARDIANS to the School


Administrator, Teachers, Academic and Non-Academic
Faculty and Staffs and Other School Personnel:
Parents/ Guardians must be open-minded, calm and
ethical in dealing with their issues and concern
towards the school administrator, faculty member,
non-teaching personnel and/or others;
B. School Safety Measure – The School must implement that
basic safeguarding procedures which includes signing
in the Guard’s Logbook before entering the school is
complied. Visitor’s should not be left alone with
the students.

C. Separability Clause
If, for any reason, any provision of these rules is
declared unconstitutional or contrary to law, the other parts

or provisions hereof which are not affected thereby shall


continue to be in full force and effect.

D. Repealing Clause
All laws, decrees, orders, rules and regulations, other
issuances, or parts thereof inconsistent with the provisions
of this policy are hereby repealed or modified accordingly.

E. Effectivity
This Policy shall take effect immediately and will be
revisited every Three (3) School Year.
