    AFFIDAVIT

    I, ANTONIO M. DE GUZMAN, of legal age, Filipino, with address at


    76D Socorro St., St. Michael Village, Talon 2, Las Pinas City; after being
    sworn under oath, hereby depose and state:

    1. That I am the manager of WORLDGATE FREIGHT EXPRESS ,


    a customs brokerage company, with the same address as stated above;

    2. That one of our clients is Q & H FOODS with address at P.O.


    Box 12506, Unit 113 Chateau Verde Condominium, Valle Verde I, E.
    Rodriguez Jr., Ave., Pasig City, Metro Manila;

    3. That we handled H & Q FOOD ‘s importation of mayonnaise


    covered by B/L HDMU LBML3078406 and was shipped out from California
    U.S.A. on December 13, 2014 with SPS Import Clearance No.
    ICDABAIQ20415150045 issued by the Bureau of Animal Industry (BAI)
    last January 9, 2015;

    4. That we admit that this SPS Import Clearance for the shipment
    was issued after the loading of the commodity in violation of regulations;
    that , we respectfully submit that this is an excusable mistake, done in good
    faith and that we or our principal did not intend to violate any regulations of
    the Bureau of Animal Industry or Bureau of Customs in this matter , and was
    done only for the following reasons:

    a) The shipment of mayonnaise covered by B/L HDMU


    LBML3078406 (the “subject importation”) which was shipped out
    from California U.S.A. on December 13, 2014 was actually covered by
    another SPS Import Clearance that was issued by the Bureau of Animal
    Industry before its date of loading, in compliance with regulations;

    b) Unfortunately, that SPS Import Clearance was used to cover


    another importation of mayonnaise by Q & H Foods from the same
    supplier which was held up at the Port of Manila for several months;
    that particular earlier shipment was released only AFTER its
    corresponding SPS Import Clearance expired; to remedy that situation,
    the undersigned has to use the SPS Import Clearance for this subject
    importation;

    5. As the SPS Import Clearance earlier issued specifically for B/L


    HDMU LBML3078406 was used for the delayed shipment, the undersigned
    has to request the BAI for a replacement SPS Import Clearance to cover this
    subject shipment; unfortunately, due to our delay, it was issued after the
    shipment was already loaded on board;

    6. Thus, the consignee and the undersigned did not intend to violate
    the regulations of the BAI and the BOC and that the subject shipment of
    mayonnaise covered by B/L HDMU LBML3078406 was actually covered by
    an earlier-issued SPS Import Clearance; but the undersigned was only
    compelled by exigencies to request for another SPS Import Clearance after
    the loading of the shipment;

    7. That the undersigned and the consignee have no intention to


    evade or violate any regulations of the BAI and the BOC; that it is
    respectfully requested that the subject shipment be released to the consignee
    through the undersigned;

    8. That the statements made herein are true to the best of my


    personal knowledge and authentic documents.
