Definitions
“Building” includes any structure or erection or part of a structure or erection which is intended to
be used for residential, industrial, commercial or other purposes, whether in actual use or not;
“Building operations” includes rebuilding operations, structural alterations of. Or additions to,
buildings and other operations normally undertaken in connection with the construction of
buildings;
“Commission” means the Delhi Urban Art Commission established under section 3;
“Delhi” means the Union territory of Delhi;
“Development” with its grammatical variations means the carrying out of building, engineering,
mining or other operations in, on, over or under, land or the making of any material change in any
building, or land and includes redevelopment;
“Engineering operations” includes the formation or laying out of means of access to a road or the
laying out of means of water supply;
“Local body” means the Delhi Municipal Corporation established under the Delhi Municipal
Corporation Act, 1957, the New Delhi Municipal Committee constituted under the Punjab Municipal
Act, 1911 as in force in Delhi, the Delhi Development Authority constituted under the Delhi
Development Act, 1957, or any other local authority concerned with urban development of Delhi;
“Member” means a member of the Commission and includes its Chairman;
“Public amenity” includes road, water supply, street lighting, drainage, sewerage, public works and
such other convenience as the Central Government may, by notification in the Official Gazette
specify to be a public amenity for the purpose of this Act;
“Regulation” means a regulation made under this Act by the Commission;
“Rule” means a rule made under this Act by the Central Government.
1. The salaries, if any, allowances and other terms and conditions of service of members of the
Commission;
2. “Connaught Place Complex”, means the area comprising Connaught Place and its extension
measuring approximately 140 hectares, being the area described as Zone D-I (Revised) in the
Delhi Master Plan;
3. “District centre” means a self-contained unit created in the Delhi Master Plan comprising
areas for retail shopping, general business, commercial and professional offices, forwarding,
booking and Government offices, cinema, restaurants and other places of entertainment.
Without prejudice to the provisions contained in subsection (1) and subsection (2), the
Commission may suo motu promote and secure the development, re-development or-
beautification of any areas in Delhi in respect of which no proposals in that behalf have been
received from any local body.
Budget
The Commission shall prepare, in such form and within such time, each year as may be prescribed by
rules, a budget in respect of the financial year next ensuing showing the estimated receipts and
expenditure, and copies thereof shall be forwarded to the Central Government.
Annual report
The Commission shall prepare once every year, in such form and within such time as may be prescribed
by rules an annual report giving a true and full account of its activities during the previous year, and
copies thereof shall be forwarded to the Central Government, and the Central Government shall cause
every such report to be laid before both Houses of Parliament.
Miscellaneous
Returns and information
The Commission shall furnish to the Central Government such returns or other information with respect
to its fund or activities as the Central Government may, from time to time, require.
Power to exempt
The Central Government may, subject to such conditions as may be prescribed by rules in this behalf,
exempt any building, building operation or engineering operation which has been designed as a result of
an Architectural competition, from the operation of ill or any of the provisions of this Act.
Delegation of powers
The Commission may, by general or special order in writing, delegate to the Chairman or any other
member or any officer of the Commission, subject to such conditions and limitations, if any, as may be
specified in the order, such of its powers and functions under this Act is it may deem necessary for the
efficient running of the day-to-day administration of the Commission.
Regulating the meetings of the Commission and the procedure for conducting business thereat;
Regulating the manner in which and the purposes for which persons may be associated with the
Commission under section 8;
Determining the terms and conditions of service of persons appointed by the Commission under
subsection (3) of section 9;
Any other matter which has to be or may be prescribed by regulations.
