Chapter 1

Introduction: This subject focuses on the Fundamentals of Criminal Investigation and


Intelligence which studies the terms and techniques that are used on this subject matter and on its
important terms such as the specialized Crime Investigation 1 with Legal Medicine, Specialized
Crime Investigation 2 with Interrogation, and Interview that all of the process and techniques of
investigations are tackled within this subject which explains the subject matters and all of its
topics it gives learning and insights on all of its parts. The subject also serves as a reviewer for
the part of the board exam as it tackles important areas related to our professions in the future it
serves as the foundation and one of the important subjects to be read and kept in mind not only
because its importance but can be applied in the profession of becoming a law enforcement and it
shares the structures, procedures and other specified Operations that is based on the law
enforcement that explains the basic and legal procedures that is always being followed and
meanings of this subject

Body:

The Fundamentals of Criminal Investigation and Intelligence is the art that deals with the identity
and location of the offender and provides evidence of the guilt of a suspect depending on the
weight of evidence presented in court in which principles of investigation is applied to the
criminal cases and through the means of criminal identification which involves the Fingerprints,
Rouges Gallery, General Photograph Method, Cartography and Police line-up. It discusses about
the phases of Investigation that includes the preliminary Investigation, Follow up Investigation,
and the Final Investigation which provides the procedures in proceedings in the investigation
processes. Information is defined as the any knowledge derived from any source which can be
used as a basis or as a means for decision making to facilitate the successful termination of a
criminal investigation that it is the first vital key that leads to a successful investigation. As well
as the interrogation the formal systematic questioning of a criminal suspect for the purpose of
securing an admission of guilt concerning his connection with, or participation in a crime under
investigation. Custodial investigation is the skillful questioning of a suspect or hostile witness to
divulge information concerning the crime under investigation. Custodial interrogation is the
stage wherein police investigators begin to focus on the guilt of the suspect, and the suspect is
taken into custody or deprived of his/her freedom of action in any substantial manner.
Confession the direct acknowledgement of the truth of the guilty fact as charges or of some
essential part of the commission of the criminal act itself

Arrest includes the taking of the person in custody in order to obtain informations about the
offense or crime committed. In accordance with law the following are exempt from arrest that
includes the senators members of the house of representatives while the congress is in session
and Diplomatic officials because of the law which exempts them to be arrested. The
responsibility of the Arresting Officer shall be to execute the warrant without unnecessary delay
to arrest and deliver him to the nearest police station or in jail. That in the methods of arrest it
must have a warrant of arrest in order to apprehend the person in which the officer shall inform
the person to be arrested if the cause or when the arrest is issued except when he flees, without
warrant of arrest is made when a crime has just been committed and the Warrants of arrest issued
by Metropolitan Trial Courts, Municipal Trial Courts or Municipal Circuit Trial Courts can be
served anywhere in the Philippines without a certification by a judge of the Regional Trial Court
and additionally Any person making an arrest on legal grounds shall, without delay and within
the time prescribed under Art. 125 of the RPC take the person arrested to the proper court or
judge for appropriate action. However, it is not the physical delivery of the arrested person that is
required under Art. 125 of the RPC, but the filing of an information against the arrested person in
the proper court, where the judge has the authority to issue an order of release or of confinement
and the another document which is made after a search is a certification of property seized.
Others included the type of searches which is wall search, standing search, kneeling search and
prone search.A raid must be legal, having its basis in lawful process and conducted in a legal
manner. This will be in the form of a search warrant or warrant of arrest.

While the type of Intelligence included many branches of the government intelligence base on
their expertise which is the following Strategic Intelligence, Line Intelligence, Counter
Intelligence that provides for the Assistance of the prevention of many types of Crimes that on
these Categories on Counter Intelligence which conducts Counter Human Intelligence with the
conduction of Special Operations on Liason, Counter Security, CI Screening, Counter Imagery
Intel, and Counter Signal Intelligence On the Document and Informal Security it is distinguished
in any classification which is the Authority, Classified Matter, Classification which is made as
soon as possible, Document Security which involves the application of security measures,
undercover assignment is an investigative technique in which agent conceal his official identity
an obtain information from that organization, Control is the authority to direct the agent to
carryout task or requirement on behalf of the clandestine organization in an acceptable manner
and security the methods of surveillance involves a form of clandestine investigation which
consist of keeping persons, place, or other targets under physical observation in order to obtain
evidence or information pertinent to an investigation.

The types of Surveillance includes Discreet in which the subject person to be watch is unaware
that he is under observation, Close is when the subject is aware that he is under observation
varied on each occasion and Loose is applied when frequently or infrequently, period of
observation varied on each occasion and from the tactical interrogation is the need for obtaining
information of highest degree of credibility on the minimum of time and focuses on the
objectives of interrogation varies and depend entirely on the situation in which the interrogator
finds himself. He must therefore be fully aware of the objectives for each interrogation.
and all others are classified as the Classification Categories that with Official matter which
requires protection in the interest of national security shall be limited to four categories of
classification which in descending order of importance shall carry one of the following
designations, Matter includes everything, regardless of its physical character, or in which
information is recorded or embodied, Security clearance is the certification by a responsible
authority that the person describes is cleared for access to classified matter the appropriate level,
Need to know is the principle whereby access to classified matter may only be only given to
those persons to whom it is necessary for the fulfillment of their duties, Certified of Destruction
is the certification by a witnessing officer that the classified matters describe therein has been
disposed of in his presence, approved destruction methods, Classified is to assign information by
one of the four classification categories, Compromise is the loosed of security, which results
from an authorized persons obtaining knowledge of classified matter , while Compartmentation
is the grant of access to classified matter only to properly cleaved persons in the performance of
their official duties, and others includes Declassify, Reclassify, Upgrading and Cryptographic
Security.

Chapter 2

In the Crime Scene Investigation it was develop by the human kind attempting to solve crimes
through the application of scientific knowledge. In Roman times, physicians routinely performed
autopsies to find out why people had died, and this was extended to the criminal arena in 44 B.C.
when the most famous Roman of all, Julius Caesar, was stabbed to death. On that occasion there
was no great secret regarding the mystery, but the fact that an autopsy took place at all does
highlight the way in which human curiosity was beginning to explore the broader aspects of
crime investigation. In the field of special crime investigation, an investigator is the person who
is tasked with the duty of carrying out the objectives of investigation. This is a multi-various job
which involves identifying the criminals, locating the criminal offender, providing evidence to
prove the guilt, and acting as a witness in favor of the prosecution. In homicide cases, if the
investigator should happen to be the first responder officer, his primary task is the verification of
death of the victim.
