TERMS AND CONDITIONS


1. Any Prepaid active subscriptions to promos and / or remaining load balance will be forfeited upon porting to Postpaid
2. Any Postpaid active subscription/ add ons will be forfeited upon porting to Prepaid
3. Postpaid accounts should settle financial obligations for outstanding and recurring charges.
4. There will be a maximum of 4 hours downtime upon completion of Change Brand request.
5. The change in service shall be subject to the acceptance of the rules and polices of the new service (ex. Prepaid to postpaid or
vice versa)
6. Customer requesting for Porting must fully met the Eligibility Criteria

PRIVACY NOTICE
Mobile Number Portability

Smart Communications, Inc. (“SMART”) respects your fundamental right to privacy and we commit to take great care
in safeguarding your personal data. As you make a Mobile Number Portability (“MNP”) request, and in compliance with
the Data Privacy Act, we share with you the principles that govern how your personal data will be collected, processed,
and shared.

Why we collect your personal data

When you make an MNP request, the following personal data will be collected from you through the Manual Aftersales
Acknowledgement Receipt (“MAAR”) Form:
(a) Name;
(b) Mobile Number;
(c) Account Number (for Postpaid Subscribers only);
(d) Service Type; and
(e) SIM Brand.

In order for us to be able to validate your identity and ownership of the mobile number that you wish to port, we will also
collect the following additional information from you:

(a) If you are porting from a Prepaid to a Postpaid account


 To document the transacting party’s identity, a Valid ID; and
 To validate your ownership of the Prepaid SIM, any one of the following:
o The original SIM Bed/Jacket of your Prepaid SIM
o The original PUK Slip of your Prepaid SIM;
o A copy of an Official Receipt issued by SMART with your Prepaid Mobile Number;
o Proof of a Smart Money Account, Paymaya Account, or MVP Rewards Account linked to your
Prepaid Mobile Number; or
o Proof of at least one-month’s registration of your Prepaid Mobile Number in the MySmart App.

(b) If you are porting from a Postpaid to a Prepaid account


 A Valid ID of the Postpaid account’s Subscriber-on-Record (“SOR”) to validate your identity and
ownership of the Postpaid account.

Why your personal data is shared

We have engaged the professional services of Amdocs Philippines Inc. (“AMDOCS”) and Huawei Technologies Inc.
(“HUAWEI”) to whom we have outsourced the technical operations and management of our network and IT
infrastructure. Both AMDOCS and HUAWEI may only process your personal data in connection with this purpose.

When your personal data is shared, we ensure that it is done on a confidential basis, through secure channels, and in
compliance with applicable privacy laws and regulations. Only personnel with a need -to-know will have access to your
personal data.

How your personal data is protected

The integrity, confidentiality, and security of your personal data i s important to us. This is why we strictly enforce this
Privacy Notice and have implemented technical, organizational, and physical security measures that are designed to
protect your information from unauthorized or fraudulent access, alteration, disclosu re, misuse, and other unlawful
activities. Your personal data is also protected from other natural and human dangers.

We likewise require the same security measures from both AMDOCS and HUAWEI.

Your rights and choices

The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under the law, you are
entitled to request:
1. Access to the personal data we process about you;
2. Rectification of your personal data if it is found to be outdated, inaccurate, or incomplete;
3. Erasure of your personal data in cases where it is no longer needed to achieve the legitimate purpose of its
processing;
4. Restriction of processing of your personal data in limited circumstances;
5. Portability of your personal data so that you may receive a copy the reof or that we transmit the same to another
company on your behalf.

Depending on the circumstances, such as when we process your personal data based on your consent, you may also
have the right to object to the processing thereof. If you believe that your data privacy rights have been violated in the
fulfillment of your MNP request, we encourage you to contact SMART’s Data Privacy Officer to seek resolution of your
complaint. You also have the right to go directly to the National Privacy Commission or to make a claim against SMART
before a competent court.
