JUDICIAL COMPLAINT-AFFIDAVIT

This Judicial Affidavit was taken at the office of the Police Master
Sergeant. Yolly Ces Secretaria at Gingoog City Police Station.

This complaint-affidavit in Judicial Affidavit form is offered pursuant to

Administrative Matter No. 05-11-07 SC, for the following purposes;

1. To establish probable cause for the filing of information for

violation of Article 226-A (RAPE) of the Revised Penal Code
(R.A8353) against Fulgoso Ambongan, Justy Ambongan, and Fred
Meomoy;

2. To identify and testify on relevant and Material documents; and

3. To prove all other matters material and relevant to the case;

Questions were propounded by Police Master Sergeant Yolly Ces

Secretaria these questions are numbered consecutively and each question is
followed by the answer of the witness.

Question No.1 (Q1): Do you swear to tell the truth and nothing but the truth?

A3: I am Maria O. Sawa, 20 years old, single, and a resident of Doming

Cuerdo, Barangay 23 Purok -3, Gingoog City. I am a student of Gingoog
University 2nd year of college (Ako si Maria O. Sawa, 20 anyos, ulitawo, ug
lumulupyo sa Doming Cuerdo, Barangay 23 Purok -3, Gingoog City. Usa
ko ka estudyante sa Gingoog University 2nd year college)
Q4: Why are you here in my office? (nganu naa man ka sa akung opisina?)

A4: To give my statement as I want to file a criminal charge for (RAPE)

under Article 266-A paragraph 1, against Fulgoso Ambongan, of legal age,
single, and Justy Ambongan, 23 years old, single, and Fred Memory, 22
years old, single. They all live at barangay Malibud, Gingoog City. (Sa
paghatag sa akong pamahayag kay gusto nakong pasakaan og kasong
kriminal (RAPE) ubos sa Article 266-A paragraph 1, batok nila ni Fulgoso
Ambongan, sa legal nga edad, ulitawo, ug Justy Ambongan, 23 anyos,
ulitawo, ug Fred Memory, 22 anyos, ulitawo. Silang tanan nagpuyo sa
barangay Malibud, Gingoog City.)

Q5: Why do you want to file a criminal charge against Fulgoso Ambongan,
Justy Ambongan, and Fred Meamoy for (RAPE)? (Nganong gusto man

Ambongan, ug Fred Meamoy tungod sa (RAPE)?

A5: On October 4, 2022, at around 5:00 PM, after we went to school, my

classmate and best friend Thalia Meamoy invited me to go to her birthday
party on October 5. She said, "It will be my biggest birthday party. We are
going to have fun, and there will be a lot of drinks, and we will definitely
enjoy it, so you need to be there, Maria, or else I’ll be sad or disappointed if
you can’t come. So, on that day, October 5, I asked my mother, Petra O.
Sawa, if she would allow me to go to the birthday party of Thalia, and she
said, “Oo nak pag amping baya ha, ayaw kaayu pagabii”. Around 5:15 pm, I
went to Thalia’s rest house in Brgy. Malibud, Gingoog City, where her
birthday would be celebrated. There are many people at the venue, and also
my other classmates are there. We jammed together and enjoyed the party,
and the birthday celebrant, who is Thalia, gave me a drink, even though I do
not drink. So, it was my first-time drinking alcohol, and then we danced
together. At around 6:30 in the evening, Thalia introduced her cousins to us,
who are Fulgoso Ambongan, Justy Ambongan, and Fred Meamoy. So, we
shared one table and jammed together and had a drinking spree. The party
was getting worse Thalia was already drunk while talking to other guys, and
lots of long-necked Tanduay were exhausted. I was also a little tipsy at that
time. Then, around 9:40 pm, my other classmates went home, so I called
Thalia to ask permission. I was about to go home because my mother, Petra
O. Sawa, might call. But Thalia was busy entertaining other guys. Then
Fulgoso, one of her cousins, abruptly stated, "Because you’re going home,
drink this before you go home so you can sleep well." (Oktobre 4, 2022,
mga 5:00 PM pagkahuman namo sa skwelahan giimbitar ko sa akong
Classmate ug Bestfriend nga si Thalia Meamoy nga mu adto sa iyang
birthday party sa Oktubre 5 sa gabii. Siya miingon nga kini ang akong
pinakadakong birthday party. Maglingaw-lingaw ta ug daghan mag inom,
and for sure malingaw ta, so need ka ana Maria or else maguol ko or ma
disappoint kung di ka makaadto. Mao nga niadtong adlawa, Oktubre 5,
nangutana ko sa akong inahan nga si Petra O. Sawa kon tugotan ba niya
ako nga moadto sa birthday party ni Thalia ug siya miingon. (Oo nak pag
amping baya ha, ayaw kaayu pagabii) Mga alas 5:15 sa hapon, miadto ko sa
rest house ni Thalia sa Brgy. Malibud, Gingoog City, diin saulogon ang
iyang adlawng natawhan. Daghan ang tao sa venue, and also naa pud ang
uban nakong classmates. Nag-jamming mi ug nalingaw sa party, ug
gipainom ko sa birthday celebrant nga si Thalia, bisag dili ko moinom. U
gunang higayon nako niinom ug alak ug nag sayaw mi. Mga alas 6:30 sa
gabii gipailaila ni Thalia ang iyang mga ig-agaw kanamo nga sila si Fulgoso
Ambongan, Justy Ambongan, ug Fred Memory. Ug nag share mi ug isa ka
table ug nag jam ug nag inom2x. Mga alas 8:30 sa gabii, nagkagrabe ang
salo-salo Hubog na si Thalia samtang nakigsulti sa ubang mga lalaki ug
daghang mga long-neck nga Tanduay ang nahurot. Medyo tipsy pud ko ato
nga orasa. Ug around 9:40 pm nauli napud akong uban classmates so
gitawagan nako si Thalia para mangayo ug permiso. Mopauli na unta ko
kay basin motawag si mama Petra O. Sawa. Pero busy si Thalia sa pag
lingaw sa ubang mga laki, Unya niingon si Fulgoso usa sa iyang ig-agaw ni
Thalia (Kay muuli ka, inoma sa ani ana ka muuli para makatulog ka og
maayo).

Q6: What happened next? (Unsa sunod nahitabo?)

A6: So, I drank the shot that he gave to me, and then I doubted why it tasted
different. Fulgoso just said “Nahilis naman gud ang Ice” then at 10:20 in
the evening, I was about to go home, but I needed to go to the toilet before
I'd go home because I needed to pee first. But when I stood up, I was dizzy
because I suddenly had a headache and felt nauseous, so Fulgoso and Fred
took me to the toilet to make me vomit. When I puked, I overheard Fulgoso
and Fred conversing and saying “ni epekto na kaha tung drugs nga
iyang nainom?” When I heard what they were talking about, I quickly got
up and got out, even though I had a headache, and when I opened the door, I
was met by both of them. They grabbed me and made me go back to the
toilet, and suddenly Fulgoso kissed me and Fred grabbed my hand. I
squirmed so hard to escape, but I couldn’t. They were strong enough
compared to me, and because I was dizzy at that moment, they took
advantage of that and undressed me and kept kissing me. I wanted to fight,
but my body is very weak. (Ug mao to niinom ko sa shot nga iyang gihatag

nagsakit ang akong ulo ug nalipong, mao nga gihatod ko nila ni Fulgoso ug
Fred sa kasilyas aron magsuka. Ug sa dihang nisuka ko, nadunggan nako si
Fulgoso ug Fred nga nag-estoryahay ug nagsulti “ni epekto na kaha tung
drugs nga iyang nainom?”. Pagkadungog nako sa ilang gistorya dali ra ko
nibangon ug nigawas bisag labad akong ulo, ug pag-abli nako sa pultahan,
gisugat ko nilang duha. Gigunitan ko nila ug gipabalik sa banyo, ug kalit
nga gihagkan ko ni Fulgoso ug gigunitan ni Fred ang akong kamot.
Nagkurog ko pag-ayo aron makalingkawas, apan wala nako mahimo. lig-on
sila kumpara nako, ug tungod kay nalipong ko niadtong higayona gi
pahimuslan nila ug gihuboan ko ug sigeg kiss nako. Gusto ko makig-away
pero luya kaayo akong lawas.)

Q7: What did they do to you? (Unsa ang ilang gibuhat kanimo?)

A7: Fulgoso took off my underwear and sniffed my panty. Then suddenly,
Justy, also a cousin of Thalia, came in and locked the door. He took off his
clothes. So, I cried a lot and begged them not to touch me “please maluoy
mo, ayaw!” but their eyes were so red that they looked like devils. At that
moment, the three of them are arguing about who will go first “akoy una
kay ako nag butang, dili! Dapat ako una uy” While they are arguing I
kicked Fulgoso’s dick because I wanted to run away. But when I attempted
to stand, Justy punched me in the stomach, and I immediately fell to the
floor, and I couldn’t move. At around 11 in the evening, Justy Ambongan
inserted his penis into my vagina. I shouted loudly and cried because of the
pain that I felt during that time. Then, after Justy fucked me, Fulgoso
replaced Justy, and he was the next one who inserted a penis into my vagina
while Fred squeezed my boobs. Justy was not yet content with that he also
forced me to eat his dick. After Fulgoso fucked me, Fred replaced Fulgoso
and inserted his penis into my vagina. I cried during the time that they
fucked me, but I couldn’t do anything because there were three (3) of them
and they were strong. They kept punching me when I shouted. During that
time, I just prayed to God that hopefully I would survive and be alive
because suddenly I didn’t feel anything and I lost consciousness. (Gihubo ni

ang akong bilat, unya kalit lang nga nisulod si Justy nga usa usab ka ig-
agaw ni Thalia ug gi-lock ang pultahan ug gihubo niya ang iyang sapot. So
nihilak kog ayo ug nananghid nga di ko niya hilabtan “please maluoy mo,
ayaw!” pero pula kaayo ilang mata murag demonyo. At that moment
naglalis silang tulo kung kinsay mauna “akoy una kay ako nag butang, dili!
Dapat ako una uy” samtang naglalis sila gisipa nako ang lagay ni Fulgoso
kay gusto ko molayas. Apan sa dihang nisuway ko sa pagbarog gisumbag ko
ni Justy sa tiyan, ug natumba dayon ko sa salog, ug wa ko makalihok, mga
alas 11 sa gabii gisulod ni Justy Ambongan ang iyang kinatawo sa akong
kinatawo nisinggit kog kusog ug nihilak tungod sa kasakit. nga akong gibati
niadtong panahona. Unya pagkahuman ni Justy ug iyot naku, gipulihan ni
Fulgoso si Justy ug siya na ang sunod nga nisulod ug lagay sa akong bilat
samtang gipisil ni Fred ang akong tutoy. Wala pagyud na kontento si Justy.
Gipugos ko niyag pa kaon sa iyang lagay. Human ko ge iyot ni Fulgoso,
gipulihan ni Fred si Fulgoso ug gisulod niya iyang Lagay sa akong Bilat,
nihilak ko sa time nga ela kung ge iyot, pero wala koy mahimo kay tulo (3)
sila ug kusgan. Sige silag suntok nako pag singgit nako, sa maong panahon,
nag-ampo lang ko sa Diyos nga unta mabuhi ko ug buhi kay kalit lang nga
wala koy nabati ug nawad-an kog panimuot.)

Q8: What did you do right after? (Unsa imong gibuhat pagkahuman?)

A8: At around 4:00 am, I woke up naked in the CR, and I was alone. I
dressed up and left the CR. When I left, I went to Thalia and told her about
the incident. She couldn’t believe that they could do something like that, and
she apologized to me because she didn’t take care of me. She was busy
entertaining other people, and she was very drunk at that time, and she
looked for me, but she didn’t see me anymore, so she thought that I was
already at home. And she said that she would help me file a criminal case
against her three cousins, and after that, I went home around 4:30 in the
morning. (Mga 4:00 am, nakamata ko nga hubo sa CR, ug ako ra. Nagbihis
ko ug nigawas sa CR. Pagbiya nako, giadto nako si Thalia ug gisultihan siya
bahin sa panghitabo. Dili siya makatuo nga mahimo nila ang usa ka butang
nga ingon niana, ug nangayo siya og pasaylo kanako tungod kay wala niya
ako giatiman. Busy siya sa pag lingaw sa uban, hubog na kaayo siya ato nga
time, ug gipangita ko niya, pero wa na siya kakita nako, ug abi niya naa na
ko sa balay, Ug niingon siya nga tabangan ko niya sa pagpasaka og kasong
kriminal batok sa iyang tulo ka ig-agaw, ug human niadto, mipauli ko mga
alas 4:30 sa buntag.)

A10: I was traumatized by the incident that happened. I cannot sleep, and I
always cry if I close my eyes, because it went against my well-being, I can
still recall what they did to me. I did not tell my mother about the incident. I
did not want to go out of my room; I had no appetite. The next day, my
mother went up to my room because she was worried about me. She asked
why I always cried and why I did not eat. So, I tell my mother, Petra O.
Sawa, what happened. I was raped by three people, and they gave me a drink
with some drugs. “gebaboy ko nila ma, gusto nako mamatay” while I
was talking to my mother, I lost consciousness and my mother brought me to
the nearest Hospital at Gingoog City. (Na-trauma ko sa nahitabo. Dili ko
makatulog, ug kanunay kong maghilak tungod kay kung gipiyong nako
akong mga mata. kay supak man sa akong kaayuhan, makahinumdom pa ko
sa ilang gibuhat nako. Wala nako sultihi ang akong inahan bahin sa hitabo
nga dili ko gustong mogawas sa akong kuwarto; Wala koy gana, Pagka
ugma, nisaka si mama sa akong kwarto kay nabalaka siya nako. Nangutana
siya nganong kanunay kong maghilak ug nganong dili ko mokaon. Mao nga
gisultihan nako ang akong inahan nga si Petra O. Sawa, unsa ang nahitabo
nga gilugos ako sa tulo ka tawo, ug gipainom nila ako sa pipila ka mga
droga (gebaboy ko nila ma, gusto nako mamatay) samtang nakigsulti ako sa
akong inahan, ako. nawad-an ug panimuot ug gidala ko sa akong inahan sa
pinakaduol nga Hospital sa Gingoog City.)

Q11: What happened in the Hospital? (Unsay nahitabo sa Hospital?)

A11: Upon arriving at the hospital, I was brought to the Emergency Room
(ER) and I regained consciousness. They saw bruises on my back and scars
on my arms. After that, I was taken to the examination room where Dr.
Canna Cubao examined me and it was found out that I suffered vaginal
laceration. Dr. Canna Cubao issued a medical certificate. (Pag-abot sa

panimuot nakakita silag mga bun-og sa akong buko-buko ug mga pilas sa
akong bukton, pagkahuman gidala ko sa examination room ug gi-eksamin

A13: Dr. S-Lenn Laran, who is a psychologist, conducted a psychological

examination and post-traumatic stress counseling. I have here with me a
copy of the psychological report made by Dr. S-Lenn Laran. (Si Dr. S-lenn

ug post-traumatic stress counseling. Naa koy kopya sa psychological report

A15: I reported the incident to the Gingoog City Police Station and
patrolman Ralph Flores took our statement and assisted us in filing the
police blotter of the case and attach the blotter as “Annex D” (Akong gi-

patrolman Ralph Flores ang among pamahayag ug iya kaming gitabangan
sa pag-file sa police blotter sa kaso ug i-attach ang blotter isip “Annex D”.)
