ABSTRACT
This study aimed to determine the level of compliance of Raffy Tulfo in Action as a mode of
online dispute resolution towards Katarungang Pambarangay Law. Their equal and
transparent approach in addressing disputes, and the effectiveness of the show in resolving
disputes as perceived by the Barangay Officials of Alfonso Lista, Ifugao. This study was
conducted in the School Year 2021-2022. The descriptive method of research was used in
this study in order to meet the objectives of this study regarding Raffy Tulfo in Justice.
Further, quantitative research was used and considered the most applicable design in this
study. The findings of the study implies that the Raffy Tulfo in Action level of compliance
with proper procedures during trial through media forum was determined often. Implying that
the show resolved disputes by following proper procedures of Katarungang Pambarangay
Law. The Barangay Officials agreed that the Raffy Tulfo in Action practiced their equal and
transparent approach in dealing disputes and rendering justice. This implied the TV Show
gained the public trust by practicing equal judgement and transparent approach without bias.
The Barangay Officials expressed, that the Raffy Tulfo in Action was moderately effective in
dealing disputed matter patterned with Barangay Justice System implying that the TV Show
is effective for almost all their actions and proceedings. It is recommended that the show
should study more about the Katarungang Pambarangay Law to improve their equal and
transparent approach to every cases and improve their effectiveness in resolving disputes and
reconciling disputed parties.

CHAPTER 1

INTRODUCTION

Background of the Study

Courts worldwide are flooded with filed cases that require resolution. Unfortunately,

not all cases are resolved timely resulting in pending cases which may extend the

procurement of justice to people. As to the report of transparency of the Sandiganbayan, the

total number of filed cases are 37,600 and 2,931 of it are only the number of cases that are

resolved. https://sb.judiciary.gov.ph/statistics_report.html. To solve the problem, dispute

resolution is used as an alternative. Dispute resolution refers to an action that aims to resolve

any civil disputes without resorting to court and undergoing litigation (Lawbite, 2021). The

dispute resolution was originated during the Spanish and American colonization with the lead

by the elders as the mediators (Disini, et.al, 2002). Alternative dispute resolution really gives

a relief to the court's duty in accepting complaints and giving justice to it (Colombo, 2012).

Tabucanon, Wall, & Yan (2008) stated that mediation seems to be the pioneer of national

solutions. It applies to a wide variety of disputes including labor administration negotiations,

community disputes, school disputes, and marital problems. Moreover, there is evidence from

China, Taiwan, India, Great Britain, Australia, Japan, and Turkey suggesting that mediation

is used worldwide (Mania, 2015).

Amicable settlement is commonly used over the past years for settling disputes and

restoring relationships between disputed parties. Conciliation settlement rates are high, the

processes of conciliation, mediation and arbitration form part of the techniques of alternative

dispute resolution which have become increasingly popular as alternatives to litigation (Eden
& Gough, 2011). Colombo (2012) stated that there are many kinds of alternative dispute as a

form of settlement.

In the Philippines, alternative dispute resolution is being applied. All disputes in an

ethnic group will be given justice through their own justice system without the concurrence

of the Philippine justice system and those persons in-charged to act as mediator or moderator

are the head of such ethnic groups. In the region of cordillera, only the leaders of every ethnic

group have the power to act as a mediator and resolve disputes between their members in

their ethnic group (Tayaban, 2020). In support of this,

Justice System was established to lessen bulk filing of irrelevant cases in

court and to promote speedy justice, and to honor traditional amicable

settlement at community level. Later on, Republic Act 7160 or otherwise

known The Local Government Code of 1991 was enacted to expand the

scope and power of the Barangay Justice System that merely made to law to

minimize congestion of court cases. R.A. 7160 appointed the barangay to

facilitate mediation and amicable settlement within the barangay to deliver

services. Katarungang Pambarangay as a community-based dispute

resolution, specialized on settling dispute among their respective barangay

members this involves the Barangay Captain and Lupon Council in

addressing and reconciling the disputed parties” (Saligan, M. & Vigo, M,

2004).
The procedure of barangay justice system starts when any individual who has a cause

of action against another individual involving any matter within the authority of the Lupon,

the second process is recording of the complaint. When the complaint is final and the date for

the hearing is made, a summon letter will be made and will be given to the complained

person. In this stage, the Punong Barangay will act as the mediator and his only intention is to

resolve the dispute and reconcile the broken relationship. After the mediation process and

reconciliation has failed to be achieved, certificate to file action will be given to them, and for

them to use it to push through their case to proper court (Tabucanon, et. al., 2008).

According to Tayaban (2020), in the Cordillera Administrative Region, traditionally,

as part of the minority group who lives in a remote location, they have their own Indigenous

Justice System, wherein the leader of a certain ethnic group acts as the mediator. They were

divided according to their way of the justice system. But when the Katarungang Pambarangay

were made, they are now bound through the laws created by the government. These are the

Barangay Justice System by virtue of PD 1508 and its process, the Alternative Dispute

Resolution as provided by RA 9285. Relevantly, Fisher (2014) cited that the Government is

doing its best to provide retributive policies to law violators even though victims remain

unsatisfied with the result of the criminal justice system brought about by the policy changes.

All things that happen in our daily lives are being posted in social media. Even others’

personal problems are being posted through social media platforms. Due to the fast

development of technology in today's generation. Dispute resolution and justice may succeed

through online mediation or online dispute resolution (Mania, 2015). According to Onge

(2021), Social media is at the forefront of modern-day communication, making it highly

influential in how people communicate, broadcast their ideas, and form opinions; social

media also makes the distribution and communication of information, whether fact or fiction,
extremely easy and accessible to anyone. Social media gives everyone a platform to share

and express whatever they want; from recipes to political rants.

According to the study of Wittig & Ghosheh (2020), Social media has changed the

tools accessible to disputed parties, civil society, peace practitioners and the public to bewitch

in both peace and war efforts. It has increased opportunities in the before time phases of

peace processes, adding assisting with data gathering and analysis and diversifying dialogue.

But it additionally carries risks. Social media can create new hierarchies due to dissimilarities

in the internet, get into use or exacerbate propaganda, and detest speech. Moreover, social

media from legal trials has emerged as one of the most convenient approaches wherein the

general public can benefit from direct participation into legal proceedings, especially in

international locations in which cameras are denied access into the courtroom. The goals of

this text are for that reason twofold: to expose how blogs converting criminal professionals’

paintings practices and to talk about what is far approximately stay blogs that results in those

modifications in expert practices (Flower & Ahlefeldt, 2021).

Relevantly, Dongho & Myoung-Kil (2016), they focus on exploring and analyzing

two vast majority of current legal cases of the abuse power by the wealthy so as to identify

the effects of social media on these types of cases. In spite of the availability of numerous

studies and findings about the tolerance level to proceeds inequality, the following logic is

more appropriate in applying and analyzing the two cases: If public don’t know, see, or

encounter the abuse of the wealthy or revenue inequality, they’re more tolerant of the abuse

and revenue inequality. Moreover, according to Powell (2014) says that, rapid developments

in information and communication have changed the engagement of communities in terms

with the local crime events and justice responses through social media.

Additionally, Lago (2021) stated that "change was unavoidable", as the courts facing

today are required to adopt online trials and online justice in settling cases. In that case, they
could inject such much needed innovation to the entire court system. Relevantly, Pavel

(2019), stated that the old judicial way didn’t offer the online dispute resolution as a correct

approach in settling disputes. But nowadays, online dispute resolution might serve as an aid

to court’s duty. However, it merely suggests that those more complex cases which require

pure legal actions will be resolved privately, following the due process of law and those that

are not complex in nature, can be done through online dispute settlement.

Katsh (2007), there is high potential for successful efforts in online dispute resolution,

while the government is making a legal basis that will create a jurisdiction in the cyber world.

Because in online dispute resolution, people may mediate, negotiate, and arbitrate with any

kind of dispute to come up with a resolution. Moreover, Rule (2020) today’s generation, all

disputes are now being noticed and heard through social media. Concerning this, there is a

big possibility that in the near future court proceedings or all legal procedures might be done

through social media platforms with the interactions of the community.

Today, online dispute resolution is becoming a trend in the Philippines acting as an

informal dispute resolving platform. The online platform is Raffy Tulfo in Action hosted by

Raffy A. Tulfo, an experienced TV Host, Broadcaster, and now, acting as mediator in his

own program. In his program, they entertained complainants who were seeking justice. The

process in his program are; 1. Complainants should go to their office, 2. File a complaint, 3.

The program informed the complained person, and lastly, the scheduling of public online

dispute resolution. According to Nicanor (2021), the show has captured the sympathy of the

Filipino people. It goes to an extent that all types of cases and complaints are being brought

before him. But as the Raffy Tulfo in Action give action to the concerns of people, they also

apply the same process under barangay justice system and it only differs their mode of

application because Raffy Tulfo in Action is done through online platforms.


Efforts of the television show Raffy Tulfo in Action in resolving disputes brought

before their office is appreciated by their clients. They are using their program online to help

people and involve their audiences to comment on their opinions to help and work with the

online program. In this manner, the program gives aid in the many works of our Barangay

Justice System and Courts on the first and second level courts. Due to their immediate

response in every case they have, the people are attracted by their course of action. Therefore,

the people come to their office, file their concerns instead of having it be reported to the

barangay level or any proper government agency that has jurisdiction over their case

(Nicanor, 2021).

The television show Raffy Tulfo in Action accepts cases whose jurisdiction is under

the katarungang pambarangay law. and these are some of the following reported cases to

Raffy Tulfo in Action out of their 7,900 uploaded videos in youtube as of October, 2021.

study is to determine the efficacy of the show “Raffy Tulfo in Action” in handling dispute as

perceived by Barngay Officials of Alfonso, Lista, Ifugao.


Conceptual Framework

On the study of Gaitenby (2004), online dispute resolution is another way of applying

alternative dispute resolution of its practice and theories in addressing cases. It utilizes online

mediation, negotiation, and arbitration as its primary tools and serves as options in order

reconcile the defendant and complainant. Moreover, Rusakova (2020), stated in his article

that online legal procedure was greatly addressed in the supreme court ruling that online

dispute resolution should have its legal guidelines for ever online dispute resolution case in

within the country of Russia. Relevantly, under the Republic Act 7160, also known as “Local

Government Code of Philippines”, which created the “Katarungang Pambarangay Law”, that

all offenses under the jurisdictions of barangay should follow the proper procedures of

barangay justice system and stated that all cases defined in the latter law should undergo first,

before the office of Punong Barangay.

Further, transparent justice boost public trust because being fair through the use of

televising trials as they happen, and giving reporters full access to files and participants so

they can report what happens. Lastly, to show that equal treatment and equal protection of

right are being practiced and observed (McLachlin, 2021). On the other hand, in the study of

Bodo & Szabo (2011), media effectively informs the public on matters of significance to it,

meaning that a healthy and free media are critical to the working or functioning of

democracy. Proceedings being held through media are concluded by the court rather fast by

and effective in resolving disputes.

To understand the conceptual framework clearly, the principle of action model was

utilized in this study. Action model is a pattern that is purposely to give the outline pattern

and process in which the research will go all throughout. It consists of boxes and lines to

make the process more understandable and clear. This will provide a systematic
understanding about legal procedures of katarungang pambarangay, equality and

transparency, and effectiveness of trial by media through social media platforms in giving

justice.

This framework conveyed the perceptions of barangay officials on what are the

implications of social media in giving justice. In the first box, perceptions of the barangay

officials will be determined in relation with the second box, the Tulfo justice’s behavior in

relation to box number three at the bottom, the rendering of justice. The last three boxes are

the variables to be measured, if the Tulfo justice really follows the katarungang pambarangay

law, the tulfo justice portrays equality and transparency, and lastly we want to know the

effectiveness of Tulfo justice in handling and resolving disputes as perceived by the

Barangay Officials.

Statement of the Problem
Relying on online mediation shows to seek justice poses risks and benefits (Haws &

Kong). Hence, this study seeks to determine the efficacy of the show “Raffy Tulfo in Action”

in handling dispute as perceived by Barangay Officials of Alfonso, Lista, Ifugao.

Specifically, the study sought to answer the following questions:

1. What procedures of the Katarungang Pambarangay Law are being observed,

complied, and practiced by Raffy Tulfo in Actions?

2. What is the perceived level of effectiveness of Raffy Tulfo in Action in

promoting equality and transparency in rendering justice?

3. What is the perceived level of effectiveness of trial by media through Raffy

Tulfo in Action in resolving disputes?


CHAPTER II

METHODOLOGY

This chapter presents the research methodology that was used to determine the

perceptions of elected Barangay Officials on the efficacy of Raffy Tulfo in Action in dispute

resolution. Thus, it describes the research method or design, research environment, research

respondents, data gathering procedure, research instrument, and statistical tool.

Research Design

This study utilized a method of Descriptive Research design. Hence, this study

adapted a survey questionnaire, distributed personally. “Descriptive Research aims to

accurately and systematically describe a population, situation or phenomenon. It can

answer What, Where, When and How  questions with the exemption of  Why . A Descriptive

Research Design can use a wide variety of research methods to investigate one or

more variables”, (McCombes, 2019).

Research Environment

The geographic area of our study was located at the northern part of Luzon. It is

within the Cordillera Administrative Region, specifically, in the Municipality of Alfonso

Lista, Ifugao Province. It has 20 barangays with a total population of 34,061 and a total land

area of 347.46 km2.

The researchers in this study had chosen the Municipality of Alfonso Lista as the

locale of study because this is the place where the respondents of the study live in. Moreover,

this place possesses the characteristics that this study looked for and it was the most

accessible locale to conduct this study.

Research Respondents

The participants of this study were all elected barangay officials of Alfonso Lista,

Ifugao, with a total of 160. It consists 140 Sanguniang Barangay members and 20 Punong

Barangay However, only 108 out of 160 respondents because the other 42 respondents

answered no in the qualifying questions of the category 1 of the actual questionnaire. The 108

respondents are composed of 16 Punong Barangayand 92 Sanguniang Barangay members.

Further, all respondents were all in legal age, the youngest was 29 while the eldest was 68

years old. Moreover, purposive sampling was employed in selecting our respondents as this

study revolved on the perceptions of barangay officials. “The purposive sampling technique

is a type of non-probability sampling that is most effective when one needs to study a certain


cultural domain with knowledgeable experts within” (Bogusz, 2020). With this sampling

method of the study, the researchers were able to gather the needed data based on its purpose.

Data Gathering Procedures

The employed type of data gathering was a survey type questionnaire. In using scale

type questionnaire, the accurate data that the researchers needed was acquired. The

researchers based in Republic 7160 in knowing who are the Barangay Officials that this study

would be needing. After all respondents were determined, the researchers prepared and

delivered Letter of Consent to the Punong Barangay informing them as the researcher’s

respondents for their pre-testing of questionnaire in their study in their respective barangay.

Next was the preparation of questionnaire for pre-testing. The researcher went back to each

barangay in their agreed scheduled and pre-testing of questionnaire was conducted. The pre-

testing questionnaire was scrutinized if some changes were needed. Next was before the

actual gathering, the researchers delivered a letter of consent to every Punong Barangay,

asking for permission to be their respondents for the final floating of questionnaire. The

researchers went back in the agreed schedule for the conduct of the data gathering. Lastly,

after all questionnaire were retrieved, the results were computed and data interpretations were

made.

Research Instrument

In this study, survey questionnaire was utilized in data gathering and it’s a self-

administered questionnaire. Likert scale questionnaire was used in gathering data of the

questions. The actual questionnaire was compost of 3 pages. The first page of the

questionnaire was the informed consent letter and the preceding page was the actual

questionnaire, and at the top of it were the barangay designation, age, position, and years in

service. In the second page was the category 1 of the actual questionnaire, as to “how familiar
are the barangay officials in Raffy Tulfo in Action”, and consists of 3 items. Category 2 is,

“which of the following procedures in barangay justice system have the barangay officials

observed complied or practiced in episodes of Raffy Tulfo in Action”, and consists of 8

items, the category 3 of the questionnaire, “what is your level of agreement on the following

statements as regards to the effect or impact of “Raffy Tulfo in Action” to promoting

equality, transparency, and justice in general”, and has 7 items. On the last page was the

category 4, “What is the barangay officials’ level of perception on the impact or effect of the

trial by media through RTI on the level of efficacy of Barangay Justice System”, and consists

of 12 items and at the bottom of same page is the expression of gratitude and assurance of

confidentiality of the respondents.

Likert scale is a rating scale utilized to assess opinions, attitudes, or behaviors. Likert

scales are popular in survey research because they allow you to

easily operationalize personality traits or perceptions (Bhandari, 2021).

The questions for the gathering of data regarding on the study, “Tulfo Justice: An

analysis on the impact of trial by media to the efficacy of barangay justice system”, were

adopted and extracted from related studies, journals, articles and a validated self-made

questions. The category 1 of the questionnaire were the qualifying questions and consist of 3

items that gave satisfaction in the inclusive or exclusive criteria. The no. 1 item on the

category 2 “summons the respondent” was extracted from RA 9285 and from items 2nd until

8th were all adopted from the study of (Agustin et al., 2018). The item no. 1 of the category 3

of questionnaire was adopted from the study of (Abdullah & Chaudhry, 2018), the 2nd item of

the same part was adopted from the study of (Moore et al., 2019), the 3rd and 4th item of

category 3 were adopted also from the study of (Lata & Gupta, 2020), the 5th and 6th item of

category 3 were adopted from the study of (Biber, 2019), and item no. 7 was adopted also

from the study of (Flower & ahlefeldt, 2021). For the category 4 of our questionnaire, the 1 st
to 7th items were all self-made questions and were validated by Atty. Virgo M. Gulan, items

8th to 10th were adopted from the study of (Bali, 2020), and 11th and 12th item were adopted

from the study of (Sastry, 2019).

In conducting the pre-testing of questionnaire, 21 respondents were selected from the

nearby 3 barangays within the municipality of Ramon. The pre-test questionnaire was

distributed through face-to-face distribution, to test the accuracy of every question. The

questionnaire was validated by an expert legal counsel and revised the questionnaire,

patterned with the suggestions of the validator. Next was the distribution of questionnaire for

pre-testing. We keenly observed the behavioral reactions of the respondents while answering

and later asked them if the questionnaire was good or some changes are needed regarding its

terminologies, and they answered, all questions are understandable.

Statistical Tool

The data was described and analyzed using Statistical Packages for Social Sciences

(SPSS) software version 21.0. Frequency and percentage distribution of the demographic

profile of the respondents were obtained. Meanwhile, for the responses of the respondents for

each category, the mean value was utilized as a measure of central tendency. Hence, standard

deviation was utilized for each category.

Ethical Consideration

Before conducting the pre-testing until the floating of actual data gathering through

floating of questionnaire, in respect to the good office of every Punong Barangay and their

Sangguniang Barangay members, assured that we had the Consent Letter from our Research

Adviser or College Dean to conduct the data gathering. As a proof that our actions are legit

and does not disrespect their positions and powers, vested by law. Their rights, privacies and
assurance were explained in the Cover Letter. All their obtained perceptions, does not destroy

their image to the community and their position as public officials.

CHAPTER III

RESULTS AND DISCUSSIONS

This section presents the interpretations of the result of the study from the respondents

of all Barangay of Alfonso Lista, Ifugao. It aimed to measure the level of compliance of

Raffy Tulfo in Action to the Katarungang Pambarangay Law. Determine how they practice

equal and transparent approach and their effectiveness in resolving disputes and reconciling

disputed parties.

Table 4 shows the perception of Barangay Officials on the level of compliance of

Raffy Tulfo in Action in Katarungang Pambarangay Law.

As shown in the table, the overall mean of the perception of the Barangay Officials on

the compliance of Raffy Tulfo in Action on the procedures of Katarungang Pambarangay is

3.32 which is rated as “Often”. This implies that Barangay Officials perceive the show Raffy

Tulfo in Action observes, complies and practices the proper procedures under Katarungang

Pambarangay Law. According to Rusakova (2020), online legal procedure was greatly

addressed in the supreme court ruling that online dispute resolution should have its legal

guidelines for ever online dispute resolution case in within the country of Russia.

However, it is also interesting to note that procedure pertaining to providing other

options to reconcile parties, as placed in item 8, obtained the highest mean of 4.00, rated as

“Always”. This means that the Barangay Officials perceive that the show constantly offers

other alternative in reconciling the disputing parties.

Conversely, items 5 and 8 both obtained the lowest mean with 3.19 but are also rated

“Often”. This implies that the show regularly gives summon the complained person and

drafts a little complain or counter claim for filing as perceived by the Barangay Officials.

Table 2 shows how the elected Barangay Officials perceived the equality and

transparency of the show, Raffy Tulfo in Action in resolving disputes.

With a mean of 2.09, the respondents rated item 2 as “Agree”. This implies that the

elected Barangay Officials perceived that the show boosts public trust to the justice system.

According to McLachlin (2021), open justice boost public trust due to its transparency and

equality that people always observed. Trials being done through media world has a great

impact to people, like the accessibility and restriction are open to public. Moreover, it builds

the connection between online trial and online user, as well as the people were enlightened

and believe that online justice is way more effective than traditional trial.

Overall, majority of the respondents “Agreed” that the show practices equality and

transparency with an overall mean 2.02. This implies that the show practiced equal and

transparent approach in resolving disputes.

This tables shows how the elected Barangay Officials perceived the effectiveness of

the show Raffy Tulfo in Action in resolving disputes.

As shown in table, it is noteworthy to mention that the elected Barangay Officials

perceived the show “Effective” particularly in item 6 and 10 which were rated “1.69”. This
implies that the show in terms of resolving all complaints being brought before their office

and allowing all people with severe disability to participate during hearing were rated by the

elected Barangay Officials “Effective”. According to Bodo & Szabo (2011), Media

effectively informs the public on matters of significance to it, meaning that a healthy and free

media are critical to the working or functioning of democracy. Online dispute resolution that

are done widely through media are concluded by the courts rather fast by and effective.

Moreover, Verma, Banwari, & Pande (2019), cited that in today’s generation, online dispute

resolution is effective in handling and resolving disputes through online media; it is cost-

effective, not time consuming, and a faster way than the traditional method of dispute

resolution.

Generally, the elected Barangay Officials perceived the show “Effective” with an

overall mean of 1.61. This implies that the show in resolving disputes and rendering justice to

the people is “Effective”, as perceived by the respondents.

CHAPTER IV

CONCLUSIONS AND RECOMMENDATIONS

Conclusions

Based on the findings of the research study, the following conclusions were drawn:

1. The perceived level of compliance of Raffy Tulfo in Action with proper procedures

was determined often. Implying that the respondents perceived the show resolved disputes by

following proper procedures of Katarungang Pambarangay Law.

2. The perceived level of agreement of elected Barangay Officials if Raffy Tulfo in

Action practiced and executed their equal and transparent approach in dealing disputes and
rendering justice. This implied the Tv Show gained the public trust by practicing equal

judgement and transparent approach without malice, prejudice and ill-will.

3. The perceived level of effectiveness of Raffy Tulfo in Action by the elected

Barangay Officials was effective in dealing disputed matter patterned with Katarungang

Pambarangay Law, implying that the Tv Show is effective for almost all their actions and

proceedings.

Recommendations

Based on the conclusions, the researchers recommend the following:

1. The Raffy Tulfo in Action should always assure that they observe, comply, and

practice Katarungang Pambarangay Law as their blueprint in handling disputes.

2. Improvement of the show in their equal and transparent approach must be done to

render efficient execution of their approach.

3. Extensive enhancement to their strategies in reconciling disputed parties should be

more effective and must be planned.

4. The future researchers may include the Age of their Respondents to know if there is

bearing of their age on how they perceived about the show and where the program was being

viewed (Free TV, Facebook, and Youtube).

5. The future researchers may study, if the years in service of the respondents has a

bearing to their perceptions towards the Raffy Tulfo in Action as a mean of trial by media.
