1. Name of the law that needs amendment:


Administrative Order (AO) No. AHS-2008-013 with the subject “Rules and Regulations
for the Use and Operation of Motorcycles on Highways”
Definition: The LTO, back in 2008, published Administrative Order (AO) No. AHS-2008-013
with the subject “Rules and Regulations for the Use and Operation of Motorcycles on
Highways”. Under Section IX C Miscellaneous Traffic Rules of the said AO, “A driver/rider
shall observe the rule and stay on one lane per one vehicle only. Lane splitting is prohibited
along a road or a highway. Motorcycles or scooters shall not [be] operated on sidewalks.”

2. 3 Advantages:
• The advantage of this law is that it will make it easier for other vehicles to pass,
hence decreasing the probability of collisions.
• It creates organized and smooth traffic flow as it is safer to change lanes when motor
riders obey traffic rules.
• It reduces congestion in wider roads.

3. 3 Disadvantages:
• Our roads are small and can hardly accommodate the volume of traffic, so the
authorities are not implementing this rule.
• The law is very general. It is plausible that it will endanger the other vehicle, especially
in the fast lane, where drivers frequently cut in front of others.
• Lane-splitting makes it difficult to avoid a collision. It traps motorcyclists into a narrow
space, making it all but impossible to veer out of the way of trouble. This is especially
dangerous if there is a hazard in/on the road, such as a pothole or debris, or if a car
pulls out in front of them. However, it was not specified in the law where and how
should it be regulated.

4. Gray Areas to amend and why it needs to be amended:


This certain law has not yet regulated the behavior of riders when it comes to lane splitting.
Although lane-splitting is already illegal, it was not implemented under this law and no clear
specification of areas and sanctions for violators. This should be amended because of its lack
of specifications, proper implementation, and knowledge among riders. Since this law was
made years ago, motorcycle riders tend to forget the importance of this law and some do not
know the existence of such law. Hence, certain amendments should follow.

5. Recommended Amendments
• Identify the areas that need the implementation of no lane splitting.
• There should be penalties for riders who commit lane-splitting in roads. The
implementation of this law will begin with the coordination of the agencies. By imposing
severe penalties, we can reduce the number of traffic accidents nationwide. By
imposing fines of increasing severity until the violator's legal documents are revoked.
• The recommendation of this law is to hold a lecture just for vehicle operators. Riders
of motor vehicles have a propensity to disregard road difficulties; therefore, adding
seminars to the process of obtaining a driver's license will provide them with the
necessary knowledge of how vehicle movement works and also provide them with
information about the dos and don'ts on the road.
