2. Bids will be received online by Accepting Officer up to the date and time
mentioned in the Notice Inviting Tender (NIT). No tender/bid will be received
in physical form and any tender/bid received in such manner will be
treated as non bonafide tender/bid.
3. Bid will be opened on due date and time fixed for opening in the
presence of tenderers/bidders or their authorized representatives, who have
uploaded their quotation bid and who wish to be present at the time of
opening the bids.
5. Unenlisted contractors are required to submit the scanned copies (in pdf
file) of documents required as per eligibility criteria mentioned in instructions
for filling the tender documents and Appendix ‘A’ to Notice Inviting Tender
(NIT) along with EARNEST MONEY DEPOSIT (EMD) (As applicable) and tender
f ee on e- procurement portal and submit the physical documents in the
office of Chief Engineer Chennai Zone, C h e n n a i – 6 0 0 0 0 9 within time
limit specified in NIT. Inadequacy/ deficiency of documents shall make
the bid liable for rejection resulting in disqualification for opening of
finance bid.

6. Contractor having not executed Standing Security Bond and Standing
Security Deposit in any MES formation shall upload scanned copy of EARNEST MONEY
DEPOSIT (EMD) (As applicable) mentioned in Notice of Tender and shall ensure receipt
of hard copy of EMD in the office of tender issuing authority before date & time
fixed for this purpose. In case of failure to abide by any of these two requirements, the
finance bid will not be opened.
8. Enlisted contractors of MES shall submit the scanned copies (pdf file) of
enlistment letter, tender fee and such other documents as mentioned in Appx. A’ to NIT
on e-procurement portal and submit physical documents in the office of Chief
Engineer Chennai Zone, Chennai – 600 009 before date & time fixed for this
purpose.
9. The contractor must ensure that the tender/ bid on the proper form is
uploaded in time as the Accepting Officer will take no cognizance of any
quotations/ offer received in any other electronic or physical form like email/ fax/ by
hand/ through post from tenderer/ bidder even if they are received in time.
11. Keeping in view the applicability of Goods and Service Tax (GST) on all
contracts, it is mandatory for the contractors to upload their GST Registration No.
along with the T-Bid. This will be one of the criteria for qualifying in T-Bid. A Contractor
who does not upload GST Registration No. shall be disqualified in the T-Bid
evaluation and his Finance Bid shall not be opened.
12. General Conditions of Contracts (IAFW-2249) (1989 Print) and errata and
amendments thereto, Schedule of Minimum Fair Wages and MES SSR (Part -I (2009)
and Part –II (2020) are not uploaded with these documents. These are available for
perusal in the Office of GE concerned and this office.
13. The bidders are deemed to have made themselves acquainted and fully
conversant with contents of above mentioned documents not uploaded before
submission of their bid and no claim whatsoever on this account shall be
entertained.
14. Instructions to be complied with by the bidder(s) are also given separately which
shall be complied with.
15. This letter and instructions mentioned above shall form part of the tender
documents.

16. COVERAGE OF BUILDING AND CONSTRUCTION WORKERS (BACW) IN THE
SCHEME FRAMED UNDER EMPLOYEES PROVIDENT FUNDS AND
MISCELLANEOUS PROVISIONS (EPF & MP ACT)
16.2. It is the responsibility of the contractor to ensure that all the workers
engaged by him/them are having universal account number (UAN) duly allotted by
Provident fund department and their contributors are properly credited into their
account. A certificate to this effect shall be furnished by the contractor while
claiming final bill.
17. Please note that the unit rate quoted in BOQ shall be deemed to be
inclusive of all applicable taxes, levies, Goods and Service Tax (GST), labour welfare
cess, Employees Provident Fund etc as on last bid submission date.

1.1 All the bidders i.e who are not enlisted with MES/who are enlisted but have
not executed the Standing Security Bond are exempted from
submission of Earnest Money Deposit. However, these bidders shall be
required to submit the following bid submission declaration duly signed and
upload along with Cover I Documents:-
I/we hereby understand and accept that if I/We withdraw or modify my/our bid
during the period of validity, or if I/We are awarded the contracts and on being called
upon to submit the performance Security/Security Deposit before the deadline
defined in the request for bid documents/Notice Inviting Tender, I/We shall be
debarred from exemption of submitting Bid Security/Earnest money deposit for a
period of six months, from the date I/We are declared disqualified from exemption from
submission of earnest money deposit/security deposit for all tenders issued by
MES during this period.
Signature of Contractor
1.2 In case of those bidders not under purview of declaration, shall submit
earnest Money Deposit as detailed in Notice of Tender in one of the following
forms, alongwith their tender/bid :-
(b) Receipted Treasury Challan for the amount being credited to the
Revenue Deposit of Garrison Engineer Avadi Chennai.
1.3 It is advisable that Earnest Money is deposited in the form of deposit call
receipt from an approved Schedule Bank for easy refund. In case the
tenderer/ bidder wants to lodge' “EARNEST MONEY DEPOSIT” in any other
form allowed by MES, a confirmation about its acceptability will be obtained from
the Accepting Officer well in advance of the bid submission end date and time.
Earnest Money Deposit shall be submitted in the name of concerned GE.

2.1C Refer Para 2.1 to 2.1B above, Condition 19 of IAFW 2249 shall be amended
accordingly.
2.2 The Performance Security shall be in favour of Accepting Officer and shall be in
any of the forms mentioned above. Work Order No. 1 shall be placed
only aft er submission of Performance Security of adequate value by
the contractor . In case a fixed deposit receipt of any Bank is furnished by the
contractor to the Government as part of the Performance Guarantee and the
bank is unable to make payment against the said deposit receipt, the loss
caused thereby shall fall on the contractor and the contactor shall forthwith on
demand furnish additional security to the Government to make good the deficit.
2.3 If the performance security is provided by the successful Contractor in the form of
Bank guarantee, it shall be issued by Nationalized/Scheduled Indian Bank
but its confirmation shall be from the Head Office of the Bank.
2.4 The period of validity of the Bank Guarantee Bond against Performance Security
shall be initially valid upto the stipulated date of expiry of Defects Liability
Period plus minimum 60 days beyond that. In case final bill is not paid during
this period, the contractor shall get the validity of Performance Guarantee
extended to cover such enlarged time required for payment of final bill.

2.5 Failure of the successful contractor to comply with the requirements of sub-
clause 2.1 shall constitute sufficient grounds for cancellation of the award of
work and forfeiture of the Earnest Money. In case of MES enlisted
contractor amount equal to the Earnest Money stipulated in the Notice Inviting
Tender shall be notified to the tenderer for depositing the amount through
MRO. Issue of tender to such tenderers shall remain suspended till the
aforesaid amount equal to the Earnest Money is deposited in Government
Treasury.
2.6 All compensation or other sums of money payable by the contractor to the
Government under the terms of this contract or under any other contract with
Government may be deducted from or paid by the sale of a sufficient part of the
Bank guarantee or from the interest arising there from or from any sums which
may be due or become due to the contractor by the Government on any
account whatsoever and in the event of his Performance Security being
reduced by reason of any such deduction, or sale as aforesaid, the contractor
shall within ten days thereafter make good in cash or securities, endorsed as
aforesaid, any sum or sums which may have been deducted from or realized by
the sale of his Performance Security or any part thereof.
2.7 Government shall not be responsible for any loss of securities or any
depreciation in the value of securities while in their charge nor for loss or interest
thereon.
2.8 In the event of contract being cancelled, under Condition 52, 53 & 54 of General
Conditions of Contract, the Performance Security shall be forfeited in full
and shall be credited into Consolidated Fund of India.
3.2 All the documents as stipulated should be scanned and uploaded in the 'pdf
form and 'xls' form as indicated.
3.3 Bid (quoted BOQ) shall be uploaded on www.defproc.gov.in portal on or before
the bid closing date mentioned in the tender. No physical form of the bid will be
submitted. In case, bid submitted in physical form by any bidder, then the e-bid
submitted by the firm will also be treated as non-bonafide and will not be
admitted.
3.4 Bid should be DIGITALLY signed using valid DSC. All pages of tender
documents, corrections/ alterations shall be signed/ initialled by the lowest
bidder after acceptance.

3.5 Drawings, if issued in physical form, must be returned duly initialed by the
tenderer/ bidder in separate envelope indicating his name and address.
3.6 The tender shall be signed, dated and witnessed at all places provided for in the
documents after acceptance. All corrections shall be initialed. The Contractor
shall initial every page of tender and shall sign all drawings forming part of the
tender. Any tender/ bid, which proposes alterations to any of the conditions
whatsoever is liable to be rejected.
3.7 In the technical bid, a scanned copy of Power of Attorney in favour of the person
uploading the bid using his/ her DSC shall be uploaded. In case the digital
signatory himself is the sole proprietor, scanned copy of an affidavit on stamp
paper of appropriate value to this effect stating that he has authority to bind
the firm in all matters pertaining to contract including the Arbitration
Clause, shall be attached in 'pdf' form. In case of partnership concern or a
limited company, digital signatory of the bid/tender shall ensure that he is
competent to bind the contractor (through partnership deed, general power
of attorney or Memorandum and Articles of Association of the Company) in all
the matters pertaining to the contracts with Union of India including
arbitration clause. A scanned copy of the documents confirming of such
authority shall be attached with the tender/bid in 'pdf form, if not submitted
earlier. The person uploading the bid on behalf of another partner(s) or on
behalf of a firm or company using his DSC shall upload with the tender/
bid a scanned copy (in 'pdf' form) of Power of Attorney duly executed in his
favour by such other or all of the Partner(s) or in accordance with
constitution of the company in case of company, stating that he has
authority to bind such other person of the firm or the Company, as the case
may be, in all matters pertaining to the contract including the Arbitration
Clause.
3.8 Even in case of firms or companies which have already given Power of
Attorney to an individual authorizing him to sign tender and in pursuance of
which tender documents are being signed by such person as a routine, fresh
power of attorney duly executed in his favour stating specifically that the said
person has authority to bind such partner (s) of the firm, or the company as the
case could be, including the condition relating to Arbitration clause should be
uploaded in 'pdf' form with the tender/bid.

3.12 In case of a company, Power of Attorney shall be executed in accordance with the
constitution of the company.
3.13 Bids to be submitted online well in time before stipulated date of bid
submission.
3.14 The contractor shall employ only Indian Nationals after verifying their
antecedents and loyalty. Attention is also drawn to special condition 3 and
also conditions 24 and 25 of IAFW-2249 (General conditions of contracts).
3.15 The tenderer shall quote his rates on the BOQ/ revised BOQ file only. No
alteration to the format will be accepted and the same will be treated as
disqualified bid.
3.16 In case the tenderer/ bidder has to revise/ modify the rates quoted in the BOQ
(excel sheet) he can do so only in the BOQ, through
http://defproc.gov.in site only before the bid closing time and date.
4.1 In the event of bidder/ tenderer revoking his offer or revising his rates
upwards/ offering voluntary reduction, after bid submission end date and time
his offer will be treated as revoked and the Earnest Money deposited by him shall
be forfeited. In case of MES enlisted contractors, the amount equal to the
Earnest Money stipulated in the Notice of Tender, shall be notified to the
tenderer for depositing the amount through MRO. Such contractors shall
remain suspended till the aforesaid amount equal to the earnest money is
deposited in Government Treasury. In addition, such bidder and his related
firm shall not bid in second call or subsequent calls. Reduction offered by the
bidder on freak high rates referred to the bidder for review shall not be treated as
voluntary reduction.
5.2 The bidder is expected to be fully conversant with the CPM technique and employ
technical staff who can use the technique in sufficient details. Sufficient
books and other literature on the subject are widely available in the market which
the tenderer/ bidder may make use of.

6. A hard copy of contract agreement will be prepared on the basis of all the
documents uploaded by the department and the quoted BOQ uploaded by the
bidder and will be signed by the authorized person(s).
7. No out of pocket expenditure incurred by bidder for quoting the bid will be
reimbursed.

1. A tender/ bidder who is qualified as per the eligibility criteria mentioned in the
tender documents and has interalia sound past record is hereby authorised to
tender for the above work. The tender/bid (both COVER-1 & and COVER-2) shall
be submitted/ uploaded on the MES website portal (https://defproc.gov.in) in
electronic form duly digitally signed by the authorised Signatory as per time and date
mentioned in tender documents. The requisite documents as mentioned in the tender
shall be physically delivered at the Office of the Chief Engineer, Chennai Zone
Chennai - 600 009 as per time and date mentioned in tender documents and

2. All quantities indicated under Col.5 of all parts of Schedule ‘A’ except Part–I
are provisional.
3. Description of buildings, works and services given in various parts of Sch `A'
are brief. These are deemed to be amplified and read in conjunction with
Special Conditions, Particular Specifications, specifications for materials and
workmanship and conditions in relevant trade sections of MES Standard
Schedule of Rates (Part-I of 2009 for Specifications and Part-II of 2020 for
Rates) and contract drawings.
4. The `Unit Rates' inserted by MES under column 4 of Sch ‘A’ Part I t o X
have been worked out at par MES Standard Schedule of Rates 2020
including amendments/ errata as indicated in tender page herein after at
the rates analogous thereto. The accuracy of the ‘Unit Rates' is
however not guaranteed. The tenderers attention is invited to Condition 6-A
sub Para (B) of IAFW-2249 (General Conditions of Contracts).

5. Schedule ‘A’ XII to XV are not pre priced by MES. The bidder is required to work
out unit rate for each item of these Schedules independently. The unit rates
shall be inserted in figures in BOQ.
7. PERIOD OF COMPLETION:
7.1 The entire work covered under this contract shall be completed within a period
from the date of commencement of work as mentioned in WO (to be given by GE),
in phases as given below: -
7.2 Two separate work orders will be issued under this contract as follows:-
7.3 Work Orders indicating date of handing over site, date of commencement &
completion of Phase-I works shall be issued be GE after acceptance of tender. The
works covered under Phase-I shall be taken over by the GE after certified date of
completion. Final bill for the works covered in Phase-I shall be paid to the
contractor after satisfactory completion of Phase-I in terms of General Conditions
of Contracts (IAFW-2249).
7.4 The completion certificate will be issued for each phase separately by GE in terms
of condition 49 of IAFW-2249. However, the defects liability period of Twenty Four
months for the entire work shall commence from the certified date of completion
of Phase – I subject to NIL defects. There will be two final bills i.e. first final bill
shall be paid after physical completion of Phase-I and the second final bill shall be
paid after physical completion of Phase-II.

8. If specification for any fittings/ fixtures are not given any where in tender
documents, the same shall be provided conforming to ISI or latest standard make
and specifications as approved by GE.
10. Probable layout of buildings are indicated on drawing for Site Plan. These are
tentative and may be varied wherever necessary at the discretion of the GE. The
contractor shall not be entitled for any claim on account of any such variation.
11. Contractor shall visit the site before quoting tender and ascertain the facts regarding
the factors affecting the execution of the work such as availability of materials,
disposal of earth, accessibility to the site, availability of labour & other issues related
to labour, etc,. The quoted rates/ amounts quoted by the contractor are deemed to
include all these factors including relevant statutory instructions as applicable.
12. Permission for the usage of any of the existing facilities such as approaches, if
available can be granted by the GE on written request from the contractor stating
that any damage caused due to usage of the same shall be made good by the
contractor at no extra cost to the Govt. On the contrary if the contractor fails to
make good the damages caused as above, these damages shall be made good and
brought back to the original standard by the department at the risk & cost of the
contractor. GE’s decision in this regard shall be final, conclusive and binding.
13. The unit Rates inserted under column 4 of Sch ‘A’ P art-I t o X and the
un it r ate quoted by the bidder under Sch ‘ A ’ Part XII t o XIV shall be
deemed to include for materials and labour or Supply and Fix complete,
unless specifically stated otherwise in these tender documents.
14. The tendered shall calculate his own amount and insert lumpsum/ unit rate
amount against each parts of Schedule 'A' in the BOQ. The lumpsum quoted by
the tendered shall be based on the description of items in Sch ‘A’ drawings and
specifications mentioned in the tender documents. It is an express condition
of the contract that the lumpsum quoted in the tender for various items of work
shall be deemed to include for the full and entire completion of the items of
work in accordance with the provision of the contract including necessary
testing. The Govt will not entertain any claim, whatsoever on account of
inaccuracies/ misunderstandings, if any in the aforesaid lumpsum amounts.
15. The under mentioned remarks shall be deemed to have been inserted in
respective columns of Schedule `A' against each items:-

16.2 `Unit Rates' inserted in column 4 of Sch `A' Part I shall be deemed to include the
following:-
a) All built in items shown on drawing.
b) Supply and fixing of HDPE water tanks.
c) Cutting chases for concealing GI pipes, PVC conduits, terminal
boxes/ metal flush boxes and making good the disturbed surfaces to match
with the adjoining surfaces etc.
d) Providing holes and making good same for fixing exhaust fan etc. e)
e ) Forming holes in/through walls, floors etc. where required and
making good the disturbed surfaces to match with the adjoining
surfaces.
f) Sanitary appliances, fittings and fixtures such as water closets,
flushing cistern, wash hand basins, Sinks etc. as shown on drawing.
g) Gully traps, Nahani traps/floor traps.
h) Waste pipe connection from Nahani traps, from wash hand basin to Nahani
traps etc.
i) Fan hooks and fan boxes.
j) Anti-termite treatment to the buildings given in Sch ‘A’ Part I (Sl Item No.1
as mentioned in particular specifications here-in-after.
k) Plinth protection with saucer drain as shown on drawing l) All
other miscellaneous item(s) shown in drawings
m) E x c a v a t i o n & E a r t h w o r k in PS clause 2.1 to 2.6 here in after.
n) Roof treatment as shown on drawing and the same shall be deemed to include
in the lump sum rate quoted.
o) Items not shown on drawings or mentioned elsewhere which are
needed for functional completion of buildings.
16.3 No price adjustment to lump sum rates in Sch `A' Part-I shall be made for cutting
chases, forming holes etc. in the event of any variation in provisional
items under above schedules.
16.4 In case details in respect of same items shown on main drawings are not given
in the drawings referred to in the main drawings, then the same shall be followed
from any other drawings included in the list of drawings.

16.7 All soil pipes shall be taken, vertically below ground level to a depth as
required but exceeding 30 cm and not exceeding 60 cm from finished ground level and
shall be provided with a bend at the lower end and connected upto first manhole with
required slope.Irrespective of what is shown on drawing , the first manhole shall be
at a distance of 2 metre from the respective external face of wall. Waste pipe from
Nahani trap to gully trap shall be 75 mm bore UPVC pipe. The quoted lump sum for
Sch `A' part I shall be deemed to include the cost of UPVC soil pipes as
mentioned above upto first manholes and UPVC waste pipes upto and including gully
traps and 100mm dia SWG pipe from gully trap to first man hole. All sewage
work including first manhole beyond the above limit shall be measured and paid
under provisional items. The cost of man hole inside shaft shall be included in the
lump sum quoted.
17. SEWAGE TREATMENT PLANT UNDER SCH ‘ A ' PART XIII
17.1 The scope of work covered under Sch ‘A’ Part XIII under this contract is entire
completion of works covered under BOQ for Sewage Treatment Plant of 450 KLD capacity
under GE OD Avadi based on Aerobic attached growth Moving Bed Bio Reactor
(MBBR) technology which includes construction of Civil works, piping, electrical &
instrumentation and other items of work required for commissioning of the plant
(Other parameters are mentioned in Sch ‘A’ Part XIII of BOQ details, Particular
specifications and drawings). The Design Data and specifications are given in the annexure
to Particular Specifications. The Tenderers have to quote the rates in BOQ for STP after
going through the Design Data given in Particular Specifications as Annexure –I.
17.2 Procurement action and commencement of work shall be undertaken only after
approval of scheme as well as other details by GE.
17.3 On receipt of Sewage Treatment Plants, sub-systems and connected accessories at site
of work, GE shall inspect the whole items to ascertain the quality. In case, the quality of
plant and accessories are found not satisfactory with respect to specification and
standards as detailed in the tender documents, the same will be rejected. GE reserves the
right to accept or to reject the plant, sub-systems and accessories according to the
requirement and contract conditions.’
17.4 Concrete foundation or platform details and details of grouting work as required at
site shall be submitted to GE well in advance for approval as per the requirement of OEM.
18.1 The performance of the plants operated under design conditions as specified in
the bid documents specifications shall be guaranteed for its process performance.
Performance of the individual units and the total treatment plants, ultimate quality
of the treated effluent from the effluent conditions, guarantee for utilities including
power and chemical consumption as specified in the process.
18.2 Performance test shall be started when the plant is stabilized under design
conditions. The plant shall be operated and controlled in accordance with procedures
set up. The comparison of the performances measured during performance test and
performance guarantees mentioned in the bid documents shall be ensured. The
guaranteed performance shall be average of data obtained during the period the plant was
stabilized with in the 72 hours of the performances test under consideration.
Representative of Accepting Officer (IEM) will inspect and test the plants and furnish
certificate thereon for effective functioning the plants. All necessary arrangements
including chemicals as required for performance testing by representative of Accepting
Officer shall be made by the contractor at no extra cost.

18.3 Procurement action and commencement of work shall be undertaken only after
approval of scheme as well as other details by GE.
18.4The Contractor shall carry out Shadow Analysis at the site and accordingly design
the layout considering optimal usage of space (inside & outside the plant rooms). The
schematic drawing as designed by the contractor shall be got approved by GE well
in advance. The Contractor should submit the layout drawings to GE for approval.
GE reserves the right to modify the layout and specification of the systems and
components as per site conditions/ requirements.
18.6 Concrete foundation or platform details and details of grouting work as required
at site shall be submitted to GE well in advance for approval.
19.1 The performance of the plants operated under design conditions as specified in
the bid documents specifications shall be guaranteed for its process
performance. Performance of the individual units and the total treatment
plants, ultimate quality of the treated effluent from the effluent conditions,
guarantee for utilities including power and chemical consumption as
specified in the process.
19.2 Performance test shall be started when the plant is stabilized under design
conditions. The plant shall be operated and controlled in accordance with
procedures set up. The comparison of the performances measured during
performance test and performance guarantees mentioned in the bid
documents shall be ensured. The guaranteed performance shall be average of data
obtained during the period the plant was stabilized with in the 72 hours of the
performances test under consideration. Representative of Accepting Officer
(IEM) will inspect and test the plants and furnish certificate thereon for effective
functioning the plants. All necessary arrangements including chemicals as
required for performance testing by representative of Accepting Officer shall be
made by the contractor at no extra cost.
19.3 A sum equal to 2.5% on the amount of STP at contract rates plus further
enhanced by 25% subject to minimum of Rs.3,00,000/- (Rupees Three
Lakh only) whichever is more shall be retained by the Government from the
contractor’s dues as security deposit for the efficiency of the STP plant, which
shall be refunded to him after completion of Phase – II.
19.4 The Guarantee bond for 60 months against efficiency of STP Plants shall be
furnished by the main contractor as well as nominated/ approved OEM.

20. General:
20.1 While informing completion and requesting for issuance completion certificate
contractor shall submit following drawings to Engineer-in-Charge and GE along
with his letter:-
(a) Three sets of B/R & E/M site plan marked with external services as
executed.
(b) One set of architectural drawings and structural drawings duly
incorporating changes, if any during execution.
(c) Schematic drawings of internal water supply and internal
electrification in a cloth bound tracing sheet.
(a) Drawings of pump room with duty staff room
(b) Schematic drawings for STP system & plants and pipelines in triplicate
(f) Test Reports of the treated water within the limits atleast for the period of
seven days.
21. The contractor shall provide digital photographs taken at various stages as
decided by GE during the progress of work and submit the same with RAR. Two
copies (A4 size) and two soft copies (CD) of each digital photograph shall be
submitted by contractor to GE. The unit rates against Sch ‘A’ Part-I shall be
deemed include the cost of above provision and nothing extra payable on this
account. In the event of failure by contractor to submit the same along with RARs,
an amount of Rs.10,000/- (Rupees Ten thousand only) will be recovered
proportionately from the contractor.
22. The contractor shall submit record drawings of the completed buildings in A1 size
polyester film and one blue print along with a CD showing all changes shall be
submitted by the contractor within 30 days of issue of completion certificate
failing which an amount of Rs. 20,000/- (Rupees Twenty thousand
only) will be recovered.
23.1 Scope of work under this contract comprises of comprehensive maintenance &
operation of Sewage Treatment Plant. The Schedule ‘A’ lists out the scope brief
and further amplified in succeeding Paras of efficient and smooth
functioning of the system to meet the desired output efficiency and to have the
requisite data.
23.2 The contractor shall advice his operating personnel to take all precautions and
always be alert so as to prevent any accident. In case of any accident/ injury/
or partial disability to his employee, the contractor shall solely be responsible
for setting all claims/ compensation. Department will have a right to recover
any sum indicated/penalty imposed by labour commissioner/ Court
directives. Contractor shall get his staff/ labour insured.

23.3 Initially after completion of Phase I works the installations shall be taken over
by the department immediately, the installation with an inventory of various
items, equipment and electrical fittings will be handed over to contractor for
proper maintenance and upkeep.
23.4 The tenderer shall submit names of the workers to be employed with their
qualifications for comprehensive maintenance and operation of the plant. The
contractor shall be responsible t o verify the antecedents of the
workmen employed by him and shall submit the Police verifi cation
certifi cate t o GE before employing them for the subject work/
Comprehensive m aintenance and operation of Sewage Treatment
Plant. Contractor has to pay for fees if the rules of Police Dept. have the
provision of the same. The unit rate quoted for the relevant items shall be
deemed to include the above aspect.
23.5 The contractor shall submit valid ID proof, address proof, age proof,
certificates of educational qualifications, 03(Three) Passport size photographs to
the Engineer-in-Charge for the purpose of record and obtaining temporary
security pass to enter into working Area.
23.6 The installation standing orders and Defence area’s security rules as
intimated by GE/Engineer-in-Charge will be strictly adhered to by the
contractor and his employees. Any violation by the contractor’s employees will
be severely dealt with including handing over them to Police custody
especially if any individual is found in intoxicated condition. Contractor shall
ensure compliance and strictly warn the individuals on this account.
23.7 The installation shall be totally under the control of contractor Sewage
Treatment Plant and all STP equipments shall be kept fully functional and
contractor shall ensure repair/ replacement of equipments/ part thereof if any,
immediately at no extra cost to department.
23.8 The installation shall be frequently visited by the MES officers. It shall be
contractor’s responsibility for proper upkeep of the area in a presentable
state all the time. Surrounding areas up to fencing shall be kept clean and
cleared of bushes/ shrubs and grass all the time to give neat & clean
appearance of the area.
23.10 Comprehensive maintenance and operation shall be got done through trained and
skilled staff for effective and safe working of the Sewage Treatment Plant. In case
any laxity is noticed by the GE on the part of the contractor in operation of
plant efficiently and which in the opinion of GE, may affect output of the
plant and/or safety of electrical installations, immediately corrective action(s)
as directed by the GE shall be taken by the contractor. GE’s decision in this
regard shall be final and binding.

23.11 The Comprehensive maintenance of the plants provided under this contract
shall be done all as given in the tender documents and as directed by the
Engineer-in-Charge and GE.
23.12 The contractor shall be fully responsible for maintaining the plants in
operational condition in consultation with Engineer-in-Charge and GE.
23.13 Any damage caused to the plants or any part thereof except for the accepted
risks as per condition 48 of IAFW-2249, shall be made good by the contractor
under his own arrangement as per the specifications given in the contract
without any extra cost to the Government.
23.14 The contractor shall be responsible for any claim whatsoever arising due to any
reason for the workmen employed by him.
23.15 The cost of Supply and replacement of worn out/defective parts, each and
every type of repairs, renewals, servicing and submitting report for efficient,
smooth and continuous functioning of plants shall be deemed to include in the
unit rates of Schedule of works/BOQ.
23.17 Sufficient reserve for required parts/ spares and T&P shall always be kept at site
all the time by contractor for smooth and continuous functioning of the
plants.
23.19 The work under this part listed in Schedule ‘A’ Part XIV shall run for a period of
02 years during defects liability period Work orders shall be placed separately by
the GE for these periods.
23.20 The contractor’s staff deployed shall be fully conversant with various checks/
maintenance needs of various equipments installed including its frequency.

23.23 The recovery rate as follows shall be made from payment of the contractor in the
following exegency :-
a) Operator found absent from duty @Rs.300/- per shift per person.
b) Not carrying out Testing of water sample @ Rs.2500/- each.
c) Not maintaing log sheet/Log book @ Rs.300/- per day.
d) Not maintaining designed parameters @ double the rate quoted rate per shift
by the contractor.
24.1 The contractor’s quoted rate shall be inclusive of the charges for imparting
training of one month to MES/ User’s staff to run and maintain the plant system
before completion of the work.
27. Contractor may use Mechanical devices required for excavation in trenches,
without any extra cost to Govt. However, payment shall be done only for the
authorized width as per drawings and preambles of SSR, irrespective of the actual
width excavated. The unit rate quoted shall be included for such provisions,
contractor shall have no claim on this account.
28. YARDSTICK
28.1 The yardstick shall be prepared by JE (Civil) & AGE of concerned Sub
Division immediately on conclusion of contract, indicating percentage
payment to be made for each stage of the building with supporting details i.e,
Detailed Estimate submitted by the contractor and shall be technically
checked by JE (QS&C)/AGE (C) of GE office and shall be submitted to the office
of CWE for further technical check by DCWE(C)/ACWE (C) of CWE office.
Yardstick shall be approved by the CWE. Copy of approved yardstick shall be
forwarded to the office of Accepting Officer for his record and comments.
28.2. The yardstick shall be finalized well in time so that the payment of RARs is not
held up on this account. The 3rd RAR will be paid by the GE only after
technical check and approval of yardstick. Payment against lumpsum
building shall be made as per approved yardstick. Payment against lumpsum
buildings shall be allowed in 3rd RAR and onwards to contractor only after
yardstick for buildings /structures finalized and approved by CWE.

29.1 Contractor may use crushed stone sand produced from hard stone having cubical
shaped particles with grounded edges of ground gradation for concrete and
masonry work without any price adjustment in lieu of natural sand/river sand.
29.2 Crushed stone sand for concrete work shall conform to materials specifications
and grading within the limits of grading zones II to III all as specified in Clause 4.4
to 4.4.7.3 of MES Schedule Part - I.
29.3 Crushed stone sand can be used for plastering with river sand in the ratio of 1:1
without any price adjustment and conforming to IS 1542-1992 and SSR clause of
plastering.
30. Scanned copy of Integrity Pact (IP) signed by Accepting Officer is uploaded along
with NIT. IP is an integral part of contract and both parties are bound by its
provision.
31.1 If Contractor does not quote his rate against any item or ‘NQ’ appears in rate/
amount column, then it shall be deemed that rate quoted is Rupees Zero i.e. the
contractor intends to execute the particular item at no cost basis (free of cost) to
the Govt. Items and their quantities for which no rates or prices have been quoted
shall be deemed to have been covered by the rates and prices quoted for the other
items of bills of quantities. Hence contractors are requested to thoroughly check
their quoted rates before submitting bid online. No representation by the
contractor on this matter shall be entertained by the department in the matter.
34. The tenderer(s) shall verify all the corrigendum uploaded on the above work
before submission of financial bid.

35.1 The following shall be strictly adhered while preparing the special rates:
(a) In case of any deviation, mode of pricing shall be decided by Accepting Officer
in terms of Condition 62 of IAFW – 2249 (General Conditions of Contracts).
(b) In the event of deviation order involving fixation of Special (Star) Rate, draft
rate shall be prepared by GE (within a maximum period of 30 days) while
initiating the proposal for deviation seeking approval of Accepting Officer
and notified to contractor. While notifying the draft rate, it will be clearly
stipulated that the same is merely an estimated rate and firm rate shall be
fixed based on actuals and receipt of supporting documents from
contractor such as vouchers/literature of product/test certificates etc (as
applicable) on completion of the work involving Star Rate. Any objection to
the method of fixing Star Rate will be dealt as per Condition 7 of IAFW –
2249 (General Conditions of Contracts).
(c) Draft Star Rate shall be made based on market enquiry through
telephonic enquiry/ quotations/ email/ rate lists/ internet based sources,
material & labour constants available in various Civil Engineering
books and record available in respect of Star Rates approved in the
past for similar items of work, etc,. Contractor may also assist GEs office in
preparation of draft Star Rate.
(d) The draft Star Rate shall be purely a draft rate and shall not be used for
claiming final payment during execution of work. However GE shall allow
part payment to the tune of 80% during execution to avoid any financial
hardship to contractor.
(e) After completion of the item of work involving Star Rate, contractor shall
submit the vouchers/literature of product/test certificates (as applicable,
decision of GE being final in case of any disagreement) for finalization of Star
Rate. The Star Rate shall be technically checked by DCWE(C)/ Director(C)
depending upon the financial effect & approved by competent authority within
a period of one month from submission of the relevant documents by
contractor as mentioned above.
(f) The Star Rate as approved by competent authority after technical check
by DCWE(C)/ Director(C) depending upon the financial effect shall be
referred as “the rate decided by AGE(I)” under Para 62(G) of IAFW – 2249
(General Conditions of Contracts).

1. Schedule of Minimum Fair Wages is not enclosed along with tender but
the contractor is deemed to have full knowledge regarding the minimum
wages payable to labourers as legally effective on the date of submission
of tender and his tendered rates shall be deemed to have been based on
this (For the purpose of reimbursement of Price variation for wage
escalation of labour the minimum wages legally effective on the date of
receipt of tender shall be the basis). The minimum wages legally effective
referred to above are the minimum wages notified in the State/ Central
Gazette governed by any local regulation whichever is higher.

SPECIAL CONDITIONS
1. GENERAL
1.1 The following Special conditions shall be read in conjunction with the
General Conditions of Contracts IAFW-2249 and IAFW- 2159 including
Errata/Amendments thereto. If any provision in these special conditions is
at variance with that of the aforesaid documents, the former shall be deemed
to take precedence there over.
2.1. The tenderers shall contact the Garrison Engineer for the purpose of
inspection of site(s) and relevant documents other than those sent herewith,
who will give reasonable facilities for this purpose. The tenderers shall also
make themselves familiar with working conditions, accessibility of site(s),
availability of materials/labourers and other cogent conditions which may
affect the entire completion of work under this contract.
2.2. The tenderers shall be deemed to have visited the site(s) and made
themselves acquainted with the working conditions, whether they actually
inspected the site(s) or not.
3.3 The Engineer-in-Charge shall at the discretion have the right to issue passes
as per rules and regulations of the installation/Area in force to control the
admission of the Contractor, his agents, employees and work people to the
site of the work or any part thereof. Passes shall be returned at any time on
demand by the Engineer-in-Charge or the authorities concerned and in any
case on completion of work.
3.4 The Contractor and his agents, employees and work people shall observe
all the rules promulgated by the authority controlling the installation/area
in which the work is to be carried out e.g., prohibition of smoking and
lighting, fire precautions, search of persons on entry and exit, keeping to
specific routes, observing specified timing etc., Nothing extra shall be
admissible for any man hours etc., lost on this account.

4.2. Visit to site within the Restricted Area permission to enter the restricted area
at the time of Submission of tenders can be obtained through the Garrison
Engineer. Tenderers are advised to send prior intimation of their agents,
representatives, etc., if any, dates and time of their proposed visit, so that
necessary arrangements may be made by the GE to secure admission.
Whether a tenderer visit the site or not he shall be deemed to have full
knowledge of the restrictions of entering into/exit from and working within
the restricted area.
4.3. ENTRY/EXIT
4.4.1 The Contractor, his agents and representatives are required individually to
be in possession of an identity card or pass duly verified by the Garrison
Engineer. The Identity Card or pass will be examined by the security
staff at the time of entry into or exit from the Restricted Area and also at any
time or number of times inside the Restricted Area.
4.5.2. Contractor shall be responsible for the conduct and action of his workmen,
agents or representatives.
5. SEARCH
5.1. Thorough search of all persons and transport shall be carried out at each
gate and for as many times as a gate is used for entry or exit and may also
be carried out at any time or any number of times at the work site within
the restricted area.

6. FEMALE SEARCHER
6.1 If the Contractor desires to employ female labour on works to be carried out
inside the area of a factory, Depot, etc., and Female searcher is not borne
on the authorized strength of the factory, depot parks etc., at the time of
submission of the tender shall be deemed to have allowed in his tender for
pay and allowances etc., for a Female searcher (Class IV servant/Gp 'D'
Servant) calculated for the period, female labour is employed by him
inside that area. If more than one Contractor has/have to employ female
searchers in addition to the authorized strength of the factory, Depot, park,
etc., the salary and allowances paid to the additional female searcher(s) shall
be distributed on an equitable basis between the Contractors employing
female labours taking into consideration the value and period of completion
of their contracts, The GE's decision in regard to the amount recoverable on
this account from any contractor shall be final and binding.
7. WORKING HOURS
7.1. The Units controlling restricted area usually work during six days in the
week and remain closed, on the 7th day. The working hours available to
contractor's labour and staff however, accordingly got reduced because of
the time taken in security checks observed at the time of entry, and during
working hours.
7.2. The exact working hours, days and non-working days observed for the
restricted area, where works are to be carried out, shall be deemed to have
been ascertained by the contractor before submitting his tender. The
tenderer attention is invited to the fact that the total number of working
hours for a unit are prescribed in regulations and they can not be increased
by the Garrison Engineer.
7.4. Contractor may also be allowed to carry out the work beyond 6 PM and
up to 6 AM (day and night) with prior approval of GE, however the same is
not guaranteed but no movements of materials and transport to/out of site
works shall be permitted during night unless special permission is
obtained from the factory/Unit Authorities.
8. WORK ON HOLIDAYS
8.1. The Contractor shall not carry out any work on gazetted holidays, weekly
holidays and other non-working days except when he is specifically
authorized in writing to do so by the GE. The GE may at his sole discretion
declare any day as holiday or non-working days without assigning any
reason for such declaration.
8.2. Access to Restricted Area After completion of Works After the works are
completed and surplus stores etc., removed, contractor, his agents,
representatives or workmen etc., may not be allowed to have access to the
restricted area except for attending any rectification of defects pointed out
to him by the GE.

8.3.1. The Contractor, his agents, representatives, workmen etc, strictly observe the
orders pertaining to fire precautions prevailing within the restricted area.
8.3.2. Motor transport Vehicles, if any allowed by authorities to enter the restricted
area, must be fitted with serviceable fire extinguishers.
9.1 The tendered rates shall be deemed to be inclusive of all taxes including GST and
levies etc., payable under the respective statutes pursuant to the Gazette
notification by Government.
9.2 Any conditional tenders regarding payment of taxes will not be considered
and is liable to be rejected.
10.3 The contractor shall have no claim whatsoever, if on account of local factors
and/or regulations, he is required to pay the wages in excess of minimum
wages as described above during the execution of work.
11.1. (Applicant for works costing rupees one crore or more). In compliance with the
Condition 26 of IAFW-2249 (General Conditions of Contracts), the
contractor shall employ skilled/semi-skilled tradesmen who are qualified and
possessing certificate in particular trade from Industrial Training Institute
(ITI)/National Institute of Construction Management and Research
(NICMAR)/Similar reputed and recognized Institutes by State/Central
Government, to execute the works of their respective trade. The number of
such qualified tradesmen shall not be less than 25% of total skilled/semi-
skilled tradesmen required in each trade. The contractor shall submit the list of
such tradesmen along with requisite certificates to Garrison Engineer for
verification and approval. Notwithstanding the approval of such tradesmen by
GE, if the tradesmen are found to have inadequate skill to execute the work
of their trades, leading to un-satisfactory workmanship, the contractor shall
remove such tradesmen within a week after written notice to this effect by the
GE and shall engage other qualified tradesmen after prior approval of GE/GE's
decision whether a particular tradesmen possesses requisite qualification,
skill and expertise commensurate with nature of work, shall be final and
binding. No compensation whatsoever on this account shall be admissible.

11.2. Site for this work lies in RESTRICTED AREA. However control of admission
of labour/employee/agents of the contractor and observation of rules and
regulations as specified in clause 3.3 and 3.4 here in before shall be
applicable.
11.3. Access to area of work site after completion of works. After the works are
completed and surplus stores etc., removed, the contractor, his agents,
representatives or workmen etc, may not be allowed to have access to the area
of work site except for attending any rectification of defects pointed out to him by
the GE.
12. ROYALTIES
13.1 Contractor will be allotted open land near the buildings site for the ollowing :-
13.3. A nominal rent of Rs. 1/- per year or part thereof will be charged from the
contractor for each separate area of land allotted to him
14.1 Water will not be supplied by MES. However contractor is allowed to take water
from bore well. Water will not be supplied by the MES. The tenderers are advised
to visit the site of works to ascertain availability of water from civil sources or
from nearby natural sources outside ministry of Defence land. The contractor
shall be allowed, if he so desires, to install hand pumps, tube wells at site of work
at places as approved by Engineer-in-Charge and nothing shall be charged from
the contractor. The contractor shall remove the hand pumps, tube wells as and
when asked to do so by Engineer–inCharge/GE and in any case on completion of
the work and before issue of completion certificate, unless GE desires that these
hand pumps, tubes wells be left in position and the contractor agrees to do so
without claiming cost thereof from department. No compensation whatsoever
shall be admissible to the contractor, if he is required to remove the pump (s)
tube wells before completion of work. Use of water from such sources shall only
be permitted if, found after testing, potable and fit for use in the work. The water
from such sources shall be got tested by the contractor from laboratory approves
by the GE, who shall after satisfying himself permit the contractor to use the
water from such sources. Testing charges shall be borne by the contractor.

15.1 The Contractor shall permit free access and generally afford reasonable
facilities to other agencies or departmental workmen engaged by the
Government to carry out their part of the work, if any under separate
arrangements.
16.1 In case the contractor desires to buy electricity from MES, it will be supplied
at point up to 03 km away from site of work shown on site plan./or as
decided by the GE.
16.2 Electric supply shall be 415/230 Volt, 50 cycles, three phase AC supply at
upto 05 KW.
16.3 The contractor shall be charged for the electric energy consumed at Rs.14.37
per unit (KWH) for lighting and power.
16.4 The above rate is all in cost rate. Duties and/or taxes if any, levied by State
Govt. and/or any Electricity Undertaking and the like on the electricity
charges will be borne by the Department.
16.5. Electricity shall be supplied from Main Switches. Main switches and KWH
meter to register the power supplied shall be provided and installed by MES.
All other fittings, cable switch, connection etc. for distribution and supply of
electricity from main switch to work site shall be arranged by the contractor
at his own according to Indian Electricity Rules and along with the routes
approved by the GE. The GE shall have free access to inspect all
installations, connections, devices for consuming the electricity and if these
are not found satisfactory the GE shall have the power to get these
disconnected.
16.6 Supply of electricity shall be during the hours as decided by the GE. However
MES does not constitute any guarantee for the continuity of supply and no
compensation shall accrue to the contractor for the supply becoming
intermittent or if there is any breakdown for any reason. Contractor shall
have provision of sufficient stand by supply under their own arrangement.

17.1. The time and progress chart to be prepared as per Condition 11 of General
Conditions of Contracts IAFW-2249 shall consist of detailed network analysis
and a time schedule. The critical path network will be drawn jointly by the
GE and the Contractor soon after acceptance of tender. The time schedule of
the activities will be done by the Contractor so as to finish the work within
the stipulated time. On completion of the time schedule, a firm calendar date
schedule will be prepared and submitted by the Contractor to the GE who
will approve it after due scrutiny. The schedule will be submitted in four
copies within two weeks from the date of handing over the site.
17.2. During the currency of the work, the Contractor is expected to adhere to the
time schedule and this adherence will be a part of the contractor's
performance under the Contract. During the execution of the work, the
contractor is expected to participate in the reviews and updating of the net
work undertaken by the GE. These reviews may be undertaken at the
discretion of the GE, either as a periodical appraisal measure or when the
quantum of work ordered on the Contractor is substantially changed through
deviation order or amendments. Any revision of the time resource schedule
as a result of the review will be submitted by the contractor to the GE within
a week for his approval after due scrutiny.
17.3. The Contractor shall adhere to the revised time schedule thereafter. In case
of Contractor disagreeing with revised schedule, the same will be referred to
the Accepting Officer, whose decision shall be final, conclusive and binding.
CE's approval to the revised schedule resulting in a completion date beyond
the stipulated date of completion shall not automatically amount to a grant
of extension of time. Extension of time shall be considered and decided by
the appropriate authority mentioned in Condition 11 of IAFW- 2249 and
separately regulated
17.4. Contractor shall mobilize and employ sufficient resources to achieve the
detailed schedule within the broad frame work of the accepted method of
working and safety.No additional payment will be made to Contractor for
any multiple shift work or other intensive methods contemplated by him in
his schedule, even though the time resource schedule is approved by the
department.
18.2. All materials and stores to be procured and incorporated in the work shall be
new and in accordance with the relevant specification.
18.3. Materials of local origin shall be procured from any source within a distance
of 40 kms from where the items meeting the required specification are
available with prior approval of the GE.

18.5. The materials, articles, fittings and fixing accessories shall be of the brands
specified and comply with the requirements indicated in the particular
specification and as per manufacturers list enclosed. Where detailed
specification is not so indicated, sample will be approved by the GE, in the
following order of precedence after which only the contractor will make bulk
procurement for incorporation in the works. Materials, articles, fittings and
fixing accessories shall :-
18.6. Building materials viz, aggregates, sand, bricks, wood etc. shall be got tested
in Engineering college or in any other approved/recognized laboratories by
Govt. at such intervals as per relevant IS. In case the contractor has not
carried out sufficient number of tests as specified above, necessary
recovery shall be made at the rates as directed by the GE based on the
rates charged by the approved laboratory/Engineering college.
18.7. Samples of materials, fittings and fixtures shall be kept on display at the site
of works duly approved by the GE.
18.8. Where the list of several manufacturers has been stipulated for the relevant
items, selection of such manufacturer shall be at the discretion of the
contractor. The contractor shall ensure that the manufacturer selected by
him has adequate resources and is fully equipped to produce the
Materials/products strictly conforming to the contract specifications and can
ensure timely delivery.

19.2 The type of tests and frequency of tests to be carried out are attached as per
Appendix “A” for guidance. However frequency given in IS in any case is to be
followed. GE, depending on the nature of work, if required, may order
additional tests/ checks to this list. The contractor shall be responsible for
such tests to be carried out. The charges for the tests carried out shall be
borne by the contractor. However, a percentage/ selected checks as decided
by the Accepting officer/ CWE, shall be got done independently in the Zonal/
Govt. approved lab and the expenditure for such tests shall be borne by the
department.
20 RECORDS:
20.1 The contractor shall maintain proper records of tests carried out
indicating date of testing, source of supply, nature of tests carried out etc.
in approved format as approved by GE. These records shall be signed by
the Engineer In charge or his accredited representative on day to day basis.
Test results shall be countersigned by Engr-in-charge and GE and kept on
record, with one copy in EIC office and one copy in the GE's office.
21.1 The tender shall remain open for acceptance for a period of 60 (Sixty) days
from the bid submission end date (amended through subsequent amendment
if any. Date shall be counted from the next date of financial bid submission
end date.
22.1. The contractor may be paid advance on account of the full value of the
under mentioned materials only, brought on the site on his furnishing
guarantee bonds from scheduled bank for the amount of retention money
which should otherwise be recoverable from him under this contract:-
a) Cement
b) Steel (Structural and reinforcement steel)
c) Non skid/ Glazed Ceramic tiles
d) Aluminium sections, steel windows
e) Galvalume sheet/ CGI sheets
f) Plumbing and sanitary fittings
g) GI/ PVC pipes and fittings.

22.2. The Bank Guarantee Bonds shall be executed for a period and on a form as
directed by the Accepting Officer. The contractor shall further arrange to
extend the period of Guarantee Bond if and when necessary, as directed by
Accepting Officer or shall furnish fresh Guarantee Bond of similar value in
lieu.
22.3. It will be noted that advance on account to the full value of materials brought
on the site is permissible only in respect of fittings and fixtures and other
manufactured items which do not lose their identity.
24.1 The contractor shall be bound by the Official Secrets Act 1923.
25.3. The Contractor shall, on demand, produce to the GE, and original receipted
paid vouchers in respect of the supplies. The paid vouchers so produced
shall be verified, defaced and stamped by Engineer-in-Charge indicating
contract number, name of work, under his dated signature. The Contractor
shall ensure that the materials are brought to site in original sealed
containers/packing, bearing manufacturer's marking except in the case of
the requirement of materials being less than smallest packing.
25.4. Contractor shall produce paid vouchers from the manufacturers and/or their
authorized agents for the full quantity of the following materials, as
applicable as a prerequisite before submitting claims for payment for
advances on account of the work done and/or materials collections in
accordance with condition 64 of General Conditions of Contracts IAFW-2249.

“Materials laying at site”, as applicable as a prerequisite before submitting
claims for payment for advances in accordance with condition 64 of General
Conditions of Contracts IAFW-2249.
25.6 The vouchers/invoices will clearly indicate the contract number and the IS
No., Specific alternative to which the material conforms in case of various
alternative in IS.
25.7. The contractor shall produce manufacturer's test certificate along with the
paid vouchers for the following items:-

25.8.2. Approval of the stages and workmanship of sample room shall be separately
entered and approved in stage passing register giving reference to sample
room for easy identification even at a later date.
26.1 For the purpose of keeping a record of cement consumed in works, the
contractor shall maintain a puck bound register in the form approved by
the Engineer-in-Charge showing daily receipts quantity used in works and
the balance in hand. The register shall be signed daily by the contractor’s
representative and the Engineer-in-Charge in token of their verification of its
correctness. The check will not, however, absolve the contractor of his
responsibility to justify the consumption of cement at the time of finalization
of his accounts.
26.2 The register shall be kept at site in the safe custody of the contractor during
progress of the work and shall, on demand, be produced for verification of
Inspecting Officers. On completion of the work, the register shall be handed
over to the Engineer-in-Charge for record with MES.
(c) Location indicating No. (Quantity) at each location on the site of work.
(d) Purchase value on the date of purchase, for the purpose of the
condition, plant/equipment, vehicle No. i.e., of trucks and lorries but
neither the workman's tools or manually operated tools/ equipment
shall be given. The Engineer-in-Charge shall record the particulars
supplied by the Contractor in the works diary and send the return to
the GE for record in his office.
28.1 The Contractor shall clean all floors walls, remove cement/lime/paint
marks/ drops, etc., clean the joinery glass panes etc, touch up all
painters works and carryout all other necessary items of work in
connection therewith and leave the whole premises clean and tidy
before handing over the buildings.

29.1 The tendered rates shall be deemed to be inclusive of all GST(Goods and
Service tax) and levies etc., payable under the respective statutes pursuant to the
Gazette notification by State Government.
29.2 Any conditional tenders regarding payment of GST (Goods and Service tax) on
works contract will not be considered and is liable to be rejected.
30.1 Any damage done to the existing structures, any existing road etc., during the
execution of the work shall be made good by the Contractor at his own
expense.Rectification, replacement, making good and touching up etc., shall be
carried out, conforming to the materials and workmanship originally provided
and to the satisfaction of the Engineer-in-Charge. In case of any dispute on
this account, the decision of the GE shall be final, binding and conclusive.
31.1 The quoted percentage shall deemed to be inclusive of the bldg and other
construction workers welfare cess. The cess at the rate as prescribed by the
state Govt/Building and other construction workers welfare Board shall be
deducted at source and no extra payment shall be admissible to the
contractor on this account.
32.1 The rates quoted by the Contractor shall be deemed to be inclusive of all
taxes (including GST on materials, GST on works Contracts, turnover Tax,
Labour Welfare cess/tax etc.,) duties, Royalties Octroi & other levies payable
under the respective Statutes. No other levies and/or imposition/ abolition of
any new/existing taxes, duties Royalties, Octroi & other levies shall be made
except as provided in sub Para 32.5 here –in-below.
32.2 The taxes which are levied by Govt. at certain percentage rates of Contract
Sum/Amount shall be termed as “taxes directly related to contract value”
such as GST on Works Contracts, Turnover Tax, Labour Welfare Cess/tax and
like but excluding Income Tax. The tendered rates shall be deemed to be inclusive
of all taxes directly related to contract value: with existing percentage
rates as prevailing on last due date for receipt of tenders. Any increase in
percentage rates of “taxes directly related to contract value: with reference to
prevailing rates on last due date for receipt of tenders shall be reimbursed to
the contractor and any decrease in percentage rates of “taxes directly related to
contract value with reference to prevailing rates of last due date for receipt of
tenders shall be refunded by the contractor to the Govt/deducted by the
Govt from any payments due to the contractor. Similarly imposition of any
new “taxes directly related to contract value, after the last due date in receipt of
tenders shall be reimbursed to the contractor and abolition of any “taxes
directly related to contract value” prevailing on last due date for receipt of
tenders shall be refunded by the contractor to the Govt/deducted by the Govt
from the payments due to the contractor.

32.3 The contractor shall within a reasonable time of his becoming aware of
variation in percentage rates and/or imposition of any further taxes directly
related to contract value” give written notice thereof to the GE stating that the
same is given pursuant to this Special Condition, together with all
information relating thereto which he may be in a position to supply. The
contractors shall submit the other documentary proof information as the GE may
require.
32.4 The Contractor shall, for the purpose of this condition keep such books of
account and other documents as are necessary and shall allow inspection of the
same by a duly authorized representative of Govt, and shall further, at the
request of the GE furnish, verified in such a manner as the GE may
required, any documents so kept and such other information as the GE may
require.
32.6. Please note that, Labour Welfare Cess/Tax and element towards ESI & PF
contribution shall be applicable to this contract besides other applicable
taxes/ levies as per law of land. The quoted offer is deemed to include this
provision.

34. CONCILIATION:-
34.1. Appointment of conciliator :-
All disputes brought out here-in-after shall be referred to the sole conciliator viz
serving officer not below the rank of Superintending Engineer/
Superintending Engineer (QS&C) having degree in Engineering or equivalent or
having passed final/direct final examination of Sub division II of
Institution of Surveyors (India) to be appointed by the Engineer-in-Chief,
Army Headquarters, New Delhi or in his absence the Officer officiating as
Engineer-in-Chief or Director General of works specifically delegated by the
Engineer-in-Chief in writing.

34.3.1 The party initiating conciliation shall send to the other party a written
invitation to conciliate, briefly identifying the subject of the dispute.
34.3.2 Conciliation proceedings shall commence when the other party accepts in
writing the invitation to conciliate.
34.3.3 If the other party rejects the invitation, there will be no conciliation
proceedings. If the party initiating conciliation does not receive a reply
within 30 days from the date on which he sends or within such other
periods of time as specified in the invitation, he may elect to treat this as a
rejection of the invitation to conciliate and if he so elects, he shall inform in
writing the other party accordingly.
34.4.1. All disputes brought out in Para 34.2 (a) to (e) above shall be referred to the sole
Conciliator viz Serving Officer not below the rank of superintending
Engineer/Superintending Engineer (QS&C) having degree in Engineering or
equivalent or having passed final direct final examination of Sub division II of
Institution of Surveyors (India) to be appointed by the Engineer-in-Chief, Army
Headquarters, New Delhi or in his absence the Officer officiating as Engineer-
in-Chief or Director General of works specifically delegated by the Engineer-in-
Chief in writing.
34.7. In case the net total amount of payment involved in the settlement agreement
exceeds Rs. 2.00 lakhs, Accepting Officer will consult next higher authority and
obtain clearance before conclusion of conciliation proceedings.
35. ARBITRATION :
35.1 Refer condition to General Conditions of Contracts (IAFW-2249)

(i) All disputes, between the parties to the contract (other than those for which
the decision of the CWE or any other person is by the Contract expressed to be
final and binding) shall, after written notice by either party to the Contract to the
other of them, be referred to the Arbitral Tribunal of a Sole Arbitrator (in case of
contract sum less than or equal to Rs 100 Crore) from MoD Panel of Arbitrators.
The officers so considered for appointment of Arbitrator, either as sole Arbitrator
or for Arbitral Tribunal, shall be having degree in Engineering or equivalent or
having passed Final/Direct Final Examination of Sub-Division II of Institution of
Surveyor (India) or similar other Institutes recognized by the Government of India.
(ii) In case of arbitration by Sole Arbitrator, the Arbitrator shall be appointed
by the Authority mentioned in the contract document within a period of thirty
days of having received the notice from any of the parties of Contract, out of MoD
Panel of Arbitrators. In case of Arbitral Tribunal consisting of panel of three
Arbitrators, both the parties will be asked by the Appointing Authority to suggest
at least two names out of MoD Panel of Arbitrators within thirty days. The
Appointing Authority will appoint two Arbitrator, one Arbitrator each out of the
suggested names. The two
(iii) Arbitrators so appointed will select one Arbitrator from the MoD Panel of
Arbitrators who will be the ‘Presiding Arbitrator’. The Serving Officer(s) so
appointed as Arbitrator(s), either as Sole Arbitrator or as one of the three
Arbitrators in the Arbitral Tribunal, can continue as Arbitrator even after
retirement, provided both the parties to the contract give written consent to this
effect. In such case, however, the Arbitrator shall not be entitled for any fee even
after retirement.
(i) All disputes, between the parties to the Contract (other than those for which
the decision of the CWE or any other person is by the Contract expressed to be
final and binding) shall, after written notice by either party to the Contract to the
other of them, be referred to the Arbitral Tribunal of a Sole Arbitrator (in case of
contract sum less than or equal to Rs 100 Crore) or to Arbitral Tribunal of three
Arbitrators (in case of contract sum exceeding Rs 100 Crore). The officers so
considered for appointment of Arbitrator, either as Sole Arbitrator or for Arbitral
Tribunal, shall be having degree in Engineering or equivalent or having passed
Final/Direct Final Examination of Sub-Division II of Institution of Surveyor (India)
or similar other Institutes recognized by the Government of India.

(ii) Provided that in the event of abandonment of the works or cancellation of the
Contract under Condition No. 52, 53 or 54 hereof, such reference shall not take
place until alternative arrangements have been finalised by the Government to get
the works completed by or through any other Contractor or Contractors or Agency
or Agencies.
(iii) Provided always that commencement or continuance of any arbitration
proceeding hereunder or otherwise shall not in any manner militate against the
Government’s right of recovery from the Contractor as provided in Condition 67
hereof.
(iv) If the Sole Arbitrator or one or more Arbitrators of the Arbitral Tribunal so
appointed resign(s) from his/her appointment or vacate(s) his/her office or in
unable or unwilling to act due to any reason whatsoever, the Authority appointing
him/her will appoint a substitute Arbitrator to act in his/her place in the manner
specified hereinabove. In case the Arbitrator resigning in this manner is the
Presiding Arbitrator, the other two Arbitrators of the Arbitral Tribunal shall appoint
the substitute Presiding Arbitrator.
(v) The Arbitral Tribunal may proceed with the arbitration, exparte, if either
party, inspite of a notice from the arbitrator fails to take part in the proceedings. The
Arbitral Tribunal may from time to time with the consent of the parties, enlarge the
time for making and publishing the award subject to the limit laid down in the
Arbitration & Conciliation Act 1996 as amended up to the date on which arbitration
proceedings commence.
(vi) The Arbitral Tribunal shall make the award within the period as provided
in the Arbitration & Conciliation Act 1996 (as amended up to the date on which
arbitration proceedings commence) from the date of entering on the reference or
within the extended period as the case may be on all matters referred to it and shall
indicate findings along with sums awarded separately on each individual item of
dispute. The Arbitral Tribunal shall give reason for the award in each and every
case irrespective of the value of claims or counter claims.
(vii) The venue of Arbitration shall be such place or place or places as may be
fixed by the Arbitral Tribunal in the sole discretion.
(viii) The Award of the Arbitral Tribunal shall be final and binding on both parties
to the contract.

Level ‘A'
a) `Site lab' means own site lab established by contractor at the work
site for such tests. This lab shall house all the facilities including
T&P, machinery, equipment, manpower etc required for conducting
tests. This lab shall be operative for the entire duration of the
contract till its completion. Tests shall be carried out in the
presence of Engineer-in-Charge to be nominated by the GE.
Random check of compliance of frequency of testing shall be done
by GE.
b) Setting up site laboratory is mandatory for works costing Rs.100
lakhs and above. The contractor may at his option set up site
laboratory for works costing less than Rs.100 lakhs.
c) Records shall be maintained at work site. These test results shall
be signed by contractor or his authorized representative and
aforesaid departmental official.
d) Within 15 days of placement of work order No 1 site lab shall be
established and fact reported by the contractor to GE in writing
who will verify the fact and satisfy himself of the facilities provided.
There after GE shall issue a certificate to this effect in writing
listing out equipment particulars etc of each material test. Only
after issue of this certificate by GE the tests shall be carried out
and materials so approved shall be incorporated in the work. Site
lab shall be made out of prefabricated relocatable shelter of size 12’
x 10’ with PCC flooring with adequate lighting/ventilation.
e) Manpower, material land infrastructure like electricity, water
etc required for conducting these tests shall be provided by the
contractor.
f) Tender is deemed to cater for above provisions in his quoted
lumpsum.
g) Remedial measures, if any, required to achieve/obtain desired
results for each test shall be taken promptly by contractor.
h) In case during any point of time contractor fails to adhere to the
laid down frequency of the tests for any reasons whatsoever the
contractor shall get the tests done from any other lab whose
name shall be approved by GE in writing. The testing charges
payable by contractor to such labs shall be paid by the contractor.
Contractor's quoted lumpsum is deemed to include for this
eventuality and nothing extra shall be payable to the contractor.
No extension of time shall be admissible on this account.

Agent/approved firm shall have provident fund code number. The contractor
who is not in possession of provident fund code number shall be
disqualified in ‘T’ bid evaluation and his financial bid shall not be

39.2. It is the responsibility of the contractor to ensure that all the workers engaged
by him/ them are having universal account number (UAN) duly allotted by
Provident fund department and their contributors are properly credited into

40.2 To ensure proper consolidation, roller must work for at least the number
of days assessed on the basis of output given hereunder. If the roller has
not worked for the number of days so assessed, recovery shall be effected
from the contractor for the number of days falling short of the days so
assessed on the basis of output stipulated. The recovery shall be effected as
under:-
(b) Where a road roller is hired by the Contractor from sources other

42.4 Road roller output of road roller in respect of other items catered in the CA, GE
Shall order a board of officers and ascertain the required output of road roller to
achieve the desired/specified compaction over a trial area which will be the basis
for the corresponding works.
42.5 The number of hours/days assessed for proper consolidation and number of
hours/days for each surface of each stretch / piece of road consolidated shall be

shall collect sewage samples from each site & get it tested to find the actual data. Accordingly
STP’s equipment size is to be increased if required, without any extra cost to achieve
parameters of treated sewage after Tertiary Treatment as promulgated by NGT Judgment
dated 30 April 2019 on OA No 1069/2018.
The interconnecting pipe work shall be flanged to GI pipes of medium grade. A drain cock
shall be provided at the lowest point in each delivery pipe work along with reflux valve.
Individual stop valves and safety valves shall be provided for each unit. Blowers shall be
driven by squirrel cage motors through a direct coupling. Blowers shall not run above 1200
rpm. Each delivery branch shall include a drain at the lowest part and a reflux or NRV valve.
The blower equipment specified herein is standard equipment for blowers handling ambient air
for use in aeration tank diffusers.
Each of the blowers shall be capable of operating without surge in parallel with the
other duty blower at the maximum mass flow against designed maximum gauge
pressure at the outlet pipe.
Performance curves for the blower system shall be submitted. Standard certified
factory test sheets showing the results of each test shall be supplied in triplicate to
the Engineer along with delivery of the blowers. The blower unit shall be capable
to operate at maximum duty for continuous operation. The blower motor shall not
exceed a maximum speed of 1500 rpm and the blower shall not exceed the
manufacture’s recommended maximum speed.
(d) TESTING

Visual Inspection : Before Painting.
The diffuser will be retained in place by two clamps. It is fitted to the pipe lateral by
CLIPIN arrangement. The laterals are connected to a pipe header. The wetted
parts of the system are made of non-corrosive material specifically SS 304. During
power shutdown at the sewage treatment plant the membrane will contract and
lose around the PP support pipe and means shall be provided to prevent any back
flow. Each diffuser shall consist of the following:
- Minimum 65 mm OD PP injection moulded support pipe.
- Porous membrane made of silicon-based rubber lateral and RCC support
block with SS 304 clamping.
- Flexible Hose pipe (drop pipe for each diffuser assembly)
- PP Ropes for Lifting and guide position.
- Hose clamp
- Pipe connector
- GI barrel nipple with connector for connection with pipe.
Complete diffuser shall be assembled at original factory level and site fabrication of
diffuser is not acceptable. All hardware accessories including clamps, fasteners, fan-
hooks, eye bolts, should be of SS 304 materials only.
Pipe shall be designed to ensure the efficient operation of the aeration system and
compliance with the noise limitations. All valves in the air delivery system shall be correctly
selected for the duty. Calculations of Cv (head loss coefficient) values for the range of
flows and pressure losses across each valve should be prepared to ensure that each
valve has adequate range of control for the duty.
However, the air piping submerged in sewage has to be in SS304 conforming to relevant
IS specification. One spare drop pipe with diffuser elements shall be supplied by the
Contractor. This will be used to replace the choked diffusers drop pipe or on preventive
basis on rotation. The choked one will be attended to and used as spare drop pipe.

9.10 PUMPS
(A) OPEN WELL SUBMERSIBLE PUMPS
Submersible pumps shall be of the single-entry design supplied complete with bolt-less
self-aligning duck-foot assemblies giving automatic connection to the discharge pipe work.
Pumps to be used in Common Collection Sump shall be Cutter pumps.
The total head capacity curve shall be continuously rising towards the shut off with the
highest at shut off. Pumps shall be suitable for single as well as parallel efficient operation
at any point in between the maximum and minimum system resistances. The pumps shall
be designed to handle solid sizes of up to 80 mm. Pumps shall run smooth without undue
noise and vibration.
The pump set shall be suitable for starting with discharge valve open and/or closed. The
pump set shall be capable of withstanding the accidental rotation in reverse direction.
of sewage along the shaft. The preliminary and secondary seals shall be oil- lubricated
with tungsten carbide or silicon carbide faces and they shall be equipped with an electrical
monitoring system for seal failure detection.
Impeller shall be non-clog open / semi open type for raw sewage and sludge application
and enclosed type for clear water / treated sewage / filet rate pumping application with
smooth blunt edges and large water ways so as to allow free passage of the large size
solids. It shall be free from sharp corners and projections likely to catch and hold rags and
stringy materials. The number of impeller vanes for pumps up to 1000 m/hr shall be limited
to two and shall be limited to three for the pumps higher than 1000 m/hr. The critical speed
of the rotor shall be at least 30% above the operating speed.
Pump sets shall have double bearings. The bearing life shall be minimum 40,000 hrs of
operation.
Each pump shall be complete with a cast iron delivery connection arrangement for fixing to
the concrete floor of the suction well. All necessary stainless-steel fixtures required for
guiding the pumps during lifting / lowering shall be provided. The installation shall facilitate
automatic installation and removal of pump without a person entering the wet well. Each
pump shall be provided with a SS 304 lifting chain with suitable provision for engaging the
hook of the crane at 1 m interval.
Each pump shall be provided with an automatic coupling device for attaching the crane
hook to the pump at low level, even whilst the pump is submerged, without the need for
personnel to enter the well. This automatic coupling device shall easily and automatically
couple and uncouple the hoist hook and be complete with necessary accessories. All links
and cables shall be multi-stranded stainless steel. The submersible pumps shall be
suitable for operation with or without submergence. The pump shall start and stop
automatically based on level in the wet well. The synchronous speed shall not exceed
1500 rpm at 50 Hz supply.
The submerged cable shall be a multi-core flexible cord, vulcanized rubber insulated with
tough rubber sheath and outer PCP sheath to BS 6500.
Where both thermal protective and moisture-sensitive devices are incorporated within the
pump, both devices shall be brought out via separate conductors within the motor cable,
although one such Conductor may be common.
i) Centrifugal pumps shall be of horizontal end suction type and shall have head/quantity
characteristics which fall continuously from the maximum pressure at closed valve
conditions and which are steep in order that variation in head shall have a minimal
effect on the quantity discharged.

ii) The design speed of any pump with a duty flow greater than 20 l/s shall not exceed
1500 rpm. Pump motor ratings shall exceed the maximum pump power consumption over
the operational range of the pump by at least 10%.
iii) Waterways through the pump shall be smooth in finish and free from recesses and
obstructions. Impeller passageways shall be as large as possible. The leading edges of
the impeller vanes shall be rounded and smooth.
iv) Water velocities in the pump suction side shall not exceed 1.5m/s and on delivery
branches of a pump the velocity shall not exceed 2.0 m/s, when the pump is operating
within its specified duty range and within this working range. There shall be no discernible
noise due to hydraulic turbulence or cavitation within either the pump or its associated
pipe work and valves.
v) The NPSH(Net Positive Suction Head) requirements of the pumps of the pumps, based
on the 3% output drop criterion shall be at least 2 m less than the NPSH available at every
working condition.
vi) The velocity of vibration shall be within 4.5mm/sec. Combined noise level of pump
motor system shall be limited to 85dBA at a distance of 1.85m from the equipment, at
manufacturers works.
vii) The pump shaft shall be of stainless steel to BS: 970 Grade 410S21 compatible with
the impeller which shall be of stainless-steel ASTM A743 CF8M and the impellers and
shaft sleeves shall be secured to the shaft by means of a key or keys. The impeller
retaining nut shall be fitted with a locking device. The pump casing shall be of Cast iron to
IS210 Gr. FG260, wearing rings shall be of Bronze to IS: 318 Gr. LTB2 and shaft sleeve
shall be of stainless steel to ASTM A 743 CA 15.
viii) All parts exposed to wear shall be adequately protected by means of renewable
sleeves, bushes, wear rings etc which shall be arranged for easy inspection, adjustment,
or replacement without removal of the pump casings, pipe work etc, or the need to disturb
the drive shaft alignment.
ix) The pump thrust shall be taken by a combined thrust and radial type bearing assembly
capable of taking the weight of the moving parts and the hydraulic loads under all
conditions of operation with minimum life of 100000 hours.
x) Bearing cooling arrangements if used shall be designed on the closed-circuit principle;
open discharge of cooling water into the pumping station drainage system is not
permissible.
xi) The pump casing and other parts of the pump subject to pressure shall be hydraulically
tested by the manufacturer to at least one and a half times the maximum working
pressure.
xii) Integral inlet and discharge flanges shall be provided and integral lifting lugs shall be
incorporated.
xiii) Facilities shall be provided for the removal of air during priming and for draining.
xiv) Glands may be fitted with mechanical seals or conventional soft packing. The gland
arrangement shall be designed for easy adjustment and removal of the seal. When soft
packed glands are used suitable means shall be provided for collecting and preventing
splashing of the gland leakage water.
xv) Drainage and gland leakage water shall be piped into the building drainage system.
xvi) The shafts of pumps fitted with conventional packed glands shall be fitted with re-
movable gland sleeves.
xvii) Drainage and gland leakage water shall be piped into the building drainage system.
xviii) The shafts of pumps fitted with conventional packed glands shall be fitted with re-
movable gland sleeves.
xix) The rotating element of the pump and the motor shall be readily removable from the
pump casing without the need to disconnect the adjoining pipe work.
xx) Rotating assemblies of pumps of 100 mm diameter inlet and over shall be statically
and dynamically balanced and shall be designed so that the first critical speed is at least
50% greater than the maximum operating speed.

(C) EARTHING
Earthing of the motor shall be done in accordance with the relevant provisions of IS3043:
2018. For the purpose of earthing these motors, earthing connection may be made to
discharge pipe.
(D) INSULATION
Any joints in the motor insulation such as at coil connections or between slot and end
winding sections shall have strength equivalent to that of the slot sections of the coil. The
insulation shall be given tropical and fungicidal treatment for successful operation of the
motor in hot, humid and tropical climate. The tropicalizing treatment shall be as per the
applicable standard.
The stator winding shall be made from high conductivity annealed Copper conductor, PVC
insulated winding wires conforming to IS: 8783:1978 for wet type motors. The stator
winding shall be of high conductivity annealed copper enamelled insulated wires
conforming to IS: 4800 (Part-VII):1970 for dry type motors.
9.13 INSTRUMENTATION

When no flow exists, the float rests at the bottom.
b. All float operated liquid level controls operate on the basic buoyancy principle which
states "the buoyancy force action on an object is equal to the mass of liquid displaced
by the object." As a result, floats ride on the liquid surface partially submerged and
move the same distance the liquid level moves.
10.0 (i) All the outdoor Pump Motors and Air Compressor & any other electrical equipment
shall be provided with suitable rain protection shed.
(ii) A suitable size of drain shall be provided in and around STP sub-systems/units so as
to channelize any spill over water/sewage during cleaning/maintenance of various
chambers / tanks and thus maintaining hygiene at the plant.
11.0 Cables
(i) Power cables:
PVC insulated, PVC sheathed, GI armoured, Stranded Aluminium conductor cables as per
IS 1554. Minimum power-cable size shall be 3c x 4-sq. mm
(ii) Control cables:
PVC insulated, PVC sheathed, GI armoured, solid copper conductor cables as per IS
1554. Control cable size shall be minimum 1.0 sq.mm.
14.0 Testing
The treated water should be get tested by the bidder from SPCB or the Lab approved by
SPCB and the report confirming that the parameters are within the limit, as specified,
should be submitted before seeking completion of the contract.

All the plants/installations as described in Schedule ‘A’ shall be taken over by the
contractor on due verification of inventory immediately on receipt of work order for
Phase II (Manning & Operation) (i.e) from the next day of certified date of physical
completion of Phase I work. The inventory shall contain the description of plant
and equipment with fittings, its performance status and shall be signed by the
contractor and Engineer-in-Charge. The plant shall be taken over from the contractor in
the satisfactory condition at the close of the contract duly signed by the Contractor
and Engineer-in-Charge. The inventory shall be verified on the first of every month
and a certificate to this effect shall be given for its satisfactory state. Any loss/damage
caused shall be made good by the contractor at no extra cost before making final bill
failing which the same will be made good at the risk and cost of contractor. Decision by
GE in this regard is final and binding.
The number of tradesmen required for each shift is shown in items of Schedule 'A' (BOQ).
However it does not include for leave/holiday reserve etc,. MES will not sanction any leave
etc for the employees employed by the contractor. It is the responsibility of the contractor to
provide necessary leave/ holiday reserve at his own arrangement by engaging additional
labour. The rates quoted by the contractor for respective item in schedule 'A' deemed to
include for such leave/holiday reserve at no extra cost of Government/ department.
b. The cleanliness of the entire plant and its surrounding areas will be responsibility of the
contractor including removal of solids from Bar Screen Chamber, removal of grit and
skimmed oil & grease from Grit cum O&G chamber on daily basis disposing it off to nearby
suitable place as identified by GE .
c. Plant maintenance should be carried out in daily, weekly, monthly basis as per directions of
the manufacturers (OEM) instructions including all minor electrical / mechanical parts (Two
years maintenance is covered under the warranty / defects liability period). Any major repair
/ replacement required should be intimated to GE and prior approval shall be obtained.
1. A tender is invited for the work as mentioned in Appendix 'A' to this NOTICE
INVITING TENDER (NIT).
2. The work is estimated to cost as indicated in aforesaid Appendix 'A'. This estimate,
however, is not a guarantee and is merely given as a rough guide and if the work cost more
or less, a tenderer/bidder will have on that account. The tender shall be based on as
mentioned in a foresaid Appendix 'A'.
4. Normally contractors whose names are on the MES approved list for the area in
which the work lies, and within whose financial category the estimated amount would fall,
may tender/ bid but incase of term contracts, contractors of categories “SS” to “E” may
tender/ bid. Incase, where the tender amount is in excess of the financial limit of the
contractor and the Accepting officer decides to accept the tender/ bid, in which event the
tenderer/ bidder would be required to lodge additional security deposit as notified by the
Accepting Officer in term of conditions of contract. Contractors whose names are on the
MES approved list of any MES Formation and who have deposited standing security and
have executed standing security bond may also tender/ bid without depositing Earnest
money along with the tender/ bid and if the tender/ bid submitted by such a
tenderer/bidder is accepted, the contractor will be required to lodge with the Controller
of Defence Accounts concerned the amount of' Individual security deposit' within thirty
days of the receipt by him of notification of acceptance of his tender/bid, failing which
this sum will be recovered from 1st RAR payment or from the first final bill. In the case of
term/running contracts, remaining sum shall be recovered from subsequent bill(s) of the
contractor. Not more than one tender/ bid shall be submitted/ uploaded by one contractor
or one firm of contractors. Under no circumstances will a father and his son(s) or other
close relations who have business dealing with one another be allowed to tender/ bid for
the same contract as separate competitors. A breach of this condition will render the
tenders/bids of both the parties liable for rejection.
5. The Office of HQ Chief Engineer Chennai Zone Chennai will be the Accepting Officer
here in after referred to as such for purpose of the contract
6. The Technical Bid and Financial Bid (Cover-1 and Cover-2) shall be uploaded by the
tenderer/ bidder on or before the date & time mentioned in NIT. A scanned copy of DD
with enlistment details/documents shall be uploaded as packet 1/cover-1 ('T' bid) of the
tender/ bid on e-tendering portal. DD is refundable in case T bid is not accepted resulting
in non-opening of 'Q' bid. The applicant contractor shall bear the cost of bank charges for
procuring and encashing the DD and shall not have any claim from Government
whatsoever on this account
6.1 Tender form and conditions of contract and other necessary documents shall be
available on defproc.gov.in/eprocure.gov.in site for download and shall form part of
contract agreement in case the tender/ bid is accepted.

6.2 In Case of contractor who has not executed the Standing Security Bond, the Cover-I
shall be accompanied with by Earnest Money of amount as mentioned in Appendix 'A' in
the form of deposit at call receipt in favour of Garrison Engineer Avadi by a scheduled
Bank or in receipted treasury Challan the amount being credited to the revenue deposit of
the Garrison Engineer Avadi.
6.3 A contractor who is not enlisted for the area in which the work lies but whose name
is in the MES approved list of any MES formation and who has deposited standing security
and executed standing security Bond may bid without depositing earnest money along with
the tender; but if the Accepting officer accepts the tender/bid, the contractor will be
required to lodge with the Controller of Defence Accounts concerned the amount of'
Individual security deposit' within thirty days of the receipt by him of notification of
acceptance of his tender/bid, failing which this sum will be recovered from 1st RAR
payment or from the first final bill. In the case of term/ running contracts, remaining sum
shall be recovered from subsequent bill(s) of the contractor.
6.4 A contractor who has executed standing security Bond but not corresponding to the
appropriate class as mentioned above, shall lodge with the Accepting Officer, Additional
Security Deposit as notified by the Accepting Officer within thirty days of the receipt of his
notification of acceptance of his tender/bid, failing which this sum will be recovered from
the first RAR payment or from the first final bill. In the case of term/running contracts,
remaining sum shall be recovered from subsequent bill(s) of the contractor. However, in
case where any payment is made to the contractor within thirty days of the receipt by him
of notification of acceptance of tender/bid, the amount of additional security deposit shall
be recovered from such payment.
6.5 The Garrison Engineer Avadi will return the Earnest Money wherever applicable to
all unsuccessful tenderers/bidders by endorsing an authority on the deposit-at-call receipt
for its refund, on production by the tenderer, bidder a certificate of the Accepting Officer
that a bonafide tender/bid was received and all documents were returned.
6.6 The Garrison Engineer Avadi will either return the Earnest Money to the
successful tenderer/bidder by endorsing an authority on the deposit-at-call Receipt for its
refund on receipt of an appropriate amount of Security Deposit or will retain the same in
part or full on account of security deposit if such a transaction is feasible.
6.7 Copies of the drawings and other document pertaining to the work signed for the
purpose of identification by the Accepting Officer or his accredited representative, sample
of materials and stores to be supplied by the contractor will also be available for inspection
by the tenderer/ bidder at the office of Accepting Officer and Garrison Engineer Avadi
during working hours.

7. The tenderers/bidders are advised to visit the site of work by making prior
appointment with Garrison Engineer Avadi who is the Executing Agency of the work (see
appendix 'A'). The tenderers/bidders are deemed to have full knowledge of all relevant
documents, samples, site, etc., whether they have inspected them or not.
8. Any tender bid which proposes any alteration to any of the conditions laid down or
which proposes any other condition or prescription Whatsoever, is liable to be rejected.
9. The uploading of bid implies that bidder has read this notice and the Conditions of
Contract and has made himself aware of the scope and specification of work to be done
and of the conditions and rates at which stores, tools and plants, etc., will be issued to him
and local conditions and other factors having bearing on the execution of the work.
11. Invitation for e tender does not constitute any guarantee for validation of 'T' bid and
subsequent opening of finance bid of any applicant/bidder, even of enlisted contractors of
appropriate class, merely by virtue of enclosing DD. Accepting Officer reserves the right to
reject the 'T' bid and not open the finance bid of any applicant/ bidder. 'T' bid validation
shall be decided by the Accepting Officer based on, inter alia, capability of the firm as per
criteria given in Appx 'A' to this NIT. The applicant contractor/bidder will be informed
regarding non- validation of his 'T' bid assigning reasons thereof through the website
www.defproc.gov.in. The applicant contractor/bidder if he so desires may appeal to the
next higher Engineer authority HQ ADG(P) Chennai on E-mail: [email protected] with copy
to the Accepting Officer on email [email protected] before the scheduled date of
opening of Finance Bid. The decision of the Next Higher Engineer Authority (NHEA) shall
be final and binding. The contractor/bidder shall not be entitled for any compensation
whatsoever for rejection of his bid.
12. The Accepting Officer reserves the right to accept a tender submitted by a Public
Undertaking, giving a price preference over other Tender(s)/bids which may be lower,
as are admissible under the Government Policy. No claim for any compensation or
otherwise shall be admissible from such tenderer/bidder whose tender/bid is rejected.
13. Accepting Officer does not bind himself to accept the lowest or any tender/bid or to
give any reason for not doing so.
14. This Notice Inviting Tender (NIT) including Appendix 'A' shall form part of the
contract.

15.2 It is the responsibility of the contractor to ensure that all the workers engaged by
him/them are having universal account number (UAN) duly allotted by the Provident fund
dept and their contributions are properly credited into their account. A certificate to this
effect shall be furnished by the contractor while claiming the Final Bill.
16. Note:- “ Court of the place from where tender has been issued shall alone have
jurisdiction to decide any dispute out of or in respect of this tender. After
acceptance of tender Condition – 72 of jurisdiction of courts of IAFW-2249 shall be
applicable”.

2. In case after opening of Cover-1, the number of MES enlisted contractors of eligible
class as well as un-enlisted contractors, if any, fulfilling the other eligibility criteria given in
NIT, are 7(Seven) or more, applications of only those two class below the eligible class
bidders shall be considered, who have previously completed similar works satisfactorily and
are meeting the criteria of upgradation in respect of past experience of completed works
(individual work experience and/or average annual turnover as applicable) and financial
soundness (solvency/financial soundness and working capital) as per details given in
Manual on Contracts. Therefore such contractors may upload the requisite information/
documents in the Cover -1.
4. Contractors enlisted with MES will upload following documents in Cover 1 for
checking eligibility:-

8. Contractor will not be allowed to execute the work by subletting or through power of
attorney to a third party/another firm on his behalf. However a contractor can execute the
work through power of attorney to sons/daughters/spouse of proprietor/partner/ director
and firm's own employees, director, project manager provided they are not having a
separate enlisted firm in MES in their name as Proprietor / Partner / Director.
9. After opening of Cover 1 and during its technical evaluation, in case any deficiency is
noticed in the documents required to be uploaded by the tenderers as per NIT, a
communication in the form of e-mail/SMS/Speed Post etc. shall be sent to the contractor to
rectify the deficiency within a period of seven days from date of communication failing
which their financial bid (Cover 2) shall not be opened and contractor shall not have any
claim on the same.
10. Invitation for e-tender does not constitute any guarantee for validation of Technical
bid and subsequent opening of financial bid of any applicant/bidder merely by virtue of
enclosing DD. Accepting Officer reserves the right to reject the Technical bid and not to
open the financial bid of any applicant/bidder. Technical bid validation shall be decided by
the Accepting Officer based on eligibility of the firm as per criteria given in this Appendix.
Tenderer/bidder will be informed regarding non-validation of his Technical bid assigning
reasons therefore through tender evaluation report which shall be uploaded on the website.
Such tenderer if desires, may appeal to the NHEA HQ ADG (P) Chennai on E-mail: adgpchn-
[email protected] with copy to the Accepting Officer on email [email protected] before the
scheduled date of opening of Cover 2. NHEA shall decide the matter within a period of seven
working days from the date of receipt of appeal. The decision of the NHEA shall be final and
binding. The tenderer/bidder shall not be entitled for any compensation whatsoever for
rejection of his bid.

11. In case an unenlisted contractor is already executing works in MES, he shall not be
considered eligible for the subject tender if the total value of such works is more than twice
the tendering limit of the MES Class of contractor for which it is eligible. For this purpose,
details of the works being executed by such a contractor shall be uploaded in the Cover-1 of
the bid and shall be checked /verified by the Accepting Officer.
12. In case the BOQ is revised through the corrigendum and the bidder has failed to quote
on revised BOQ (ie he has quoted on pre revised BOQ), such bid shall be treated as willful
negligence by the bidder and his quotation shall be considered non-bonafide. In such cases
the lowest tender shall be determined amongst the valid/bonafide bids only. Accepting
Officer may decide whether to re-tender or consider the lowest bonafide tender for
acceptance.
13. Revoking the offer or revising the rates upward and offering voluntary reduction by the
lowest tenderer, after opening of Cover 1 shall be considered as a willful default. For this
default a penalty of an amount equal to Earnest Money shall be levied. In case of an
unenlisted tenderer, Earnest Money deposited by him shall be forfeited. In case of MES
enlisted tenderer having deposited the Standing Security Bond, an amount equal to the
earnest money stipulated in the NIT, shall be notified to the tenderer for depositing through
MRO and consideration of such tenderer in tender evaluation for future works shall remain
suspended till the aforementioned amount is deposited in the Government Treasury. No
other disciplinary/administrative action shall be taken against such tenderers. In such a
situation, the next lowest offer shall not be considered for acceptance. Instead, retendering
shall be resorted to in a transparent and fair manner and the defaulting tenderer and his
related firm if any, shall not be eligible for this tender in second call or subsequent calls.
14. Tender to related firms shall not be issued simultaneously. Firms shall be treated
as related if Proprietor/one or more Partners/Directors are common. Decision of Accepting
Officer on issue/deny the tender to any one of the related firms shall be final and binding.

1. Authority competent to enlist shall be called Registering Authority.
2. The categories for enlistment shall be decided on the basis of nature of works executed
by Contractor. Contractors who have experience of executing of Prefab/Pre Engineered
Structures and fulfil other criteria, shall also be eligible for enlistment in category a(i). At the
time of renewal, contractors already enlisted in Cat (a) (i) Building & Roads, shall be enlisted
in Cat (a) (i) Building works & (a) (v) Roads. In case of E class contractors, Registering
Authority shall issue suitable amendments to enlistment letters in respect of separate
categories for buildings works ie a(i) and roads i.e. atv) without any application from
contractor.
4. Working capital with the Contractor shall be judged from balance sheet/bank's
certificate as per Appendix 1.3/ bank statement for last 6 month/overdraft or cash credit
facility from bank/ fixed deposit receipts with banks.
5. The requirements of minimum reserves are applicable for enlistment related process of
existing contractors i.e. Change in constitution/Renewal/Reclassification (Revision in
Monetary Limit), etc, if they have contracts in hand not having Performance Security
provisions, till their contracts are completed and their Final Bills do not become MINUS. For
this, these contractors will submit affidavit on non-judicial stamp paper of appropriate value
(minimum value Rs. 100) declaring that all their contracts without Performance Security
provisions are completed and the Final Bills are not MINUS. Immovable/movable property
(minimum reserve) shall be exclusively in the name of Contractor and not in the name of
family members/relatives/others. In case of Limited companies, immovable/movable
property (considered for minimum reserve) shall be exclusively in the name of Company and
should be reflected in the Balance Sheet of the Company.

6. "Last two consecutive years" shall mean immediate last two consecutive financial years
reckoned from the date of application for upgradation. Two consecutive years for the purpose
of fresh enlistment shall mean any of the two consecutive financial years in last Five
Financial Years preceding the date of application for enlistment. For documents in support of
works experience, TOS certificate for IT/Sales Tax NAT/GST shall also be asked from
applicant firms. All documents related to works experience and turnover (except Form 26 AS
and portal generated GST return) shall be got independently verified from the client/issuing
authority. Registering Authority may seek clarification from the Chartered Accountant in
case of any doubt. Annual turnover to be considered for enlistment purpose shall mean the
turnover from all businesses carried out by the applicant firm in relation to construction
work related to categories of works for which the enlistment is being sought. It may be total
turnover as shown in the audited balance sheet or part thereof. Necessary clarification shall
be obtained from the Chartered Accountant whose audited balance sheet is submitted by the
applicant firm in case considered necessary by the Registering Authority.
(a) Contractor has completed works, value of which is more than 1.25 times the
requirement in which the upgradation is being considered.
(b) Average Annual Turnover of the contractor is more than 1.25 times the requirement
in which the upgradation is being considered.
Example: For a contractor enlisted in class 'C' having tendering limit of 100 lakh,
proposed to be upgraded to class 'A' having tendering limit of 7.50 crare, minimum
value of works completed and turn over shall be as under:
(i) Two works completed costing not less than 5.00 crore each (1.25 x 4.00)
or
One work costing not less than 7.50 crore (1.25 x 6.00)
(ii) Average annual turnover 7.5 crore (1.25 x 6.00)
(c) Average marks secured in Performance Reports (Stage-II) for the works completed
in last five years shall not be less than 70%. Where report for any work is not available, it
will be deemed to contain only 60% average marks.
8. Contractors of 'A' class and above only shall be eligible for enlistment in categories (a)
(iii) Runways and Pavements and (a)(iv) Marine and Harbour Works subject to prior approval
of E-in-C.
9. The criteria laid down above for enlistment/ upgradation may be relaxed in the case of
contractors whose performance has been found to be of a very high order. Such relaxation
may, however be given only with the prior approval of E-in-C's Branch.

(c) List of works executed during last five years (As per Appendix 1.2) including
copies of Work Orders/Work allotment letters, Copies of completion certificates and
Form 16 AlTDS certificate for GST (GSTR-7A).
(d) Annual turnover certificate duly supported with audited balance sheet. The
turn over certificate must bear the UDIN (Unique Document Identification Number).
The turn over certificate and audited balance sheet should be from same Chartered
Accountant. In case balance sheets are not audited, Form 26 AS and lor Annual GST
return shall be forwarded in support of turnover.
(e) Audited balance sheet of last five years in case of Limited companies
(f) Solvency certificate from scheduled bank as per specimen given in Appendix-
1.3
(g) Working Capital certificate from scheduled bank as per specimen given in
Appendix-1.3.
(j) Affidavit from contractor giving brief details of arbitration/ litigation cases he
was involved in. Registering Authority will critically examine such details and if
contractor is considered habitual litigant, his enlistment upgradation shall not be
carried out. Contractor shall be deemed to be a habitual litigant if he moves the court

(p) Affidavit that no near relative(s) of the contractor or his/their employees/agents
is/are working as Junior Engineer(s) in MES/Corps of Engineers. If his near relative(s)
is/are working in such capacity in any formation upto CWE/ GE (I) office, the
contractor shall furnish details. The contractor shall not be entitled to tender for the
works in entire area of that CWE/GE (I).
(q) Copy of power of attorney/Resolution of the Board in favour of any Partner/
Director of the firm.
(r) Copy of immediate last Income Tax Return.
(s) A separate sheet containing specimen signatures (signed in black ink) and
affixed with photographs of Proprietor/Partners/Directors (to be used as Appendix B
of enlistment letter).
(t) Self-attested copy of PAN Card of Proprietor, Partners, Directors and the firm/
Company.
(u) Self-attested copies of GST registration, EPFO registration and ESIC
registration certifcates.
Notes:-
(i) All the documents submitted by the contractor shall be signed by Proprietor/all
Partners/all Directors unless specifically authorised to a Partner/Director through
POA or Resolution of the Board.
(ii) Photocopies of documents shall be self-attested. Registering Authority shall ask
production of original documents to verify the photocopies.
(iii) All affidavits shall be given on non-judicial stamp paper of appropriate value
duly signed by the contractor and attested by the Magistrate/Notary public.
(iv) Registering Authority shall cross-verify the genuineness of financial documents
at Para (d) & (e) above from issuing Chartered Accountant (CA) and documents at Para
(f) & (g) from the concerned Bank branch by referring in writing to them alongwith
copy of above documents submitted by contractor. Registering Authority is also at
liberty to verify the genuineness of all the documents from other reliable/authentic
sources.
(v) All documents related to work experience and turnover (except Form 26AS and
portal-generated GST return) shall be got independently verified from the client/
issuing Authority. For documents in support of works experience, TDS certificate for
IT/ Sales Tax/ NAT/GST shall also be asked from applicant firms. Registering
Authorities may seek clarifications from the Chartered Accountant in case of any
doubt.
(vi) Documents mentioned at Para 1.5 (a) and 1.5 (s) shall not be applicable for the
purpose of documents to be uploaded for bidding purpose by unenlisted firms.

Appendix ‘ B ’ t o NIT
INTEGRITY PACT
GENERAL
Objectives
3. Now, therefore, the Principal/Owner and the Bidder agree to enter into this pre-
contract agreement, referred to as INTEGRITY PACT (IP), to avoid all forms of
corruption by following a system that is fair, transparent and free from any
influence/prejudiced dealings prior to, during and subsequent to the conclusion of the
contract to be entered into with a view to :-
3.2 Enabling Bidder to abstain from bribing or any corrupt practice in order
to secure the contract by providing assurance to them that their competitors
will also refrain from bribing and other corrupt practices and the
principal/Owner will commit to prevent corruption, in any form, by their
officials by following transparent procedures.

4.2 The Principal/Owner will, during the pre-contact stage, treat all
Bidders alike and will provide to all bidders the same information and will not
provide any such information to any particular Bidder which could afford an
advantage to that particular Bidder in comparison to other Bidders.
4.3 All the officials of the Principal/Owner will report to the appropriate
Government office any attempted of completed breach(s) of the above
commitments as well as any substantial suspicion of such a breach.
6.1 Bidder will not offer, directly or through intermediaries, any bribe, gift,
consideration, reward, favour any material or non-material benefit or any other
advantage, commission, fee, brokerage or inducement to any official of the
Principal/Owner, connected directly or indirectly with the bidding process, or
to any person, organization of third party related to the contract in exchange
for any advantage in the bidding, evaluation, contracting and implementation
of the contract.
6.2 The Bidder further undertakes that he has not given, offered or
promised to give, directly or indirectly any or through intermediaries, any bribe,
gift, consideration, reward, favour or any material or non-material benefit or
any other advantage, commission, fee, brokerage or inducement to any official
of the Principal/Owner or otherwise in procuring the contract or
forbearing to do or having done any act in relation to the obtaining or
execution of the contract or any other contract with the Government for
showing or forbearing to show favour or disfavour to any person in relation
to the contract or any other contract with the Government.
6.3 The Bidder will not collude with other parties interested in the
contract to impair the transparency, fairness and process of the bidding
process, bid evaluation, contracting and implementation of the contract.

6.4 The Bidder will not accept any advantage in exchange for any
practice, unfair means and illegal activities.
6.5 The Bidder would not enter into condition contract with any
Agent(s), broker(s) or any other intermediaries wherein payment is made or
penalty is levied, directly or indirectly, on success or failure of the award of
the contract.
6.6 The bidder commits to refrain from giving any complaint directly or
through any other manner without supporting it with fun and verifiable facts.
Complaint will be processed as per Guidelines for Handling of Complaints in
vogue. In case the complaint is found to be vexatious, frivolous or malicious in
nature, it would be construed as a violation of Integrity Pact.
7. Previous Transgression
7.1 The Bidder declares that no previous transgression occurred in the last
three years immediately before signing of this Integrity Pact with any other
company in respect of any corrupt practices envisaged hereunder or with any
Public Sector Enterprise in India or any Government Department in India.
7.2 If the Bidder makes incorrect statement on this subject, Bidder can be
disqualified from tender process or the contract and if already
forwarded, same can be terminated for such reason.
9.1 Any breach of the aforesaid provisions by the Bidder of any one employed
by him or acting on his behalf (whether with or without the knowledge of
the bidder) or the commission of any office by the Bidder or any one employed
by him or acting on his behalf, as defined in Chapter IX of the Indian Panel Code
1860 or the Prevention of Corruption Act 1988 or any other act enacted for the
prevention of corruptions shall entitle the Principal/Owner to take all or any
one of the following actions, wherever required :-
(i) Technical bid of the Bidder will not be opened. Bidder will not
be entitled to or given any compensation. However, the proceedings
with the other Bidder(s) would continue.

(ii) Financial bid of the Bidder will not be opened. Bidder will not be
entitled to or given any compensation. However, the proceedings with the
other Bidder(s) would continue.
(iii) The Earnest Money Deposit shall stand forfeited either fully or
partially, as decided by the Principal/Owner, in case contract is not
awarded to the Bidder and the Principal/Owner shall not be required
to assign any reason therefor. For enlisted contractors an amount less
than or equal to Earnest Money Deposit as decided by the
Principal/Owner shall be deducted from any amount held with the
Department/ any payment due.

(x) The Bidder shall not lend to or borrow any money from or enter into
any monetary dealings or transactions, directly or indirectly, with any
employee of the Principal/Owner and if he does so, the Principal/Owner
shall be entitled forthwith to cancel the contract and all other contracts with
the Bidder.
9.2 The decision of the Principal/Owner to the effect that a breach of the provisions of
this Integrity Pact has been committed by the Bidder shall be final and binding on the
Bidder. However, the Bidder can approach the Independent External Monitor(s)
(IEMs) appointed for the purposes of this Pact.
10.1 MoD has appointed the following Independent External Monitor for this pact in
consultation with the Central Vigilance Commission ;-

10.3 In case of any complaint with regard to violation of Integrity Pact, either party can
approach IEMs with copy to the Nodal Officer and the other party. If any such
complaint from bidder is received by the Principal/ Owner, the Principal/Owner
shall refer the complaint to the Independent External Monitors for the
recommendations/inquiry report.

10.4 If the IEMs need to peruse the relevant records of the Principal/
Owner and/ or of the Bidder/Contractor in connection with the complaint
sent to them, the Principal/Owner and/or the Bidder/ contractor shall
make arrangement for such perusal of records by the IEMs as demanded
by them including unrestricted and unconditional access to the project
documentation and minutes of meeting. If records/documents of Sub-
Contractor(s) are also required to be perused by the IEMs, the Bidder shall
make arrangement for such perusal of records of the IEMs as demanded by
them. IEMs are under obligation to treat the information and documents
of the Principal/ Owner and Bidder/Contractor/Sub-Contractors with
confidentially.
10.5 The task of the IEMs, is to review independently and objectively, any
complaint received with regard to violation Integrity Pact and offer
recommendations or carry out inquiry as deemed fit. The IEMs are not
subject to any instructions by the representatives of the parties and shall
perform their functions neutrally and independently. The report of
inquiry, if any, made by the IEMs shall be submitted to either of the
following for a final and appropriate decision in the matter keeping in view the
provision of this Pact :-

(b) Partnership firm - The Integrity Pact must be signed by all partners or
by one or more partner holding power of attorney signed by all
partners.
(c) Limited liability firm - The Integrity Pact must be signed by all
partners or by one or more partner holding power of attorney signed by all
partners.
15. Validity
15.1 The validity of Integrity Pact shall be from date of its signing. It expires for
the Contractor after the final payment under the contract has been made or till
the continuation of Defect liability period, whichever is later and for all other
bidders, till the contract has been awarded.
15.2 Should one or several provisions of this Pact turn out to be invalid, the
remainder of this Pact remainder valid. In this case, the parties will strive to
come to an agreement to their original intentions.

The subject Notice Inviting Tender (NIT) is an invitation to offer made on the
condition that the Bidder will sign the Integrity Pact, which is an integral part of
tender/ bid documents, failing which the tender/ bidder will stand disqualified

rejected.
This declaration shall form part of parcel of the Integrity Pact and signing of the

I/we agreed that the Notice Inviting Tender (NIT) is an invitation of offer
made on the Condition that I/we will sign the Integrity Pact, which is an integral
part of tender document, failing which I/we will stand disqualified from the
tendering process I/we acknowledge that THE MAKING OF THE BID SHALL BE
REGARDED AS AN UNCONDITIONAL AND ABSOLUTE ACCEPTANCE of the
conditions of the NTI.
I/we confirm acceptance and compliance with the Integrity Pact in letter
and spirit and further agree that execution of the said Integrity Pact shall be
separate and distinct from the main contract, which will come into existence
when tender/bid is finally accepted by MES. I/we acknowledge and accept the
validity of the Integrity Pact, which shall be in line with Para 15 of the enclosed
Integrity Pact.
I/we acknowledge that in the event of my/our failure to sign and accept
the Integrity Pact, while submitting the tender/bid, MES shall have unqualified,
absolute and unfettered right to disqualify the tender/bidder and reject the
tender/bid in accordance with terms and conditions of the tender/bid.
