Fe (Q ~yf. pw ( 6 Lat : NN - THE UNIVERSITIES’ ACADEMIC STAFF UNION Sb ae (UASU) 28" October, 2019 She op CCF 80 Oke 9 ee Page 2 of I REPUBLIC OF KENYA COLLECTIVE BARGAINING AGREEMENT BETWEEN INTER-PUBLIC UNIVERSITIES’ COUNCILS CONSULTATIVE FORUM (IPUCCE) OF THE FEDERATION OF KENYA EMPLOYERS (FKE) AND THE UNIVERSITIES’ ACADEMIC STAFF UNION (UASU) NT is made between the INTER-PUBLIC UNIVERSITIES’ COUNCILS CONSULTATIVE FORUM (IPUCCF) OF THE FEDERATION OF KENYA EMPLOYERS (FKE) hereinafter referred to as “the Employer” of the one part and the UNIVERSITIES’ ACADEMIC STAFF UNION (UASU) duly registered as a Trade Union Under the Labour Relations Act, 2007, Laws of Kenya, hereinafter referred to as “the Union” of the other part. THIS COLLECTIVE BARGAINING AGREEME! PREAMBLE WHEREAS by the terms of the Recognition Agreement between the Employer and the Union, the Employer having recognized the Union as properly constituted as the sole labour organization capable of representing the interest of Unionisable Academic Staff in all the Public Universities. The purpose of this Agreement is to set forth the understanding between the parties as to the terms and conditions of employment of Members’ of the Union as specified herein; and, WHEREAS the Salaries and Remuneration Commission (SRC) by a letter dated 28" ‘August, 2019 under Reference Number SRC/TS/JE/PURTI/3/33/7 Vol.IV (67) advised on the negotiation parameters for the Collective Bargaining Agreement for the period 2017- 2021. NOW, THEREFORE, it is hereby agreed as follows: 41. INTERPRETATION 1.1The interpretation of this Agreement or any part thereof shall be vested in the Joint Negotiating Committee of the Employer and the Union, subject to the right «af adjudication by the Employment and Labour Relations Court. BASIC SALRRY AND SALARY SCALES Sm Ww ey The basic monthly salaries, in Kenya shillings, shall be paid to the staff members of the Union as provided in the SCHEDULE 1A and 1B. =a ‘ F < Hh 2 enn gi) SO oh 4 of HUCCE and LASU 2° Oe, 2019 ; awe) JI ws ~~ Te Se CAH Caan ‘repiuccr en tasv2 dco, 29 NI On eal a Page 3 of 11 3, HOUSE ALLOWANCES The house allowances, in Kenya shillings, shall be paid to the staff members of the Union as provided in the SCHEDULE 2, The house allowances remain unchanged from the 2013-2017 CBA. 4, THE OTHER TERMS AND CONDITIONS OF THIS AGREEMENT 4.1 Other terms and conditions of service currently in force as approved by the respective Councils or supplementary collective bargaining agreements shall remain unchanged until when the individual Universities’ Councils and the Union conclude supplementary collective bargaining agreement. 4.2The individual Universities’ Councils and the Union shall initiate and conclude structured negotiations on other Terms and Conditions of service under the 2017-2021 Collective Bargaining Agreement on or before 31% March 2020. 4.3The implementation of this Collective Bargaining Agreement (CBA) shall be on or before 30% November, 2019. 4.4There shall be a Joint Implementation Committee in every University to oversee the implementation process. Every University shall designate three (3) officials to oversee the implementation process and the respective Universities’ Academic Staff Union Chapter shall appoint three (3) officials to oversee the implementation process. The Vice Chancellors shall designate an officer at the level of Deputy Vice Chancellor to be the team leader and/or manager of the implementation process in the respective Universities. 4.5 Any surplus or deficiency in the allocation of the Collective Bargaining Agreement (CBA) Funds shall be reported to the National Implementation Committee. Any deficiency shall also be reported to the Salaries and \«*~ Remuneration Commission and the Ministry of Education for allocation of funds. 4.6 There shall be a National Implementation Committee comprised of:~ , 2. i. Co- Chairmen of the Joint Negotiations Committee; 4 \ Secretary General of the Universities’ Academic Staff Union; - iii. IPUCCF shall nominate three (3) people; and \ \ iv. Universities’ Academic Staff Union shall nominate three (3) people. We 4.7 The National Implementation Committee shall monitor and evaluate the Lt implementation and review of this Agreement in accordance with the --™ "4 Implementation Notes in SCHEDULE 3, freer be oO 4.8 For jobs/grades whose current salaries are above the basic salary structure, the a existing salary structure shall be retained with annual increments in accordance with the Salaries and Remuneration Commission (SRC) advisory dated 28th August, 2019 under Reference Number SRC/TS/JE/PURTI/3/33/7 Vol.IV (67). < 2013-2017 CBA, such jobs shall be placed in the rightful grade and implemented _— (with annual increments) in accordance with the Salaries and Remuneration ‘4.9 For jobs/grades whose cur‘ent salaries were below the basic salaries in the @ Commission (SRC) advisory dated 28th August, 2019 under Reference Number . — uni Page 4 of II | | | | | ‘SRC/TS/JE/PURTI/3/33/7 VoL.IV(67). 4.10 Upon a written request, the universities shall grant leave of absence to Union officials elected to national office for the duration of their term of office. 4,11(a) The retirement age shall be 75 years; (b) An academic member of staff may retire voluntarily at the age of 50 years or above. 4.12 Pending Union dues and agency fees shall be recovered directly from arrears of this Collective Bargaining Agreement. 4,13 A subscription fee of 2% of basic salary shall be charged as Union dues and payable to the Official UASU designated Account in accordance to the Labour Relations Act, 2007, 5. EFFECTIVE DATE AND DURATION OF AGREEMENT 5.1 This Agreement shall cover the period from 1*July, 2017 up to 30% June, 2021. Thereafter this Agreement shall continue to be in force until mutually amended or when the Parties herein shall negotiate and bring to force another agreement. 5.2 Any party intending to amend this Agreement shall give the other party one (1) month’s written notice and the details of the amendment required. The responding Party shall do sc within thirty (30) days from the date of receipt of the notice. 5.3 In the event of it proving impossible to obtain mutual agreement on the amendments, either party may seek dispute resolution in accordance with the Labour Relations Act, 2007. These notes contain the guidelines for making (a) Salary Adjustments and (b) Implementation of the 2017-2021 CBA. A Salary Adjustments The salary structure being implemented succeeds the basic salary scales in the 2013-2017 CBA by the parties, Itis noteworthy that there are discrepancies between the basic salary rates contained in the 2013- 2017 CBA for the year 2016/2017 and the base figures provided by the SRC for the 2017-2021 CBA. The following guidelines will be followed in adjusting the basic salaries to bridge the gap between the two CBAs: 1. Ina situation where the figures for 2013-2017 CBA are higher than the figures in the basic salary scales provided by SRC for the 2017-2021 CBA, the difference is negative. Such negative differences will be zero-rated and the 2017-2021 CBA rates shall apply. 2. Where the differences are positive, then they constitute arrears payable to the affected employees for 2016/2017 only. The following tables provide guideline on the workings: (a) Identify the salary scale and steiy where a staff was in July 2016 using the 2013-2017 CBA implemented in November 2017. This may involve writing back the arrears paid for that period.
