    MOTION TO LIFT BENCH WARRANT

    MOVANT, through undersigned counsel and unto this Honorable Office


    respectfully avers that:

    1. The Honorable Court issued a Bench Warrant of Arrest dated _______ directing
    the apprehension of the accused for failure to appear during___

    2. That the records of the case would show that accused was personally informed
    of the supposed pre-trial setting on the said date, resulting in his absence.;

    3. That Notice of Pre-trial was sent through registered mail to the address of the
    accused but per Registry Return Card.

    4. That said notice of Pre-trial was never turned over by the said to the accused;

    5.That movant sincerely apologizes to this Honorable Court and the other party for
    whatever inconvenience his actions may have caused;

    6. The accused most respectfully begs this Honorable Court to immediately lift the
    bench warrant in the interest of substantial justice

    7. That movant shall endeavor to attend all succeeding hearings in the above-
    captioned case. If accused anticipates that he may not be able to appear for just and
    valid reasons, he shall immediately inform this Honorable Court.;

    8. This motion is not intended to delay the proceedings of this case but solely for
    the reasons stated above
    WHEREFORE, PREMISES CONSIDERED AND IN THE INTEREST OF
    SUBSTANTIAL JUSTICE, it is most respectfully prayed that Bench Warrant of
    Arrest dated___ issued by the Honorable Court against the accused be lifted.

    Other relief is likewise prayed for.
