Noriel H.

Rodriguez, petitioner
vs.
Gloria Macapagal-Arroyo et. al
G.R. No. 191805, November 15,2011

Ponente: Sereno, CJ.

Facts:
Rodriguez is a part of Alyansa Dagiti Mannalon Iti Cagayan, a peasant group connected to
Kilusang Magbubukid ng Pilipinas (KMP). As a result of the military's Oplan Bantay Laya,
KMP members were labeled as enemies of the state and were therefore a prime target for
extrajudicial killings and forced disappearances. On September 6, 2009, Rodriguez had just
gotten off a tricycle when he was grabbed by four guys and pushed into a car where more men
dressed in civilian attire were waiting. Rodriguez stayed silent until they arrived at a camp of the
Philippine Army, where he was then subjected to beatings and torture by personnel of the
Philippine Army. The men began striking Rodriguez inside the car and forced him to confess that
he is a member of the NPA. Rodriguez was repeatedly beaten and tortured, forced to sign some
documents.

Issue:
Whether the rights to life, liberty and property of Rodriguez were violated by the respondents

Held:
Yes. The rights to life, liberty and property of Rodriguez were violated or threatened by
respondents. The SC held that there was no reason to depart from the actual findings of the Court
of Appeals, the same being supported by substantial evidence following the doctrine of totality
of evidence in amparo cases which is to consider all the pieces of evidence adduced in their
totality, and to consider any evidence otherwise inadmissible under our usual rules to
be admissible if it is consistent with the admissible evidence adduced. The sworn affidavit of the
petitioner and the "medical examinations conducted on him are sufficient evidence proving that
the military personnel involved in the case indeed abducted Rodriguez on September 6, 2009 and
then detained and tortured him.
