PROJECT CONSTRAINTS / DELAYS

We, POWERCHINA SEPCO1, as a Contractor is struggling for the project from the signing of the
contract dated i.e. 18-11-2019, due to several unavoidable factors we’re unable to achieve the project
timeline, mainly Change in Order, Change in Scope of Work (Conventional Foundations to Pile
Foundations) due to Change in Design which was identified after the Soil Investigation report of 220
kV Mirpur Khas Substation. As our resources, team, material, machinery is at Project site from last
2 years but we’re unable to resume our site activities due to several postponements of approvals i.e.
Site Selection and Demarcation, delayed approvals of design especially GLO and Civil Design,
Change of scope and Change of facilities.
As a result of worldwide inflation SEPCO1 suffered the most and eagerly sought for the
commencement of site activities and to finish the project in stipulated time. Several constraints has
been encountered to date, due to which the project has been suffered approx. 22 months delay.

The detail of delays in the project progress is as following:

1. CHANGE IN PROJECT SCOPE

With reference to the change in scope of subject project, As advised by C.E (Civil), we submitted
Detailed Design Analysis & Load study of Control House Building Pile Design vide our letter ADB-
200-2018/192 dated 14-06-2021 and Equipment Pile Foundation design along with detailed
calculations vide our letter ADB-200-2018/199 dated 28-06-2021. Approval was granted after the
interval of 172 days by C.E(SS Design) office dated 3-12-2021. To start the site activities Bore hole
Layout was submitted dated 22-7-2022 and approved by C.E (Civil) office which was later on
cancelled by SS Design office due to pending approval of General Layout. *Approval of Borehole
layout was linked with the approval of General layout which was delayed about 71 days due to
piecemeal comments of SS Design.

2. CHANGE IN ORDER/ CHANGE OF FACILITIES

As per clause 39 (Change in the facilities) Section 7, General Conditions of Contract, and considering
the low bearing capacity of soil investigation report of 220kV Mirpur Khas Substation which we
submitted vide our office letter no ADB-20012018/159 dated 11-03-21. We received the response of
C.E (Civil) NTDC office through C.E (SS Design) NTDC office on 02-06-2021 demanding the
Drawings of Equipment's Foundations for the approval of Change of facilities case. Submitted the
detailed calculations and analysis, complete Design was submitted on 28-06-2021 and got the
approval from C.E (SS Design) NTDC office on 03-12-2021. On the basis of approved design,
Change of facilities case with complete analysis was submitted on 7-01-2022 and received the
approval of rates from C.E(Civil) office on 4-02-2022.
After the several meetings, reminders and follow-ups, Change in order/ Change of facilities case was
approved and the contract has been ammended by the authorities dated 25-08-2022. It took more
than 7 months for the approval of Change of facilities case which is the main cause of delay in starting
the site activities at 220kV Mirpur Khas Substation.

3. DELAY DUE TO LATE APPROVALS OF DESIGN

As per clause 20.3 of General Conditions of Contract, Section VII of Contract Documents, all the
technical documents/drawings are to be submitted by Contractor which reply must come within 14
days after receipt of these documents. We submitted the Design drawings for approval to C.E (SS
Design) NTDC office, however the approval of drawings took abnormal time.

4. DELAY DUE TO FORCE MAJEURE

As per clause 37.2 (Force Majeure) of General Conditions of Contract, Section 7 of Contract
Documents, if either party is prevented, hindered or delayed from or in performing any of its
obligation under the contract by an event of Force Majeure.

Pandemic COVID-19 outbreak all over the world, cause delay in mobilization in the start of project.
Mirpur khas district was declared as a “Calamity affected area” by Government of Sindh. We
POWERCHINA SEPCO1 team along with NESPAK Consultant are at site to start the site activities
as per project plan submitted to your office dated 11th August 2022. Unfortunately approx. 4/5 feet
flood and rain water is standing at 220kV Mirpur khas Substation Site and all over the city. As our
resources are already available at 220kV Hala road Substation but due to severe climate conditions
we are facing difficulties in transportation/ mobilization of our Heavy Machinery to 220kV Mirpur
Khas Substation.

We approve the Change Order due to change in the scope of the facilities due to the fact that as per
the Geo Technical Soil lnvestigation report of the subject project, soil-bearing capacity is very low and
the water table depth is high and pile foundation is deemed necessary instead of
shallow/conventional foundation for the long health, safety and durability of the structure. This is
added to the scope of work of subject Contract. We further agree to adjust the Contract Price in
accordance with Clause-39 of General Conditions of Contract.
