copies of the DOE Certificate of Registration with its corresponding number 2183, dated
and other pertinent documents evidencing and conferring upon the LA LIBERTAD
RANK AND FILE EMPLOYEES UNION (LALIRFEU), this municipality, as the duly

COLLECTIVE NEGOTIATION AGREEMENT


Executive By and Between
LA LIBERTAD RANK AND FILE EMPLOYEES UNION (LALIRFEU) a duly
registered union of the employees of the municipal government of La Libertad, Zamboanga del
Norte with the Civil Service Commission (CSC) and the Department of Labor and Employment
(DOLE) with Certificate of Registration No. 2183 dated with place of
operation at the Municipal Building, La Libertad, Zamboanga del Norte, represented herein by
, President, hereinafter as the UNION.
And
The Municipal of La Libertad, a local government agency, duly created and existing by
virtues of the laws of the Republic of the Philippines with office and place of operation located
at, Poblacion, La Libertad Zamboanga del Norte, represented by ,
Municipal Mayor, hereinafter referred to as the AGENCY.
WITNESSETH
WHEREAS, the LALIRFEU is the only existing legitimate labor organization of the
named Agency.
WHEREAS, the purpose of the UNION and the AGENCY to enter into an agreement is
to foster and promote a noble and enduring relationship between the employees and management
through the development of harmonious and sound labor management practices for the purpose
of improving the welfare and well-being of the workers through better employment and working
conditions.
NOW, THEREFORE for and in consideration of the foregoing and the furtherance of the
labor-management cooperation, the parties manifest and hereby express their agreement on the
following.

ARTICLE I
REGOGNITION

SECTION 1. The AGENCY hereby recognizes the UNION as the sole and exclusive
representative for all employees of the Agency with respect to terms and conditions of
employment.

ARTICLE II
NEGOTIATING UNIT AND COVERAGE

SECTION 1. All association member-employees having permanent, co-terminus,


plantilla casual status and the agency under the approved plantilla of personnel are herein
referred as the negotiating unit and shall be the coverage of this agreement.
ARTICLE III
CONFLICT

SECTON 1. If there is any conflict between the provision of the Agreement any rules and
regulations hereto promulgated or laid down by the AGENCY, the terms of the Agreement shall
prevail.

ARTICLE IV
UNION’S SECURITY

SECTION 1. Membership in the UNION. All employees within the negotiating unit who
are members of the association on the date of the signing of this Agreement, as well as all
employees within the negotiating unit who subsequently become members of the UNION during
the effectivity of this Agreement. Employees who are not members of the UNION hired for the
positions within the bargaining unit after the executive of this Agreement may at any time join
the UNION.

ARTICLE V
UNION’S MEETING

SECTION 1. Union’s Meeting. The association shall be allowed to conduct quarterly


officers; general membership and committee meetings and such special meetings as may be
deemed necessary, for information and educational purposes during office hours and shall be
allowed the use of government facilities for such meetings, after the approval of the Agency of
its duly authorized representative.
SECTION 2. Projects. The AGENCY shall allow the UNION to undertake certain
projects or activities that redound to the benefit of the members.
SECTION 3. Bulletin Boards. The AGENCY agrees that the UNION set up Bulletin
Boards in specified places within the Agency’s premises.
SECTION 4. Physical Fitness and Sports Development Program. The AGENCY agrees
to allow and support the UNION in the conduct of a regular physical fitness and sports
development program for the employees.

ARTICLE VI
GRIEVANCE PROCEDURE

SECTION 1. All disputes between the UNION and the AGENCY shall be settled through
negotiations. Disputes along the members of the association shall be settled by the Grievance
Committee of the Association.

ARTICLE VII
PERSONNEL FILE AND OTHER FILES

SECTION 1. The UNION shall have free access to records/documents or any related
information subject to the provision of R.A 1613 whenever such information and documents are
necessary for the professional development and interest of employees and public as a whole.
SECTION 2. The Human Resource Management Officer (HRMO) shall furnish with
documents relative to the recruitment, termination and retirement of employees not later than 15
days upon its effectivity for the purposes of recommendation.

ARTICLE VIII
UNION’S ROLE

SECTION 1. The UNION shall act with vigilance and renewed vigor in the achievement
of an effective honest and courteous public service and shall not prejudice the service in the
conduct of their activities.
SECTION 2. The UNION shall forge a coordinative effort with the Agency with regards
to the formation, discipline and development of the employee towards his/her job.
SECTION 3. The UNION shall implement saving measures on:
A. Travel
1. Whenever necessary, limit number of participants to trainings/seminars called
by government sponsored activities.
2. Limit number of travels to Dipolog City, especially transaction pertaining to
submission of reports. Coordinates with other offices having similar
transaction in Dipolog City and let her/him be the courier of said reports.
3. Limit number of participants attending conventions sponsored by different
association/leagues.
B. Use of Electricity
1. Minimize use of light noon break (12:00nn-1:00pm), if necessary, turn-off all
the lights.
C. Use of Computer Sets/ Air Conditioning Units
1. Whenever necessary, all computer sets must be turned off at noon break from
12:00nn to 1:00pm to save energy.
2. All employees irrespective of rank are prohibited from playing computer
games, viewing films, or connecting with the internet to view facebook,
twitter and the like, except for official connections with different government
portals;
3. Anyone caught violating the aforementioned conditions shall be dealt with
accordingly.
4. All offices with air conditioning units shall have daily regulated time in
turning on and off of he said unit as follows:

D. Overtime
1. Consistent with Civil Service Commission Rules adopt scheme that will allow
employees/officials rendering overtime to be compensated through time/days
of work in lieu of overtime pay, subject to existing accounting rules auditing
procedures.
E. Use of Supplies and Materials
1. Encourage recycling of used office supplies and materials, such as bond
papers, folders, fasteners, etc. if necessary.
ARTICLE IX
INCENTIVE

SECTION 1. A Collective Negotiation Agreement (CNA) incentive may be granted to


both management and rank and file employees of the agency with approved and successfully
implemented CNA'S IN recognition of their efforts in accomplishing targets at lesser cost, in
attaining more efficient and viable operations through cost-cutting measures and system
improvements, (Joint Resolution No. 4dtd July 28, 2008).
SECTION 2. The CNA incentive shall be served surely from savings from reserved
Maintenance and Other Operating Expenses (MOOE) allotments for the year under review, still
valid for obligation during the year of payment of the CNA provided such savings were
generated out of the cost cutting measures identified in the CNA' s and supplement thereto. The
CNA Incentives shall be source solely from the allowable MOOE Allotments as enumerated
under 4.3.1 Budget Cellular No. 2016-7 dated December 1, 2016:
a. Travelling Expenses;
b. Communication Expenses;
c. Repairs and Maintenance;
d. Transformation and Delivery Expenses;
e. Supplies and Materials; and
f. Utility Expenses.
SECTION 3. The CNA incentive for the year shall be paid as a onetime benefit after the
end of year, provided that the planned programs/activities/projects have been implemented and
completed in accordance with performance targets for the year.
SECTION 4. The CNA Incentive shall not be given upon signing and ratification as this
gives the CNA Incentive the character of the CNA Signing Bonus which the Supreme Court has
ruled against for not being truly reasonable compensation (Social Security System Vs.
Commission on Audit; 384 SCRA 548, July 11, 2012) and maybe higher for employees in
offices or organizational units which contributed more in cost savings, productivity, profitability,
or a combination thereof, as the case maybe.
SECTION 5. The CNA Incentive may vary year during the term of the CNA, at rates
depending on the savings generated after the saving generated after the signing and ratification of
the CNA.

ARTICLE X
PROCEDURAL GUIDELINES

SECTION 1. An Employees’ Organization, Management Consultative Committee of a


similar body composed of designated representatives from the management and the accredited
employees’ organization shall review the agency’s financial records and report of operations at
the end of the fiscal year and arrive at a consensus on the following item:
1. The guidelines/criteria to be followed in the grant of the CNA Incentives;
2. The total amount of unencumbered savings at the end of the year which were realized
out of cost-cutting measures identified in the CNA’s and supplements thereto, and
which were the results of the joint efforts of labor and management.
3. The apportioned amounts of such savings shall cover the following items:
a. Fifty percent (50%) for CNA Incentive;
b. Thirty percent (30%) for Improvement of working conditions and
other programs and/or to be added as part of the CNA Incentive, as
maybe agreed upon the CNA;
c. Twenty percent (20%) to be reverted to the General Fund.
SECTION 2. Such agreement shall be incorporated in a written resolution to be signed by
the representative of both parties and noted by the agency head. This resolution shall serve as
basis for accounting and auditing purposes.

ARTICLE XI
DURATION

SECTION 1. This agreement shall become effective upon signing and shall remain in
effect within (3) years as long as associations exist.

ARTICLE XII
SAVING CLAUS

SECTION 1. If the law is silent on any provision of this Agreement or on the application
hereof, said provision shall be deemed valid and subsisting except to the permitted by law, but all
other provision of this Agreement which is held contrary to law or declared invalid by any court
of competent jurisdiction shall nullify the same, but all other provisions or applications not
otherwise declared will continue in force and effect.

ARTICLE XIII
FINAL PROVISIONS

SECTION 1. In the event that any provision of this Agreement is declared invalid or
illegal by any competent court or authority or amended or qualified by national legislative and
executive issuance, all the other provisions not affected thereby shall remain in full force and
effect.
SECTION 2. Separability. The Agency and the Union acknowledge that each section and
article of this agreement is separated and independent from each other and it is not to be consider
or interpreted as having any restrictive or expansive effect upon the meaning, intention,
interpretation or implementation of other section or article of the Agreement either implicitly or
explicitly, unless it is specifically provided; and in the event any provisions of this agreement
shall conflict with any present or future valid law, the provisions of such law shall prevail
without affecting other provisions of this agreement.
SECTION 3. Complete Settlement. The Municipal Government and the Employees’
Association with attendant and express intent, manifest that this Agreement is a full and
complete settlement of all collective demands, request, claims, and issues of every nature and
kind that the employees’ association may have any against the municipal government or vice
versa, proceeding the date of the effectivity hereof.
SECTION 4. Duration and effectivity of this agreement. This Agreement which shall be
binding upon the Municipal Government and the Employees’ Association and their respective
successor-in-interest shall become effective upon the conclusion and signing hereof and shall be
in full effect within a period of three (3) years from its effectivity.
SECTION 5. Municipal Government and the Employees’ Association shall convene to
discuss, negotiate, and bargain the terms and conditions of new Collective Negotiation
Agreement to be entered into by the parties herein within five (5) months before the expiration of
previous agreement.

SECTION 6. Appropriation. Provision of this Agreement which require appropriation is


subject to confirmation/legislation by the Sangguniang Bayan of the Municipality of La Libertad
Zamboanga del Norte subject however to availability of LGU Funds.

IN WITNESS WHEREOF, the parties thereto, by their authorized representatives have executed
this COLLECTIVE NEGOTIATION AGREEMENT. , 20 .
