SUBJECT: REVISED GUIDELINES AND PROCEDURES GOVERNING THE


AVAILMENT OF PROTECTIVE SECURITY TO GOVERNMENT
OFFICIALS, DIPLOMATS, AND PRIVATE INDIVIDUALS
AUTHORIZED TO BE GIVEN PROTECTION

2. RATIONALE:

This Memorandum Circular (MC) provides the guidelines and procedures


to be undertaken by concerned PNP Offices/Units in the provision of protective
security to government officials, diplomats, and private individuals in consonance
with the directive of President Rodrigo Roa Duterte to reimpose the" Alunan

Doctrine."

3. SITUATION:

Provision of the PNP or civilian personnel as protective security or


bodyguards to government officials, private individuals and abusive personalities
breeds consternation from the general public. In fact, some individuals erijoy
excessive security personnel which depletes the resources of the PNP in the
exercise of its mandate to serve and protect the interest of the majority of the Filipino
people.
To streamline the policies and procedures in the provision of protective
security. there is a need for the PNP to implement a uniform set of guidelines and
procedures in the availment of protective security to government officials, visiting
dignitaries, and private individuals in consonance with PRRO's directive to reimpose
the" Alunan Doctrine" which is to strictly observe and implement the provision of a
maximum of two (2) security personnel 10 government officials and private
individuals. The excessive use of security personnel constitutes private armed
groups.

4. PURPOSE:
To provide and establish a uniform guidelines and prOcedures governing
the availment and detail of Protective Security Personnel (PSP) and Protection
Agent (PA) to govemment officials, visiting dignitaries, and private individuals
authorized to be provided with protection.

5. DEFINITION OF TERMS:
For purposes of this MC, the following. terms, words, and phrases shall
mean or, be understood, as follows:
a. Alunan Doctrine - refers to Letter of Instructions 01/93 (Paglalansag
"Charlie") issued by former Secretary Rafael M. Atunan III,
DILGfChairman, Joint Cabinet Task Force OPLAN Pagla1ansag dated
November 11, 1993 which sets forth the specitic operational objectives,
concepts, and tasks to be strictly followed by all concerned agencies in
the campaign to fast track and finally end the existence of private
armed groups throughout the country.

b. Applicant - the person requesting for the availment of PSP.

c. Cabinet Members - refer to Department Secretaries and other


Cabinet level officials.

InvestIgationInto all Important aspects of an individual's life history.

e. Chairmen of Constitutional Commission - refers to the Chairman of


the Commission on Audit, Commission on Elections and Civil Service
Commission.
f. Di.pl~mats - refer to the collective body of Heads of Diplomatic
Mls~lons and Consular Posts accredited by the Department of Foreign
Affairs (DFA). It also refers to the heads of visiting foreign dignitaries
and DFA accredited international organizations. .

g. Emergency Situation - a series of unexpected and often dangerous


situation requiring immediate action. It may also be a condition or etete
which resulted in Jossof life/property aridlor there is imminent danger
or threat to life and property where delay of action will endanger or may
cause the loss of life/property of the requesting party.
h. Extreme Case - a highly unusual condition that necessitates the
deployment of a temporary security detail.
i. Family - refers to a group of persons who are connected by
consanguinity or affinity within the second degree.

j. Highly Exceptional Cases - situations wherein the threat level of


applicantlprotectee requires more than two protective security as
recommended by the Directorate for lntelligence.
k. Key Government Officials - refer to the President and Vice President
of the Republic of the Philippines, Senate President, Speaker of the
House, Chief Justice of the Supreme Court, Secretary of the Interior
and Local Government,· ChaIrmen of Constitutional Commissions,
Cabinet Members, Senators, Members af the House of
Representatives, Presiding Justice of Sandiganbayan. and Associate
Justices of the Supreme Court. .-
I. Key Officers of corporations/Companies Registered with
Securities and Exchange Commission (SEC) - refer to
President/Chief Executive Officer, Treasurer, Secretary, and Chairman
of the Board or its equivalent.
m. Local Chief Executives - refer to incumbent Govemors and Mayors.

n. Lice~e To Own and Possess Fireann (LTOPF) ...;refers to a written
authonty granted by the Chief, PNP through the Chief FEO to a
qualified individual for him/her to own and possess a fir~.
o. Next of Kin - the person/s who isfare most closely related to a given
person.

p. Other Govemment Official - refers to a national and/or local


government official, either elected or appointed, not categorized as key
government official.

Q. Private Foreign National - refers to a person, visiting or residing in


the country, who is a citizen of another country and is not part of any
diplomatic mission.

r. Private Individual- refers to a non-govemment andtor non-diplomatic


individual, both local and foreign citizen availing protective security. .

s. PNP Mobile Forces - is a general and collective term for mobile


reaction units established in all Police Regional Offices (PROs), Police
District Offices, Police Provincial Offices (PPOs) and City Police Offices
(CPOs) for intem~1 security operations and to reinforce/support
territorial police units in public safety operations, law enforcement
operations, and special police operations. This includes the Special
Action Force.

t. Protectee - an individual with approved availment of' protective


security.

u. Protection - is the state or quality of being secured or free from


danger and uncertainty. It may also include the various means or
devices designed to guard person and property against a broad range
of security hazards and threat

v. Protection Agent (PAl - refers to PNP SOSIA-licensed private


security personnel provided by an accredited Private Security Agency
(PSA) or a Private Detective Agency (PDA). qualified and selected to
perform security protection to individuals entitled f9r protection.

W. protective Security - refers to aspecitlc type of security provided for


by a PSP or PA using close-in protection principles and .concepts
against threatls to the protectee.

x. Protective Security Personnel (PSP) - is a uniformed member of the


PNP who is authorized and/or detailed to provide protective security to
protectee.

y. Special Duty Detail Order (SODO).- is a written order approved by


the Chief, SOSIAID, eSG and/or RD, PRO. This includes the duties,

responsibilities, authority and limitations of the PAs in securing persons
entitled for protection. .

z. Temporary Security Detail-Letter Order (TSD-LO) - refers to a


written interim authority issued by the Police Security and Protection
Group (PSPG) and RegionaVDistrictlProvinciallCity Police Offices to a
PSP directing himlher to provide protective security to an applicant for
a certain period while the application for availment of security is being
processed.

aa Threat - whether perceived or actual, is an indication of something


impending and usually undesirable or unpleasant. with an intention to
inflict evil, injury or damage on another, usually as retribution or
punishment for something done or left undone. It is an expression of an
intention to inflict loss or harm on another by illegal means and
especially by involving coercion or duress over the person or ,his
welfare.

bb. Threat Assessment (TA) - is a validation of the existence of threat


against an applicant who is availing protective security. This includes
the conduct of background investigation on the applicant to determine
his/her non-involvement in any illegal activities.

ce. Vetting - process of selection for deployment of qualified PSP and PA.

6. GENERAL GUIDELINES:

a. The detail of protective security either PSP or PA may only be allowed


in emergency situation which shall depend on the revel of threat as
validated by the Directorate for Intelligence.

b. The detail and deployment of a maximum of two~:(i)foteGtive:-security;~


shall always be observed and implemented.

c. All requests for protective security shall be made in writing to the Chief.
PNP stating therein the details of the existence of threatls to justify the
grant thereof.

d. In highly exceptional cases. applicantlprotectee may request for a


maximum of six (6) additional -PAs subject to the approval of the
President of the Republic of the Philippines.

e. All active personnel of the PNP. AFP and other uniformed


services/agencies are not entitled to avail the services of PSP .:

f. In case the applicantlprotectee has availed the protective services of


AFP and other government agencies, the request for PSP shall be
denied/withdrawn or recalled as the case maybe.

g. The protective security may be withdrawn or recalled anytime before


the expiration of the detail on the following circumstances:

1) When the exigency of the service so require;


2) When the provisionls of this MC. laws, rules, regulations, or related
issuances are violated;
3) Upon request of the PNP personnel on security detail; andlor
4) Upon request of the protectee.

h. Threat Assessment (TA) and Complete Background Investigation (CSI)


shall be conducted and validated by the intelligence units of the PNP
(Annex C). This is to ensure that applicant is not involved or have links
in any illegal activity, terrorism, organized crime, or determine criminal
liability or derogatory record.

I. Re-assessment and re-evaluation of threat shall be done fifteen (15)


days prior to the expiration of the security detail to determine whether
such threat still exists. In the event that the threat no longer exists, the
detail shall be terminated with due notice to the protectee concerned .

j. The Directorate for Intelligence may conduct periodic threat
assessment during the one year validity of the availment of protective
security.

k, When there is more than one applicant in a family, only two PSP shall
be allowed to the whole family. however, other family members may be
aUowed to have a maximum of two PAs each. .

L Except for key government officials and local government officials, the
following are the approving authorities on the detail of PSP:

1) The Chief, PNP is vested the authOrity to detail protective security


for a period of one year. The Chief, PNP may approve the
recommendation of 0, PSPG for the extension of such detail after
revalidating the threat at least fifteen (15) days prior to the
expiration of the security detail.

2) The D, PSPG is vested with the· authority to detail protective


security for a period of six months. Any request for extension or
renewal shall be for the approval of the Chief, PNP.

3) In extreme cases, the following authorities may issue TSD-lO:

a) The Director, PSPG is authorized to detail PSP for a period of


thirty (30) days extendible for two months subject to the
approval of the Chief, PNP;
b) The Regional Directors and District Directors are authorized to
detail PSP for a period of thirty (30) days without extension or
renewal; and .

c) The ProvincialiCity Directors and C. RPSPUs are authorized to


detail protective security for fifteen (15) days only without
extension or renewal.

m. When a PNP personnel being requested as protective security is not


an organic personnel of PSPG and the period of detail is beyond six
montl'ls, concerned personnel shall be issued reassignment or detail
orders with the PSPG, whichever is appropriate. .

n. In the case of PAs, the period of detail shall be determined by the


contract between the PDA and the protectee. However, during the
monthly evaluation of threat, if it was determined or established that the
threat to the protectee had already ceased, the PNP shall automatically
terminate his/her protective security detail;

o. for deployment of PAg, the following are authorized to approve ar:tdlor


issue relevant detail order:

1) The Chief, PNP shall be the approving authority for the detail of
PAs for the period of one year; and"

2) The Director for Operations is vested with the authority to detail PAs
for a period of six months. Any request for extension or renewal
shall be for the approval of the Chief, PNP.

p. Issuance of SODa for PAs by the following issuing authority shall be in


accordance with the existing PNP circulars and issuances:'

1) Director,CSG is authorized to issue SODa for a period of sixteen


(is) days and above but not exceeding one month;

2) Chief, SOSIA is authorized to issue SOOO for a period not


exceeding fifteen (15) days; and

3) Chiefs, Regional Civil Security Units (C. RCSU) shall recommend to


Chief, SOSIA to issue Interim SODa for POAs/PSAs within their
AOR for a period not·exceeding fifteen (15) days.

q. SOOOs are renewable but shall not exceed the period of the validity of
the approved Authority to Deploy. -

r. The duties of PSp' and PAs shall be confined to protective functions


and shall NOT include the following:

1} As security guard, gatekeeper, family driver, errand boy, and other


similar utility tasks;
2) As employees in the protectee's business establishments; and

3) As an instrument to harass or intimidate other people.

S. Personnelfrom the PNP Mobile Forcesare prohibitedto be detailedas
protective security. This is to ensure the combat effectiveness
readinessand integrityof mobileforces. I

t. Only uniformedpersonnelwith the ranks of Police Officer 2 (P02) to


Senior Police Officer 3 (SPD3) shall be detailedfor protectivesecurity.
For Police Commissioned Officers (PCDs), only Police Senior
Inspector may be detailed as protective security to key govemment
officialsupon approvalof the Chief, PNP.

u. No PSP shall be detailedto governmentofficialsand privateindividuals


who.arerelatedto the latterwithin the fourthdegreeof consanguinityor
affimty.
V. Absolutely, no personnel shall be detailed as protective secoritvto
secureestablishmentssuch as clubs. commercialbuildings,companies
or religiousand educationalestablishments.

W. Protectee shall not engage in any illegal activity or enterprise that is


against public morals and decency or enter gambling dens, beer
houses, and other similar establishments. If the protective security,
through his personal assessment perceived that the protectee is
involved in any illegal activity, he shall report it to the nearest police
stationor to his unit.
X. Any violation of this Me and other related issuances shall cause the
revocationof the protectivesecuritygiven to the protecteeand shall be
a basisfor the denial of subsequentrequest.

y. In the interest of public service and to institutionalize uniformity of


action on protective security, the Director, PSPG in coordinationwith
Chief, SOSIAshall:
1) Accredit all Private Security Training Institutions(PSTI) to include
its protectivesecurityiQstructors;
2) Designa Programof Instructionsfor protectivesecurityto be strictly
adoptedby the PSTls providingprotectivesecuritytrainings;

3) Ensure that the deploymentand activities of PAs shall conformto


standards;
4) Require all PAs to render monthly reports and attend Police
Informationand Continuing Education and other capacity building
initiatives;and

capability of PSPs and PAs in coordination with concerned
stakeholders.

7. OPERATIONAL GUIDELINES:

a. GovernmentOfficials
1) Key Government Officials
a) The Chief. PNP in the exigency of the service, may detail
protective security personnel to the following persons even in
the absence of a written request. TA. and CSI:

c) The detail of PSP shall be coterminouS with their respective


terms of office unless otherwise terminated or recalled.

a) The local Chief Executives, upon request shall also be entitled
to a maximum of two (2) PSp, subject to TA and CBt

b.1) The. Chief, PNP shall be the approving authority for the
detail of PSP for a ~eriod of one year. The Chief, PNP may
approve the extension of such detail after revalidating the
threat at least 15 days prior to the expiration of the security
detail;

b.2) The Director for Operations (TOO) shall be the approving


authority for the detail of PSP for a non-extendible period of
six months;

b.3) The Regional Director of Police Regional Office (RD, PRO)


shall be the approving authority for the detail of PSP for a
non-extendible period of three months; and

bA) In emergency situations, the Provincial Director of Police


Provincial Office (PD. PPO) may detail PSP for a periOd of
one month without extension or renewal.

c) In highly exceptional cases and in relation to paragraph S.d,


protectee may request for a maximum of six (6) additional PSP
or PA subject to the approval of the President of the Republic of
the Philippines.

3) Other Government Officials

a} Other govemment officials may be provided with a maximum of


two (2) protective security (1 PSP and 1 PA or 2 PAs) upon
written request and subject to TA and CBI; and

b} The application shall be endorsed by the concerned head of


agency/department and subject to the approval of the Chief,
PNP upon recommendation of the 0, PSPG, Chief, SOSIA, and
D,CSG.

b. Private Individuals

1) Local
a) Private individual may be provided with a maximum of two (2)
protective security (1 PSP and 1 PA or 2 PAs) upon written
request and subject to TA and CBI; and

b) If upon receipt and evaluation of the application, the threat is


imminent or highly probable, the Director. PSPG; RD, PRO; and
Chief, SOSlA or D. CSG shall provide temporary security detail.

2) Private Foreign Nationals

a) Private foreign national may be provided with a maximum of two


(2) protective security (1 PSP and 1 PA or 2 PAl upon written
request and subject to T A and CBI; and
b) The request for protective security shall be endorsed by the
concerned embassy/consular office through diplomatic channels
and subject to the approval of the Chief, PNP.

3) Private Individuals by Virtue of their Former Office/Position

The following private individuals who by virtue of their former


office/position or status are entitled to PSP upon request with the
following maximum number of security personnel subject to existing
rules and regulations:

4) Key Officers of Corporations/Companies Registered with SEC

a) By virtue of their position, may be provided with a maximum of


two (2) protective security (1 PSP and 1 PA or 2 PAs) upon
written request and upon confirmation of threat to their life and
conduct of complete background investigation;

b) If upon receipt and evaluation of the application. the threat is


imminent or highly probable. the Director for Operations;
Director, PSPG; RD. PRO; and Chief. SOSIA or D, eSG shall
provide temporary security detail until such time that a regular
PSP or PAs shall be made available in accordance with this Me;
and

c) When there is more than one applicant in a corporation, only two


PSP shall be allowed, however, other key officers may be
allowed to have a maximum of two (2) PAs each.

c. Diplomats
1) In fulfillment of Article 22 (2) of the Vienna Convention and other
international treaties, the PNp· shall take all appropriate steps to
ensure that security is provided to foreign missions and officials in
the Philippines;

channel: However, when the need arises, the PNP shall provide as

country, the international practices and protocol shall be adopted to
ensure the safety and security of the local and international
participants.

8. SPECIFIC GUIDELINES:
a. There shall-be an Oversight Committee on Protective Security which
shall provide oversight function, monitoring and periodic ~ssessment
and evaluation an the implementation of this MC, composed as

h. PSP and PA may wear authorized barong, bush jacket, suit and any
suitable clothes depending on the situation while in the perfonnance of
their duties. However, during special events and as required by the
Chief, PNP such as during election period, the agency prescribed
uniform shall be worn by deployed PSPs and PAs for easy
identification;

d. PAs shall always carry their agency-issued firearms covered by SOOO


and shall always be concealed carry; .

e. The RDs, PROs shall submit monthly written report of all individuals
provided with PSP in their Area of Operation to the Directorate for
Operations;

f. All detailed PSP .shall submit to PSPG a monthly report on all activities
of his/her protectee copy furnish the Director for Operations;

g. Detailed PSP shall report to the Head of territorial unit for courtesy call
and accounting purposes;

h. The Provincial/District/City Directors shall report withio 24 hours their


approved protective security detail to their respective Regional
Directors who shall in turn submit report to the Chief, PNP (Attn:
Director, PSPG). Likewise, Chief, SOSIA shall furnish a related copy
of report to Director, PSPG;

i. The Director, PSPG shall conduct monthly physical accounting of all


detailed PSP personnel; and

j. The Director, PSPG shall prepare Monthly Security Detail Report for
the information of the Chief, PNP through the Director for Operations
as the over-all supervisor.

9. FEES:
The schedule of fees shall be promulgated as part of this issuance after
the conduct of public consultation as may be required under relevant laws and rules.

10. ADMINISTRATIVE SANCTIONS:


a. Any PNP personnel found violating any provisions of this MC shall be
administratively liable pursuant to existing laws, NAPOLCOM, and
PNP regulations; .
b. Any Protective Agent found violating any provision of this MC shall be
liable pursuant to the provisions of RA 5487, as amended, and its
IRR and PNP Me No. 001-2006; and .
c. Any violation by the applicant/protectee of any provision of this MC or
of his Affidavit of Undertaking. as well as misrepresentation or false
entry on the documents submitted as part of the application shall be a
ground for the outright termination or revocation of the protective
security provided.

11. REPEALING CLAUSE:

All policies, directives, and other issuances that are inconsistent with the
provisions of this Me are hereby deemed repealed or modifi~d aeeordingly.

12. EFFECTIVITY:

After confirmation by the National Police Commission, this PNP Me shall-


take effect after fifteen (15) days from the filing of a copy hereof at the University of
the Philippines Law Center in consonance with Section 3, Chapter 2, Book VII of
Executive Order 292 otherwise known as the "Revised Administrative Code of 1987,"
as amended.

2. Reassessment and re-evaluation of threat shall be done fifteen (15) days poor to
the expiration of the security detail to determine whether such threat still exists.
The detail shall be terminated with due notice to the VIP concemed under
protectiVe security.
3. The maximum period of detail of PNP unifonned personnel as PrQtective security
other than those enumerated in paragraph 1 above shall be for six (6) months but
in case an imminent danger to life still exists on the person of the requesting party
as confirmed by the concemed Chief, RID and approved by TOI, such detail may
be extended up to a maximum period of six (6) months.
