Dear Secretary Mayorkas:

Under your leadership the Department of Homeland Security (DHS) is failing to take the steps
necessary to achieve and maintain operational control of our borders. Instead of securing our
borders, your department is facilitating the release of illegal aliens into the country. Your catch
and release policies have made our country less secure and are encouraging illegal aliens to cross
our borders.

In January 2022, the Transportation Security Administration (TSA) confirmed to members of


Congress that between January 1, 2021, and October 31, 2021, TSA allowed approximately
45,000 illegal aliens to board planes without presenting identification (ID) included on TSA’s
acceptable forms of ID list.1 Instead of providing acceptable forms of ID, these illegal aliens
presented DHS-issued documents.2 And last month, Acting Administrator David Pekoske
testified that so far this calendar year TSA permitted “under 1,000” individuals to travel “with
arrest warrants or deportation notices” instead of approved forms of ID.3 This number seems
extremely low given the fact that DHS has released nearly 500,000 illegal aliens into the United
States so far this year.

Last October, Assistant Secretary Alice Lugo informed Members of Congress that TSA accepts
I-862s (Notice to Appear) with an I-385 (Alien Booking Record), ICE Form I-200s (Warrant of
Arrest of Alien), ICE Form I-205s (Warrant of Removal/Deportation), ICE Form I-220As (Order
of Release on Recognizance), ICE Form I-220Bs (Order of Supervision), and CBP I-94s (Arrival
and Departure Form) as acceptable identification documents.4 These documents are not secure
documents and can easily be forged, copied, or otherwise manipulated. Given the fact that
American citizens are constantly being reminded that their IDs will soon need to be REAL ID
compliant to board an airplane, it is extremely troubling that TSA is allowing illegal aliens to use
nonsecure documents as IDs to board planes.

The fact that U.S. taxpayer dollars are being used either directly or indirectly to pay for illegal
aliens to be transported throughout the country is a slap in the face to all law-abiding, tax-paying
Americans. Instead of using taxpayer funds to transport illegal aliens, DHS should be using
those funds to acquire additional detention space so that it may detain the illegal aliens as
required by the law.

As Congress prepares to debate the fiscal year 2023 Department of Homeland Security
Appropriations Act, we need information from your department to determine how you have been
spending the funds we have previously appropriated. Please provide answers to the following
questions and the requested information and documents by September 9, 2022.

1. Since January 20, 2021, how many illegal aliens has TSA allowed to board flights
without ID included on TSA’s acceptable forms of ID list?
2. Since January 20, 2021, how many illegal aliens has TSA allowed to board flight with
DHS-issued documents?
a. Please provide a breakdown of the number of times each type of DHS-issued
document was used by an illegal alien.
3. In addition to the forms previously identified, what additional forms of ID does TSA
accept in lieu of ID included on TSA’s acceptable forms of ID list?
4. What additional screening or vetting procedures are used by TSA or any other DHS
component to verify the identity of an illegal alien prior to allowing the illegal alien to
board a flight?
5. Please provide copies of all guidance documents provided to TSA employees regarding
the screening of illegal aliens at airports.
6. How many illegal aliens has DHS paid to transport to locations throughout the United
States?
a. Please provide a breakdown for each means of transportation (e.g., bus, plane, or
train).
b. Please provide breakdown of the destinations for each alien.
7. How many non-governmental organizations (NGOs) has FEMA reimbursed with funds
from the Emergency Food and Shelter Program?
a. Please provide a list of all NGOs that have been reimbursed for transporting
illegal aliens throughout the United States with funds from the Emergency Food
and Shelter Program or any other program.
b. Please provide copies of the documentation submitted by each NGO in support of
the reimbursement request.
8. Since January 20, 2021, how many NGOs have contracted with DHS or entered into
Memoranda of Agreement (MOA), Memoranda of Understanding (MOU), or other
agreements with DHS to transport illegal aliens throughout the United States, to house
illegal aliens either permanently or temporarily in the United States, or to provide other
services to illegal aliens in the United States?
a. Please provide copies of all these contracts, MOU, MOA, or other agreements.
9. Since January 20, 2021, how many NGOs have received grants from DHS to transport
illegal aliens throughout the United States, to house illegal aliens either permanently or
temporarily in the United States, or to provide other services to illegal aliens in the
United States?
a. Please provide copies of all grant applications and award letters for these grants.
