The purpose of deposition is to discover all facts and find out what
the witness knows and to preserve that witness' testimony or testimonial
evidence. Another, to allow the parties to learn all of the facts before the trial, so
that no one is surprised once that witness is on the stand.

2. In your opinion, why do you think that seized drugs still need to undergo drug
test even if police officers know that item is an illegal drug?
It’s because it is according to the law and to confirmed it so that it will be
valid in the court of the law. Another, it’s because to maintain and safeguard
the integrity of the police officers and to avoid the wrong assumptions that may
destroy the image or the reputation of the police departments.

1. Explain the importance of the chain of the Chain of Custody Form in the Drug
related cases. (25pts)
In the drug related cases the chain of custody form is very important
because this is used to know the record of all drug items confiscated, seized
and/or surrendered and the information on who released and received the
pieces of evidence. It is also for the monitoring the authorized movements of the
illegal drugs, the time they were seized from the accused until the time they are
presented in court. Chain of custody form is used to ensure that the integrity
and evidentiary value of the seized drug are preserved, as thus dispel
unnecessary doubts as to the identity of the evidence.

2. Why is there a need for an arresting officer to request for a medicolegal


examination for an arrested person involved in an illegal drugs? (25pts)
The arresting officer must request for medicolegal examination for an
arresting officer involved in an illegal drug for her/him to avoid claims of abuse
from the suspect and to determine if the suspect is really under the influence of
illegal drug. With this it will not make a big trouble for the arresting officer since
there is an evidence showing if the person is really under the influence of illegal
drug or not.

Pre-test
1. Why is there a need for police officers to apply for a petition for wiretapping
before they can obtain any recorded or being recorded information as evidence?
Because court application can only be made for crimes that involve national
security and not for common offenses. So, this is not just used as evidence in any
crimes and without a valid court order, any communication obtained through wire
tapping cannot be used as evidence.
2. As a private individual, where will you use the affidavit of loss?
Affidavit of lost will be used by individuals if they lost their documents such
as passport or diploma.
It’s Your Turn
1. In your own words, distinguish the difference between affidavit and
undertaking? (20pts)
Affidavit is a written facts that is considered made under oath. This is filed
with the court to show that specific information is true. False and untruthful facts
are punishable, and this is called perjury. In addition, this can be used by an
attorney to have a person appear in court or in legal proceedings. It is also useful
beyond the court. On the other hand, undertaking is the promising in the court or
law or it is a written promise made by a person. Since the person made a promise
he/she take responsibility that he promises to do.
2. Explain the importance of Crime Incident Reporting System to law enforcement
and to the issuance of police and NBI clearance. (20pts)
Crime incident reporting system is very important because it makes the
work of law enforcer easier and faster especially in accessing information. This
presents a quick, fast and reliable transmission of crime information from lower
police units and offices of the PNP to the National Headquarters. They can just type
and click the keyboard then all the information will pop out in the screen. The
Crime Incident Reporting System will provide highly-quality, detailed data for the
PNP. In short, all the information of the victims and criminals are stored here. For
the issuance of NBI clearance it became faster to process the paper since law
enforcer can just type your name if you have a criminal record or any offenses
against the laws of the Philippines.

I Police Master Seargent Gora Thoms, 32 years old, married, resident Tadian,
Bontoc Mountain Province, after having been duly sworn to in accordance with the law
do hereby depose and state the following.
That I am the Investigator on Case who conducted the initial investigation of the
alleged murder of Judy Ramos, 21 years old a criminology student of Mountain
Province State Polytechnic Collage , resident and native of Caluttit, Bontoc Mountain
Province.
That on December 23,2019 at about 2:00 am, the victim and alleged suspect
Mayo Rayes (based on the text message) as his boyfriend planned to hike Bontoc to
Maligcong and final destination would be Mt. Fato where the victim’s dead body was
found.

That after the Initial Investigation, the SOCO team conducted the crime scene
processing.

That during the crime scene processing, there are evidence found these are
finger prints, pubic hair and semen.
That after Photographing, the dead body was brought to Bontoc General
Hospital for autopsy.

That all the information and evidence at hand, Mayo Reyes the boyfriend of the
victim Judy Ramos , 24 years old, Accountancy student of Mountain Province
Polytechnic Collage is the suspect.

Telephone call from Khaye Feng at around 8:30 am of December 23,
2019 which was entered in the police blotter as entry no. 0111.

2. At around 8:30 am of December 23,2019, Police Lieutenant Mars Go, officer of


the day, received a call from Khaye Feng, a female, 22 years old, single, resident
of Guina-ang, Bontoc Mt. Province that a dead body of a woman was found at
Mt. Fato located at Maligcong, Bontoc Mt. Province. Thus, the investigation on
Case proceeded immediately at the said place of incident.

3. Police Master Seargent Gora Thoms, Investigator on Case, conducted initial


investigation and found out that the victim Judy Ramos, 21 years old, a
criminology student of Mountain Province State Polytechnic Collage of Bontoc
Campus, resident and native of Caluttit, Bontoc Mountain Province. On
December 23,2019 at about 2:00 am, the victim and alleged suspect Mayo
Rayes (based on the text message) as his boyfriend planned to hike Bontoc to
Maligcong and final destination would be Mt. Fato where the victim’s dead body
was found.

4. After Photographing, the dead body was brought to Bontoc General Hospital for
autopsy.

5. Case is still under follow-up investigation and progress report will follow.

2. At around 8:30 am of December 23,2019, Police Lieutenant Mars Go, officer of


the day, received a call from Khaye Feng, a female, 22 years old, single, resident
of Guina-ang, Bontoc Mt. Province reporting the found dead body of a woman
named Judy Ramos, 21 years old, a criminology student of Mountain Province
State Polytechnic Collage of Bontoc Campus, resident and native of Caluttit,
Bontoc Mountain Province.

3. In the Initial investigation conducted by the investigator on case, it was found


out that, the victim and suspect are hiking from Bontoc to Maligcong and final
destination would be Mt. Fato where the victim’s dead body was found. From
the phone of the victim their identities are known.

4. During the crime scene processing of the SOCO team led by Police Major Gina
F. Te-er, a fingerprints, pubic hair (2) and semen were recovered which were
subjected for laboratory examination. As the autopsy conducted for the body of
the victim, it reveals that the victim died because of strangulation and
laceration on her reproductive.

5. With the information and evidence at hand, the Investigator on Case


coordinated to PNP for arresting the suspect.

6. Continuation report will be submitted as soon as possible.

2. Judy Ramos, 21 years old, a criminology student of Mountain Province State


Polytechnic Collage of Bontoc Campus, resident and native of Caluttit, Bontoc
Mountain Province was found dead at Mt. Fato located at Maligcong, Bontoc at
around 8:30 am of December 23, 2019 by Khaye Feng, a female, 22 years old,
single, resident of Guina-ang, Bontoc Mt. Province and immediately call the 911
for help. The Investigation on Case seek the assistance of the SOCO for crime
scene processing. During the crime scene processing, there are different kinds
of evidence found, a fingerprints, pubic hair (2) and semen were recovered and
were subjected to laboratory examination. The body of the victim was subjected
for autopsy and was found out that the cause of death is strangulation and
there is also laceration on the reproductive part.

3. Within the help of PNP the suspect was arrested at around 7 pm of May
02,2020 at their vacation house in Bauko, Mountain Province. The suspect is
Mayo A. Reyes, 24 years old, Accountancy student of Mountain Province
Polytechnic Collage.

4. The suspect was brought to the station for the accomplishment of booking and
custodial investigation.

5. All the evidence found at the crime scene matched with the that of the suspect.

6. The suspect now is currently detained at Baguio District Jail and waiting for
trial.

7. This case is considered closed or solved.
