CONSTITUTION & BY-LAWS

PREAMBLE

We, the teachers and staff of Colongulo National High School, in order to foster a
goodwill, understanding and cooperation among ourselves, and in order to establish an
association that will embody our ideals and aspirations to uphold the teaching
profession, to promote and protect the common welfare, justice through unity, have
mutually agreed to form as we hereby form an association for which we ordain and
promulgate this constitution.

ARTICLE I - NAME AND DOMICILE

Section 1. The association shall be known as the “ CoNHS Faculty and Staff
Association ( CoNHS FASA)”.

Section 2. The CoNHS Faculty and Staff Association shall have its office at Colongulo
National High School, Colongulo, Surallah, South Cotabato.

ARTICLE II - OBJECTIVES

Section 1. The objective of this Association shall be to advance and promote the
interest and welfare of the Faculty and Staff of the Colongulo National High
School. Specifically, the association shall seek to:

a. Maintain mutual understanding, unity and love among members;


b. Protect the rights of members and make them aware of their privileges
and obligations;
c. Facilitate the improvement of economic welfare and social well-being of all
members;
d. Encourage the professional growth among members;
e. Develop members to become effective and dynamic leaders; and
f. Help in planning and implementing of projects for the development and
progress, specifically, the learners and stakeholders of Colongulo National
High School.

ARTICLE III - MEMBERSHIP

Section 1. All Faculty and Staff of Colongulo National High School who are active in the
service shall be qualified as members of the association.

Section 2. All members shall accomplish the membership form as basis of their
membership to the association, duly signed by the President and the
Secretary.

Section 3. Duties of members. Each member shall have the following duties:

1. Pay his financial obligations to the association, such as the following:

a. Contributions during any association’s activity as agreed upon by the


general assembly.

2. Attend all general meetings and participate in all activities of the


association;
3. Obey rules and regulations set forth by the association, the by-laws, the
decision of the elected officers, and the general assembly, and policies
and decisions that may be promulgated; and

4. Promote the aims and objectives of the association.

Section 5. Rights of members. Every member shall have the following rights:

1. Participate in the deliberation during membership meetings;

2. Vote on all matters brought before such meetings;

3. Avail himself of the services of the association without any discrimination


whatsoever upon compliance with the conditions and regulations set
thereto; and

4. Exercise other rights and privileges of a member.

ARTICLE IV – OFFICERS AND ELECTION OF OFFICERS

Section 1. The officers of the Association shall be the President, Vice President,
Secretary, Treasurer, Auditor, Business Manager/s and Public Information
Officer (PIO).

Section 2. All members are qualified for the position and shall select 3 members of the
electoral committee.

Section 3: The officers of the association shall be elected from the general assembly by
plurality vote as long as their services are needed unless otherwise remove
for cause, death or voluntary resignation.

Section 4. The elected officers shall be sworn to office by a person whom the officers so
desire.

Section 5. The election of officers shall be held during the general assembly of the
members of the association, every third Friday of June.

Section 6. All elected officers of the association shall hold office for a term of two years
(2) years or after the election, qualification and assumption into office of their
successors;

Section 7. The incumbent officers whose term is expiring can be re-elected in the same
office but not more than two (2) terms.

ARTICLE V - OFFICERS DUTIES & FUNCTIONS

Section 1. The elected officers shall have the following duties and functions:

A. President:

1. Represent the Association in the public occasions of vital interests to


the association, and in case of emergency of any member or such
matters of urgency vital to the interest of the Association;

2. Shall call and preside over all meetings and deliberations of the
association;

3. Perform any and all acts and duties usually performed by a presiding
officer;
4. Shall preserve orders and defend the by-laws of the association and
the rights and prerogatives of the members;

5. Be one of the major signatories in the bank account of the Association;

6. Order and approve disbursements duly authorized by the association;

7. Shall deliver the state, the association message to the members during
the regular meeting every last Friday of the month of each year
wherein members are given the opportunity to meet;

8. Shall organize different committee among the members of the


association; and

9. He may, in urgent cases solve in the name of the association, any


question or problem of a member on issues affecting its progress and
betterment.

B. Vice President:

1. Shall assume the powers and duties of the President in the absence or
disability of the same, and shall in such case have the power and
prerogative of the president, provided, however, that in case of death,
resignation or removal of the President, the officers may decide to
elect its successor.

C. Secretary:

1. Keep a complete list of all its members;

2. Write the minutes of the meeting and keep and maintain the records of
all meetings of the officers and of the association/general assembly;

3. Read to the members during the meeting all minutes of the previous
meeting before the business of the day will be taken;

4. Provide copies of all approved minutes of the Association;

5. Attest all minutes, records of the association;

6. Inform in writing all members of the association whatsoever has been


carried or approved for the members;

7. Give notices of all meetings called;

8. Shall act as temporary chairman in the absence of both President and


Vice President.

D. Treasurer:

1. Keep and safeguard the funds of the association and all accounts,
books and records necessary for the purpose;

2. Collect necessary fees, dues and contributions from the members and
issue corresponding receipt for whatever amount shall be collected;

3. Deposit all funds of the association and keep necessary records;


4. Keep book of accounts showing the names of all members of the
association with the payment made by each member of the association
and another book showing the collection deposited in the bank;

5. To withdraw and pay all authorized accounts and expenses which


were approved and countersigned by the President and the Auditor;

6. Have books and records open for examination at any time by any
member of the association;

7. Prepare and submits to the general assembly a statement of report on


financial standing or status of the association at every meeting, as
required;

8. Act as custodian of the property belonging to the association and


prepare inventory of such property.

E. Auditor:

1. Examine and audit all records and book of the association’s treasurer
from time to time and certify to the correctness of the same to the
officer during the meeting;

2. Approves disbursement made by the treasurer as approved by the


President;

3. Keep a book of accounts showing money received and disbursed by


the treasurer in accordance with the Constitution and By-Laws;

4. Suspends or withholds payments of accounts incurred not in


accordance with the expressed policy of the officers;

5. Issue rules and regulations in accordance with sound accounting


procedures.

F. Business Manager:

1. Have supervision of the social function and business undertakings of


the association;

2. Prepare the venues of meetings and programs of the association.

G. Public Information Officer (PIO):

1. Shall set as publicity man of the association and of course for


publication and information of the public interest about the association
upon the approval of the President;

2. Inform and disseminate message of the association.

Section2. All members who have the time and willingness to serve are qualified to be
elected except those who are under any of the following circumstances which
disqualify them to be elected upon to the position or to continue as such:

1. Having been absent for three (3) consecutive officers’ meeting without any
valid excuses; and

2. Having been associated with any anomalies in the association.

ARTICLE VI - MEETINGS
Section 1. There shall be two (2) kinds of meetings: Regular and Special Meetings.

Section 2. The Regular meeting of the officer shall be called by the President every last
Friday of the month.

Section 3. The Regular association meeting shall be held every last Friday of the month
at 4:00 in the afternoon.

Section 4. A special meeting of the officers may be called on emergency cases.

Section 5. A special meeting of the association maybe called when important matters
are to be decided by the members of the association, such as: making of
amendments to the constitution and by-laws, ratification of the amendments,
and other matters which are not within the power and prerogatives of the
officers;

Section 6. A special meeting may be called by the President or by three (3) members of
the association based on their written request;

Section 7. Majority of the members of the association in a general assembly must


constitute a quorum or to pass or approve any resolution;

Section 8. The order of Business during meetings of the members shall be as follows:

i. Proof of the required notices of the meeting;

ii. Proof of the presence of a quorum;

iii. Reading of the minutes of the previous meeting and action thereof;

iv. Report of the different committee;

v. Election of officers (in case of general assembly annually);

vi. Unfinished business;

vii. New business;

viii. Adjournment

The order of the business to be followed at any meeting maybe changed by


a vote of the majority of the members entitled to vote at each meeting.

The order of business to be followed at any time during the special meetings
maybe determined by the presiding officer or by a vote of the majority of the
members entitled to vote.

Section 9. In all meetings, every member is entitled only one (1) vote; provided,
however, that in case of election of officers, every member entitled to vote
shall be entitled to cast his vote in such cases made and provided.

Section 10. All meetings of the association shall be designated by the President.

Section 11. The association shall have a general assembly two (2) times a year. An
annual general assembly for the purpose of election shall be held during the
general assembly.

Section 12. One-half (1/2) plus one (1) of all members shall constitute a quorum.
ARTICLE VII – FUNDS

Section1. The association shall have the following source of funds:

1. Contributions;

2. Donations;

3. Other sources of funds as maybe determined by the officers or by the


association;

4. No other fees except those duly recognized or approved by the officers


shall be collected or imposed without the approval of the majority of the
members present.

ARTICLE VIII – TEACHERS’ WELFARE AND BENEFITS

Section 1. There shall be a Mutual Aid System (MAS), in case of death of a member
or/and immediate family of the members.

Section 2. There shall be a hospitalization aid when a member of the association is sick.

Section 3. No other fees except those duly recognized or approved by association and
the DepEd shall be collected or imposed without the approval of at least two-
thirds (2/3) of the members present.

Section 4. Every member is entitled of the benefits upon approval of his membership by
the President.

ARTICLE IX – ASSOCIATION SEAL

Section 1. The association seal shall be in such a form and design as maybe
determined by the association officers or by the members.

ARTICLE X – FISCAL YEAR

Section 1. The fiscal year of the association shall begin on the first day of January and
ends on the last day of December of each year.

ARTICLE XI – GENERAL PROVISION

Section 1. To achieve the objectives of this association, it shall be the duty of the
members to bring to the attention of the officers orally or in writing any matter
of important interest to the association;

Section 2. All elected officers shall hold office until a new set of officers have been
elected and inducted into office as provided by the Constitution and By-
Laws.

ARTICLE XII - AMENDMENTS

Section 1. This By-Laws or any provision thereof, maybe amended or repealed by at


least three-fourths (3/4) of the members of the association entitled to vote in
any regular or special meeting hold for the purpose and such amendments
shall be valid as part of the laws.
ARTICLE XIII – ADAPTION

Section 1. This By-Laws was adapted this 29th day of April, 2022 in the Municipality of
Surallah, Province of South Cotabato, Philippines, by the majority of all
members of the association.
