    JUDICIAL AFFIDAVIT OF COMPLAINT

    I, Irish Sagud y Cabigquez 21 y.o., single, and a resident of Brgy. Abra,


    Municipality of Isabela, Province of Aurora, Philippines, after having been
    duly sworn to in accordance with the law do hereby depose and state:

    PRELIMINARY STATEMENT
    The person examining me is PSSg Melanie O. Cabacungan of Baler
    Police Station, Isabela, Aurora Province, who conducted and supervised my
    examination as complainant at her office at Baler Police Station, Isabela,
    Aurora Province.
    That I am answering the question herein fully conscious, that I do so
    under oath and that I may be criminally liable for false testimony or perjury.

    PURPOSE: This affidavit/Testimony of IRISH SAGUD Y CABIGQUEZ is


    being offered to prove that the respondent RUSTAN ANG y PASCUA was
    allegedly violated R.A. 9262.

    1. Q. Please state your name and other personal information.


    A. I am Irish Sagud y Cabigquez 21 y.o., single, and a resident of Brgy.
    Abra, Municipality of Isabela, Province of Aurora, Philippines.

    2. Why are you here at the Women and Children Protection’s Desk of
    Baler Police Station?
    A. I am here to file a proper complaint against Rustan Ang.

    3. Q. Why do you want to file a complaint against Rustan Ang?


    A. Because he caused my sleepless nights due to stress of what he did
    to me.

    Bakit gusto mo magsampa ng reklamo laban ky Rustan Ang?


    Sya and dahilan kung bakit hindi na ako nakakatulog nang maayos sa
    gabi dahil sa ginawa nya sa akin.

    4. Q. What Rustan Ang did to you?


    A. He threatened me to send a naked picture of a woman with my face in
    the chatrooms of Tarlac group chats.

    Ano ang ginawa ni Rustan Ang sa iyo?


    Binantaan nya ako na ipapadala nya ang isang litrato nang hubo’t
    hubad na babae na ang mukha ay ako sa mga chatrooms ng Tarclac
    group chats.

    5. Q: How are you related to Rustan Ang?


    A: Rustan Ang is my former boyfriend.

    Si Rustan ay dati kong kong nobyo.

    6. Q: How long have you and Rustan being boyfriend-girlfriend?


    A: A couple of months, from the start of October 2004. We were "on-
    and-off" sweethearts towards the end of 2004.

    Ilang buwan din po, simula October 2004. Naging “on-and-off”kami
    na magkasintahan hanggang sa pagtatapos ng taong 2004.

    7. Q: Why did your relationship end?


    A: When I learned afterwards that Rustan had taken a live-in partner
    (now his wife), whom he had gotten pregnant, I broke up with him.

    Bakit kayo naghiwalay?


    Nang malaman ko pagkatapos na si Rustan ay nagkaroon ng live-in
    partner (na ngayon ay asawa na niya) at nabuntis nya ito,
    nakipaghiwalay na agad ako sa kanya.

    8. Q: What happened next?


    A: Before Rustan got married, he got in touch with me and tried to
    convince me to elope with him, saying that he did not love the woman
    he was about to marry.

    Gayunpaman, bago nagasawa si Rustan, nakipagugnay siya sa akin at
    sinubukang kumbinsihin ako na makipag tanan sa kanya at sinasabi
    niya na hindi niya mahal ang babaeng pakasalan nya.

    9. Q: You said that he convinces you to elope with him? Did you agree
    with it?
    A: I rejected the proposal and told Rustan to take on his responsibility
    to the other woman and their child. I then changed my cellphone
    number but Rustan somehow managed to get hold of my new number
    and sent me text messages. Rustan used two cellphone numbers in
    sending his messages, namely, 0920-4769301 and 0921-8084768.

    Nakumbinsi ka ba niya na makipag tanan sa kanya?


    Tinanggihan ko ang kanyang alok at sinabi kay Rustan na panagutan
    ang kanyang responsibilidad sa kabilang babae at kanilang anak.
    Pinalitan ko ang numero ng aking cellphone ngunit kahit papaano ay
    nalaman ito ni Rustan at pinadalhan ako ng mga text message.
    Gumamit si Rustan ng dalawang numero ng cellphone para sa
    pagpapadala ng kanyang mga mensahe, katulad ng, 0920- 4769301 at
    0921-8084768.

    10. Q: Did you happen to reply to any of his messages?


    A: I replied to his text messages but it was to ask him to leave me alone.

    Nagkataon bang tumugon ka sa alinman sa kanyang mga mensahe?


    Tumugon ako sa kanyang mga mensahe ngunit ito ay upang hilingin sa
    kanya na iwan akong mag-isa.

    11. Q: Did he continue to message you after that?


    A: No. However, in the early morning of June 5, 2005, I received
    through multimedia message service (MMS) a picture of a naked
    woman with spread legs and with my face superimposed on the figure.
    I think that he copied the picture of my face from a shot he took when
    we were in Baguio in 2003.

    Ipinagpatuloy ba niya ang pag-mensahe sa iyo pagkatapos nito?


    Hindi. Gayunpaman, umaga ng Hunyo 5, 2005, nakatanggap ako sa
    pamamagitan ng multimedia message service (MMS) ng larawan ng
    isang hubad na babae na naka bukaka ang mga binti at ang aking
    mukha ay nakadikit sa larawan.

    12. Q: Do you have a copy of that photo?


    A: Yes. I brought a copy of the edited photo and the photo from Baguio
    with me.

    Meron ka bang kopya ng larawan?


    Opo. May dala po akong kopya ng malaswang larawan at nga larawan
    ko sa Baguio.

    13. Q: Do you confirm and agree that I attach the photos in this complaint
    as “Annex A” and “Annex B respectively?
    A: Yes.

    Kukumpirmahin mo ba at sasang-ayonan na ikakabit ko ang larawan


    sa reklamo na ito bilang "ANNEX A"?
    Opo.

    14. Q: Do you know who sent the picture?


    A: Yes. The sender’s cellphone number, stated in the message, was
    0921-8084768, one of the numbers that Rustan used.

    Alam mo ba kung sino ang nagpadala ng larawan?


    Opo. Ang numero ng cellphone ng nagpadala na nakasaad sa mensahe,
    ay 0921-8084768, isa sa mga numero na ginamit ni Rustan. Sa tingin
    ko kinopya niya ang larawan ng aking mukha mula sa isang larawan
    na kuha noong nasa Baguio kami noong 2003.

    15. Q: What happened next?


    A: After I got the obscene picture, I got other text messages from
    Rustan. He boasted that it would be easy for him to create similarly
    scandalous pictures of me. And he threatened to spread the picture he
    sent through the internet. One of the messages he sent to me, written in
    text messaging shorthand, read: "Madali lang ikalat yun, my chatrum
    ang tarlac rayt pwede ring send sa lahat ng chatter."

    niya sa akin, nakasulat sa text messaging shorthand, basahin: "Madali
    lang ikalat yun, my chatrum ang tarlac rayt pwede ring send sa lahat
    ng chatter."

    16. Q: What did you do after knowing that?


    A: I sought the help of the vice mayor of Maria Aurora who referred
    me to the police.

    Humingi ako ng tulong sa bise alkalde ng Maria Aurora na sumangguni
    sa akin sa pulisya.

    17. Q: What do you want to happen with your complaint?


    A: I pray that Rustan Ang be charged for Violation of RA No. 9262 on
    the grounds of inflicting anguish, psychological abuse and humiliation.

    Ipinagdarasal ko na si Rustan Ang ay masampahan ng kasong
    Paglabag sa RA No. 9262 sa kadahilanang makapagdulot ng

    A: No, but I am willing to add if necessary.

    statements?
    A: Yes.
