Agreement of Tenancy
THIS AGREEMENT OF TENANCY is made at Karachi on ____ day of ____, ____ BETWEEN
Mr/Mrs _______ S/o D/o ____, ____, Adult, R/o Flat/House ________ Karachi, holding
CNIC no _________ hereinafter referred to as the landlady/landlord or the Party of
the 1st Part AND Mr. ______ S/o D/o________, Muslim, Adult, R/o House/Flat
_______ ,Karachi, holding CNIC No ________, hereinafter referred to as the Tenant
or the Party of the Second Part.
WHEREAS the landlord/landlady above named is the sole and absolute owner of
House/Flat ______________, Karachi, hereinafter referred to as the DEMISED PREMISES
AND WHEREAS the landlord/landlady has agree to let out and the tenant has
agreed to take the said premises on rental basis on the terms and conditions
hereinafter appearing:
1. That this TENANCY SHALL BE DEEMED TO BE EFFECTIVE FROM __, ___,____ and
shall remain enforced for a period of which may be extended on mutual consent of
both the parties. The landlord/landlady has agreed to let out the above premises at
Rs. _____ (Rupees _____ only) per month.
2. That the tenant has paid to the landlord/landlady Rs. _____ (Rupees ______
only) as security deposit which shall be refunded to the tenant at the time of
vacating the said premises and handing over the peaceful and vacant possession of
the same to the landlord/landlady subject to adjustment of any lost/damage/wear and
tear or dues if any.
3. That the Electric, Water, Gas and maintenance charges shall be paid by the
second party every month without fail
4. That the second party shall not sell/mortgage/transfer or sublet the said
premises or any portion thereof to anybody else under any circumstances.
5. That the second party shall not make any kind of addition, alteration or
change in the present structure of the premises.
6. That this agreement shall remain valid for the period of 11 months,
commencing from ____,____, ____ (same date as that of the first date), and is
subject to renewal, with consent of both the parties, if not renewed, the second
party shall have to vacate and handover vacant possession of the said premises to
the first party.
7. That both the parties shall give one month’s prior and written notice to get
the said premises vacated.
8. That if the second party fails to pay the monthly rent for a consecutive
period of two months, the first party shall be entitled to eject the tenant by
serving period notice of ONE MONTH on the tenant
9. That the second party shall pay monthly rent by the fifth day of every
English Calendar month, positively.
IN WITNESS WHEREOF the parties hereunto set and subscribed their respective
hands to this Agreement at Karachi on the day, month and year first above
mentioned.
